For the first time in Arizona, the Arizona Multihousing Association, will bring together the State’s largest management companies for a property management career fair on Tuesday, October 11th at the Phoenix Convention Center. “We are always looking for bright, hardworking individuals. We find that many people outside of our industry don’t know about all of the opportunities we have. There are always new positions being created at our properties and we are looking for dynamic people we can train for a lifetime career opportunity,” said Pam Shelton, principal with AllisonShelton Real Estate Services. AMA President and CEO Tom Sim- plot created this event to help these growing companies and to introduce opportunities to potential employees. “It’s a win-win for employers and applicants. This Career Fair will give job seekers an opportunity to learn more about property management and interview with Arizona’s largest management companies. MyCAA Provides Career Training Dollars for Military Spouses The Military Spouse Career Advancement Accounts (MyCAA) Program, a federal career development and employment assistance program sponsored by the Department of Defense (DoD), helps military spouses pursue a license, certificate, certifica- tion or Associate’s Degree necessary for gainful employment in a high demand, high growth portable career field and occupation. The MyCAA program provides up to $4,000 in financial assistance with up to $2,000 a year to eligible military spouses for education and training. Management companies looking for motivated and talented employees may consider working with military spouses who can access training assistance through the MyCAA program. These families follow their next assignments and are accostmed to moving and house-hunting in new communities. Their personal experiences can translate into great professional skills in the apartment industry as they understand the needs of families looking for housing. AMAPAC made the endorsements based upon the candidates’ track records in office, their completion of the industry questionnaire and their participation in the candidate interview process. AMAPAC endorses candidates of which the committee deems to be supportive and receptive to the apartment and rental housing industry. FAX: 520-323-3399 1 ArizonA Multihousing AssociAtion AMA Introduces New Patron Recognition Program By Janice Olson, AMA Staff T he Arizona Multihousing Association is excited to introduce a new program aimed at recognizing the extraordinary financial contributions made directly to the Association by AMA Associate members. This program is the result of months of hard work by a Task Force made up of Associate members, AMA staff and chaired by the Association President Lesa LaRocca. In August, the AMA Task Force was originally appointed to discuss the possibility of changing the Associate member dues structure from a flat fee for all members to a tiered membership dues structure. As hours of discussion passed, the Task Force decided a change in the dues structure was not in the best interest of the Associate members or the Association; however, they agreed that extra recognition for Associate members who contribute a significant amount of financial support to the AMA should receive additional company recognition. From there, the dedicated members of this Task Force spent more time coming up with ideas and guidelines in creating the new AMA Patron Recognition Program. As the AMA rolls out this exciting program, the Association is pleased to recognize Patron members from 2010, for the remainder of 2011. In January 2012, the AMA 2011 Patron members will be announced based on financial amounts contributed from January 1 through December 31, 2011. There are three levels of the Patron Recognition Program: Platinum, Gold and Silver. This quarterly report provides property owners and managers in Arizona with a benchmark with which to compare their portfolio’s performance. The second quarter national MAR Index, including studios, one-, two-, three- and fourbedroom units, was 105. Here is how Arizona performed in the second quarter compared to last year: • Phoenix-Mesa-Scottsdale, AZ: 2Q11 MAR Index =99 • Phoenix-Mesa-Scottsdale, AZ: 2Q10 MAR Index = 97 The MAR Index is derived from the statistical scoring model from CoreLogic SafeRent, which is the multifamily industry’s only screening model that is both empirically derived and statistically validated. With this unique applicant risk index, property managers and owners are able to compare their applicant credit quality trends with that of the average MAR Index trends. This comparison indicates whether their portfolio is performing above, below or at market levels with respect to attracting and securing applicants with higher credit quality and an increased likelihood of fulfilling their lease obligations. The Multifamily Applicant Risk Index (MAR Index) provides trends of national and regional traffic credit quality scores whereby a lower index value indicates