Pursuant to A.R.S. § 38-431.01, notice is hereby given to members of the Higley Unified School District No. 60 Governing
Board and to the general public that the Higley Unified School District No. 60 Governing Board will hold a Board Meeting.
The Governing Board reserves the right to move into executive session for legal advice with its attorneys for any item
listed on the agenda, in person or by telephone, pursuant to A.R.S. § 38-431.03(A)(3).

A.R.S. § 38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter,
responding to any criticism or scheduling the matter for further consideration and decision at a later date. Please limit your

On the date and at the place above written, the Governing Board, Higley Unified School District No.
60, met in a Regular Board Meeting. Present were: Venessa Whitener, President; Kristina Reese,

Mrs. Reese called the Regular Meeting to order at 6:36 p.m.

PUBLIC HEARING – FY2015 EXPENDITURE BUDGET AND TRUTH IN TAXATION
At 6:39 p.m., Mrs. Reese moved to recess the regular meeting for the purpose of holding a Public
Hearing on the proposed expenditure budget and truth in taxation for the 2015-16 school year in
accordance with the A.R.S § 15-905.01. Members of the audience were invited to make comments
and ask questions during the public hearing.
1. Presentation of FY2016 Expenditure Budget and Truth in Taxation by Shannon Duus,
Director of Finance
a. Ms. Duus explained how DAA and Unrestricted Capital are calculated
b. Special Education budget from the state was explained and a parent clarification
question was asked.
c. Prop 301 CSF explanation of how the 301 dollar amounts are configured. Additional
funding can be used by teachers in the Higley District.
d. Federal Project and Instructional Improvement Programs also known as Indian Gaming
e. FY2016 Truth in Taxation worksheet – Mr. Hoffman asked what projects would be
using these funds and Ms. Duus responded.

2. Questions and Comments Regarding Proposed Budget – Mr. Hoffman asked if the amount
proposed will cause the primary property tax rate to decrease and mentioned it looks like it
is increasing from 5.16 to 5.3. Mr. Hoffman asked if it is a combined tax rate and Ms.
Duus responded it is a combined tax rate. Another clarification from Mr. Hoffman: it
seems like the numbers are off on the two slides because on slide one, it goes down by
$6.54 and on the other slide it goes down by $7.89. So it looks like it would be $100,000
on both. Is that correct, he asked? Ms. Duus stated it is based on the fluctuations of
property values and will not have a significant impact on the rate. On the first slide it is
based on current cash and June numbers. On the second slide (Truth in Taxation
Worksheet); it is based on a formula by statute that explains the numbers if there were no
other tax liabilities. If it were at zero, it would be the $7.89 dollar amount.

4. Adjourn Public Hearing and Reconvene in Regular Meeting at 6:52 p.m.
Arizona Revised Statute 15-905 requires school districts to adopt a Proposed Annual Expenditure
Budget no later than July 15th. The statute also requires districts to hold a Truth in Taxation Hearing
on or before the date of the Budget Adoption if they levy for adjacent ways funding (the improvement
of property owned by the district). Notice of this Hearing was published in the Arizona Republic.
Ms. Duus explained that school districts that budget for any amount of Adjacent Ways Funds are
required to publish a Truth in Taxation notice and hold a Truth in Taxation Hearing. Ms. Duus also
explained the process going forward. Later in board meeting she will ask that the adopted budget be
accepted. Then the budget will be uploaded to the Department of Education and the county for
approval and acceptance. The next revision will be in December 2015. Mrs. Reese invited
questions/comments from the public.
Mrs. Reese called for the board to adjourn the public hearing and reconvene into the regular board
meeting at 6:52 p.m.

Dr. Thomason invited the board to attend the Welcome Back Assembly celebration with all staff on
Tuesday, July 21, 2015.
Board Comments
 Mr. Wojtovich would like a list of Open Houses and Curriculum nights for all schools.
 Mrs. Reese asked about the Meet the Teacher nights. Dr. Nance responded that all elementary
schools are scheduled next Thursday, middle schools are next Wednesday and the high schools are
dependent on the school and the year of the student.
 Mr. Wojtovich thanked the Human Resources Department for recruiting the best teachers in the
district.

