Subject Property consists of the unoccupied Camelot School property and is approximately 7 acres The Petitioner contract purchaser of the property is proposing to demolish all of the 11 existing improvements and construct 57 new single family homes The proposed lots would not meet the minimum standards of the Zoning Ordinance or the Subdivision Regulations Therefore the Petitioner is seeking approval of the following 1 Preliminary Planned Development to permit a 57 unit single family residential development ANALYSIS Background The subject property was annexed in 1990 and previously operated as the Camelot School a private school The school vacated the premises several years ago and the property has been vacant since Zoning and Site Design The Petitioner is proposing to subdivide the property and construct 57 new residences Access to the site would be provided by an internal street system with a full access off of the Northwest Highway frontage road and a right out from Dundee Road The primary in streets are proposed to be public and would be located within dedicated right way of The total subject property area is 11 7 acres Of this area 2 15 acres would be dedicated for the public street and 2 24 acres would be reserved for storm water detention and the required park land dedication The Petitioner is proposing to dedicate the required land area 1 61 acres to the Park District A new park would be constructed by the Park District on the property fronting onto Doe Road A pedestrian path would be constructed to connect the proposed development through the park site to Doe Road The Park District has reviewed the proposed dedication and does not object to the size or location Setbacks for the properties would be substandard The Petitioner proposes front yard setbacks of 20 feet rear yard setbacks of 25 feet and side yard setbacks of 5 feet The s least restrictive single Village family designation is R 2 which would require 30 foot front yard setbacks 40 foot rear yard setbacks and 10 foot interior side yard setbacks The residences would each have a 2 car garage and room for 2 parking spaces in the driveways The parking ratio would be 4 spaces per unit which exceeds the minimum 3 spaces required by the Zoning Ordinance There is no guest parking provided and limited on street parking The proposed lots would not conform to the requirements of the Zoning lot would have a minimum 963 sf of open yard area 53 less than minimum standard 2 Staff has reviewed the development potential if the property was designed utilizing the sR Village 2 minimum standards Under this scenario the Petitioner would be able to fit approximately 28 to 32 units depending on the design If the Petitioner were to propose a mix of housing types including attached single family on the southern portion of the development and R 2 single family on the northern portion of the development they would be able to fit approximately 41 units Engineering There is an approximate 20 grade change on the property from northwest to southeast Sanitary sewer and water services would be provided by existing facilities on site The existing utilities would need to be rerouted and possibly resized Storm water management would be provided on site within two detention basins One basin would be located at the far south end of the site and one would be provided on the three vacant lots fronting onto Doe Road Both detention basins would be dry bottom They would ultimately discharge into existing storm sewers and at grade swales to the south and east of the site Sidewalks would be extended down the Northwest Hwy frontage and across the width of the property The Petitioner is seeking a Variation from the Subdivision Regulations to allow a right of way width of 50 feet instead of 60 feet and to allow a street width of 25 feet back of curb to back of curb instead of the required 28 feet The Director of Public Works has expressed concerns with the Village s ability to provide services on sub standard streets especially snow and leaf removal The Fire Marshal has expressed concerns with emergency vehicle access on the sub standard streets The Petitioner has indicated they would restrict parking to one side of the street only The Petitioner is also proposing to provide a private street for access to Lots 7 12 Because this street does not connect to another development or provide access to other areas of the Village it is not eligible to be dedicated to the Village Because this private street does not have a turn around for emergency vehicles the Fire Marshal would require these six units to have sprinkler systems A traffic report was prepared by KLOA Their report determined this proposal would be expected to generate approximately 50 total morning rush hour trips and 64 total evening rush hour trips IDOT estimates the current daily trip counts on Dundee Road are 18 300 and on Northwest Highway are 23 600 The report concludes that the proposal will not have a negative impact on the existing street system and that the proposed internal street system is adequate to handle the traffic generated Architecture The Petitioner has submitted a proposed product line for the property The sizes of the homes range from 2 100 square feet to 3 000 square feet Each unit would be 2 stories and would have a 2 car attached garage All units are 35 feet wide to fit the lot widths with the required setbacks STAFF RECOMMENDATION Previous development proposals on this property were asked to provide feasibility studies for a potential commercial component to this parcel Given the responses Staff received from former applicants