an applicant pool with a higher risk of not fulfilling lease obligations. A MAR Index value of 100 indicates that market conditions are equal to the national mean for the index’s base period of 2004. A MAR Index value greater than 100 indicates market conditions with reduced average risk of default relative to the index’s base period mean. A value less than 100 indicates market conditions with increased average risk of default relative to the index’s base period mean. The screening model was developed from historical resident lease performance data to specifically evaluate the potential risk of a resident’s future lease performance. The model generates scores for each applicant indicating the relative risk of the applicant not fulfilling lease obligations. Simplot Honored as Housing Hero By AMA C ongratulations to Tom Simplot on his selection as a winner of a 2011 Brian Mickelsen Housing Hero Awards in the “Elected Official” category. The Housing Hero Awards are presented annually by the Arizona Department of Housing, in conjunction with the Arizona Housing Forum. Councilman Simplot’s was recognized for his ongoing support for affordable housing projects and programs, including housing for home- less, domestic violence, special needs and low income families and seniors. Valley of the Sun United Way developed the Housing First model to provide wrap-around services and housing for the chronically homeless. This unique comprehensive model supports individuals in their efforts to maintain independence and rebuild their lives. The business stakeholder group agreed to support a temporary twoyear UI assessment that would begin in the fourth quarter of calendar year 2011. The solution came in the form of HB2619 which was ultimately signed by the Governor. HB2619 created a temporary assessment that increases the current UI assessment by 0.4% (or $28 per employee) in calendar year 2011, and 0.6% (or $42 per employee) in calendar year 2012, on the first $7,000 of taxable wages. So how did we get this point? The Federal Unemployment Tax Act (FUTA) dictates that the state and federal governments have the shared responsibility in providing unemployment insurance. The current FUTA rate for employers is 6.2% on the first $7,000 of taxable wages. The employer is allowed a maximum credit of 5.4% against the FUTA rate (6.2%), meaning Arizona employers only pay a 0.8% FUTA rate (or $56 per employee per year). Since many out-of-work Arizonans cashed-in on unemployment benefits during this great recession, the UI trust fund was nearly depleted. So much to the point that the state was forced to borrow over $400 million from the U.S. Department of Labor in March of 2010, in order to continue funding the benefits and maintain the trust fund’s solvency. The loan, part of the American Recovery and Reinvestment Act (ARRA), was granted interest-free through 2010. The state has since repaid over $200 million of the original loan amount but was unable to, with the prior UI assessment rate, repay the entire loan. And because the ARRA loan stipulated that interest would begin collecting in 2011, the state’s obligation to the federal government ballooned significantly. If the state had continued down that path, the interest payments would have continued to grow and the fund would have likely become insolvent. If this were to happen PHOENIX the state would face significant penalties from the federal government including a possible reduction in the 5.4% FUTA credit. In other words, if we didn’t pass this temporary UI assessment, we would have incurred a higher, more permanent assessment via the federal government. As many business leaders have put it, with this proactive temporary assessment, we were picking our own destiny. HB2619 did include “trigger language,” provisions specifically requested by the business community in the event the economy improves in the next year. In essence if the economy improves and the need for an assessment in 2012 diminishes then the 0.6% assessment would not be implemented. Further if the federal government extends the interest-free borrowing period, the bill’s “trigger language” would again reduce the temporary assessment. Though it is possible that the federal government could extend the interest-free borrowing period since over 30 other states face similar UI solvency issues, I would not count on it. To that I recommend that employers plan for the worst and budget for the special assessment accordingly. Below, the chart breaks down the costs per employee, assuming an assessment of 0.4 percent in 2011 and 0.6 percent in 2012, timely loan repayment, no loss of FUTA credits, and a gradual economic recovery. q *The 0.4% and 0.6% assessment on the first $7,000 of taxable wages provides sufficient additional contributions to address Fund solvency while avoiding the loss of FUTA credits. This would amount to $28 per employee for the 0.4% assessment; and $42 per employee for the 0.6% assessment. TREE SERVICE, INC. Work interruptions are