9.1
Adopt FY2016 Expenditure Budget
Mr. Wojtovich moved that the Governing Board adopt the FY16 Expenditure Budget. Mr. Little
seconded. Mrs. Reese asked the question if this is the budget that has to be submitted to the state by
July 15th, which Ms. Duus confirmed it did. Arizona Revised Statute 15-905 requires that school
districts adopt an Annual Expenditure Budget no later than July 15th. The statute also requires
districts to hold a Truth in Taxation Hearing on or before the date of the Budget Adoption if they levy
for adjacent ways funding. Notice of this Hearing was published in a local paper.
The motion carried 3 to 1. Mr. Hoffman voted against.
9.2
Establish Eligibility of District Employees for Fringe Benefits for the 2015-2016 Fiscal Year
Mr. Wojtovich moved that the Governing Board establish eligibility of district employees for fringe
benefits for 2015-16 fiscal year. Mr. Hoffman seconded.
Governing Board Policies GCBD Professional Staff Fringe Benefits and GDBD Support Staff
Fringe Benefits provide that “Minimum standards of eligibility for fringe benefits will be
determined by the Board annually.” The proposed budget is based on eligibility for benefits to be
0.75 FTE, but there should be a specific statement of eligibility.
Mr. Hoffman asked for an additional explanation of what the change is from Mrs. Sorenson. At the
present time HUSD has eight employees who are classified as less than a 0.75FTE (full time
employment). The district defined full time benefits-eligible employees would be 0.756 hours/day or
30 hours a week. The information states several employees have elected to be at the FTE they are
currently working because they either want to job share or desire a part-time status. They have been
earning the leave at a pro-rated amount. They would be allowed to keep the leave they have
accumulated but would not continue to accumulate additional leave. Mr. Hoffman asked for
clarification on why the district would reduce leave after it was already pro-rated. Mrs. Sorenson said
the unfunded balance of leave increases in large amounts. When an employee leaves the district, it
becomes a financial burden. The district is trying to be consistent with all employees. Mrs. Reese

disagreed with the timing of when this was brought to the board. Mr. Hoffman said because classified
staff did not invest the time, effort, and funds to earn certification, it would not be equitable for them
to have the same benefits as those who did even if they work less than full time. Mr. Hoffman said
that because this decision was not made prior to the distribution of contracts, it is not equitable at this
time. Also, Mrs. Reese suggested following the policy that the board approved to make it equitable,
but to wait until 2016-2017 to implement only for this segment of certified staff. Mr. Hoffman asked
to table the item until January. Mrs. Sorenson and Ms. Good communicated a decision must be made
for the 2015-2016 school year. Mr. Wojtovich withdrew his original motion. Mr. Hoffman seconded.
Mr. Little asked for additional clarification on whether classified staff under 0.75 would earn no leave
or benefits? Mrs. Sorenson confirmed support staff must work 30 or more hours a week to earn the
benefits but certified employee benefits are pro-rated to the hours worked. Benefits include health
insurance, as well as earned leave hours.
Mrs. Whitener arrived at the board meeting at 7:08 p.m.
Mrs. Whitener suggested allowing the eight employees should receive their leave time for this year
and get additional information for the future. Mr. Hoffman moved to establish the minimum
standards of eligibility for fringe benefits for the 2015-2016 fiscal year as 0.75 FTE for support staff
and continue the pro-rated benefits for certified staff. Mrs. Reese seconded the motion.
The motion carried 5 to 0.
9.3 Information 2015-2016 Student Code of Conduct
In accordance with A.R.S. 15-841(A), the Governing Board Policy JIC–Student Conduct, the Student
Code of Conduct is presented to the Board. The Student Code of Conduct will be available
electronically to parents for the 2015-2016 school year. Dr. Nance explained the minor changes to the
Student Code of Conduct. The I.T. usage section has the most updates going forward. The
Technology Acceptable Use Policy was re-written to make it more comprehensible. Syntax clean up
in the document were the main changes. Mr. Hoffman asked Ms. Good to insure the verbiage is legal
and clear. Mrs. Whitener requested that the established consequences for misuse of technology are
clarified throughout the document.

