M~ D D e - CHARGES AND ACCUSATIONS ~ "You are hereby given notice that pursuant to order of the Board of Medical Examiners of the State of North Carolina the following charges and accusations are made and presented agains t you by said Board, to-wit: "1 That in the month of July 1956 and during the year 1956 you failed to maintain re cords of narcotic drugs administered by you in accordance with the laws of the State of North Carolina and of ~ the United "2 States. at the November term 1956 you were indicted pursuant to the Grand of Harnett Jury by County upon the charge that you did unlawfully neglect and fail and refuse to keep a record of narcotic drugs administered, dispensed, or professionally used by you otherwise than by prescription and at the May 1957 term of Criminal Court of Harnett County you were found guilty of said charge for which you were indicted and you were convicted of a felony ~ ~ That action "3 That you narcot ic drugs ~ "4 have been and are habitually addicted to the use of ~ That during the year 1956 you did unlawfully dispense narcodrugs to various persons addicted to the use of the same in violation of the laws of the State of North Carolina and the laws of the United S tates ~ ~ tic "5 ~ That in the above respects you have been guilty of dishonorable and unprofessional conduct unworthy of and affecting the practice of your profession and grounds exist for the revocation of your license to practice medicine in the S tate of North Carolina' 62 "6 ~ You are further will given notice that a hearing be held up- foregoing charges and accusations be fore the Board of Mediof the State of North Carolina on October 10th, 1957, cal o' at 9 clock a ~ m. at the Sir Walter Hotel, Raleigh, North Carolina, at which time you will be given an opportunity to be heard, either personally or through counsel of your ch oice, to cross-examine witnesses and to present on your own behalf evidence in the matter, if the Board will receive any you so desire, and that in the meantime the charges which you may wish to foregoing answer or written reply to f ile although you are not required to make such written reply or answer ~ Following this hearing the Board will make such findings and will take such action regarding a suspension or revocation of your license to practice medicine as to the Board appears warranted and jus ti f ied. on the Examiners "This 21 day 1957 ~ of August, S/ Joseph J ~ Combs Secretary, Board of Medical Examiners of the State of North Carolina " After a full hearing was rendered "IN RE ' by in the matter the following judgment the Board WILEY ROYSTER YOUNG M. F INDINGS AND ORDER "The Board of Medical Examiners of the State of North Carolina following the presentation of all the evidence in the above matter at its regular meeting on October 10, 1957, at the Sir Walter Hotel, Raleigh, North Carolina, pursuarrt to notice to Dr. Wiley Roys ter Young of charges and accusations and of hearing, and after full consideration of all the evidence, rendered the following decision and verdict upon the charges and accusations presented against Dr. Wiley Royster Young: "1 The Board f inds Dr. Wiley set forth in paragraph one of ~ "2. Carter - continued The secretary also reported that a form of consent for the voluntary surrender for revocation of Dr. Carter's license had been executed by Dr. Car ter ~ VERDICT '- WHEREUPON, mot i on duly upon made and seeded, it was ordered that the license to practice medicine in the State of North Carolina o f Dr ~ W ~ Percy Carter be and is hereby revoked. October 10th Thursday, 2:30 P. M - (See Minutes June, 1957) RE: Dr. Geor e WE Melchior Dr. Melchior was granted an interview upon request at this time He stated that he came to discuss with the Board any possibilities there might be for him in the field of medicines (See interview in f ile) The meeting was adjourned ~ Friday, October 11th 9:30 AD MD RE: Dr. Daniel Ef land Forrest Hillsboro, North Carolina (See previous Minutes) - On September 24th, 1956 Dr. Forrest's medical license was revoked based upon evidence and his voluntary surrender ~ Dr Forrest appeared at this time petitioning for reinstateof his medical license. He was released .from the United States Public Health Service Hospital at Lexington, Kentucky in April, 1957 He stated that he had had no narcotic drugs since 1955 and no barbiturates since his readmission to the United States Public Health Service Hospital. ED Pugh gave Dr. Forrest a. recommendation when called on the phone by the secretary' (Letter of recommendation from Dry Pugh in the office of the secretary upon return from this ~ ment ~ ~ ) Dr. J. J. moved, subject to the recommendation of Dr. A ~ E Pugh, Director of Medical Services, Veterans Hospital, that Dr. Daniel Efland Forrest's medical license be restored on a conditional basis of 18 months probation; if during which time that the Board receives satisfactory information that he has misused the use of barbiturates or narcotic drugs, that his license be automatically revoked. If no evidence has been forthcoming within the period of the probation, that his license be in full force and effect. G Thurston and passed VERDICT: Combs ~ ~ unanimously' further moved that this order go in effect when Dr. Daniel Efland Forrest has come to the secretary's office and signed a statement that he accept the probation period and his license will be restored as of that date This motion was duly seconded by Dr. Carl VS Tyner and passed unanimously' Dry Combs ~ RE: Dr. John William Strau han Warsaw, nt to receipt of report of investigation otic addiction, view. North Carolina the State Bureau Dry Straughan was reby RE: Di ~ Strau han continued John William Pope discussed