a leading cause of workplace injuries. A recent survey found that nearly 60 percent of workplace disruptions involve attending to social media tools such as email, Facebook and text messaging. With the growing use of personal cell phones, workers can send texts to friends and family throughout their shift. And with the introduction of smart phones, iPads and other electronic tablets, workers have access to their social media sites as well. Collectively, these devices can interfere with a workers’ focus, said SCF Senior Loss Control Consultant Neil Van Tuyl. “The danger doesn’t just exist when using the electronic devices while driving, they can become a distraction in all work environments,” Van Tuyl said. “Most companies have adopted policies that prohibit the use of these electronics while performing certain critical job functions. Enforcement is the key to ensure the policies are efficient and the workers remain safe,” Apartment News • October 2011 Van Tuyl added. “A disciplinary process is essential for effective enforcement of safety standards,” he advised. “This typically includes a verbal warning for the first offense, written warning for the second and finally termination.” To keep workers safe from the social media distractions, safety advocates recommend that employers’ policies: � Block social media sites from the company’s intranet � Set companywide rules for personal cell phone or personal electronics use (such as times employees can use them) and ensure they are enforced � Require that cell phones are set in silent mode and require that incoming calls go to voicemail, to be checked only during the employee’s breaks or lunch � Keep email and text messaging notifications turned off Other common workplace distractions can include socializing, horseplay, employees who constantly chatter and uncomfortable environmental conditions such as temperature and noise. To address these, safety experts recommend that employers: � Alleviate uncomfortable environmental working conditions that could cause fatigue or irritability � Keep instruction manuals on site to eliminate the need for employees to interrupt other workers � Encourage workers to speak up about unsafe distractions � Remind employees to be cautious when interrupting their colleagues Distractions are abundant but can be eliminated primarily through communication, Van Tuyl said. “Communicating company policies to all employees is the first step in ensuring that work hazards and accident prevention measures are clearly understood,” he said, adding that awareness and policy enforcement are crucial in preventing accidents and workers’ compensation claims. Hull O ne of the most often asked questions is, “How much can I charge a tenant who causes damage to the carpet in his or her apartment?” While the Arizona Residential Landlord and Tenant Act does not directly address carpet loss, there is case law in Arizona that does. This article will offer some guidance in assessing carpet damage. A.R.S. § Sec. 33-1341 states in part: “The tenant shall not deliberately or negligently destroy, deface, damage, impair or remove any part of the premises or knowingly permit any person to do so.” Generally, a tenant has a legal obligation to return an apartment in the same condition as when originally rented, normal wear and tear excepted. Carpet damage usually results from pets tearing the carpet or urinating on it, or from human error, food and drink stains or cigarette burns. In the matter of Devine v. Buckler, the court illustrates how it reacted when it found a tenant responsible for carpet damage in an apartment unit. At issue in this case was whether the plaintiff sufficiently proved they suffered a loss as a result of having to replace carpeting that had been ruined through negligent workmanship by the tenant while attempting to dye it. The Court of Appeals determined that “plaintiffs were entitled to recover an amount that would put them in the position they were in before they were injured.” The court stated: In determining actual value, a trial judge has wide latitude. Depending upon the particular conditions and circumstances, he may consider the cost of the property when new, the length of time it was used, its condition at the time of loss or injury, the expense to the owner of replacing it with another item of like kind a n d in similar condition, and any other factors that will assist in assessing the value to the owner at the time of loss or injury. The carpet was approximately three years old when ruined. Its original cost was $13.00 per yard. The trial court awarded the plaintiffs $10.00 per yard. The evidence clearly proved three points: 1) The entire carpet was damaged; 2) It was in excellent condition at the time the loss occurred; 3) Its replacement cost should be depreciated based on the value the owner had already received from its use. In order to meet the burden of proof, the landlord first must show the tenant actually caused the damage. Helpful items to include are