Second Read and Approval of Amendments to Policy JICK–Student Violence/ Harassment/
Intimidation/ Bullying and Regulation JICK-R – Student Violence/ Harassment/
Intimidation/Bullying
Mr. Hoffman moved that the Governing Board approves the amendments of Policy JICK and
Regulation JICK-R –Student Violence/ Harassment/Intimidation/Bullying. Mrs. Whitener seconded.
Ms. Good confirmed the changes were primarily driven by changes in FERPA correct.
The motion carried 5 to 0.

Adopt a Resolution to Assign Court Ordered Garnishment Processing to Maricopa County
Education Service Agency for 2015-2016
Mr. Hoffman moved that the Governing Board adopts the resolution that all court ordered
garnishments will be processed by the Maricopa County Education Service Agency, Superintendent of
Schools as the Chief Disbursing Office for all garnishment of wages made upon any employee of the
district for 2015-2016. Mrs. Reese seconded. The $50.00 cost for registering the garnishment will be
paid for by the employee. Discussion followed on whether Maricopa County Education Service
Agency is efficient and if there are other agencies from which to choose from. Sheila Sorenson
clarified MCESA is the only organization which processes garnishments. These are garnishments and
the employee pays a $50 fee for the collection.

9.6 Appointment of Student Activities Treasurer and Assistant Treasurers for Fiscal Year 15/16
Mrs. Whitener moved that the Governing Board appoints the Director of Finance as the Student Activities
Treasurer and the Business Manager as the Assistant Student Activities Treasurer. Mrs. Reese seconded.
A.R.S. § 15-1122 requires the Governing Board to appoint a Student Activities Treasurer and may also
designate Assistant Student Activities Treasurers. All disbursements will require one of these designees
as a check signer. Ms. Duus confirmed that Isabel Collis is the District Business Manager.
The motion carried 5 to 0.
9.7
Review and Approve a Statement in Favor of the Maintenance & Operations Override to
Appear in the Informational Pamphlet
Mrs. Whitener moved that the Governing Board review and approve a statement in favor of the
Maintenance & Operations Override to appear in the informational pamphlet and submit it to the
Maricopa County Elections Department and/or Maricopa County Educational Services Agency by
August 7th, 2015. Mr. Wojtovich seconded. Maricopa County requires that the Governing Board
submit a pro statement supporting the Maintenance & Operations Budget Override. Changes to Pro
Statement were made with several suggestions and comments and the approved statement is as
follows:

We carefully make decisions supporting our mission to “connect, engage, and inspire.” Higley Unified
is rated #1 Large District academic performer in Arizona. Higley graduates received $22 million+ in
scholarships for two consecutive years and admitted into Honors Colleges and notable universities.
This M&O Override supports the infrastructure necessary to provide all students with the highest
degree of success.
Renewing M&O funding will:
• Increase competitive teacher compensation;
• Maintain/improve Elementary Specials: such as Art, Music, Physical Education/District athletic
programs;
• Provide staffing to reduce average class size;
• Support Gifted programs, Special Education, all-day Kindergarten;
• Add educational resources to classrooms.
The Board supports a ‘yes’ vote Nov. 3, 2015, and asks for your support in continuing Higley’s
exceptional learning experiences.

