2011 William C Knauf Golf Day
Sunny skies and a delicious continental breakfast greeted over
70 Eighth District members at Springville Country Club, who
gathered to hear Dr. Franklin Shull of Columbia, SC present
“Everyday Dentistry – Pearls for Your Practice”. After a hearty
lunch, 115 golfers battled on the course in perfect 70° sunshine.
Dr. Peter Igoe, with a fine 81 from the back tees, won this year’s
Eighth District Dental Society Championship Title.

Following cocktails and a steak dinner, 83 participants won raffle
prizes. Event co-chairs Drs. Stan Zak and Paul DiBenedetto
announced that the 2012 Knauf Day is scheduled for Tuesday,
May 29, 2012 at Park Country Club in Williamsville, NY.
The evening was highlighted by Dr. Bill Knauf’s daughter,
Jessica, and former partner Dr. Tim Stanford saying a few words
about what the event meant to Bill, and why he worked so hard to
elevate its status before his passing in 1992.

“PEEVES, CROTCHETS, AND IRKS”

Using literary license, I borrowed my title from a syndicated
column written by the late journalist and television commentator
James Kilpatrick. In his column he tried to educate his readers on
the proper usage of language in an effort to foster better
communication. That is my goal also.
My pet peeve, crotchet, and irk? It is the all too common usage
of the phrase “we accept insurance”. Perusal of the advertising
section of the yellow pages, local Penny Saver, etc. will
immediately make you aware of the amazing numbers of
professional dental practices which use this phrase. Why??? I
suspect it is because all too frequently the first question patients
ask you or your staff is “do you accept my insurance?”.
However, the ambiguity of this phrase can lead to
misinterpretation and serious misunderstandings. In illustration:
does “we accept insurance” mean:
a) you participate in my plan and abide by its contract
provisions regarding fees, the collection of co-payments
and deductibles;
OR
b) you do not participate in my plan but you will process my
insurance claim and balance bill me for any unpaid
amounts after the insurance has paid its portion;
OR
c) you will accept my insurance
as full payment for
everything!; you will not bill
me for anything even if there
are deductibles, co-payments, and unpaid balances due
after insurance has paid its portion.
Hopefully, we all realize that the third example is not only
unethical and illegal, but can result in the loss of your license to
practice dentistry. However regrettable and unfortunate, the third
example is precisely what most patients truly think “we accept
insurance” means!
My office staff has been instructed to never respond to
the question “do you accept my insurance?” with a yes or no answer
or to use the phrase “we accept your insurance”. The consequences
of doing so will result in termination. The only appropriate response
is that we either participate or do not participate in a particular
plan. This is followed immediately with a full explanation of what
participation or lack thereof means in regards to fees, deductibles,
and co-payments.
I strongly encourage you to eliminate the phrase “we
accept insurance” from your vocabulary, and that of your staff,
and from all your advertising and correspondence. Doing so, I am
certain, will lead to better communication and less
misunderstanding with patients. n

In 2011 the employee portion of the FICA withholding dropped
from 6.2% to 4.2%. The employer portion remains at 6.2%, so the
combined FICA rate is 10.4% rather than 12.4%.
If you did not make the change, your employees are overpaying
by 2% of their gross wages. The Medicare tax remains unchanged
at 1.45% for both the employer and the employee. The total
combined FICA and Medicare tax has dropped from 15.3% to
13.3%. Please contact your personal accountant for more
information. n
A dentist received a phone call from a “company” reporting a
negative statement about them on the internet. They said that if
they paid $200 per month to their company, they would watch for
and delete such items. The so-called company is based in Miami.
The dentist did not accept their offer, but contacted our office for
guidance.
I would assess the call as a scam. No company is going to be
successful at removing these internet items. Federal law grants
immunity to Internet providers who post such defamatory items.
Therefore, the only remedy is to sue the underlying person who
posted the item to the internet for defamation. Often, you aren’t
even able to identify for certain who the underlying poster is to
sue. Not a very useful remedy in the long run. The scammer could
be reported to the Federal Trade Commission (FTC) for action
since it is a Florida company. The FTC has been pretty relentless
lately in pursuing these kinds of comsumer scams. n

