has scrapped and
abandoned plans for a
November statewide
pension reform initiative that had drawn
not only local but national attention. Last
month, on March 14, 2014, courts handed
a victory to associations and unions. Otherwise, this so called “pension reform”
initiative would have made fighting it a top
priority not just for us but all the other associations and unions.
Reed still maintains that he and a
handful of other city puppet leaders across
California, who had joined this train wreck
initiative, will continue to pursue the proposed constitutional amendment for 2016.
Reed, who can’t look in the mirror and
blame himself, is blaming an unfavorable
ballot summary from the attorney general
and the upcoming mid-April deadline

for qualifying a November initiative for
the delay. It’s just another sorry excuse.
If you ask me I doubt the initiative will
be any more practical in two years. In
the meantime Reed struggled to raise the
millions of dollars needed to hire signature
gatherers for the initiative. It should also
be known that in 2012, earlier efforts to
secure statewide pension reforms also
collapsed after advocates for the initiative
encountered difficulty raising the funds
needed to gather qualifying signatures.
Experts say the best opportunity for
Reed’s pension reform initiative was this
year. Obviously the money wasn’t there,
and that was the principal reason Reed
backed off.
As your RSA President, I will tell you
this – we, and others, will mount an aggressive campaign to defeat this initiative
if it ever comes up in the future.
What’s more, Reed will be out of office
at the end of this year and has indicated
no plans to continue his political career,
lowering his stature on the statewide
political stage and his ability to reach a
broad public audience.
While there was no independent
polling on the measure, Reed maintained
private surveys indicated support in the
two-thirds range, while unions proclaimed
their own research showed little public enthusiasm with only 1 in 3 voters supporting
his measure. The unions’ polling was likely

accurate, and low popularity accounts for
the lack of funding for Reed’s measure.
Reed, a fiscally conservative Democrat,
gained national recognition and the enmity
of the public employee unions that bankroll
his party when he won passage in 2012 of
a San Jose measure reducing pensions for
new city hires and making current employees either pay more for their retirement or
choose a less-generous plan.
He has since traveled the state and to
the nation’s capital, giving his own opinion
on pensions and encouraging changes to
government pensions, stating the soaring
costs of which have used up funds for
municipal services and contributed to a
handful of city bankruptcies. Maybe he
should look at those cities’ leadership and
how they mismanage their cities’ funds.
This misleading information about the
cost of government pensions lead unions
to come together and sue to overturn
Reed’s Measure B as Reed attempted to
gather support for the statewide initiative
that would change that doctrine, allowing
elected officials to negotiate pension
reductions as long as they applied only to
employees’ future years on the job.
This statewide initiative fell apart in
December when a judge blocked the key
provision that would make current city
workers pay more toward their pensions,
citing a series of earlier rulings that effectively guarantee government workers the
same or better retirement plan throughout
their careers.
In a last ditch effort Reed complained
that Attorney General Kamala Harris’
ballot summary failed to make that distinction, suggesting instead that it would
broadly “eliminate” pension protections
for police, firefighters and teachers. A
judge Friday ruled the summary wording
was fair. I believe the measure might be
dead for 2016, as well but we will keep an
eye on it.
I am a firm believer that the bargaining
table is not a ballot box. The appropriate
place to address the budget challenges
facing our communities, county and state
is at the table. I also believe the RSA’s
members are committed to working hard
to ensure the public is safe and at the end
of their careers they have a retirement
security they have earned.

Baker To Vegas Teams Brave
The Desert Through 120 Miles
T
eams from the Riverside County
Sheriff’s Department braved the
Nevada desert on March 23 for the
2014 Baker To Vegas Challenge Cup Relay
race. Team members individually take legs
of the race to complete the gruelling 120mile course.
The Baker to Vegas Challenge Cup
Relay race is a 120-mile, 20-stage, foot
relay race, that starts just outside of
Baker, California and goes through the
desert by way of Shoshone and Pahrump,
over the mountains, to Las Vegas,
Nevada. Teams are restricted to Law
Enforcement teams (Federal, State, and
Local agencies including Police and Sheriff departments, FBI, DEA, CIA, USPS,
Military, Tribal, and many more). All of
the teams are responsible for providing
their own logistics and support efforts,
including communications.
The race, organized by the Los Angeles
Police Revolver & Athletic Club, drew
about 6,700 runners in 261 teams. The race
originated in 1985 and has become one of
the biggest law enforcement sporting events
of the year.
The RSA helped sponsor six teams and
also sponsored the “after party,” which was
held at the Las Vegas Hotel and Casino.
Race results for Riverside’s six teams
were:
• RSO Corrections: 24th place in their
category at 17:26:18.
• RSO mixed team: 26th place in their
category at 17:30:15.
• RSO Probation: 29th place in their
category at 17:42:16.
• Riverside County DA’s Office: 1st
place in their category at 16:28:25.
• RSO Open Team: 9th place in their
category at 14:36:49.
• RSO Women’s Team: 8th place in
their category at 19:35:24.

