The Victorian Civil and Administrative
Tribunal has considered an application pursuant
to section 89 of the Equal Opportunity Act
2010 (the Act) by Mind Australia (the applicant).
The application for exemption is to enable the
applicant to advertise for and employ only a
male in the role of community mental health
worker (the exempt conduct).
Upon reading the material filed in support
of this application, including the affidavits
of Denise Hearne and Megan McDonald, the
Tribunal is satisfied that it is appropriate to grant
an exemption from sections 16, 107 and 182 of
the Act to enable the applicant to engage in the
exempt conduct.
In granting this exemption the Tribunal
noted:
The applicant provides services to persons
with mental illness. The role which is the
subject of the application is to be based at the
applicant’s Solomon Street Youth Residential
Rehabilitation Service in Bendigo (service).
Presently the service employs four staff, all
of whom are women. The service currently
has six clients, four of whom are male.
The service is a structured but flexible
intensive residential psychosocial recovery
service for young people aged 16 to 24 years
who have experienced or are experiencing
mental health issues. It offers individual
service in a supportive community with
24-hour staffing. Clients are encouraged
to actively participate in the service as a
community as well as their own individual
programs. The staff work in a holistic way to
provide the young people with opportunities
to make positive changes in their lives.
Victoria Government Gazette
There is an emphasis on helping them to
deal with day-to-day tasks and to prepare
for independent living. It is preferable for
there to be gender balance within the staff to
reflect the gender balance of the clients.
No exception or current exemption already
applies to the exempt conduct and in the
absence of an exemption the exempt conduct
would amount to prohibited discrimination.
When making decisions about exemptions,
the Tribunal is required to give proper
consideration to relevant human rights as
set out in the Charter of Human Rights
and Responsibilities Act 2006 (Charter).
Arguably, this exemption limits the right
to equality and in particular the right to
equal and effective protection against
discrimination of females who would wish
to be employed in the community mental
health worker role. I am satisfied that, in
the circumstances discussed above, the limit
imposed by this exemption is reasonable and
justified under the Charter.
The Tribunal hereby grants an exemption
from the operation of sections 16, 107 and 182
of the Act to enable the applicant to engage in
the exempt conduct.
This exemption is to remain in force from
the day on which notice of the exemption is

The applicant organisation is a communitybased organisation which was established
in 1988. Its primary task is to support
women who are exiting prison or who are
at risk of being imprisoned. It provides
services including access to appropriate
and affordable housing. It links women
with support, education and information to
re-establish them in the community postrelease. It also works with women to prevent
their re-incarceration.
The women’s prison population comprises
women who have experienced significant
levels of violence and sexual assault. As a
consequence, those women are reluctant
to disclose their personal histories and
that disclosure is necessary for relevant
services and referrals to be provided. In
these circumstances, it is preferable that the
staff who work with and interact with these
clients are also women.
The applicant is currently governed by
women only. In so far as it provides services
to women, including those involved in its
governance, it is appropriate that those
services be provided to women only.
The applicant currently has an exemption in
respect to Outreach Support and Advocacy
Workers which expires on 29 August 2017.
That exemption does not cover other roles
within the applicant organisation. No
exception or current exemption applies to
the exempt conduct and in the absence of
an exemption the exempt conduct would
amount to prohibited discrimination.
When making decisions about exemptions,
the Tribunal is required to give proper

DANGEROUS GOODS
Pursuant to section 57(1) of the Dangerous Goods Act 1985 (the DG Act), before WorkSafe
Victoria (the trading name of the Victorian Workcover Authority) makes a recommendation
concerning a proposed Code of Practice, it must issue the proposed Code of Practice for public
review and comment. WorkSafe Victoria proposes to recommend the making of the Code of
Practice for the Storage and Handling of Dangerous Goods.

does not give rise to any criminal or civil liability. If a Code of Practice makes provision for or
with respect to a duty or obligation imposed by the Act or Regulations and the person complies
with the Code of Practice to the extent that it makes that provision, the person is, for the purposes
of the Act and Regulations, taken to have complied with the Act or Regulations in relation to that
duty or obligation.