roll out a program to raise money for the programs of the
Foundation such as the Good Neighbors Clinic, Children’s Dental
Health Month and the Mouth Guard program. You will receive a
mailing soon from Garfield and the Foundation asking that you
consider putting your scrap metal in an envelope and send to
Garfield. The money which you would have received will be sent
to the Foundation. Garfield will be reporting your donation to the
Foundation and we will send you an acknowledgement letter.

AED Bill Signed Into Law
On Wednesday, June 8, 2011, Governor Cuomo signed an
important piece of legislation into law that will improve public
health and safety of New Yorkers statewide.
•
It is estimated that an individual’s chances for survival
decreases by 10% for each minute that defibrillation is
delayed
Beginning January 1, 2012, all dental offices in New York State
will be required to have Automated External Defibrillators (AEDs)
on-site. Dentists in New York are already required to be trained to
use these devices. AEDs save lives and now over 10,000 dental
offices across the State will have them available.
•
Early defibrillation has been shown to be more effective
than CPR alone
•
The national average for survival after sudden cardiac
arrest is 5-6% without immediate defibrillation
NYSDA’s support of AEDs in dental offices is a result of the
indisputable evidence that they greatly improve outcomes for
people experiencing cardiac arrest.

In metropolitan areas, the survival rates are actually lower,
1-2%, leading many communities to equip first responders
with AEDs
While dental offices are not a site where cardiac arrest is likely
to occur, as many people frequent dental offices, the availability
of an AED provides additional protection for those in a dental
office who may experience an unanticipated cardiac event,
regardless of the cause.

To All: For those interested, a number of people have asked
about the new federal “Sunshine Law” created under Section
6002 of the Patient Protection and Affordable Care Act
(PPACA). The Sunshine Law – a copy of which appears below
(and which is cited as 42 U.S.C. §1320a-7h or as Section
1128G of the Social Security Act) – is given that name because
its aim is to shed light on the practices of pharmaceutical and
medical device manufacturers in doling out perks to health
care providers as part of the promotion of their products. The
new law applies to dentists as health care providers because
the definition of a “physician” under Section 1861(r) of the
Social Security Act includes a dentist.
However, neither dentists nor dental associations are
required to do anything under the law and no penalties under
the law apply to dentists or to dental associations. The burden
under the new law falls entirely on manufacturers. The
manufacturers must report all payments they make to dentists
or teaching hospitals [payments can take various forms,
including grants; education; consulting fees; honoraria; gifts;
charitable contributions; food; travel; entertainment; research;
royalties or licenses; ownership of investment interests; direct
compensation for faculty or speakers for an education
program; or any other payment or transfer of value to be
defined by the Secretary of the United States Department of
Health and Human Services (HHS)].
The report by the manufacturer must include the name of
the recipient; the business address of the recipient; the specialty
and National Provider Identifier (NPI) number of the recipient;
the amount of the payment or other transfer of value; the dates on
which the payment or other transfer of value was made; a
description of the form of the payment (cash or cash equivalent;
in-kind item or service; stock or stock option; dividend, profit, or
other return on investment; any other form of payment); a
description of the nature of the payment (as described above: grants,
education, etc.); and the name of the product if the transfer of
value is related to marketing, education, or research specific to
the product. The information reported must be made available to
the public through an Internet Web site, except that the NPI
numbers of dentists will not be posted on the Web site.
There are limited exclusions to these sunshine provisions, as
follows: 1) a manufacturer need not report a transfer of value that
is less than $10 unless the aggregate amount transferred to a dentist
exceeds $100 in a calendar year, in which case all transfers become
reportable for that dentist; 2) product samples that are not intended
to be sold and that are for patient use are excluded from reporting;
3) educational materials that directly benefit patients or are intended
for patient use are excluded from reporting; 4) loan of a device for
trial periods not to exceed 90 days to permit evaluation of the
device are excluded from reporting; 5) items provided under
contractual warranties, like replacement items, are excluded from
reporting when specifically included in a lease or purchase contract
for the device; 6) discounts and rebates are excluded from
reporting; 7) in-kind items provided for charity care are excluded
from reporting; 8) dividends or profit sharing in a publicly traded
company or mutual fund are excluded from reporting; 9) transfers