pleased they were able to field a team this
year when it looked like it wouldn’t happen.

they placed 24th out of 75 teams in their
category, he said.
“All runners were out of RPDC,” he said,
with 20 runners and four alternates making
up the team.
“We weren’t going to have a team this
year, but our Captain was a huge help. She
put out an email that we needed runners
and volunteers.”
Although this was Segerra’s third time
competing in Baker To Vegas, he said for
more than half of the team it was their first
time. “We worked with them to get them
trained for it,” he said. “Everybody came
together. We had guidance from more
seasoned teams, too.”
Jesse Quintana, captain of the Baker To
Vegas Team for the probation department,
said his team finished the race in 17:42:16,
their average team pace was 8:51 per mile.
This had the team placing 29th in the IMIX
Category out of 62 teams.
“The runners fought through
tremendous adversity this year only to
come together in support of each other,”
Quintana said in a written statement. “One
team, one goal, when it truly mattered. The
support staff came together as well; drivers,
timers, and support runners mastered their
individual responsibilities on the follow
vehicle and worked as a team to ensure
our team received no penalties from race
officials. They also made sure the runners
were safely supported while encouraging the
runners to push their limits throughout their
assigned legs.”
Quintana said he was proud of how
his team represented themselves and
their department. “These runners demonstrate the utmost professionalism when
it comes to representing our department
in a race that includes 273 other law enforcement agencies not only from the
United States, but around the world. I
was truly humbled and moved in the experience of being this year’s Team Captain, thank you so much for the
opportunity and the experience. It is my
honor and pleasure to say congratulations team on a job well done.”

Wars”
came
to a head with Mayor
Chuck Reed and his
merry band of pension busters when
they failed to secure
the needed number
of signatures to put
Reed’s pension initiative on this November’s
ballot. As you may recall, Reed’s Initiative
would (among other things) strip vested
pension rights from all public employees.
Reed was able to “con” the San Jose voters
into adopting “Measure B,” a local pension
measure that was later invalidated by the
courts. Nevertheless, Reed is determined to
push on, despite losing “Measure B” in court
and despite failing to secure the needed
number of signatures for his statewide pension initiative in November.
Reed’s latest ploy is to sue California’s
Attorney General, alleging that the Title
and Summary Attorney General Harris
prepared for his initiative was “false,
misleading, and/or prejudicial.” In fact,
what’s false, misleading, and/or prejudicial is
Reed’s ballot initiative which would take away

your constitutionally protected right to the
future accrual of YOUR retirement benefits! For members who are already vested in a
retirement system, Reed cannot take away
what you have already accrued. However,
going forward, he seeks to divest you of your
future retirement benefits. This is precisely
why so many police officers left San Jose,
despite the fact San Jose was within the top
five cities in pay and benefits. If you have
not yet vested in a retirement system, or
have only vested recently, your retirement
benefits would be in real jeopardy if the
Reed Initiative passes. Unless the courts
overturned his measure (like they did
Measure B) your pension system would
likely default to a 401 (k) type plan. This
is precisely why your union is fighting
to defeat Reed and the other pension
busters who seek to undermine your future
financial security, while using you as their
political fodder!
Protecting your pension interests is
at the top of our political and legislative
agenda this year, and I will keep you posted
on efforts to defeat Reed and his cronies and
on other pension issues.
Privacy issues will be another front
burner issue in 2014. Last year, we cosponsored AB 25 (Campos, D., San Jose).
AB 25 seeks to close a loophole in current
law that arose after passage of AB 1844. By
judicial interpretation, AB 1844 (Campos,
D., San Jose) did not close the privacy loophole for public employees so the law would
allow public employers to access your social
media (Facebook, twitter etc.) accounts.
AB 25 stalled, after drawing overwhelming
legislative support, when the Governor
indicated he would not sign the bill as
presented. The California Police Chiefs
wanted to secure a “law enforcement”
exemption to the bill. Such an exemption
would allow management to access your
private Face book or twitter account, and,
if management so chose, discipline (or even
terminate an officer) because of your social
media posting. It is our position that peace
officers should not be tracked differently
than any other public employee. Just
because you are a peace officer, you should
not relinquish your right to privacy or have
your first amendment rights chilled by overly
intrusive management!
Another privacy issue concerns efforts
to limit law enforcement access to data
retrieved from license plate recognition
(LPR) systems. As you know, LPR technology is vital to law enforcement. It is critical
to solving many crimes, particularly crimes
involving stolen cars. SB 893 (Hill, D., San
Mateo) would limit law enforcement’s use
of data collected by LPR technology. This is
the other side of the privacy coin. There is
no reasonable expectation of privacy in your
license plate data when you drive or park
your vehicle. We will actively oppose Senator Hill’s efforts to limit law enforcement’s
use of LPR data as it would effectively tie
our hands!
There are other major bills involving
jail privatization, law enforcement civilian
oversight, firearms, and medical marijuana
regulation to name a few, but they will
have to wait for another time. Until then,
stay safe!