The motion carried 4-0-1. Mr. Hoffman abstained because he did not support putting the override on
the ballot.
9.8 Approve Food Service Contract Renewal FY2015-FY2016
Southwest Foodservice Excellence (SFE) provided a presentation on the food served to Higley
students and staff. SFE members present were: Rachael Veatch, General Manager; Stephanie Lucas,
Director of Regional Operations; Dan Matello, President; Rachel Linstrom, Director of Compliance.
Recap of the year in Higley. Last year SFE was awarded their contract four days prior to beginning
of the 2014-15 school year. They showed their fiscal package overview and the forecasted return of
$393,874 for the 2016 year. They outlined plans for the upcoming year. In addition, SFE will offer
Wellness Education, a health fair and GetFit exercise program. Their compliance experts assist in
the annual ADE review and audit. It was clarified that districts can submit for a waiver to ADE to
be able to sell non-compliant items, but they cannot be sold during service times (lunch and
breakfast times). There are impacts to both SFE and also to Higley. Estimated reimbursement
revenue loss for a one-day fundraiser will be $14,854. Meal count loss of 12,000 and total for both
would be $27,140 loss for Higley, depending on what the fundraiser is serving during the lunch and
breakfast time. SFE is expecting a 9% increase in costs due to fewer chickens, turkeys, beefs and
vegetables for various reasons that will affect the bottom line. SFE is losing money because we do
not have large numbers of free and reduced students (Higley Free and Reduced students are about
25%), as well as when students bring their lunches instead of buying hot lunches from SFE. As a
result, SFE asked for a reduced amount based on the average, using this year’s numbers. If there is a
drop off in sales, SFE will come back and ask for relief. To keep from taking that step, it would
help if the fundraising was done after school and not during service times. Mr. Hoffman does not
want the district to authorize the waiver which would result in the relief money to SFE.
Administrators have been trained on the issue of waivers and they will pass it on to their staff.
When fundraising days are planned at the schools, SFE requested two weeks’ notice to allow them
adequate time to adjust their meal schedules and avoid waste. Smart snacks are different and must be
compliant during the school day. SFE also sells smart snack options for students and staff and a list
of these snacks is available. The guarantee minimum is $400,000 on projected return. Mr. Hoffman
got clarification that when costs are less than expected, will HUSD receive additional amounts (the
return). Reports detail the amounts that are cash paid and accounts paid, which show there more
cash students in higher grades versus the elementary. Dr. Thomason was asked to pull the reports so
the board may have the information on hand. Mrs. Reese moved that the Governing Board approve
the renewal of the Food Service contract with Southwest Foodservice Excellence, LLC. Mr.
Wojtovich seconded.
The motion carried 5 to 0.

Compliance Officer
The Superintendent or the Superintendent’s designee shall be the compliance officer. Any
person who feels unlawfully discriminated against or to have been the victim of unlawful
discrimination or retaliation by an agent or employee of the District or who knows of such
discrimination against another person should is strongly encouraged to file a complaint
with the Superintendent. If the Superintendent is the one alleged to have unlawfully
discriminated, the complaint shall be filed with the President of the Board.
Complaint Procedure
The District is committed to investigating each complaint and to taking appropriate action
on all confirmed violations of policy. The Superintendent shall investigate and document
complaints filed pursuant to this regulation as soon as reasonable. In investigating the
complaint, the Superintendent will maintain confidentiality to the extent reasonably
possible. The Superintendent shall also investigate incidents of policy violation that are
raised by the Governing Board, even though no complaint has been made.
If after the initial investigation the Superintendent has reason to believe that a violation
of policy has occurred, the Superintendent shall determine whether or not to hold an
administrative hearing and/or to recommend bringing the matter before the Board.
If the person alleged to have violated policy is a teacher or an administrator, the due
process provisions of the District's Policy GCQF shall apply, except that the supervising
administrator may be assigned to conduct the hearing. In cases of serious misconduct,
dismissal or suspension proceedings in accordance with A.R.S. 15-539 et seq. may be
initiated.
If the person alleged to have violated policy is a support staff employee, the
Superintendent may follow due process and impose discipline under Policy GDQD if the
evidence so warrants. The Superintendent also may recommend a suspension without
pay, recommend dismissal, or impose other appropriate discipline.
If the person alleged to have violated policy is a student, the Superintendent may impose
discipline in accordance with policies JK, JKD and JKE.
If the Superintendent's investigation reveals no reasonable cause to believe policy has
been violated, the Superintendent shall so inform the complaining party in writing.

