(CEG) was retained by Ballantry Homes Inc. to conduct a Scoped Environmental Impact Study (EIS) of the property recognized as 2390 Khalsa Gate, Oakville, Ontario (herein referred to as the Site). The legal description of the Site is defined as Block 134 on Plan 20M-930 designated as Part 3 on Plan 20R-15670. The Site is bounded by Pine Glen Road to the north, Old Bronte Road to east, Khalsa Gate to the south, and Bronte Road to the west. Refer to Figure 1 for the Site location. There are no buildings on the Site and predominant cover consists of grasses and shrubs. Currently, the Site is surrounded by residential lands to the north, east, and west. The immediate land to the south of the Site is vacant. An aerial photo of the area is provided in Figure 1. The total Site area is approximately 1.96 hectares. The purpose of the Scoped EIS is to identify, evaluate, and provide recommendations to mitigate the impacts of development in the study area on the natural environment. Natural heritage features which are to be considered as part of the assessment includes areas of natural significance (ANSI), linkages, wildlife, vegetation communities, and other environmental features and their functions. This study is complemented by CEG’s Storm Water Management (SWM) Report, Phase I Environmental Site Assessment (ESA) Report, and Functional Servicing Report (FSR) which are submitted under separate cover. 2.0 Scope of Study The Scoped EIS study is based on the key objectives as outlined by Conservation Halton’s Environmental Impact Study Guidelines, dated November 2005. The terms of reference were modified to take into consideration site specific characteristics of the subject site and its surrounding land-use. The lands surrounding the Site are mostly developed for residential land-use and preliminary investigations have not identified any natural heritage features on the Site. A considerable amount of previous environmental work has been conducted in the study area as part of the developments in the surrounding area. As part of this assessment, the following tasks were performed: • • • Reviewed physical characteristics of the Site and surrounding area; Considered the potential application of planning regulations, policies and Acts; Inventoried terrestrial and aquatic environmental features and functions of the Site including any vegetation communities, wetlands, woodlands, and fish habitat; L09-488 (April 2014) Page 1 of 9 Ballantry Homes Inc. • • • Updated Scoped EIS for 2390 Khalsa Gate, Oakville, Ontario Searched for ANSIs, environmentally sensitive areas (ESAs), and natural heritage features associated with the Site; Assessed the potential for environmental effects due to the proposed development; and Recommended mitigation measures to address impacts of the proposed development on environmental features and functions. Key documents which were used to form the basis for the assessment include: • • • • • • 3.0 Fourteen Mile Creek Main and West Branches Subwatershed Plan, Philips Engineering Ltd., dated June 2000; Water well records obtained from the Ministry of the Environment; Natural features mapping obtained from Land Information Ontario, Ministry of Natural Resources; Livable Oakville, Town of Oakville Official Plan, dated 2009; The Halton Regional Official Plan, dated 2009; and The Provincial Policy Statement, dated April 2014. Proposed Development The proposed development will include 123 townhouse units as well as a 10-story apartment building with 248 units, for a total of 371 units. The apartment building will be serviced with two (2) levels of underground parking. Refer to the FSR for a detailed description of the proposed development. 4.0 Applicable Planning Regulations, Policies and Acts The EIS was completed to assess the environmental features and function of the Site as outlined in the following applicable environmental policy frameworks: • • • 4.1. Livable Oakville, The Town of Oakville Official Plan (OP), dated 2009; The Halton Regional Official Plan, dated August, 2009; and The Provincial Policy Statement, dated April 2014. Town of Oakville Official Plan Livable Oakville, The Town of Oakville Official Plan (OP), dated 2009 was established to govern the physical development of the town. Through the promotion of controlled and orderly physical, social, and economic growth, the OP strives to protect the environment, and ensure the health and safety of the townspeople. The OP consists of clearly defined goals and objectives for Greenlands and Environmental Management, included in Part B Sections 8 and 9 of the plan, respectively. Updated Scoped EIS for 2390 Khalsa Gate, Oakville, Ontario relevant to the EIS include the