Warmer Weather Means It’s Time To Build Mike Zehner, 2014 SIBA President After a freezing 1st quarter slowed our business down, the warmer sunshine seems to be warming things up for us. I started to think it wouldn’t ever get warm again! But I think spring is here. Winter has been deceptive, so it’s tough to be sure. I hope all the builders are taking full advantage of the sunny days. And I hope all SIBA members are taking advantage of the benefits and services provided by the Builders Association. This is a great organization, that really goes to bat for its members. And speaking of work by the Builders Association, I am glad to say HB 1301 was signed into law. This legislation will streamline the process for getting buildings started without diminishing code compliance. This will affect commercial builders first and foremost. But residential builders will feel the relief too. From the viewpoint of the SIBA President, I want to relay to all members that SIBA is a great value. The members need to convey the value of the association to our subcontractors and suppliers. Building houses provides many jobs, and without this kind of representation, many of the people who are connected to our industry will not have work. There are several other main topics that SIBA is working on to benefit our building businesses. SIBA deserves our support. Other benefits and services by SIBA are: The insurance program through Logan Lavelle Hunt. Business and Health insurance programs are saving thousands of dollars for some companies. The Spring Preview and Fall Tour of Homes are excellent events that allow builders to meet buyers. And of course the upcoming Parade of Homes is an icon in the community that delivers buyers to our homes. The builder rebates program has paid builders thousands of dollars, for simply reporting the products used in their homes or remodeling projects. In September, Speed Networking proved to be a smash hit, bringing builders to participating suppliers face-to-face literally!!! And that’s just one of our regular monthly meetings. The Quality Assurance Builder Standards is a great value for SIBA builders. These guidelines need to be put into our contracts, and they will help protect us from unreasonable customers. I highly encourage all builders to participate in this program fully. Another program available to SIBA members only. I hope you are taking advantage of everything the Association offers you. And if you are, please make sure the people whose jobs depend on working for you understand this too. We need to build our membership. The Legal Language by Shannon Frank Kahn, Dees, Donovan & Kahn LLP A recent case making its way through the Federal appeals court (see Metcalf Constr. Co. v. United States) calls to issue a contractor’s responsibility to investigate site suitability and adapt construction methods to account for irregular conditions. While this case involves a military housing project in Hawaii, the issues in question should be given attention by residential builders, especially considering the multitude of soil conditions that exist in Southwestern Indiana. A builder’s custom contract needs to address that the owner is responsible to conduct all evaluations and testing of the real estate to confirm its appropriateness for construction of the residence, as well as clearly state the builder will not be performing any such testing or evaluations of the soil. To the extent the owner has testing performed, the builder must then tailor its price, materials and construction techniques in accordance with the results set forth in the report, as well as attach a copy of the report to the construction agreement. Depending on the testing results, it may also be prudent to require the owner to engage an engineer to formulate construction specifications to address the soil conditions. This will give the builder an expert’s blueprint upon which to rely during construction and potentially reduce the builder’s liability. The contract should also require the owner to disclose any site conditions for which they have knowledge, such as rock, utility lines, previous mining or other issues that may impact ground conditions. The owner’s representation can then be confirmed within the terms of the construction contract. Builders must be wary of any language that places independent site testing requirements on the builder, as failing to perform could result in liability to the builder, even when the owner discloses or makes representations concerning the ground’s suitability for construction. Individual Mandate: -The ACA requires everyone to be enrolled in a health plan by March 31, 2014 -If you do not have coverage there will be a penalty. -The last enrollment date for individual plans is 3/31 for a 4/15 effective date. -If you are not enrolled by 3/31/2014 you will have to wait until this fall to enroll. The Exchange Marketplace Kynect gives you a choice of the following insurance companies: o Anthem/Pathway o Kentucky Health Cooperative o Humana (HMO options only in Louisville, Lexington and Northern Kentucky). To be eligible for any subsidy, you must enroll through the Kynect website. Subsides are based on income and family makeup. The Off Exchange Marketplace The carriers that are writing individual plans outside of Kynect are : o Humana (PPO & HMO) o Anthem/Pathway o Assurant. When considering which market place is best for you, pay attention to the plan designs and the provider networks available. Do not assume that your doctor or hospital is taking the plan you chose simply because it is an Anthem or Humana plan. They have significantly changed their provider networks for these products YOU MAY NOT HAVE ANY COVERAGE IF YOU GO