this matter with the Board and that Dr. S traughan f irst received treatment at the United States Public Health Service Hospital, Lexington, Kentucky, in 1953 and had received treatment since that time in Greensboro; that it appeared now that he had rehabilitated himself; that Dr Straughan related that he had been informed he was required by law to prescribed narcotics to addicts enroute to Eexington Agent R ~ W ~ advised ~ ~ Dr ~ S traughan was interviewed and he readily admitted to the Board that he had been addicted to narcotics; that he had had no narcotic drugs since March, 1956; that he had worked continuously since May, 1956 ~ That he used his order form to order narcotics in July, 1958 for the first time in 15 years. Dof fermyre: The Board is fully conscious of the violated not only the law, but the ethics of the profession of medicine, but in view of the fact that you have apparently had no narcotics since March, 1956, it is going to allow your case to stand status quo ~ That is they are reserving judgment and will allow you to continue with your narcotic stamp, but that any violation of the Narcotic Laws, either state or Federal, will be cause for your reappearance be f ore this Board, looking to revocation of your license to practice medicine in North Carolina That you are advised that there is no law, state or Federal, that will allow you to prescribe to narcotic addicts, whether in transit or not That the Board will have the State Bureau of Investigation to check on you at intervals. That any information received that you are using narcotics or prescribing narcotic drugs in excess will be investigated to ascertain the facts ~ That the Board will reserve the right to ask you to appear before one member of the Board at a time at its discretion licensees for a test of blood or ur ine f or narcotics ~ VERDICT: Dr you have fact that ~ ~ ~ RE: Dr John A Parrott - Dr. Parrott requested an appointto appear before the Board in order to petition for recommendation for reinstatemen t of his narcotic Due to the fact that an investi gation is being made Jr' in Duplin County by the State Bureau of Investigati on in regard to Dr ~ Parrott and other matters, which is not co mplete the Boer'd took no action at this time ~ Letters of recommendatlon were receoved and are on file in regard to Dr ~ Parrott (Copy of interview on file) ~ ~ ment Dr. David E ~ Plummer, Thomasville, North Carolina - Dr requested an appointment to appear before the Board to petition for recommendation for reinstatement of his narcotic license, which he was given. He was also advised to obtain letters of recommendation ~ Letters of recommendation were not presented, Dr. Plummer did not appear at this time, and no further word has been heard from RE: Plummer ~ him. RE: Dr. Louis D. Ha man , Jacksonville, North Carolina -(See previous Minutes)- The State Bureau of Investigation was requested to make a routine checkup an Dr. Hayman, the synopsis of which is as follows: That since Dr. Hayman's trial in the Superior Court of Onslow County in 1956 two incidents have occurred which caused associates to suspect him of being under the influence of a drug', that close associates do not feel his narcotic license should be restored at this time ~ That Dr. Hayman stated he was making progress in the direction of a complete cure of his trouble, but admitted two incidents since January, 1956 when he became de pressed and took Seconal ~ Tha t he did not wish his narcotic license restored at this time f or fear of jeopardizing his practice of medicine ~ A report was received from ~ +I ~ ~'k RE: Dr Louis ~ Cornelius Dr ~ factorily'~ Jr man Ha D~ Lansing, continued ~ stated his therapy who was progressing satis- The secretary reported that he had a with Dry J ~ DE Piver, who conducted a poll licenseeswas in Jacksonville, the concensus of which Dry Hayman not to have a narcotic if asked D ~ there The above Hayman, Jr ~ was feeling there, good was telephone conversation of the medical profession that it was better for ThC Dry Piver upon being replied that there was. received as information in regard to Dr ~ Louis RE: Dr. Paul Crum ler Clinton, North Carolina (See previous Minutes ) Agent R ~ YI ~ Pope re por ted on his inve st igat ion nade Se ptember 3rd, 1957, a synopsis of which is that Dr. Crumpler received requisitioned narcotics on July 10th, 1957 in violation of orders of the Board of Medical Examiners given orally by Dr ~ L. R ~ Dof fer- on July 9th, 1957; that he had also according to information presented narcotic prescriptions to patients with instructions that they obtain drugs and return them to his of f ice, also in violation of the Bca rd's instructions. That Dr. Crumpler said he is not dispensing narcotics from his office, only administering. That he stated most of the patients in that vicinity with kidney colic came to him as he was accessible, his of f ice bei ng connected with his home That he had some narcotics in his of f ice and some in his lock box at the bank Mr. Pope said he understood that his patients are old, whome he has treated for years. It was brought out by Mr. Pope that drugs received on July 10th, 1957 had been ordered previous to Dr Doffermyre's interview with him, myre ~ ~ ~ J. Dof fermyre reported that a committee meeting was held on Wednesday evening, October 10th, at the S ir Walter Hotel with J. Melville Broughton, Jr. , Chairman, Senator Kelly Bennett and Dr. Yates Palmer from the Hospitals Board of Control and Drs. Carl V ~ Tyner, J ~ J ~ Combs and L. R. Dof fermyre from the Board of Medical Examiners ~ That the committee from the Hospital Board of Control was thoroughly in accord with the stand of the Board of Medical Examiners.