and interested parties since then and given the lack of commercial development proposals since the property has been available Staff no longer believes a commercial development of this parcel is likely Staff believes the single family units along the eastern side of the development should provide a better transition between the larger lots on Doe Road and the proposed smaller lots in this proposal Lots conforming to the R 2 standards might be more appropriate Additionally Staff does not support the sub standard right way width or the sub of standard street width However a residential development proposal with an appropriate density and setbacks and public improvements would receive a positive recommendation from Staff Therefore staff does not recommend approval of the proposal as currently designed If the Plan Commission recommends approval of the preliminary development as designed Staff would recommend the following conditions be addressed prior to this item being scheduled for the required final hearing 1 The final development plans shall significantly conform to the Plat of Subdivision prepared by Manhard Consulting dated and last revised 11 26 and attached hereto as Exhibit A 9 and to the preliminary engineering plans by Manhard Consulting dated 11 26 last revised 9 11 and attached hereto as Exhibit B to the Architectural Plans attached hereto as 24 10 Exhibit C to the Landscape Plan prepared by Gary R Weber Associates Inc attached hereto as Exhibit D and to the Site Plan prepared by Gary R Weber and Associates Inc dated 10 11 and attached hereto as Exhibit E except as such plans may be changed to 25 conform to Village Codes and Ordinances and the following conditions 2 The Petitioner shall verify the capacity of the downstream sanitary sewer to determine if upgrades are needed improvements 3 Final Engineering Plans shall be submitted including a cost estimate and revised storm water calculations 4 Declarations shall be submitted for the review and approval of the Village Attorney The Declarations shall make clear that the streets shall remain private unless the Village at residents with a traditional sized lot and creates an intimate front porch community The requested variances in lot dimension right way width and lot of coverage are requested for the following reasons October 25 2011 Mr Anderson p 1 The site configuration restricts the planning options The east west dimension at the north end of the site allows for only two 100 lots and a 50 right of way This configuration is carried through the site for consistency 2 While townhomes would typically be a buffer between single family homes and a higher intensity use like the Park District s facility townhomes have been denied in past applications We believe the smaller lot single family homes are a preferable use to the adjacent residents than the townhome alternative 3 The smaller lots provide residents a lower maintenance alternative to a targe lot single family home while still having a private yard unlike townhomes Opportunities for this type of living are rare in the area especially in new construction While the property to the east is zoned R 2 many of these properties do not meet the standard zoning requirements for setbacks A few have rear setbacks as small as 20 feet In multiple frontages ANALYSIS Text Amendments to 8 01 Signage General Requirements Section 8 01 of the Village of Palatine Zoning Ordinance To add a Statement of Purpose to In order to further provide additional context and outline the basis and rationale for the Sign Ordinance regulations Staff recommends including a Statement of Purpose as a preamble to the sign ordinance This will establish the basis for the regulations contained within Article VIII Therefore Staff recommends adding the following introduction to the Sign Ordinance Section 8 01 The siqn ordinance shall requlate the location size placement of all siqns within Palatine It is the intention of this ordinance to establish requlations which will Maintain and enhance aesthetic controls within the Villaae Promote pedestrian and Operation of Electronic Message Boards and the total number of messages displayed in a one hour period of the Village of Palatine Zoning Ordinance In 2008 Staff drafted the Electronic Message Board section of the sign ordinance Section 01 i was adopted to allow EMB signs in certain locations Northwest Highway Rand 8 Road Lake Cook Road and Dundee Road within Palatine to apply for Special Use review in order to request the ability to have this type of sign Additional controls related to both the size of the property within these corridors and spacing limitations between EMBs were also adopted Finally there were operational restrictions which limited the hold times required for message 60 seconds and the total number of inessages allowed within a 24 hour period 4 different messages 24 hours There have been ten electronic message boards approved by the Village Council since 2008 In order to reduce driver distraction opportunities the current code requires that all messages are displayed for a minimum of one minute This allows traffic to cycle through an area without attracting the attention of a driver There is a great amount of data and research on the subject of EMB signs and drive distraction he Federal Highway Administration through an extensive and multi year study culminating with The Effects of Commercial Electronic Variable Message Signs on Driver Attention and Distraction 2009 update conducted a scientific review of such signs Without specific recommendations or conclusions this study indicates