to dentists as patients rather than as health care professionals are
excluded from reporting; 10) payments made with respect to
litigation (such as expert witness fees) are excluded from reporting;
11) payments for self-insured health insurance for employees of
the manufacturer are excluded from reporting even if they include
dentists; and 12) payments made to licensed non-medical
professionals (such as an attorney) are excluded from reporting
even if the person is also a dentist, as long as the payment is for
the non-medical services only. Also, a manufacturer need not report
a payment made to someone other than a dentist or teaching hospital
where the manufacturer has no idea who the intermediary might
transfer the payment to that is a dentist or teaching hospital (but
this exception does not allow for the use of an intermediary as a
cover; it has to be a situation where the manufacturer would
genuinely have no idea that the payment would be used for dentists
or a teaching hospital).
While this law has no direct effect on dentists or dental
associations, it has a collateral effect in that manufacturers will be
seeking to obtain and record certain information that will ultimately
be made public. For associations that put on meetings and receive
sponsorship grants for educational offerings, manufacturers will
likely be seeking information on the attendees at their sponsored
events. Finally, HHS will be promulgating regulations to further
flesh out and implement the new law by October 1, 2011. The
American Dental Association will likely be tracking this as a federal
issue, so stay tuned for those regulations to appear later this year. n

The New York State Nurses Association (NYSNA) is honoring our own Chemical
Dependency Committee chairman, Dr. Robert J. Herzog. NYSNA has selected Dr. Herzog
to receive its “2011 Statewide Peer Assistance for Nurses Award”. This will be the first
time the award will be presented to a non-nurse. The award will be presented at NYSNA’s
annual convention scheduled in Niagara Falls on September 24, 2011.
NYSDA continues to be a national leader in successful, non-punitive responses to
addictive illness among professionals. Dr. Herzog, a certified interventionist, serves as
NYSDA’s Peer Assistance Coordinator. He also participated in a White House conference
call about the new federal prescription drug abuse plan hosted by Gil Kerlikowske, Director
of US National Drug Control Policy. Dr. Herzog is one of four members named to the
ADA’s current wellness task force as well. He also has been named chairman of the Dental
Section at the 2012 Utah School on Alcohol and Drug Dependency. The Utah School is
an annual training program for health professionals focusing on addictive illness.

Labor Law Amendments
New York State recently amended Section 195 of the Labor
Law with an amendement entitled “New York State Wage Theft
Prevention Act” It is effective April 9, 2011. This law requires all
private employers (such as dentists) notify employees regarding
their pay rate, deisgnated pay date and the basis of wage payment.
You need to provide this information at the time of hiring and
between January 1 and February 1 each year. The first annual
notice needs to be given between January 1, 2012 and February 1,
2012.You cannot provide the notice earlier than January 1 to be in
compliance unless the notice is in connection with hiring.
The employee must sign and date the form and you must keep
this copy for 6 years. All employees are covered b this law. There
are no exceptions. New York can assess penalties of $50 per week
per employee if notice is not given.
There are new requirements as well with regard to the wage
statement. Current requirements are hours worked, gross wages,
allowance, deductions and net wages. New requirements are name,
address and telephone number of the employer and the beginning
and ending date for the period covered by the payment. The penalty
for noncompliance with this part of the law is $100.00 per employee
per week.