2015 budget proposal
on March 4, 2014. The
budget proposes a $350 billion increase over this year’s
expenditures, for a total budget package of $3.9
trillion.
The budget request is a suggested outline
from the White House and will not be adopted by
Congress. The Appropriation bills that will be considered in upcoming months will appropriate funds
for the government. Every year it is a fight to secure
funding for SCAAP and this year is no exception.
The budget request would authorize spending
such sums as necessary for one time death benefits
and $16,300,000 for educational assistance for
survivors.

For the second year in a row, the budget request
would eliminate funding for SCAAP, which reim-

and local governments with half the cost of purchasing puncture-resistant or bulletproof vests. The

stand alone appropriation.

ate last year,
while I was still
on patrol with
San Jacinto PD, I
took a follow-up call
for burglary report
of a travel trailer,
which was being stored at the San Jacinto
chapter of the Veterans of Foreign Wars
(VFW). At the time, I didn’t think too
much about it, other than it was a routine
call where I needed to get info for another
deputy. However, earlier this year, my wife
and I saw a couple of gentlemen sitting at
a restaurant wearing their VFW hats from
the Korean and Vietnam Wars. We joked
about the fact that we were both eligible to
be members and get a hat for our deployments in support of Operations IRAQI
FREEDOM and ENDURING FREEDOM
and someday, that could be us. Later she
checked into it and mentioned it would
be a good organization for us to join. As
a result, I enrolled as a Lifetime Member
and she enrolled as an Annual Member
(due to the cost of a Lifetime Membership
and she will change to a Lifetime Member
next year).
The VFW dates back to 1989, after
members of the Spanish American War
returned home and found they had no
benefits, no jobs and nobody cared about
them. Since American soil had not been
harmed, the American government did
not see the need to put any money into a
rebuilding or veterans type effort. It wasn’t
until several former members of the 17th
Infantry Regiment got together to form an
organization that would stand up for the
rights and benefits due American military
members. Ultimately, the group evolved
into the VFW and is a congressionally
chartered war veterans’ organization under and decoration with an Armed Forces Expeditionary Medal, a campaign medal (or
Title 36, USC, Chapter 2301. The VFW

One of the ways the VFW assists
veterans is through the Sports Clip Help a
Hero Scholarship. It awards up to $5,000
for eligible students who are retired, active
or former military members, with the rank
of E-5 and below. The deadline to apply
is April 30, 2014, and the link is listed
below as well. Another way the VFW
assists veterans is through the NVS, which
helps any veterans file their disability
claims or re-open existing claims. This is
a free service that you do not have to be
a member to receive. Those of you who
have contacted me in the past, or have
had issues with their claims should contact
the organization at the link below for
assistance.