OUT OF STATE. Don’t take a chance on this, get with a professional insurance broker (like Logan Lavelle Hunt) and discuss thoroughly. Only a licensed broker in Kentucky, under the ACA, can make a recommendation to a client, so call Logan Lavelle Hunt for sound guidance. Small Group Employers (2-50): January 1, 2014 began the full implementation of health care reform nationwide. o Community Rating is how health insurance rates are set for this size company o Carriers can no longer use health history to set your premiums. o Age, geographic location and smoker/non smoker are only factors used do determine rates. Because of this rating methodology many (a majority) of employers accepted an “early renewal” for December 1, 2013 to avoid the negative effect this will have on your premiums. For employers who did not accept this “early renewal” or got busy and did not pay attention, there have been renewal increases from 30-80%. Small Business has not been offered an extension or waiver to put off the effects of the ACA. This segment of employers is getting hit the hardest due to ACA. The unique benefit of being a member of a Trade Association that has a group insurance program is that the group medical plan for members avoids these rating provisions. o The Association Plan is treated as a large group health plan under the ACA oThe Association Plan is able to use medical history to set premiums. Although not a perfect fit for every employer, this is a strong option that members need to look into. Logan Lavelle Hunt, our agent, has had recent success with a member who received an 80% increase as a result of community rating and the ACA. Through the Association plan that member only experienced a 9% increase for the same benefit selection. Large Group Employers (5099) Another delay in ACA implementation was handed down on February 10, 2014 for companies of this size. If you have a company that is in this category, you are probably familiar with the “Play or Pay” provision that is in the law. Basically, “play or pay” means that you either provide a minimum health insurance plans to Continued on page 7... This has been very problematic for the administration politically and therefore changes were made for this segment of companies. The changes are as follows: o “Play or Pay" deadline has been pushed back to January 1, 2016 o Community Rating (described above) will take effect on January 1, 2016 The Association group medical plan can be an attractive option today for larger employers, why wait? Remodelers from around the country agreed with the forecast, citing increased demand from home owners for upgrades to existing bathrooms and kitchens. NAHB projects that residential remodeling spending on owneroccupied single-family homes will increase 2.5 percent in 2014 over 2013, and another 1.8 percent in 2015. “Remodelers are regaining confidence in the market as home owners continue to upgrade their homes and make repairs or replacements that were deferred during tough times,” said 2014 NAHB Remodelers Chairman Paul Sullivan, CGR, CAPS, CGP, a remodeler from Boston. “NAHB Remodelers looks forward to working in a strengthened market as homes sales rise.” “We are predicting slow and steady growth in remodeling activity throughout 2014 and into 2015,” said Paul Emrath, NAHB’s vice president for survey and housing policy research. “That outlook is consistent with the indicators of future activity in our recent Remodeling Market Index (RMI) survey. It’s a positive sign that whole house remodels have rebounded somewhat as home equity levels increased in 2013, though traditional bath and kitchen projects remain the most popular remodels.” Repairs and replacements of old components and the desire for upgraded amenities were cited as the top reasons for customers to hire a remodeler, according to a recent NAHB survey. The survey results describe the changes the remodeling market has undergone in recent years, such as the growth in whole house remodels after a dive in 2010. Builders from across the country were surveyed on what features they were most likely to include in a typical single-family home this year, revealing that convenience, livability and energy efficiency are top priorities. “Newly constructed homes can suit the specific requirements of today’s home buyers,” said NAHB Chairman Kevin Kelly, a home builder and developer from Wilmington, Del. “And now is a great time to consider buying a new home, as consumers can take advantage of competitive home prices and low interest rates to find the perfect new home for their families.” Home builders are including features that are practical and functional for the daily lives of today’s home buyers. The features that are most likely to be included in a typical single-family home this year are: -Walk-in closet in the master bedroom -Low-e windows -Laundry room -Great room. Energy efficiency is a key theme with Energy-Star rated appliances, programmable thermostats and EnergyStar rated windows at the top of the list. These features help make the home more comfortable and can save the home owner significant money over the long term. On a median per square-foot basis, home owners spent 78 cents per square foot per year on electricity, while owners of new homes spent 65 cents per square foot per year, according to data from the 2009 American Housing Survey (AHS). Builders also list features such as granite countertops, a double sink and a central island as winning elements in new-home kitchens, and a linen closet and a private toilet in the bathroom. Additional features likely to be included throughout the home include first-floor ceilings at least nine-feet high, a front porch, outdoor lighting and a patio.
