The Board is saddened to report the unexpected
death of member Mr. Windell Daniels of Wilmington.
Mr. Daniels died suddenly April 22 in Wilmington.
Mr. Daniels was appointed to the Board by the
General Assembly on the recommendation of
President Pro Tempore of the Senate Marc Basnight
in January 2002. Mr. Daniels was involved in a
wide range of community and civic activities in
Wilmington and New Hanover County. He is
survived by his wife Wilma, sons Windell and Euran,
grandchildren Symone and Chris, his mother
Elease Daniels and 5 brothers and sisters.

The Board will host a Continuing Education
clinic on Tuesday, August 5 at the McKimmon
Center on the campus of NCSU in Raleigh.
The hours will be from 9 a.m. to 4:30 p.m.
Registration will begin at 8 a.m. and the fee
will be $ 35.00. Presenters will include
representatives of Carolina Donor Services
and the NC Eye Bank, NC Vital Records and
the Board staff.

Recent advances in the treatment of chronic pain
have resulted in implants that may not be
readily identified or placed where they can
be easily found. Prior to cremation thoroughly
examine bodies for implanted medical devices
especially if the authorizing agent is uncertain
of implants. This may require obtaining
permission from the next of kin or authorizing

Rule changes
The North Carolina Rules Review Commission approved the proposed changes to 21 NCAC
34B (rules on continuing education) on February 21, 2008. The effective date of the rule
changes was March 1, 2008.

Pre-Need
The Board recently issued a recommendation
about funeral home ownership of policies
funding preneed contracts.
requirements and is preferable to an absolute
assignment. A request was sent to the Chief
of Recipient Services in the Division of
Medical Assistance to review the concerns
regarding pre-need regulation, consumer
protection and the apparent advocacy of the
Division of Medical Assistance for funeral
establishments to be owners of policies.
“In January of 2008 the Board began
discussions of funeral establishment
ownership of life policies that fund
preneed contracts. These discussions
included concerns for consumer
protection when an establishment is
made the owner of a policy and the
broad powers the owner of a policy has.
The Board invited comment through
publication to interested parties and
received a number of written replies
and some public comments.
The Board delayed action on this matter
pending a reply from the Division of Medical
Assistance. To date that reply has not been
issued and the Board did not believe any
further delay would be beneficial to
consumer protection.
Therefore it is the Board’s recommendation
that the establishment should not be owner
of any life insurance policy funding a
pre-need funeral contract unless directed
by a Department of Social Services that this
is necessary to meet Medicaid eligibility
requirements for the contract beneficiary.”
The experience of the Board staff
and written comments from
licensees supported that there are
inconsistencies in directives from local
Medicaid units regarding eligibility and
insurance funded preneed contracts.
In some cases directives are the
establishment must be owner of policies
to meet eligibility requirements while
others direct an irrevocable assignment
or beneficiary designation will meet
the requirements. The Adult Medicaid
Manual, published by the Division
of Medical Assistance, NC Department
of Health and Human Services, refers
to funeral establishment ownership
of policies (defined in the manual as
an absolute assignment) as a means
to meet eligibility requirements
however also states an irrevocable assignment or beneficiary designation to
the funeral establishment will meet the
Since this advisory recommendation was issued the
Board staff spoke with Ms. Carolyn McClanahan,
Chief of Recipient Service for the Division of Medical
Assistance. Ms. McClanahan agreed that social
workers at the local level should not be requiring
funeral homes to own policies that fund preneed
contracts since there is an alternative available as an
irrevocable assignment of proceeds. She has asked
that the Board begin tracking the areas locations
where this is occurring so she can properly instruct
those jurisdictions of the proper procedures. Licensees
are encouraged to report this to the Board staff so
this can be sent to Ms. McClanahan.

Authority for disposition
Some licenses appear to believe that the person
who may be able to pay expenses is the person
who has legal authority to direct disposition.
That is not always the case and recently the
Board has taken disciplinary action on licensees who ignored the wishes of the person with
legal authority. There may be occasions when a
licensee must suggest the two parties reach a
compromise; however, licensees should follow the
directions of the person or persons who have the
legal authority to decide the method and place
of disposition if the deceased has not left written
directions pursuant to North Carolina law.

In addition she stated her opinion that minor
wording errors in the required disclosures would
result in a compliance letter. She further stated
omissions of the required disclosures or failure
to deliver the GPL within five minutes on two
consecutive visits would result in a citation for
violation and referral to the Funeral Rule Offenders
Program. While the Board’s inspectors review areas
of Funeral Rule compliance when inspecting
establishments, that does not prevent the FTC
from conducting sweeps and test shopping
of establishments.