a move in and move out checklist, photographs and a sample of the damaged carpet. It is the policy of law in civil cases to award only those damages that will fairly and adequately compensate the injured party. If a landlord is entitled to any recovery, it will be the replacement cost for rooms actually damaged minus the depreciated value that takes into account the number of years the ruined carpet had been in use. AS AN EXAMPLE CONSIDER THE FOLLOWING: “Four tenants rent an apartment at the Jigger In/Stumble Out apartment complex. The residents, Dee U. Eye, Bud Y. Zurr, Jack Daniels and Jim Beam, lease an apartment with brand new carpet. Six months later they leave and the carpet is completely urine soaked from their unauthorized pets. Manager, Dee P. Ess, sues the former residents for complete carpet replacement. Judge E.Z. Life, awards all the carpet cost since it was brand new only six months before move in.” q Andy M. T he federal government has now taken official notice of bedbug-related issues, at least in HUD-insured and assisted housing. In a memo released on August 16, 2011 HUD issued guidance establishing how management at HUD-insured and assisted housing is expected to respond to bedbug infestations. Although this guidance specifically references active HUD-Insured, HUDHeld or Direct Loan, Section 202 and 811 Capital Advances, Project-Based Rental Assistance Contracts, and/or HUD Use Agreements, it is likely that the same standards will be applied to other affordable housing projects, such as those offered through the City of Phoenix. Most important, the guidance prohibits properties from charging residents at covered properties for any treatments relating to bedbug infestations, without regard to how the infestation occurred, when it was reported or whether the resident cooperated with treatment plans. To cover the treatment costs, covered properties may request HUD financial resources to deal with bedbug infestations and HUD may also consider an increased pest control line item in the property’s operating budget, if necessary. The guidance also prohibits properties from refusing to rent to a person because the person previously resided in a premise that had a bedbug infestation. However, it does not prevent properties from asking about prior exposure to bedbugs and it allows them to voluntarily offer to inspect tenants’ furniture before move-in and require the non-chemical treatment of furniture upon tenant move-in. HUD also requires operating authorities to take a three-part step to deal with bedbug infestations: • When a resident initially reports an infestation the property must make contact with the resident within 24hours to provide the resident with information about bedbugs and discuss measures the resident may be able to take before the inspection is performed. Much of that information should already have been provided to the resident as part of the Bedbug Information sheet that the resident was given at move-in. • Next, the property must arrange to inspect the resident’s unit, as well as the apartments immediately above, below, and to the right and left of the resident’s unit within three (3) calendar days. These inspections may be performed by either a trained representative of the operating au- thority or by a third parity trained in bedbug detection. If reputable, licensed pest control companies are not available to conduct the inspection within three (3) calendar days, the operating authority is required to retain documentation on the efforts it made to obtain qualified services. NOTE that if an infestation is suspected but cannot be verified, the operating authority must reinspect the unit(s) periodically over the next several months. • When an infestation is identified, the infested unit and all surrounding apartments must be initially treated for bedbugs according to the integrated pest management plan (IPM) established by the operating authority. A guide for developing such plans will be made available by HUD at http://www.stoppests.org, though it had not yet been posted as of this writing. HUD recommends that those treatments involve encasement, interception devices, vacuuming, teaming, freezing and commodity or building heat treatments rather than chemicals, insofar as possible. These initial treatments should occur within five calendar days of the time the infestation is verified, if possible, and must be repeated until the infestation has been eradicated. Tenants are expected to fully cooperate with all scheduled treatments and, presumably, may continue to be issued Five Day Health and Safety Notices if they fail to do so. Tenants are not entitled to reimbursement for the cost of any additional household expenses that they incur as a result of the infestation, including such things as the purchase of new furniture, clothing or cleaning services. The Law Office of Scott Clark has prepared a revised Pest Control Addendum for Bedbugs that can be used by properties affected by these new HUD requirements.