that driver distraction plays a role in traffic accidents While without specific conclusion to that report the research and data attempted to quantify the impact of roadside advertising on traffic safety Staff reviewed this data and other municipal regulations and ordinances which require a message to be static for a period of time usually expressed in seconds Such restrictions are common and appropriate While we are not recommending changing the time duration requirement the current ordinance requirement to hold a message for 60 seconds is higher than most of the communities surveyed Staff believes that limiting both the hold time duration and the number equipment within the Village of Palatine This would apply to vehicles and other trailers or non independently maneuverable equipment Staff has received complaints about the use of trailers as signs within the Village Also we have had zoning enforcement cases involving business adhering signs to either existing business vehicles or independently maneuverable vehicles in Palatine While our sign ordinance regulates the non placement size and location of freestanding and attached signs within the Village it is less direct related to either signs or business signage on trailers or signs placed on vehicles e g a 5 x 10 sign placed in the bed of a pick up truck As part of the review for this question Staff contacted the Northwest Municipal Conference to complete a survey of the surrounding communities to determine how this question has been answered elsewhere We received many responses and the response spreadsheet and actual ordinance language from those communities is included in the packet In order to eliminate the use of a vehicle or trailer as a second freestanding sign Staff believes that it is appropriate to include some restrictions related to the use and placement of signage on vehicles within the Village Staff will present the final draft of this text amendment to the Plan Commission on Tuesday Text Amendment to 8 03 c 2 and d 2 of the Village of Palatine Zoning Ordinance related to the number of attached signs allowed for stores located with multiple frontages In certain instances the sign ordinance allows two attached signs for corner properties and stores that front on two streets This is allowed o for unified developments less than two acres For unified center between two and five acres and larger than five acres only one attached sign is permitted regardless if the property has multiple frontages or is located on a corner Staff believes this language was inadvertently omitted and that if the ordinance allows corner properties or stores with multiple frontages to have two signs for unified centers less than two acres this allowance should apply to unified centers in all three categories Therefore Staff recommends the text amendment 03 c 8 Article shall be liberally constructed in a manner which ensures the protection of the rights of persons groups associations and entities as guaranteed by the United States and Illinois constitutions It is not the intent of this Article to infringe on any such rights B The purpose of this Article is to provide a legal framework for the comprehensive regulation of signs in the City of Des Plaines It recognizes the need for adequate identification advertising and communication within the community which is structurally sound well maintained and attractive in appearance To achieve this purpose this Article is intended to control the height area location and other similar aspects of signs and sign structures while also 1 Preserving the non commercial character of residential neighborhoods 2 Providing reasonable yet appropriate conditions for identifying businesses and services rendered in commercial institutional and industrial areas 3 Reducing traffic hazards by restricting signs and lights which exceed a viewers capacity to receive information or which increases the potential for accidents created by signage which distracts or obstructs a viewers visions and 4 Protecting the health safety and general welfare of the residents of the City 2 11 Signs Proliibited The following signs shall be prohibited A Signs which move or give the appearance of movement including but not limited to signs which flutter undulate swing rotate oscillate or otherwise move by natural or artificial means 1 Temporary signs such as pennants banners and streamers shall not be deemed to fall within this prohibition provided a sign permit is first obtained from the Zoning Administrator pursuant to Section 11 3 below 2 Time and temperature signs shall not be deemed to fall within this prohibition 3 Signs containing electronic message boards shall be subject to the standards and regulations as set forth in Section 11 7 of this ordinance ord 07 5 11 Z B Roof signs City of Des Plaines Administrator 2 Applications Applications for a sign permits shall be filed with the Zoning 3 11 Administrator on forms so provided and in accordance with the requirements of Article 3 Section 3 1 Applications and Hearings 3 11 Issuance of the Permit A The Zoning Administrator Upon receipt of a fully complete sign permit application the Zoning Administrator shall examine the application and all material attached thereto to determine its compliance with this Article as well as any other applicable City Code ordinance or law The Zoning Administrator shall take formal action on the application within thirty days of the date tlie application was filed Except where needed to determine if a sign meets the requirements set forth in this Article the content of proposed signs is irrelevant and is