The View of One FTC Inspector
While attending a recent conference the
Board staff had an opportunity to observe a
presentation by an FTC inspector for a region
in the Midwest. This inspector applies a five
minute time limit in order to receive a General

Disciplinary matters
Case File Number: V07-024.
Licensees: Hertford County Undertakers Union (FE
#245; PNE #548); Mildred Cooper (FDL #3185; PNS
#FD-3185).
Summary: The licensees failed to deposit all preneed
funeral funds into a preneed trust account and did not
timely file the contract with the Board on an approved
preneed contract form.
Board Action: The licensees entered into a consent
order placing the preneed establishment license
of Hertford County Undertakers Union, the funeral
service license of Mildred Cooper, the preneed sales
license of Mildred Cooper on probation for one (1)
year. Hertford County Undertakers Union also had
its probation extended for one (1) year. The licensees
also agreed to take preneed continuing education and
testing.
EFFECTIVE DATE: November 14, 2007.
Case File Number: M05-019.
Licensees: Scarborough & Hargett Funeral Home (FE
#533, PNE #230); J.C. Scarborough III (FSL #571, PNS
#FS-571); Judie Rice (FSL #1669, PNS #FS-1669).
Summary: The Board’s Inspector found extensive
preneed violations pertaining to recordkeeping and
timely filing documents. Several violations were not
corrected on reinspection. The Inspector also found
more than one trust deposit been placed in
Respondents’ operating account without being
forwarded to the insurance company insurance
policy. Finally, the Inspector found that Funeral
Establishment’s preparation room was not in
compliance.
Board Action: The parties entered into a consent
order placing Scarborough & Hargett’s funeral establishment permit and preneed establishment licenses
on probation for three years. Mr. Scarborough was
placed on probation for one year. The parties paid a
$7,000 civil penalty and agreed to hire a new preneed
a new preneed sales licensee to manage its preneed
records. Preneed Establishment would also maintain
a bond during the period of probation, file all
correspondence within ten (10) days, and agreed
to take preneed continuing education and testing.
EFFECTIVE DATE: September 12, 2007 (Rice).
November 14, 2007 (others).
Case File Number: V04-088; V05-044; M05-028;
V06-058.
Licensees: David Reese (FDL # 3550); Charles Reese
(FSL # 1303); Susanne Blair (FSL # 2386); Cremation
Services (CR # 28).
Summary: The Board received several complaints
against the former Memorial Funeral Chapel of
Winston-Salem alleging that one or more deposits
to the preneed contracts were not timely deposited
made in a timely manner and that their preneed
contracts were not timely filed. The Board’s Inspector
also found that Cremation Services, Charles Reese,
and Sue Blair engaged in activities under Crematory’s
license that required a funeral establishment permit.
Board Action: The parties entered into a consent
order placing each of the three licensees on probation
for three (3) years and the crematory on probation
for five (5) years. David Reese also had his funeral
director license suspended for six (6) months, and
Charles Reese agreed to special terms of probation
pertaining to any future show cause action. The
Reeses also agreed never to apply for a preneed
license of any kind in the future. Finally, the parties
also paid a $6,000.00 civil penalty.
EFFECTIVE DATE: December 12, 2007.
Case File Number: M06-005.
Licensees: Taylor-Tyson Funeral Service(FE #576);
Jody Tyson (FSL #2086).
Summary: Licensee, manager of Funeral
Establishment, filed several death certificates listing
him as embalmer when he did not complete the
arterial and initial cavity work on those cases.
Board Action: The parties entered into a consent
order placing Mr. Tyson on probation for one year and
paying a $1,000.00 civil penalty. Taylor-Tyson Funeral
Home was issued a letter of caution. Mr. Tyson has
ceased the practice of signing as embalmer when he
is not the embalmer who performs the arterial
embalming.
EFFECTIVE DATE: November 14, 2007.

