THEATRE SUED FOR UNDER-REPORTING TO STUDIOS
A recent Variety article reported that a group of nine film distributors have joined together to sue a Tennessee theatre owner for under-reporting boxoffice receipts.
Sony, Buena Vista, Warner Brothers, Paramount, Twentieth Century Fox, Universal,
Miramax, New Line and Dreamworks joined in a suit against Ajay Theatres, owners of the
Hollywood 16 in Jackson, Tennessee. The distributors claim that the theatres provided false
information on the number of admissions, admissions in various categories, and the serial
numbers of tickets from March of 2003 to the present time.
No actual damages were specified in the suit although the studios claimed the underreporting amounts to “hundreds of thousands of dollars”. The studios are asking that
actual damages, attorney fees and punitive damages be determined by the court. The
suit was filed March 14 in Los Angeles. Studio contracts with theatres provide
that all disputes come under the jurisdiction of California courts.
In past years, the law firm of Sargoy, Stein, Rosen and Shapiro of New
York represented the studios in numerous suits against theatres
accused of under reporting grosses. Those suits often covered multiple years of alleged false information resulting in many thousands of
dollars of claims. The intent was to drive dishonest operators out of
the business. All theatres, large and small, continue to be the
subject of “open” and “blind” checks of ticket sales to catch
under-reporting.
The Newsreel
Marcus Theatres of announced March 22 that
they are acquiring 122 screens in 11 locations in 5
metropolitan markets from St. Cloud, Minnesota
based Cinema Entertainment Corporation. The
theatres involved are located in St. Cloud, Min.:
Duluth/Superior, WI; Fargo, ND/Moorhead, MN.:
Cedar Falls/Waterloo, IA; and Iowa City, IA.
Marcus, a publicly traded company based in
Milwaukee, WI, said they will be paying approximately $75,650,000 for the theatres subject to closing adjustments. The transition is expected to be
completed in April.
CEC will continue to own and operate the rest
of their circuit which will be comprised of 20 locations with 127 screens in Minnesota, North Dakota,
Iowa, Nebraska, and Wisconsin.
Bob Ross, chairman of CEC Theatres said, “I am
pleased that Marcus Theatres will carry on the tradition of excellence established at CEC by the Ross
family. Marcus theatres will serve our communities
with all of the resources available to a larger company and will provide the same dedication to our
customers and associates that has been a hallmark
of CEC for over 50 years. Marcus’ Theatres philosophy is that same as CEC-providing customers with
the best entertainment experience possible.”
Marcus will operate 628 at 52 locations making
them the seventh largest circuit in the country.
Steve Marcus, chairman and chief executive of the
Marcus Corporation said, “The purchase of the CEC
theatre locations is a synergistic addition to our circuit. Our two companies share a similar history, are
deeply rooted in the values of the Midwest and
have the same focus on guest service and quality.
CEC is an excellent theatre operator and we intend
to continue enhancing the movie-going experience
for which CEC is well known.” Marcus is also building new theatre in Brookfield, WI. This flagship
theatre, called the Majestic, will be a complete
entertainment destination including two ultra
screens, a multi use venue for performances and
meetings, a pizza café, coffee and ice cream shops,
and a cocktail lounge.
Her many industry friends were saddened to
hear that Mary Felix resigned from her job as
General Manager of the North Branch and
Andover Cinemas in January and is leaving the
industry. She is taking a job with a property management company.
Mary also served as the chairperson of North
Central NATO’S scholarship committee. Although
no longer employed in the industry, she is continuing her volunteer work with North Central NATO
to see this year’s scholarships through to the
awards in May. Thank you Mary!
According to local newspaper reports, Bob and
Janice Moore, owners of theatres in Foston,
Blackduck, and Crookston, Minnesota are planning
a new 12 screen theatre in the River Walk Center
Mall in East Grand Forks, Minnesota. The Moores
are currently in negotiations to buy part or all of
the mall from the city of East Grand Forks. The
Moores hope to conclude negotiations, start construction, and have the theatres open by Mid May.
The theatre will be called the River Cinema 12.
The Sunset Cinema in Pequot Lakes, MN
closed Sunday, February 11. Owners Clayton and
Sandy Sundvall built the five-screen, stadium seating, 12,000 square foot theatre and opened it April
29, 2005.
The Sundvalls were quoted in local
newspaper reports saying there just wasn’t enough
business to keep the doors open.
Dave Quincer has started construction on a third
screen at the Cozy Twin Theatres in Wadena,
Minnesota. He purchased the building next door
and is gutting the offices
that were in it, raising the
roof, and making other
alterations to convert the
building into a theatre.
The new auditorium will
feature stadium seating and digital
stereo sound.

