Indiana Builders Association
Indiana General Assembly Down to Crunch Time
The Indiana General Assembly must adjourn for the session no later than March 14, which means one more
week of legislative activity and movement on bills or they
are dead for the year. 2014 is a short session, which
means they do not have the burden of passing a twoyear state budget and all 100 members of the Indiana
House of Representatives will be up for election this year
and 25 of the 50 Indiana Senators will be up for election. A lot of behind the scenes legislative wrangling
takes place the last week of session as members from
both parties meet in conference committees to iron out
differences with bills before gaining approval from the full
body of the House and Senate. Negotiations will take
place all the way up to the final hours of session. Indiana
Builders Association lobbyists will be on the scene protecting and promoting housing affordability for Hoosiers. A full recap of the bills that passed and died in 2014
will be included in next week's Legislative and Regulatory
Report.
Action Item: HB 1301 Passes Committee Nearly Unanimously; Contact Your State Senator
House Bill 1301 (HB 1301) was heard in the Senate
Commerce, Economic Development, and Technology
Committee on Monday and received a nearly unanimous
vote (7-1). HB 1301 was authored by Rep. Heath VanNatter (R-Kokomo) and sponsored by Sen. Carlin Yoder
(R-Middlebury). The bill as drafted will streamline the
state plan review process for Class 1 structures, redefine
certain townhouses as Class 2 structures, require the
Building Commissioner to issue interpretations of fire and
building codes no later than 10 days after receiving a
request, and permanently extend the builder and remodeler licensing moratorium that was passed during the
2013 legislative session.
Several IBA members attended the hearing to support
the bill, and IBA CEO Rick Wajda provided testimony
championing HB 1301. The bill drew opposition from local building and fire officials as well as fire sprinkler advocates including the Indiana Fire Chiefs Association, National Fire Sprinkler Association (NFSA), and National
Fire Protection Association (NFPA) who want to require
fire sprinklers in residential structures. Testimony and a
letter provided by Indiana Department of Homeland Security Executive Director John Hill that "No structure built
in accordance with the Indiana Residential Code is required to be sprinklered." affirmed IBA's testimony that
the bill does nothing more than codify existing rules with
regard to townhouse construction. Fire sprinkler advocates have resorted back to spreading misinformation
about the bill, questioning the validity of IBA's testimony
at Monday's hearing, and refusing to negotiate in good
faith. Their goal is to mandate fire sprinkler systems in
residential construction. Our goal is to build safe and af-

fordable housing. IBA is opposed to mandating fire
sprinklers in residential construction.
Several groups have activated their members asking
them to reach out to their senators to oppose this
bill. HB 1301 is a good bill for IBA members and for the
State of Indiana. Even if you have already contacted
your Senator in the past about this bill, please reach out
again to reemphasize your support for HB 1301. You
can contact your legislator using IBA's voterVOICE system at: http://www.buildindiana.org/votervoice.htm.
Action Item: Preserve the Free Market - Ask Your State
Representative to Vote No on SB 173
The Indiana House of Representatives will take a final
vote on Monday on SB 173, the nursing facility moratorium bill, authored by Sen. Pat Miller (R-Indianapolis)
and sponsored by Rep. Tim Brown (RCrawfordsville). The bill prohibits the state department
of health from approving the licensure of comprehensive care health facilities or new or converted comprehensive care beds. It also prohibits residential nursing
care facility beds from being converted to comprehensive care beds. The Indiana Builders Association is
opposed to this bill. Several builders and many of our
trade partners are actively engaged in this business and
the diversification has allowed many members to keep
their doors open during the housing downturn. This
segment of the population is expected to grow and their
housing demands will need to be met by our membership. IBA supports a free-market approach to this industry and consumers and/or family members deserve
the right to choose which facility their loved ones are
placed in.
This bill is a job-killer for the construction industry and
would put the brakes on many economic development
projects across the state. Please urge your State Representative to vote NO on SB 173. You can contact

Title Insurance Passes 2nd Reading
A bill that will add transparency to title insurance rate
filings successfully passed the Senate on 2nd Reading
Thursday. The bill is now eligible for 3rd Reading as
early as Monday, March 3rd. House Bill 1224 (HB
1224), authored by Rep. DeVon and sponsored by Sen.
Travis Holdman (R-Markle), requires the department of
insurance (department) to create a title insurance consumer comparison tool (tool). Additionally, it provides:
(1) that the filed rates of all insurers that issue title insurance policies in Indiana will be included on the tool;
(2) that the information on the tool shall be designed to
allow an average consumer of ordinary intelligence to
compare and differentiate between substantially similar
title insurance rates offered by title insurers; (3) that the
tool must be made available to the public free of charge
on the department's Internet web site by September 1,