SEXUAL HARASSMENT
All individuals associated with this District, including, but not necessarily limited
to, the Governing Board, the administration, the staff, and students, are expected to
conduct themselves at all times so as to provide an atmosphere free from sexual
harassment. Sexual harassment is harassment on the basis of sex/gender
(including pregnancy, sexual preference, gender identity, transgender)
Sexual harassment includes unwelcome sexual advances, requests for sexual
favors, and other verbal or physical conduct of a sexual nature when made by a
member of the school staff District employee or student to a student, or to another
staff member a District employee, parent or individual with whom the District does
business , or when made by a student to another student where:
 Submission to such conduct is either explicitly or implicitly made a term or
condition of an individual's employment or education; or
 Submission to or rejection of such conduct is used as a basis for employment
or education decisions affecting such individual; or
 Such conduct has the purpose or effect of substantially interfering with an
individual's educational or work performance, or creating an intimidating,
hostile, or offensive employment or education environment.
Sexual harassment may include, but is not limited to:
 Suggestive or obscene letters, notes, invitations, derogatory comments,
slurs, jokes, epithets, assault, touching, impeding or blocking movement, leering,
gestures, or display of sexually suggestive objects, pictures, or cartoons.
 Continuing to express sexual interest after being informed that the interest
is unwelcome. (Reciprocal attraction between peers is not considered sexual
harassment.)
 Implying or withholding support for an appointment, promotion, or change
of assignment; suggesting that a poor performance report will be prepared;
suggesting that probation will be failed; implying or actually withholding grades
earned or deserved; or suggesting that a scholarship recommendation or college
application will be denied.
 Coercive sexual behavior used to control, influence, or affect the career,
salary, and/or work environment of another employee; or engaging in coercive
sexual behavior to control, influence, or affect the educational opportunities,
grades, and/or learning environment of a student.
 Offering or granting favors or educational or employment benefits, such as
grades or promotions, favorable performance evaluations, favorable
assignments, favorable duties or shifts, recommendations, reclassifications, etc.,
in exchange for sexual favors.
Anyone who is subject to sexual harassment, or who knows of the occurrence of
such conduct, should is strongly encouraged to inform the compliance officer, as
provided in ACA-R.
A substantiated charge against a staff member in the District shall subject such
staff member to disciplinary action.
A substantiated charge against a student in the District shall subject that student
to disciplinary action, which may include suspension or expulsion.
The Superintendent shall be the compliance officer, and shall develop procedures
and forms to receive and investigate complaints . All matters involving sexual
harassment complaints will remain confidential to the extent possible.

PROFESSIONAL STAFF HIRING
It shall be the policy of the District to employ and retain the best qualified
personnel. This will be accomplished by giving careful consideration to
qualifications and by providing competitive salary schedules within the financial
capability of the District, adequate facilities, and good working conditions.
The Board has the legal responsibility of approving the employment of all
employees. While this responsibility cannot be waived, the Board assigns to the
Superintendent the process of recruiting staff members. In carrying out this
responsibility, the Superintendent may involve other staff members as needed. All
personnel selected for employment must be recommended by the Superintendent
and approved by the Board. The Board adopts the following general criteria, which
shall be utilized in the selection process for initial employment:
 There will be no discrimination in the hiring process due to race, color,
religion, sex/gender (including pregnancy, sexual preference, gender identity,
transgender), age, national origin, or disability, genetic information or familial
status of an otherwise qualified individual.
 Candidates for professional positions shall be qualified for and have the
training necessary to perform the instructional and other duties or functions for
which they have applied.
 Each candidate shall provide evidence of meeting relevant state
requirements for certification.
 Each candidate shall be requested to complete a consent-and-release form
regarding conduct of a background investigation.
 A "background investigation" - consisting of communication with the
applicant's (or employee's) former employer that concerns education, training,
experience, qualifications, and job performance for the purpose of evaluation for
employment - shall be conducted on each individual to be considered for a
recommendation of employment. Forms developed for this purpose are to be
used.
Any employee's misstatement of fact that is material to qualifications for
employment or the determination of salary shall be considered by the Board to
constitute grounds for dismissal.
Before employment, schools or school districts shall verify the certification and
fingerprint status of applicants who apply for school or school district positions that
require certification.
Should the need arise to employ a teacher who meets the requirements for a
conditional certificate before an applicant has obtained the appropriate valid
fingerprint clearance card, the District may assist in obtaining the conditional
certificate, and employ the teacher, by meeting all of the following conditions:
 The District verifies in writing on a form provided by the Arizona
Department of Education (ADE) the necessity for hiring and placing the
applicant into service before a fingerprinting check is completed.
 The District obtains from the Department of Public Safety a state-wide
criminal records check on the applicant. Subsequent criminal records checks
must be completed every one hundred twenty (120) days until a permanent
certificate is received.
 The District searches the criminal records of all local jurisdictions outside
Arizona where the applicant has lived in the previous five (5) years.
 The District obtains references from the applicant's current employer and
two (2) most recent previous employers, except that for applicants who have
been employed for at least five (5) years by the most recent employer, only
references from that employer are required.
 The District provides general supervision of the applicant until permanent
certification is issued by ADE.
Upon recommendation for employment the District shall confirm employment
authorization and employment eligibility verification by participating in the EVerify program of the Department of Homeland Security's (DHS) U.S. Citizenship
and Immigration Services Bureau (USCIS) and the Social Security Administration
(SSA). The District will then complete the Form I-9 as required and maintain the
form with copies of the necessary documents and documentation of the
authorization and verification pending any inquiry.
The Superintendent of Public Instruction may also impose any additional
conditions or restrictions deemed necessary.
Any person who permits unauthorized access to criminal history record
information, releases criminal history record information, or procures the release or
uses criminal history record information other than in accord with A.R.S. 41-1750 is
guilty of a class 6 felony.
A professional candidate's acceptance of a contract offer must be indicated within
ten (10) business days from the date of the written contract or the time set forth in
the contract, whichever is less or the offer is revoked. Written notice of the
deadline date for acceptance shall be included in the contract offer or an attachment
to the contract offer. The candidate accepts the contract by signing the contract and
returning it to the District Office on behalf of the Governing Board or by making a
written instrument which accepts the terms of the contract and delivering it to the
District Office on behalf of the Governing Board. If the written instrument includes
terms in addition to the terms of the contract offered by the Board, the candidate
fails to accept the contract.