Case File Number: M07-019.
Licensees: Simmons Funeral Service (FE #550).
Summary: During a recent inspection, the Board’s
Inspector found that Simmons Funeral Service was
not in compliance with either the Board’s
requirements for a funeral establishment permit or
the Funeral Rule. Several violations were not
corrected from a previous inspection.
Board Action: The Board adopted a consent order
placing the funeral establishment on probation for six
(6) months and assessing a $250.00 penalty.
EFFECTIVE DATE: January 9, 2008.
Case File Number: M05-024.
Licensees: Hargett Funeral Service (FE #224), Nelson
Miles (FS #1440), Jerrold Wheeler (FS #2665).
Summary: Hargett Funeral Service had its preneed
license revoked by the Board in 2002. During an
inspection, the Board’s Inspector learned that
Mr. Wheeler, with the knowledge of Mr. Miles, the
firm’s manager, engaged in one or more activities
constituting preneed funeral planning under the
Board’s laws and rules. Several contracts were
pre-arranged at Hargett Funeral Service and then
referred to a preneed establishment as their contract.
Hargett Funeral Service accepted payment for the
contract in at least one contract.
Board Action: The Board adopted a consent order
placing the funeral establishment, Mr. Miles, and Mr.
Wheeler on probation for three years probation each.
The parties would also pay a $5,000.00 civil penalty
and would be ineligible to hold a preneed
establishment license indefinitely.
EFFECTIVE DATE: January 9, 2008.
Case File Number: M05-016.
Licensees: R. H. Greene (PN #FD-3195).
Summary: The Board’s staff found multiple filing
deficiencies in two preneed annual reports for the
Respondent pertaining to certificates of performance.
The Board’s Inspector also found multiple contracts
that had not been filed during her past inspection.
The firm has changed ownership since the case was
originally sent to the Board.
Board Action: The Board adopted a consent order
placing the preneed sales license on probation for
three (3) years and paying a $2,500.00 civil penalty.
The preneed licensee would be required to undergo
continuing education and competency testing.
EFFECTIVE DATE: February 13, 2008.
Case File Number: V06-061.
Licensees: Russell Costner (FD #3689); Albert
Costner, Jr. (FS #1084); Millicent Costner (trainee).
Summary: The Board received monthly work reports
signed by Ms. Costner, her supervisor, Russell
Costner, and the firm’s manager, Albert Costner.
Russell Costner also signed a certification that
Ms. Costner had completed all requirements for
her traineeship. The Board received information that
Ms. Costner had not completed all requirements
for certification of a traineeship in funeral service,
which Russell Costner confirmed.
Board Action: The Board adopted a consent order
placing Albert and Russell Costner on three years
probation. The parties paid a $4,000.00 civil penalty.
Ms. Costner would be placed on three years probation
upon qualifying for a license.
EFFECTIVE DATE: January 9, 2008.
Case File Number: M06-009.
Licensees: Price Funeral Home (FE #478); Kenneth
Price (FSL #520).
Summary: The Board’s Inspector discovered Price
Funeral Home used an unregistered name in Spanish
on a business card and on a transport vehicle. Upon
investigation, the Board’s Inspector found that an
unlicensed person admitted to making arrangements
for funerals. The licensees’ defense was that they did
not understand the Spanish translation provided
by the unlicensed person and explicitly told the
unlicensed person not to make arrangements when he
was hired. The licensees corrected the violations and
terminated the employment of the unlicensed person.
Board Action: The Board adopted a consent order
placing the licenses on probation for three (3) years.
The parties paid a $2,000.00 civil penalty.
EFFECTIVE DATE: February 13, 2008.

Summary: The licensee filed its annual report
untimely for two consecutive years and did not pay
its late fees.
Board Action: The Board adopted a consent order
suspending its license for one year, with said
suspension stayed for a one year period of probation.
EFFECTIVE DATE: February 13, 2008.

Licensees: Hamilton Funeral Chapel (Goldsboro).
Summary: Preneed Establishment did not file several
certificates of performance on its 2006 annual report
and did not respond in a timely manner despite
multiple requests from the Board staff. Preneed
Establishment has corrected the violations.
Board Action: Preneed Establishment wishes to enter
a consent ordering paying a $1,000.00 civil penalty.
EFFECTIVE DATE: April 16, 2008.
Case File Number: M06-021.
Licensees: Grier Funeral Service (PNE #507).
Summary: Grier Funeral Service withdrew several
deposits from the preneed account of the surviving
spouse and claimed they were actually intended
to satisfy the deceased’s at-need account. They also
transferred one deposit between two preneed
accounts to eliminate a difference between the

A Sobering Reminder to
licensees:

“Every morning we strap our three year-old granddaughter into a booster seat in the back seat of our
car and take her to her preschool. The same practice is followed anytime she gets into any vehicle. It
makes sense and it is the law!
Do funeral professionals follow the same procedure when using their limousines and transporting small
children during funeral services? From my non-scientific observations, it appears they don’t. We’ve
experienced times where we used our own or the child’s family had a booster seat that could be placed
in the rear seat of the limousine.
An hour ago I returned from a fatal accident involving two funeral home limousines that were on the
way to a funeral. A pickup truck – coming in the opposite direction – was passing a car. The first
limousine tried to avoid the obvious collision, but still ended up being struck and on the far side of the
road, upside down. The second limousine (our limousine) was struck head-on. A nine year-old child
in the middle seat was killed immediately.
Our limousine was being used by another funeral home, and I was called to the accident scene as the
owner of the car.
Standing beside the totaled automobile, my eyes filled with tears as I saw the tarp covering the body
of a small child, still lying in the middle seat; a life snuffed before it truly lived.
Hindsight is 20-20. If the child had been restrained in a child safety seat and in the back seat . . .
A nine year-old is dead before she could make an impact on our world . . . or has it.
Please be sure that all children are in child restraint or safety seats. Maybe this reminder could save
others.”