Town’s general policies for Environmental Management (Part C Section 10), land use policies for Urban Centre (Part D Section 12.4), and the Palermo Village Community special study area (Part E Section 22). Land Use in Palermo Village is presented in Appendix A. 4.2. The Halton Regional Official Plan Similar to the purpose of the OP, the Halton Regional Official Plan (HOP) provides direction as to how physical development should take place in the Halton Region to meet the current and future needs of its people. The HOP’s goal for Environmental Quality is to achieve a high-quality environment, for present and future generations that will sustain life, maintain health and improve the quality of living. Goals relating to the Environmental Quality of Halton Region are presented in Part IV of the HOP. 4.3. Provincial Policy Statement The purpose of the Provincial Policy Statement (PPS) is to provide direction for appropriate land development while protecting resources of provincial interest, public health and safety, and the natural environment. Section 2.0 of the PPS (Wise Use and Management of Resources), identifies objectives for management of natural heritage features and water resources. As stated in the PPS, natural features shall be protected for the long-term. Development and alteration shall not be permitted on the site and adjacent lands with habitat for endangered species and threatened species or significant wetlands, unless it is determined that there will be no negative impacts on the natural features or on their ecological functions. 5.0 Physical Description 5.1. Physiography and Topography A map of the physiography of the area indicates that the Site is located on drumlinized till plains as seen in Figure 2. According to Chapman and Putnam, 1984, the Site is located within the South slope physiographic region, which is a narrow band located between Lake Ontario and the Oak Ridges Moraine. The South slope contains a variety of soils which are more clayey in the location of the Site, and are considered to be excellent for agricultural use. Topographic data of the Site and adjacent lands indicate that the land gently slopes downward in a southerly direction as seen in Figure 3. L09-488 (April 2014) Page 3 of 9 Ballantry Homes Inc. 5.2. Updated Scoped EIS for 2390 Khalsa Gate, Oakville, Ontario Geology and Hydrogeology 5.2.1. Bedrock Geology The bedrock below the Site is considered to be of the Queenston Formation of the Upper Ordovician period and is shown in Figure 4. According to Hewitt, 1972, the Queenston Formation consists of red shale and is about 800 feet thick at St. Catharines, but thins northward to about 160 feet in the Bruce Peninsula. From subsurface information obtained from Ecolog ERIS’s Water Well Information System search (completed in 2010), it is estimated that the bedrock on the Site is located about 3 meters below ground surface. 5.2.2. Surficial Geology and Soils The surficial geology in this area, Figure 5, consists of thin glaciolacustrine- derived silty to clayey till deposits which varies from silts and clays to fine sand to gravel. A map indicating the surficial soils of the Site is seen in Figure 6. According to Gillespie et al., the surficial soils found on the Site are Oneida Clay Loam and Bottom Land. The following are abbreviated descriptions of each soil type according to Gillespie et al: • • The Oneida soils are the moderately well-drained members of the Oneida catena and generally occur in association with the imperfectly drained Chinguacousy and poorly drained Jeddo soils. These soils have developed on fine textured glacial till. The till is largely composed of ice-ground materials from the underlying Ordovician rock formations. Bottom land is the flat, frequently flooded land found adjacent to some streams. The Bronte and Oakville Creeks in Halton County meander across a relatively level clay plain. The volume of water carried by these streams fluctuates widely, the streams having cut wide and sometimes deep beds. These streams often run full in springtime but by midsummer occupy a small portion of the bed. The recent flood deposits occurring on such locations are mainly fine sand and silt. The color is a dark grayish brown with little horizonation. 