PRESIDENT’S REPORT

Every year we say how important the upcoming political season
will be and every year it is because the Brothers and Sisters of
Labor Organizations are always under attack from Corporate
America, who believe that we deserve nothing more than low
wages and inadequate working conditions.
With Right to Work surrounding us and 26 states now having
passed legislation, it is clear that we have to stand on our own 2
feet and fight. The sole goal of Right to Work is to defund unions
and take the voice away from workers, making them weaker. In
Right to Work states, the rate of workplace deaths is higher, the
poverty rates are higher, the workforce is less likely to have job
based health insurance, and the average income is $5,971 less
annually.
Meanwhile, politicians are signing devastating trade deals that
are destroying good paying jobs that this Country was built upon.
Since the enactment of NAFTA, over 700,000 U.S. jobs have been
lost. Job losses, just due to trade with Mexico, were relatively
high paying manufacturing positions. States with heavy emphasis
on manufacturing industries like California, Indiana, Michigan,
Ohio, and Pennsylvania, were significantly affected by the job
losses. These billionaires and corporate cronies are trading our
jobs like playing cards and then stifling the workers, telling us to
like what we are given. Irene Rosenfeld, the CEO of Mondolez Bakeries, which makes
Oreo cookies, Ritz crackers and Cadbury chocolates, announced
they will be moving 600 well-paying jobs from its long time
based Chicago facility to Mexico because they don’t want to
invest money in modernizing the plant. This is the same CEO
whose salary rose above $21 million per year since 2014. Jamie
Dimon, the CEO for JPMorgan Chase had his salary boosted to
$27 million per year, even as Wall Street braced for more than
6,500 job cuts. These jobs are being stripped from Americans and
sent to Mexico. Once there, their own citizens are being exploited
with constant lowering rates. Those citizens then come to America
illegally to find work which cheapens what jobs we do have left.
The 1% in America have made it very clear that they do not care
about the working man, about the families who suffer, about
our safety in the workplace and about the dream of retirement.
October 11, 2016 is the deadline for registering to vote for the
2016 election. I urge each and every one of you to stand strong, as
we did in the fight against SB5/ Issue 2, and show the politicians
and greedy corporate mongers that we have had enough.

David Reed is a Swing Driver for Republic Services and
has been a proud Teamsters Local 20 member for over 8
years. He has been a valuable asset for the union while
representing his fellow brothers and sisters as Chief
Steward. Outside of work, David is a Lieutenant for the
Wakeman, Ohio Fire Department where he volunteers
his time.
We are honored to have David as a member and thank
him for his brotherhood to the union and selfless service
to the community.
Public Employees Live to Fight Another Day
Unless you have been living under a rock, you have no doubt heard that the United States Supreme Court
rendered a 4-4 split decision in Friedrichs v. California Teachers Association, which, for now, effectively
leaves the charging of “agency fees” intact for public employees.
In Friedrichs, non-union teachers in California challenged the practice of charging agency fees on the
ground that the First Amendment prohibits unions from requiring teachers to pay their fair share of the
cost of representation services. Friedrichs also challenged whether the First Amendment requires public
employees who wish to join a union to opt-in for membership rather than the current opt-out system.
The case was heard by the US Supreme Court on January 11th, and it appeared, from oral arguments, that
we were certain to see a 5-4 decision finding it unconstitutional to charge agency fees. However, Justice
Antonin Scalia died, leaving the Court split.
The Court issued its decision on Tuesday, a split decision, which affirms the lower courts’ decision
upholding the long standing practice previously affirmed by the US Supreme Court in 1977. Since it
was a split decision, the case will not set precedent so we can’t rely on the decision for upholding the
practice of charging agency fees.
What now?
It is anticipated that the attorneys involved in the case for the plaintiffs will file a rehearing petition. This
petition needs to be filed within 25 days and requires 5 Justices to order the rehearing, 1 of which who
must have joined in the decision. This seems unlikely in light of the split decision, and no new Justice
added to the Court.
Another option is for a new case to work its way through the lower courts and again be brought before
the Supreme Court for it to decide when there is a full bench.

WHAT IS TAX FORM 1095-B?
Many employees are confused over how to report that they
received health coverage when filing their income tax returns
this tax season. This is the first year in which they’re required
to affirm that they had Affordable Care Act (ACA)-compliant
coverage throughout the year or risk penalties under the
individual mandate. You should have received yours in
February 2016. These should be given to your tax preparer, as
any other tax documentation that is normally filed with your
tax return. Also, they do not have to be mailed to participants,
until March 31, 2016. The deadline for next year has not been
established at this time. If you have questions concerning
this, please ask your tax preparer.

WHAT DOES IT MEAN TO HAVE A WORKERS’
COMPENSATION CLAIM?