NC NATO THEATRE CONVENTION – MAY 1 & 2, 2007
With this year’s convention being held in Council Bluffs/Omaha, we thought it appropriate to dig out some pictures of historic theatres in the heart of downtown Omaha. Three of the theatres were all within a few feet of
each other, anchoring the theatre district in the 1920’s.
Early Bird Registration Deadline is Monday, April 9, 2007!
RIVIERA THEATRE was built by A.H. Blank and opened March 26,
1927 at 2001 Farnam Street. It was designed by famed theatre
architect John Eberson in a Moorish and Italian Renaissance
style. It was an atmospheric theatre meaning the inside of the
auditorium was designed to look like an outside courtyard complete with twinkling stars in the ceiling and projected clouds
and moon that would move across the ceiling in two hour
cycles. Three years after opening it was sold to Paramount
Theatres and was renamed the Paramount. It closed in 1960,
sold to Creighton University and had a short stint as a bowling
alley. In 1962, Creighton leased it to Dubinsky Theatres who
reopened it as the Astro in honor of John Glenn’s space flight.
It closed in the 1979 and sat vacant until Rose Blumkin bought
it in 1981 for $200,000 and helped finance its restoration. It is
now known as the Rose Blumkin Performing Arts Center and is
home to the Omaha Theatre Company for Young People.

corner of 15th and Douglas Streets
downtown where the Union Pacific
building is now located. The architect
was John Latenser, Jr. The theatre
seated 2247 and closed in the 1970’s.

Rialto. The World seated 2500 in 1948. It was
operated at that time by Tri-State Theatres,
anaffiliate of Paramount Theatres.

Central NATO Theatre Convention. The 2007 North
Central NATO Theatre Convention is slated for
Tuesday and Wednesday, May 1 & 2, 2007, at Harrah’s
Casino and Hotel in Council Bluffs, Iowa. This regional convention is the perfect time to make or renew
friendships with fellow exhibitors; get a sneak preview of the summer films by participating studios;
learn about the latest products and equipment at the
vendor trade show. There will be informative seminars, a movie screening, a silent auction benefiting
the scholarship fund, and the latest information on
the transition to digital cinema. Make sure to get
your registration(s) in before the Early Bird Deadline
on Monday, April 9, 2007, deadline. After that date,
the price of the theatre convention and hotel room
rates will increase! Get those registrations faxed or
mailed today!
Harrah’s Casino & Hotel is an exciting venue for
this year’s convention. Outside of the convention
agenda, you’ll find ample opportunities to meet with
other exhibitors and/or vendors at “Stir,” Harrah’s
upscale cocktail lounge. If you’re feeling lucky, the
casino is open 24 hours a day. Also, there is a nice golf
course adjacent to Harrah’s hotel. With a great convention lineup and so many other fun activities in the
immediate area, you (and your immediate staff) will
certainly want to plan on attending this year’s North
Central NATO Theatre Convention in Council Bluffs,
Iowa.
Tuesday, May 1
The North Central NATO theatre convention
begins at 12 Noon with a welcome from N.C. NATO
President Jeff Logan followed by the Film
Marketing/Promotions Seminar for 2007. Film studios
that have already agreed to participate include: 20th
Century Fox, Warner Bros., Sony Pictures, Paramount,
Buena Vista./Disney, Universal Studios. In addition,
other studios are hoping to attend or send their 2007
preview reels for summer, fall and winter. All studios
are providing “goodie bag” items and are excited
with the new location!
Following the Film
Marketing/Promotions Seminar, the trade show will
be open from 2:30 to 6:30PM in the Harrah’s
Ballroom. It is hoped that forty-plus vendors are present for the 2007 N.C. NATO Trade Show. During the
Trade Show and into the evening, Silent Auction
items will be available to “bid on” with the proceeds
benefiting the scholarship fund. A Cocktail Hour will
be held on the Trade Show floor prior to the Gala
Dinner and Awards. Our keynote speaker from the
National NATO office will be Mary Ann Anderson.
Executive Director of National NATO since 1988 and
honored with ShoWester of the Year 2007, Mary Ann
will bring us up-to-date on key topics of interest on
the national level. The evening will conclude with the
announcement of the silent auction winners.
Wednesday, May 2
Day two of the convention starts with a
Continental Breakfast in the Harrah’s Ballroom followed by shuttle transportation to the Star Cinema in
Council Bluffs (about 5 minutes away) for a Movie
Screening (TBA). Following the screening, shuttles
will return all those to Harrah’s for the Luncheon in
Harrah’s Ballroom. Following the Luncheon, the first
seminar of the afternoon will be on Digital Cinema.
The keynote speaker on this topic will be J. Wayne
Anderson, Executive Director of the Cinema Buying
Group and honored with ShoWester of the Year 2007.
Wayne has been actively involved with the transition
to digital cinema and will answer all questions regarding the past, present and future of digital cinema.
Following a refreshment/snack break, the second
seminar will be a panel discussion on a variety of theatre topics.