SUPERVISION OF SUPPORT
STAFF MEMBERS
The supervisor(s) of the various departments or divisions shall be responsible
for the supervision of personnel assigned to these areas and shall provide the
necessary orientation to new employees and in-service training for all
employees under their supervision.
In-service training shall include
instruction concerning the prohibition of discrimination based upon race,
color, religion, sex/gender (including pregnancy, sexual preference, gender
identity, transgender), age, national origin, disability, genetic information or
familial status, and examples of prohibited conduct.
All other support staff employees shall be under the supervision of the
administrative heads of the units to which the employees are assigned. The
administrative head shall be responsible for the necessary orientation of new
employees and shall provide in-service training as needed.
Supervision shall include evaluation of the employee.
Supervisors shall not treat employees differently on the basis of the unlawful
discrimination identified above when hiring, assigning, disciplining,
evaluating or taking any other employment action. Violation of this policy
shall be subject to appropriate discipline, up to and including dismissal.

ISSUE:
The ethical principles of Policy GBEA were combined into Policy GBEB in 2007, In
handling employee misconduct it is useful for the “ethics” and “conduct” not to be divided.
Apparently by an oversight, Policy GBEA was not repealed. We recommend the repeal of
GBEA as a clean-up to accompany the amendment of GBEB, which is presented under
separate cover.
RECOMMENDATION:
That the Governing Board approves the second read of the repeal of Policy GBEA–Staff
Ethics.

STAFF ETHICS
(Statement of Ethics for School Employees)
All employees of the District are expected to maintain high standards in their
school relationships. The employees acknowledge that the schools belong to the
public they serve for the purpose of providing educational opportunities to
all. Every employee assumes responsibility for providing leadership in the school
and community. This responsibility requires the employee to maintain standards of
exemplary conduct. It must be recognized that the employee's actions will be
viewed and appraised by the community, associates, and students. To these ends,
the Board adopts the following statements of standards.
The school employee:
 Makes the well-being of students the fundamental value of all decision
making and actions.
 Maintains just, courteous, and proper relationships with students, parents,
staff members, and others.
 Strives for the maintenance of efficiency and knowledge of developments in
the employee's field of work.

Fulfills job responsibilities with honesty and integrity.
 Directs any criticism of other staff members or of any department of the
school system toward improving the District. These improvement suggestions
are to be shared with the school administrator or other staff member who has
the responsibility for improving the situation. If this does not remedy the
situation, the information is to be shared with the next staff member in the
organizational chart.
 Constructive input is to be made directly to the school administrator or other
staff member who has the responsibility for improving the situation.
 Supports the principle of due process and protects the civil and human
rights of all individuals.
 Obeys local, state, and national laws and does not knowingly join or support
organizations that advocate, directly or indirectly, the overthrow of the
government.