Finally, I wanted to start recognizing
each military branch’s birthdays. This
month the Army and Air Force Reserves
celebrate their birthdays. The Coast Guard
and Navy Reserves recently celebrated
their birthdays on February 14 and March

W
ith the slogan “Conquering all
Challenges,” Sheriff Stan Sniff
held the 2014 Sheriff’s Awards
Ceremony on April 2 recognizing the
bravery and achievements of Department
personnel.
Held at the Morongo Casino and Resort,
the event honored 85 recipients for acts of
heroism, courage, lifesaving, distinguished
service, community service, and making a
difference in the communities served by the
Riverside County Sheriff's Department.
The award recipients included the men
and women of the Riverside County Sheriff's
Department, department volunteers
and members of the community. Several
community members were recognized for
various acts including community service,
distinguished service and lifesaving.
The ceremony was attended by over
500 dignitaries and guests. The event was
sponsored by private donations.
A highlight of the event was the opening
ceremony that had Sergeant Angel Ramos
singing the national anthem. Sergeant

were awarded the Medal of Valor for their

heroism during a fight for their lives when
a violent inmate escape attempt was made
from the Blythe Jail. Three of the employees
have returned to full duty, while one is still
on the road to recovery.
The Medal of Valor is the Department’s
highest award and may be awarded to
Department members who distinguish
themselves by conspicuous heroism under
exigent or life-threatening conditions, and
consciously performing acts of bravery
or other outstanding feats while facing
imminent danger.
Correctional Deputy Manuel Padilla,
Correctional Deputy Ashley Trakes and
Correctional Deputy Bryan Warman are the
first three correctional deputies to receive
the Sheriff’s distinguished Medal of Valor
award in the history of the Riverside County
Sheriff’s Department.

Always Opt For Representation When
You Are In Trouble, But Be Flexible
Insisting On One Specific Attorney May Mean
You Will Go Without Representation
Quezada v. City of Los Angeles (January 8,
2014, B245879) – Cal. Rptr 3rd –, Cal.

The three officers filed suit for
violation of their POBRA rights. The
trial court granted the City’s motion for
summary judgment. The three officers appealed but the Court of Appeals affirmed
the trial court’s decision.
THE FACTS
THE HOLDING
Three Los Angeles Police officers,
two males and one female, finished
their regular work shift at 11 p.m. and
went to a local bar. While the female
officer only had one drink, the two males
consumed numerous drinks and became
intoxicated. They left the bar at 2 a.m.
and returned to pick up their cars from
the station parking lot. The female officer
was talking on her cell phone when she
turned around at the sound of five or six
gunshots. Believing that one or both of
her drinking companions had discharged
his gun, she disarmed them both. Other
officers from the station responded to the
scene and the three officers were ordered
back on duty by their sergeant and were
separated from one another.
An internal affairs investigation commenced immediately. The three officers
requested that they be represented by an
individual panel attorney. That attorney,
however, was not available until late in
the evening because he had prior interviews for other LAPD clients scheduled
with LAPD Internal Affairs. The attorney
advised the three officers that he could
represent them at 9 p.m. Internal Affairs
determined the situation was exigent
and required the officers be interrogated
that day, whether or not their requested
attorney could represent them. The
interrogation of the three officers began
at 2:30 p.m., without the presence of the
requested attorney.
The Court determined that even
though the officers were at times deprived
of access to food and water, kept awake
for 30 hours while the two male officers
were still drunk and/or hungover, their
POBRA rights were not violated because
the officers had access to food, water and
restrooms during their actual interrogation. The Court of Appeal noted that the
officers did not request medical attention
and concluded that the fact that the
officers had been awake for many hours
before being interrogated was a result
of the incident occurring after they had
been on duty for many hours and not
because of the Department’s unreasonable actions.
More importantly, the Court found
the officers were not entitled to wait until
their requested attorney was available.
The Court has taken the holding from
Upland Police Officers Association v. City of
Upland (111 Cal. App. 4th 1294) which
requires that an officer choose a representative who is “reasonably available” and
quantified that “reasonable availability”
to mean available at least within the
six and a half (6.5) hours after his/her
services are requested. The attorney in
this case was requested at 8 a.m. and
the interrogations began at 2:30 p.m.,
without the attorney’s presence. In doing
so, the Court relied on the Department’s
justification that the seriousness of the
circumstances - “the drunken random fir-

members should also be

represent them due to

ing of shots by off-duty officers” - required
the investigation be conducted at the
earliest opportunity while the officers’
memories were freshest.
THE RULE FOR YOU
Since the Court of Appeal accepted
the questionable assumption that the
interrogation must be completed while
memories remained the freshest, any
members who find themselves confronted
with the need for representation should
contact their preferred attorney immediately. However, members should also
be prepared to contact other attorneys
in case their preferred attorney cannot
represent them due to scheduling conflicts. The Court of Appeal noted that the
three officers did not seek to find alternate
representation when Internal Affairs would
not reschedule the preferred attorney’s other
interrogations in order to represent the three
officers. To sum this up, “be flexible - - anticipate these problems and be prepared to
deal with them. The RSA Legal Defense

