NORTH BAY-MATTAWA CONSERVATION AUTHORITY MINUTES of the TENTH meeting of the North Bay-Mattawa Conservation Authority held at 7:00 p.m. on November 28, 2012 in the North Bay-Mattawa Conservation Authority Natural Classroom, 15 Janey Avenue North Bay, Ontario. Carried Unanimously 2. Adoption of Minutes After discussion the following resolution was presented: Resolution No. 97-12, Reid-Brydges THAT the minutes from October 24, 2012 are adopted as written. Development, Interference and Alteration to Waterways Permits Brian Tayler presented the permits issued since our last meeting. After discussion the following resolutions were presented: Resolution No.98-12, Walters-Curran THAT Development, Interference with Wetlands and Alterations to Shorelines and Watercourses permits 80-12 to 92-12 be approved and appended to the minutes of this meeting. Carried Unanimously 5. Development, Interference and Alteration to Waterways Permits – Trillium Woods Phase II Brian Tayler presented the report from staff. After discussion, following resolutions were presented: Resolution No.99-12, Reid-Corbeil THAT permit 93-12, with its specific conditions outlined within the Report be approved and appended to the minutes of this meeting. Carried Unanimously 2 6. Policies and Guidelines – Ontario Regulation 177/06 Brian Tayler presented the Policies and Guidelines for Ontario Regulation 177/06. After discussion, the following resolution was presented: Resolution No. 100-12, Albright-Geisler THAT the North Bay – Mattawa Conservation Authority Board of Directors approve the NBMCA proposed Policies and Guidelines schedule for the Administration of the Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation (Ontario Regulation 177/06) (dated November 8, 2012). Carried Unanimously 7. Wetlands Policy and Environmental Impact Study Guidelines Brian Tayler provided the members with the Wetlands Policy and Guidelines for Environmental Impact Studies. After discussion the following resolution was presented: Resolution No.101-12, Foisy-Brydges THAT the North Bay –Mattawa Conservation Authority Board of Directors approve the Final Drafts of the NBMCA Wetland Policy and Environmental Impact Study Guidelines as prepared by Stantec Consulting Ltd., September 26, 2012. Carried Unanimously 8. Five Year Capital Forecast Brian Tayler provided the members with a five year capital forecast. After discussion the following resolution was presented: Resolution No.102-12, Vrebosch-Geisler THAT the Board of Directors receives the NBMCA Five Year Capital/Special Projects Forecast to Levy report for the period of 2013 to 2017, and FURTHER THAT staff are directed to use this report to guide preparation of the 2013 Capital/Special Projects Budget for the NBMCA Carried Unanimously 3 9. Source Water Protection Funding Update Brian Tayler gave the members an update on the Source Water Protection Funding; noting that the guidelines for preparing funding proposals were now out and that proposal submissions were due December14th. The members thanked Brian for his update. 10. Committee of the Whole After discussion the following resolutions were presented: Resolution No.103-12, Reid-Foisy THAT the meeting move into “Committee of the Whole” to discuss legal and personnel matters. Carried Unanimously Resolution No.104-12, Albright-Foisy THAT the meeting move out of “Committee of the Whole” and into a Full Authority meeting. Carried Unanimously 11. Correspondence Items None reported 12. New Business Brian Tayler gave an update to members on the Laurentian Escarpment Conservation Area trails group that is being formed. A reminder was given to members that our next meeting is Wednesday December 19th. Another reminder was given to members that our annual environmental awards ceremony is set for November 29th at 7:00pm, NBMCA Natural Classroom, 15 Janey Ave. North Bay. 13. Carried Unanimously ------------------------------------------- --------------------------------------------- Dave Mendicino, Chair Brian Tayler, Chief Administrative Officer, Secretary Treasurer 5 TO: The Chairman and Members of the Board of Directors, North Bay-Mattawa Conservation Authority ORIGIN: Susan Brownlee, Regulations Officer DATE: November 19, 2012 SUBJECT: Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses Permits for board approval Background: Section 28 of the Conservation Authorities Act, and subsequently Ontario Regulation 97/04 empowers each Conservation Authority to establish their own regulation to prevent the loss of life and property due to flooding and erosion, and to conserve and enhance natural resources. On May 4, 2006 the North Bay-Mattawa Conservation Authority (NBMCA) received its regulation entitled the Development, Interference with Wetlands, and Alterations to Shorelines and Watercourse Regulation (Ontario Regulation 177/06). This regulation will continue to be used as the tool by which the NBMCA manages issues related to development in natural hazard areas including areas with floodplains, wetlands and steep slopes. Within this regulation, a permit may be given by an Authority for development applications within the Authority’s jurisdiction for 28(1)(b) prohibiting, regulating or requiring permission of the authority for straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; 28(1)(c) prohibiting, regulating or requiring the permission of the authority for development if, in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development.(Conservation Authorities Act, R.S.O. 1990, Chapter C.27). Conservation Authority staff have been delegated the approval authority for permits under this regulation, subject to a final endorsement by the board of directors. Analysis: Fourteen new permits were issued by the Conservation Authority since the previously approved minutes as per the policies, procedures and guidelines of the NBMCA under the Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses regulation; a table summarizing these permits issued is attached to this report. Five permits were issued for residential lots to work on water-related projects. Proposed works included construction of cribs and shoreline stabilization, while Permit 80-12 was issued for remedial works related to the clean-up of an oil spill on a residential lot. Five permits were issued for the construction of dwellings, sheds and a driveway for residential lots. Permit 82-12 was issued for minor repairs to a private dam that was constructed in the 1950 for agricultural purposes. Although the Ministry of Natural Resources issues work permits under the Lakes and Rivers Improvement Act for dams, as this was considered a minor work to repair undermining that has taken place beneath a spillway, the Conservation Authority issued a permit under O. Reg. 177/06 as well as a Letter of Advice for fish habitat matters. Permits 81-12 and 92-12 were issued for work related to the development of commercial establishments, while Permit 94-12 was issued to the City of North Bay for work proposed to stabilize two sections of Chippewa Creek in the Thompson Park area. Recommendation: The permits that have been issued are consistent with the policies and guidelines of the Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses Regulation. Therefore, it is recommended that the Conservation Authority Board of Directors approve these permits (see attached).