Implements the Governing Board's policies and administrative rules and
regulations.
 Refrains from using school contacts and privileges to promote partisan
politics, sectarian religious views, or selfish propaganda of any kind.
 Pursues appropriate measures to correct any policies or regulations that are
not consistent with sound educational goals.
 Avoids using position for personal gain through political, social, religious,
economic, or other influence.
 Maintains the standards and seeks to improve the effectiveness of the
profession through research and continuing professional development.
 Stresses the proper use and protection of all school properties, equipment,
and materials.

Honors all contracts until fulfillment or release.
In the performance of duties, employees shall keep in confidence such information
as they may secure unless disclosure serves District purposes or is required by law.

ISSUE:
The amendment to the policy adds a section concerning the reporting of bullying to
accompany the reports of bullying by both students and employees called for in Policy
JICK. The statutory definition of a drug-free school zone is added, for clarification of the
duty to report a violation. In order to have in one place those criminal activities for which a
report is required, there is added a brief notation of the duty to report child abuse, with a
reference to the policy specific to such reports.
RECOMMENDATION:
That the Governing Board approves the amendment of Policy GBEB Staff Conduct.

STAFF ETHICS AND CONDUCT
General Expectations for Ethical Conduct
Employees shall conduct themselves in a professional manner that promotes a safe,
effective and orderly work and educational environment. Employees are expected to
maintain high ethical and behavioral standards in the performance of their job
duties and in their relationships with other employees, students and community
members. The Board adopts the following standards, which are to be applied in all
situations, including those situations for which more specific criteria are found in
this and other policies included in the Governing Board Policy Manual.
District employees shall:
• Make the well-being of students the fundamental value of all decision making
and action.
•
Maintain just, courteous and proper relationships with students, parents,
staff members and others.
•
Fulfill job responsibilities with honesty and integrity.
•
Direct criticism of others toward improving the District. Adhering to the
established chain of command and providing constructive input directly to
the administrator who is responsible for improving the situation.
•
Support the principle of due process and protecting the civil and human
rights of all individuals.
•
Refrain from using school contacts and privileges to promote partisan
politics, sectarian religious views, or selfish propaganda of any kind.
•
Refrain from using the employee's position for personal gain through
political, social, religious, economic, or other influence.
•
Pursue appropriate measures to correct any policies or regulations that are

Employee Conduct with Students
In addition to the standards set forth above, employees shall adhere to the following
standards in interacting with students:
• Employees will exercise general supervision over the conduct of students at
all times on school grounds or during other school-related activities.
• Staff members will treat students with respect and will avoid embarrassing
any student unnecessarily.
• In relating to students, employees’ behavior will reflect the social and moral
values of the community for adults who are responsible for the welfare of
students.
• Employees will not engage in relationships with students that can be
characterized as courtship, dating or any romantic involvement.
• Employees shall communicate with students only regarding school matters
and shall use only the District’s authorized communication devices and
electronic systems for such purposes.

Employees must remain aware that District discipline, up to and including
dismissal, loss of professional certification and criminal prosecution may
result from sexual conduct with or sexual harassment of students.
Employees entrusted with the care and supervision of students may use
reasonable and appropriate physical force upon a student only to the extent
reasonably necessary for self-defense, defense of others or to prevent or
terminate the commission of theft or criminal damage to the property of the
District or of persons lawfully on District premises.
An employee who uses physical force upon a student shall submit a written account
of the incident to his/her supervisor within twenty-four (24) hours of the incident.
The supervisor shall submit the incident report to the District Office within two (2)
working days of receipt.
An employee who violates District standards or state law concerning conduct with
students is subject to disciplinary action, up to and including dismissal. Other legal
action may be taken as appropriate.
Misconduct
Misconduct means any act or omission contrary to the ethical and behavioral
standards set forth in this policy, other District policies and administrative
regulations, any applicable law or regulation (whether federal, state or local), the
employment contract, or the direction of the employee’s supervisors.
Employees are cautioned that they must become familiar with the requirements of
other District policies that require or prohibit conduct noted in those policies, and
that a failure to comply is misconduct, for which the employee is subject to
disciplinary action. Below are some examples of misconduct.
Misconduct includes, but is not limited to:

Dishonesty related to the job that does or could reasonably injure the
District’s interests.
Falsification of employment application, time records or any documentation
related to employment.
Misuse, abuse, damage or theft of District property.
Failure to follow procedures for caring for District funds and tangible
property, including but not limited to purchasing procedures, calling for
repair of objects or systems, obtaining supplies.