5.2.3. Site Specific Geological Information A geotechnical report was prepared for the subject Site in 2009 by Soil Engineers Ltd. The deepest borehole extended 10.8 m below ground surface (bgs) whereas the majority of boreholes reached 6.2 m bgs. In most boreholes, the top 4.5-6 m consisted of silty clay till underlain by weathered shale bedrock. L09-488 (April 2014) Page 4 of 9 Ballantry Homes Inc. Updated Scoped EIS for 2390 Khalsa Gate, Oakville, Ontario 5.2.4. Groundwater No groundwater was observed during the geotechnical investigation conducted in 2009 by Soil Engineers Ltd. The geotechnical report indicated that the water table likely occurs below the investigated depths. The main water bearing units in the area are mostly attributed to coarse grained units and the underlying fractured bedrock system. Groundwater flow in this region typically flows in a southeasterly direction towards Lake Ontario. Local shallow groundwater likely reflects topography and flows in a south-westerly direction, towards a tributary of Fourteen Mile Creek. 5.2.5. Well Records A search request for water wells was placed with the Ministry of the Environment for a 1 kilometer radius around the Site. The search resulted in 166 water wells in the area. Well records from the search are located in Appendix A. A location map for all wells in the area can be seen in Figure 7. The following is a summary of well use as reflected in the search: • • • • • • • • • • • 46 well have been abandoned 45 wells used for monitoring purposes 38 wells used for domestic purposes 10 wells used for unknown purposes 8 wells used for commercial purposes 5 wells used for public purposes 5 wells used for other purposes 3 wells used for livestock purposes 3 wells used for test hole purposes 1 wells used for industrial purposes 2 wells are not used MOE water well records identified a well within the boundaries of the subject site, about 150 m from the south east boundary corner. The available well details indicate that the well was 46 feet deep and was used for water supply, but is identified as unfinished. No other information is available regarding the well and none were identified during the site visit. 5.3. Land-Use & Land Cover The Site is presently not occupied by any structures, nor is it used. The predominant ground cover consists of grasses and shrubs. The Site is surrounded by residential lands to the north, east, and west. The land immediately to the south of the Site is vacant. An aerial photo of the area dated 2010 is provided in Figure 1. The total Site area is approximately 1.96 hectares. L09-488 (April 2014) Page 5 of 9 Ballantry Homes Inc. Updated Scoped EIS for 2390 Khalsa Gate, Oakville, Ontario The Site is designated “Urban Centre” in the Town of Oakville Official Plan (OP) as shown in Appendix A. According to the OP, the “Urban Centre” designation represents the key development area within the Palermo Village Centre, a lively and active mixed use district. 5.4. Natural Heritage Features Greenbelt Plan The Greenbelt Plan, published by the Ministry of Municipal Affairs and Housing in February 2005, identifies development constraints in order to protect agricultural lands and the associated ecological features and functions occurring on this landscape. The Site is situated outside of the Greenbelt, within settlement areas. Environmentally Sensitive Features Considerable environmental mapping has been prepared by the Town of Oakville Official Plan (OP), the Halton Regional Official Plan (HOP), and the Fourteen Mile Creek Main and West Branches Subwatershed Plan prepared by Philips Engineering in June 2000 (Subwatershed Report). The documents indicate that the Site is void of any natural heritage features including valley lands, watercourses, woodlots, natural wildlife corridors, ANSIs, wetlands, and ESAs (refer to Appendix B). The Subwatershed Report shows the Site to be void of any terrestrial habitat and is considered a “cultivated agricultural field”. A “poorly defined channel (not fish habitat)” was identified as bisecting the Site. This corresponds with the drainage swale observed on site; however, it is positioned closer towards the western property boundary. National Heritage Information Centre The National Heritage Information Centre (NHIC) was queried for areas of natural significance for a 1 kilometer radius around the Site. Results of the query are shown on Figure 8. The search resulted in no areas of natural significance on-Site and did not identify any wetlands within the 1 kilometer radius. The search resulted in the identification of wooded areas to the northeast, northwest and southwest of the Site. The Site is approximately 200m northeast of a small water body and is approximately 300m from three different tributaries of the Fourteen Mile Creek. Species At Risk The National Heritage Information Centre (NHIC) was queried for areas of natural significance for a 1 km radius around the Site. Terrestrial Environment A Site visit was conducted on April 1, 2014 to assess the terrestrial ecology of the Site and immediately surrounding lands. The terrestrial assessment included mapping