Dangerous Goods Act 1985
TRANSPORT EXEMPTION – VCAP-01-EXEMP CA 2013-01
This exemption from compliance with provisions of the Dangerous Goods (Transport by Road
or Rail) Regulations 2008 in relation to the transport of a Portable Tank (QRA 453) that contains
residual amounts of sodium cyanide UN 1689 that has lapsed the inspection and testing requirement
under clause 9.7.2.19 of the Australian Code for the Transport of Dangerous Goods Code by Road
and Rail 7th Edition, is issued by the Victorian WorkCover Authority, pursuant to section 168 of
the Regulations.
Background:
The Competent Authorities Panel (CAP) decided, by out of session vote, that this exemption
should have effect in all participating jurisdictions (Victoria, NSW and Queensland) and is
applicable to owners, consignors, loaders, prime contractors, rail operator and drivers.
Exemption issued to:
Orica Australia Pty Ltd, 1 Nicholson Street, Melbourne, Victoria (owner/consignor), and Toll
Mining Services (prime contractor, rail operators, loaders and drivers).
Provisions of the Regulations subject to exemption:
Dangerous Goods (Transport by Road or Rail) Regulations 2008

Regulation 69 Owner (Equivalent to regulation 4.5.3 of Model Subordinate Law on the

Regulation 70, Consignors (Equivalent to regulation 4.5.4 of Model Subordinate Law on the
Transport of Dangerous Goods by Road or Rail 2007), in so far at it relates to clause 6.7.2.19 of the
Australian Code for the transport of Dangerous goods by Road or Rail [ADG Code].
Regulation 72, Loaders (Equivalent to regulation 4.5.6 of Model Subordinate Law on the
Transport of Dangerous Goods by Road or Rail 2007), in so far at it relates to clause 6.7.2.19 of the
Australian Code for the transport of Dangerous goods by Road or Rail [ADG Code].
Regulation 73, Prime contractors and rail operators (Equivalent to regulation 4.5.7 of Model
Subordinate Law on the Transport of Dangerous Goods by Road or Rail 2007), in so far at it relates
to clause 6.7.2.19 of the Australian Code for the transport of Dangerous goods by Road or Rail
[ADG Code].
Regulation 74, Road vehicle Drivers (Equivalent to regulation 4.5.8 of Model Subordinate Law
on the Transport of Dangerous Goods by Road or Rail 2007), in so far at it relates to clause 6.7.2.19
of the Australian Code for the transport of Dangerous goods by Road or Rail [ADG Code].
Dangerous goods to which the exemption applies:
Sodium Cyanide, Solid UN1689.
Period of time the exemption remains in force:
This exemption has effect on and from 26 March 2013 up to and until 30 April 2013 unless the
exemption is varied or revoked by the Victorian WorkCover Authority.
Conditions:
1.
A copy of this exemption must be carried in the cabin of the vehicle at all times it is involved
in transporting the Portable Tank (QRA 453) and must be produced upon request of a
WorkSafe Inspector, or officer of an Emergency Services.
2.
Each transport route (Melbourne to the Orica maintenance facility at Yarwun, Queensland)
must be determined in accordance with ORICA Route Risk Assessment.

A fully operational ‘Transport Emergency Response Plan’ must be in place prior to the
transporting of the Portable Tank (QRA 453).
4.
All other requirements within the Dangerous Goods (Transport by Road or Rail) Regulations
2008 and the Australian Code for the Transport of Dangerous Goods by Road and Rail 7th
Edition relevant to the transport of the Portable Tank must be complied with.
This exemption has effect only when all conditions are complied with in full.

International Dragon Boat Festival, are prohibited from entering or remaining in the waters of the

I, Jane Doolan, Deputy Secretary, Water Group, Department of Sustainability and Environment,
as the delegate of the Minister administering the Water Act 1989, make the following Declaration:

This Declaration is called the Extension of the Wangaratta Sewerage District Declaration
2013.

In accordance with section 287ZC of the Water Act 1989 the Goulburn–Murray Rural Water
Corporation provides notice that it has made By-law No. 1/2013 – Recreational Areas. The by-law
was made using a model by-law issued by the Minister for Water on 9 October 2012.
The title of the by-law is By-law No. 1/2013 – Recreational Areas.
The purpose and general purport of the by-law is to provide for:
(a)the control, management and use of land, services and facilities; and
(b)the protection of land, services and facilities; and
(c)the protection of people in the area from injury or nuisance; and
(d)the conservation and preservation of plants, animals, flora, fauna and habitat; and
(e)the control of the introduction of any new plants and animals; and
(f) the management, protection and use of lands, waterways and works –
in a recreational area under the management and control of the Goulburn–Murray Rural Water
Corporation.