2014; and (4) that, after that date, when an insurer makes
a new, approved filing, the department shall make the insurer's rates available on the tool not more than 10 business days after the insurer's application is stamped "filed"
by the department. IBA supports this bill because it will
allow IBA members to shop title insurance rates in a much
more practical and efficient way. Please click here to read

Bill on Assessment of Real Property Clears House
Senate Bill 266, authored by Sen. Schneider (RIndianapolis) and sponsored by Rep. Culver (R-Goshen)
consolidates provisions relating to the burden of proof
concerning assessments into one section of the Indiana
Code. Specifies that if the assessed value of real property is increased above the amount of the assessed value
as reduced by any assessing official or reviewing authority, the assessing official making the assessment has the
burden of proving that the assessment is correct. (Under
current law, this burden of proof applies only if the assessed value was reduced by the property tax assessment board of appeals.) Amends the existing law concerning the assessor's burden of proof when an assessment is
increased by more than 5% over the prior tax year by
specifying the following: (1) In calculating the change in
the assessment, the assessment to be used for the prior
tax year is the original assessment for that prior tax year
or, if applicable, the assessment for that prior tax year as
last corrected by an assessing official, as stipulated or
settled by the taxpayer and the assessing official, or as
determined by the reviewing authority. (2) If the assessor
fails to meet the burden of proof, the burden of proof shifts
to the taxpayer to prove the correct assessment. (3) If neither the assessor nor the taxpayer meets these burdens
of proof, the assessment reverts to the assessment for the
prior tax year. (4) These provisions concerning the burden
of proof do not apply to an assessment that is based on
improvements, zoning, or uses that were not considered
in the assessment for the prior tax year. IBA supports
SB 266. The bill passed the Indiana House earlier this
week by a vote of 95-1. The bill now heads back to the
Indiana Senate, where they could agree to the changes
made in the House or assign the bill to a joint conference
committee to work out the differences.

Indiana Communities Ranked #1 & #2 for Safest Cities
Movoto Real Estate released its rankings earlier this week
for America's Safest Mid-Sized Cities and 2 Hoosier communities topped the list. Carmel received the number 1

ranking and close behind was its neighbor to the east,
Fishers. The complete top 10 list of safest suburbs
looks like this:

To produce this ranking, Movoto relied on a list of 120
places which are the largest suburbs of the 50 most
populous cities in the U.S. and then applied the same
criteria to the suburbs that was previously used to determine how safe the largest cities within certain states
are. These were:
 Property crimes per capita (burglaries, thefts, and
motor vehicle thefts)
 Violent crimes per capita (murders, rapes, robberies, and aggravated assaults)

Quest for a Car Wash:
Do You Do What You
Say You Do?

misleading?!!?"

Defeated and irritated, I left
that gas station and found a
different place to wash the
car.
The melting snow and winter road salt made my
car so dirty I could hardly see through the windows.
But I did manage to see a gas station sign that
said "Carwash." I pulled in and filled the tank but
the pump computer never gave me the option to
purchase a car wash, so I went inside and approached the clerk standing at the cash register.
"The pump outside didn't let me purchase a car
wash," I said.
The clerk responded. "Sorry, the car wash is
broke."
I certainly didn't want to hear that. "Geez," I responded, "The car wash is really the only reason I
came here."
The clerk didn't have much sympathy for my
plight.
"That car wash hasn't worked for two years," he
said with a tone of voice that implied I was an idiot
for somehow not knowing that.
I was incredulous as I pointed to the tall sign in
front of the building. "You mean to tell me that
the car wash has been broken for two whole
years and you still have a big sign along the street
advertising a carwash?" I asked with emphasis on
"Sorry, I don't know what to
tell you, man."
This little experience got me thinking about my own
work - is there anything I'm doing in my business that
unintentionally misleads clients? Am I promoting
something I can't deliver? Is my marketing communication as clear and unambiguous as it should be?
I imagine the workers at that gas station were so accustomed to seeing the sign that it never occurred to
them to remove it. Or maybe they just never got
around to it. Either way, there is a moral to my twoyear-deceased car wash story: It's a good idea to
assess your communication. We should all make
sure we are saying what we really intend to say. We
need to make sure we don't mislead customers,
stakeholders or colleagues. We can get so comfortable with the message and so used to the words,
that we don't really see or hear them anymore.
Be careful, because some unsuspecting guy driving
a dirty car might take your message at face value
and actually think you're offering a working carwash.