help locating alternate representation if
your preferred representative is not available by calling the RSA Legal Defense

he war may be long over, but the
sacrifice of those who served live on
and continues to be remembered. A
March 29 patriotic ceremony recognized
that sacrifice at the 2014 Welcome Home
Vietnam Veterans Day Motorcycle Ride and
Patriotic Ceremony.
Observing Welcome Home Vietnam
Veterans Day, the event included a motorcycle ride that began at at Fairmount Park
in Riverside and culminated in a patriotic
ceremony held at Riverside National
Cemetary.
Proceeds from the motorcycle ride
benefited Vietnam Veterans of American
Inland Empire Chapter 47.
Redressing hostility shown toward
returning veterans more than 40 years ago,
in 2009 Gov. Arnold Schwarzenegger signed
legislation that established March 30 as
“Welcome Home Vietnam Veterans Day” in
California. Other states have passed similar
legislation.
Riverside County Superior Court Judge Helios
J. Hernandez, a US Navy and Vietnam War
veteran, served as the keynote speaker.
More than nine million personnel served
during the Vietnam era, and according to
the U.S. Census Bureau among nearly 8
million living Vietnam era veterans about
600,000 of them live in California. More
than 58,000 American military personnel
died in Vietnam.
The free event honored all veterans,
active and military. Veterans gave their
personal accounts of military experience.

veterans issues and has organized this annual event in the past as well as spearheading other local memorial projects.
After the motorcycle procession completed at the National Cemetery, Rasso
opened the event with welcoming remarks.
RSA Chaplain Harley Broviak was on hand
for the invocation. Patriotic music was performed by the Dancing Cloud Singers and
singer Sydney Dever. Helios J. Hernandez, a
US Navy and Vietnam War veteran, served
as the keynote speaker. Helios is a Riverside
County Superior Court Judge. State Assemblymember Eric Linder (60th District) offered awards of recognition.

Children’s Hospital this month
brought some very welcomed
smiles to the faces of many young cancer
patients. I will always remember the little
boy who received four tickets to Disneyland and some spending money for his
visit. He had never been to Disneyland because his Mother could not afford it. He
took his tickets and the check we gave
him and went from room to room telling
every child he could find “I’m going to
Disneyland, I’m going to Disneyland”. We
also came across another young man who
was wearing a Superman Tee Shirt and we
presented him with a gift as well. However
when he saw our volunteer
Kylleen Coogan wearing a Mickey
Mouse wrist watch he was enthralled. I guess it was just meant
to be because Kylleen had just put
on the new watch that day for her
visit to Loma Linda and, you
guessed it she gave him the watch
and a big hug. Paradise Chevrolet

Becky Young were themselves like
big kids eagerly handing out gifts
to the children and loving the
warm responses in return. All in
all The Debbie Chisholm Memorial Foundation brought over
$15,000 worth of gifts to these wonderful
kids and we are looking forward to doing it
again May. Thank you RSA members for
helping us in making these kids forget
their cancer for just a little while and
that’s a big victory for them.

t was a chilly,
dark October
night. I was sitting on my fat leather
chair with my Boston
Terrier. Roxie had
her head on my leg
sleeping. She kept looking at me quizzically, then got up and walked to the door. I
opened the door for her to go out. She did
not. I urged her and still she wouldn’t go.
Only the soulful eyes beseeching me.
“O.K., I get the message Roxie, you
want to go for a walk.” Happy, panting and
spinning dizzily, we went to the beach. I
sat down on a rock as she scampered back
and forth. She tired and came over to sit
next to me. The dark night sky was covered
with acres of stars. She came up to me and
nuzzled me and lay at my feet.
Across the bay, porch lights glimmered
on the water. They were the only illumination on the glass like surface. I think the
moon was on vacation.
Suddenly, a head popped up in the shimmering water. I thought “Ah ha! A seal is
coming to the beach to rest!” Then the head
grew shoulders as a man strode through the
still waters. He walked directly toward me
then stopped, surprised. “Oh my God! What
are you doing here?”
I said, “The better question is, what
are you doing here?” Don’t you know that

He shrugged it off, pushed back his mask
and snorkel up on his brow and knelt down
in the sand. I said, “What brings you here?”