Harrah’s Casino & Hotel is an exciting venue for
this year’s convention. Outside of the convention
agenda, you’ll find ample opportunities to meet with
other exhibitors and/or vendors at “Stir,” Harrah’s
upscale cocktail lounge. If you’re feeling lucky, the
casino is open 24 hours a day. Also, there is a nice golf
course adjacent to Harrah’s hotel. With a great convention lineup and so many other fun activities in the
immediate area, you (and your immediate staff) will
certainly want to plan on attending this year’s North
Central NATO Theatre Convention in Council Bluffs,
Iowa.
Tuesday, May 1
The North Central NATO theatre convention
begins at 12 Noon with a welcome from N.C. NATO
President Jeff Logan followed by the Film
Marketing/Promotions Seminar for 2007. Film studios
that have already agreed to participate include: 20th
Century Fox, Warner Bros., Sony Pictures, Paramount,
Buena Vista./Disney, Universal Studios. In addition,
other studios are hoping to attend or send their 2007
preview reels for summer, fall and winter. All studios
are providing “goodie bag” items and are excited
with the new location!
Following the Film
Marketing/Promotions Seminar, the trade show will
be open from 2:30 to 6:30PM in the Harrah’s
Ballroom. It is hoped that forty-plus vendors are present for the 2007 N.C. NATO Trade Show. During the
Trade Show and into the evening, Silent Auction
items will be available to “bid on” with the proceeds
benefiting the scholarship fund. A Cocktail Hour will
be held on the Trade Show floor prior to the Gala
Dinner and Awards. Our keynote speaker from the
National NATO office will be Mary Ann Anderson.
Executive Director of National NATO since 1988 and
honored with ShoWester of the Year 2007, Mary Ann
will bring us up-to-date on key topics of interest on
the national level. The evening will conclude with the
announcement of the silent auction winners.
Wednesday, May 2
Day two of the convention starts with a
Continental Breakfast in the Harrah’s Ballroom followed by shuttle transportation to the Star Cinema in
Council Bluffs (about 5 minutes away) for a Movie
Screening (TBA). Following the screening, shuttles
will return all those to Harrah’s for the Luncheon in
Harrah’s Ballroom. Following the Luncheon, the first
seminar of the afternoon will be on Digital Cinema.
The keynote speaker on this topic will be J. Wayne
Anderson, Executive Director of the Cinema Buying
Group and honored with ShoWester of the Year 2007.
Wayne has been actively involved with the transition
to digital cinema and will answer all questions regarding the past, present and future of digital cinema.
Following a refreshment/snack break, the second
seminar will be a panel discussion on a variety of theatre topics.
In this newsletter, you’ll find an individual registration form for the 2007 Theatre Convention. If you
need additional copies, please feel free to photocopy
and fax completed forms to (608) 326-5382 along
with credit card information. If you wish to mail your
registration, attach your check for payment and mail
to the address shown on the bottom of the registration form. Please note the Early Bird Deadline is
Monday, April 9, 2007. Your registration includes all
Convention events including the seminars, admission
to the Trade Show, movie screening, cocktail party
and the Gala Dinner, breakfast and luncheon.
Convention registration does not include accommodations and personal activities at Harrah’s Casino and
Hotel. A special rate of $89.00 per night has been
reserved for convention attendees ONLY. Please make
your reservations by calling 1-800-HARRAHS (1-800427-7247). Please be sure to mention S05NATO when
making your reservation to secure the special rate. A
limited number of rooms have been reserved at this
rate, so make your reservations prior to Monday, April
9, 2007. If you chose to stay at an off-premise hotel,
you will need to provide your own transportation to
and from Harrah’s.
