CATALOG FEES AND COMMISSIONS
Full commission, and any and all fees, will be charged on
any animal entered and/or sold through or by reason of a
sale held and conducted by The 4B E. TN. Horse Sale. The
consignor fee is $125. The consignor fee is separate from
and does not apply to the commission charged. The consignor/seller shall also pay and be charged a commission
equal to 5% of the final bid price.
For all categories where consignor/owner has the right of
refusal, consignor or consignor’s agent must advise the auctioneer of his desire to accept or refuse the final bid on said
animal before the animal leaves the ring.
All consignors, in addition to the fees and commissions described above, shall be charged and shall pay a veterinarian
inspection (VET) fee and a Horse Industry Inspection
(DQP) fee.$25-30.
A stall fee for a second night if needed will be a $25 charge.
Purchasers shall be charged and hereby accept and agree to
pay a buyer’s premium in an amount equal to 5% of the final bid price on all entries, animals or lots purchased. This
fee will be waved if paid in cash.
The purchaser shall immediately after the fall of the hammer sign the purchaser acknowledgement form.
Purchaser will make settlement for horses purchased with
thirty minutes of the conclusion of the sale session on the
day of purchase for the full purchase price. Settlement is to
be in the form of U.S. currency, certified or cashiers,check,
travelers check, personal check or credit card. All payments
made other than cost shall be considered conditional payment only until the amounts paid and owed are fully credited to 4B E. TN Horse Sale’s bank account (Woods Livestock).
Any announcement from the auction box will take precedence over the printed matter in this catalog and all other
prier announcements.

LIABILITY
Everyone on the sale premises is cautioned to exercise reasonable care, and attendance at the sale shall be at his assumption
of risk for damages or injuries to his animals or himself. 4B
E.TN HORSE SALE assumes no liability or responsibility
whatsoever for any damages or injuries to animal or person.
GUARANTEE
 Each owner or consignor will make known the guarantee or
warrant he desires for his animal, and will be solely responsible thereon. Such guarantee or warranty will be announced
when and as the animal is offered for sale. 4B E. TN HORSE
SALE does not guarantee or warrant the condition or soundness of any animal offered for sale. If no announcements are
made, the animal will be sold in as “as is” condition.
 The buyer assumes full control, responsibility, and expense
for the animal immediately upon the fall of the auctioneer’s
gavel.

AGREEMENT GOVERNING SALES
TERMS & CONDITIONS
The consignor agrees that all animals shall be at the place of
sale in proper time delivered free of expense to our sale
grounds, and subjection to our directions for sale by auction.
A negative Coggins test is strictly required.
The consignor guarantees the title of the property to the purchaser and hereby represents that there are no claims against,
nor lien upon, nor ownership, in whole or in part , of any animal entered by him that can in any way interfere with the said
animals rightful sale and delivery or that can hereafter deprive
the purchaser of full, complete, and peaceful ownership. The
consignor further agrees that all defects, tricks, unsoundness,
or faults of any nature known to the consignor will be stated,
and that no animal suffering from any contagious disease or
that is unsafe or vicious, will be sent by him to any sale.
The consignor agrees that he will be present in person, or
have a fully authorized representative present, acknowledged
as his agent, to make true representations respecting each animal.
In case any Purchaser fails to pay for and/ or pick up any animal sold to him, The 4B E. Tn. Horse Auction is authorized to
accept the purchase price from another person or persons, or
in the alternative the 4B East Tn. Horse Sale may put the said
animal up for auction a second time.
Auctioneer will settle any disputes as to bids. Should any dispute arise between or among two or more bidders at the auction, the auctioneer shall forthwith settle the dispute.
Each owner or consignor will make known the guarantee or