You were injured on the job. The Bureau of Workers’ Compensation or
the Self-Insured Employer has acknowledged your injuries. So, what does
that mean exactly?
Logically, one would think it means you can get the treatment you need,
that it would be covered, and that you would be compensated accordingly
for your injuries. Makes sense, doesn’t it?
But, having an established claim does not guarantee treatment or
compensation without a fight. In fact, all it means is that your injuries have
been acknowledged as having occurred on the job. It does not guarantee
treatment or compensation for your injuries. For every treatment request,
for every condition requested, for every request of compensation, the
Bureau of Workers’ Compensation, the Managed Care Organization and/or
the Self-Insured Employer have the ability to make an initial decision. In
a state funded claim, the Bureau of Workers’ Compensation will make the
initial decision on the claim. Once the claim is established, the Managed
Care Organization will make the initial determination on any treatment
requests that are submitted. The Bureau will address compensation and
any additional conditions that are diagnosed. In self-insured claims, it is the
self-insured employer that addresses all requests. While it certainly does
not make sense, there are times where injured workers will find themselves
with an established workers’ compensation claim and yet still not able to get
the treatment or compensation they are rightfully entitled to and desperately
need.
There is good news, however. While the Bureau, the MCO and the SelfInsured Employers have the initial decision making ability, none of them
have the final say. You have the right to appeal a denial and request a
hearing before the Industrial Commission of Ohio.
To say that maneuvering through the workers’ compensation system in
Ohio is difficult is an understatement. That is why we are here to help. If

A secret mail ballot election is being held for 7 delegates to the 2016 IBT Convention. When you receive your ballot,
vote for no more than 7 candidates for delegate.
To vote, place a mark in the box to the left of the candidate(s) or slate of your choice.
INSTRUCTIONS TO VOTER:
1. Vote for no more than 7 delegate candidates.
You may vote for a full slate.
2. You may vote for a partial slate plus additional candidates, whether or not on a slate, so long as the total number
of delegate candidate votes does not exceed the total to be elected.
3. Instead of voting for any slate or partial slate, you may vote for individual candidates, whether or not on a slate,
so long as the total number of delegate candidate votes does not exceed the total to be elected.
4. To vote, place a mark in the box (or circle) to the left of each candidate or slate of your choice.
5. By placing a mark in the slate box (or circle) you will have voted for all of the individual candidates on that

After voting, fold the ballot (do not tear off any portion) and insert the ballot into the envelope marked “Secret
Ballot Envelope.” Seal the secret ballot envelope. Do not put any identifiable marks on the secret ballot envelope.
Use of this envelope ensures the confidentiality of your vote.
Place the sealed Secret Ballot Envelope in the return envelope, seal and mail the return envelope. Postage is already
provided. Do not remove or deface the mailing label which contains your name and address. This label must
be visible for your vote to be counted.

USF HOLLAND
USF Holland was founded in 1929 in Holland, Michigan and became part of
YRC Worldwide in 2005. USF Holland provides full-state regional delivery
service within 12 states and 2 providences in Canada.
The Toledo terminal boasts an 80 door facility and is home to many Teamster
members with over 80 local city drivers, more than 45 over-the-road drivers
and 9 office support staff, along with 10 part-time employees working as
dock-only casuals.
At USF Holland there are four (4) City Stewards: Craig Keller, Gary Kime,
Brian Moore, and Tova Blachuta, two (2) Line-haul Stewards: David
Koepke and Darryl Gould; and two (2) Office Stewards: Donna Kasper and
Tom Pauwels.
The dedicated Teamsters Local 20 members have made their mark at USF
Holland and have worked very hard to make the Toledo terminal one of the
best in the LTL transportation industry.
The Teamsters Local 20 Women’s Committee attended the
YWCA 21st Annual Milestones: A Tribute to Women Awards Luncheon.

Johns Manville Employees Give Back to the Community
On February 9, 2016, Johns Manville members took part in a team building event. The morning was
spent in DISC training. DISC helps individuals “understand the communication styles of others, which
leads to clearer understanding of other’s objectives, intentions and goals.” Prior to the training, the team
members completed an assessment so they were able to understand and discuss the four behavioral styles,
and their own dominant personality.
During the afternoon they built eight wheelchairs. The employees didn’t know how or why they were
building them only that it was a team building exercise. The four teams used iPads to perform various
tasks and answer questions to earn points. The points earned gave the teams various tools/items to build
the wheelchair.
The wheel chairs were built to give to a local charity – Flag City Honor Flight. This charity is dedicated
to sending local Veterans to Washington, D.C. to see the memorials built and dedicated in their honor.
Amongst the teams, there were several Veterans as well.