of Ecological Land Classification (ELC) vegetation communities and confirming soil characteristics. Field results are included in Appendix C. The Site consisted of several species of Vascular and Herbaceous vegetation. A small drainage ditch runs just outside of the east boundary of the Site. Minor ponding was evident on the south portion of the Site and along the west boundary of the Site. The property is drained by an outlet located on the west side of the Site. 6.0 Environmental Impact Assessment The following section serves to analyze the findings of the study and present recommendations of how to proceed with mitigating the potential impacts of development. With any given development, typical implications could include impairing surface water and groundwater quantity and quality, and disturbing terrestrial and aquatic habitat, and disrupting other ecological functions. The analysis presented in this section has been categorized as Potential Direct Impacts and Potential Indirect impacts. The Potential Direct Impacts are considered to be immediate alterations that occur as part of the construction process. Potential Indirect Impacts are categorized as issues that are less obvious and whose impacts may occur over longer periods of time. 6.1. Potential Direct Impacts 6.1.1. Loss of Significant or Sensitive Wildlife Habitat or Vegetation The Site is comprised of former agricultural fields and limited cultural vegetation communities. A field assessment and classification of animal habitat showed that the Site provides limited sensitive wildlife habitat. In addition to this, adjacent lands have been developed and are poor in terms of supporting any wildlife habitat. Based upon these facts, CEG is of the opinion that there will be no loss of significant or sensitive wildlife habitat or vegetation as a result of this development application. 6.1.2. Loss of Aquatic Habitat As mentioned in this EIS, the Site is void of water bodies and aquatic life. A small drainage ditch runs just outside of the east boundary of the Site. Minor ponding was evident on the south portion of the Site and along the west boundary of the Site. Based upon this fact, CEG is of the opinion that the proposed development will not result in a loss of fish habitat. L09-488 (April 2014) Page 8 of 9 Ballantry Homes Inc. Other Direct Effects Impacts due to the construction process are not anticipated to be an issue due to the lack of onsite and surrounding natural heritage features. 6.2. Potential Indirect Impacts 6.2.1. Changes to Groundwater Quantity and Quality According to the Fourteen Mile Creek Main and West Branches Subwatershed Plan, the study area is covered by relatively low permeability overburden which provides limited infiltration. Also, the groundwater found in the Queenston shale, which currently may be used for private water supply, generally provides poor quantity and quality of water. The surrounding area is serviced by lake based municipal supply and it is likely that additional use will not impact the quantity or quality of the existing water supply. Hence, CEG is of the opinion that no significant ground water influences should occur due to the proposed development. 6.2.2. Changes to Surface Water Quantity and Quality As discussed in the FSR, stormwater quantity and quality issues are to be addressed using existing stormwater management facilities. It was concluded that on site quantity and quality controls were not required. The Site was found to be void of any water courses and is currently drained by a water outlet located on the west boundary of the Site. Since the Site does not contribute to any surface water bodies, changes to any surface water bodies are not anticipated. 6.2.3. Indirect Impacts on Adjacent Vegetation or Wildlife Due to the land use surrounding the Site, there will be no direct or indirect impacts on significant or sensitive vegetation communities. 7.0 Summary The environmental assessment for the Site did not identify any natural heritage features including valley lands, watercourses, woodlots, natural wildlife corridors, ANSIs, wetlands, and ESAs. Several tributaries of Fourteen Mile Creek were found within a 1 km radius of the Site, the closest of which is about 400 meters west of the Site. Several woodlots are also located within 1 km of the Site. These systems are classified as part of the Greenlands System in the HOP. Potential Direct Impacts are not anticipated since the subject site is not considered environmentally sensitive or core terrestrial habitat. Similarly, minimal Potential Indirect Impacts are anticipated since the development will not significantly affect the surface water and groundwater water balance.