Absence from work without authorization; excessive absences; repeated
tardiness; failure to give notice of absence
Inability to perform duties because of the use of alcohol, legal or illegal drugs;
unlawful activities involving drugs or contraband (possession, distribution or
sale, other prohibited activities) on District premises or during work time.
Employees who hold a valid registry identification card issued by the Arizona
Department of Health Services to allow the medical use of marijuana are
subject to all regulations prohibiting use, possession, distribution, being
under the influence and other activities related to drugs while on duty and
while on District premises.
Refusal or knowing failure to perform assigned duties or failure to perform
assigned duties to a generally acceptable standard.
Insubordination, disobedience, refusal to follow reasonable and proper
instructions given by a supervisor.
Carrying or possessing a weapon on school grounds unless the employee is a
peace officer or has obtained specific authorization from the school
administrator.
Immoral conduct that directly affects the employee’s ability to perform
his/her responsibilities and/or to enforce District policies.
Failure to report to one’s immediate supervisor, within forty-eight (48) hours,
the fact that one has been criminally charged with any offense other than a
minor traffic offense.
Repeated or intentional failure to follow channels in processing complaints
and grievances.
Physical or verbal abuse or harassment of, or threat of harm to other
employees, students or members of the school community.
Physical or verbal abuse or harassment of, or threat of harm to other
employees, students or members of the school community, based upon race,
color, religion, sex/gender (including pregnancy, sexual preference, gender
identity, transgender), age, national origin, disability, genetic information
and familial status.
Conduct that is destructive to a positive work or educational environment
and/or to interpersonal relationships, including the use of profane, obscene or
abusive language, symbols, gestures or acts.
Improper personal or sexual relationships with students.
Conduct that obstructs, disrupts or interferes with any District activities.
Forceful or unauthorized entry to or occupation of District facilities,
buildings, grounds, vehicles or other property.

Failure to comply with lawful direction of District officials, security officers or
law enforcement officers acting in performance of their duties, or failure to
identify oneself to such officials or officers when lawfully requested to do so.
Employee Responsibility to Report Disorderly and Criminal Activity
Drug-Free School Zone Violations
“Drug free school zone” means the area within three hundred (300) feet of a school
or its accompanying grounds, any public property within one thousand (1,000) feet
of a school or its accompanying grounds, a school bus stop or on any school bus or
bus contracted to transport pupils.
Pursuant to A.R.S. 13-3411, it is unlawful for a person to: 1) Intentionally be
present in a drug-free school zone to sell marijuana, peyote, prescription-only drugs,
dangerous drugs or narcotic drugs; 2) Possess or use marijuana, peyote, dangerous
drugs or narcotic drugs in a drug-free school zone; or 3) Manufacture dangerous
drugs in a drug-free school zone.
Any employee who observes a violation of the law shall immediately report the
violation to a school principal or the Superintendent, who shall then immediately
report the violation to a peace officer. It is a violation of the law for any school
personnel or school administrator to fail to report such a violation.
Bullying
A school employee who becomes aware of or suspects a student is being bullied shall
immediately notify the school administrator. School personnel shall maintain
confidentiality of the reported information.
The initial notification of an alleged incident may be provided verbally. A detailed
written description of the incident and any other relevant information must be
provided on form(s) made available by the school and submitted to the school
administrator or other administrator within one (1) school day of the verbal report.
Should the principal be the employee who observes, is informed of, or suspects a
student is experiencing bullying the principal shall document the incident or
concern in writing. Failure by an employee to report a suspected case of bullying
may result in disciplinary action up to suspension without pay or dismissal
pursuant to Board Policies GCQF and GDQD.

Knowingly submitting a false report under this policy shall subject the employee to
discipline up to and including suspension or termination of employment. Where
disciplinary action is necessary pursuant to any part of this policy, relevant District
policies shall be followed.
Other Suspected Crimes
As required by A.R.S. 15-341(33), the Board expects employees to immediately
report to the Superintendent any suspected crime against a person or property that:
(a) Is a “serious offense”, as defined in A.R.S. 13-604; (b) Involves a deadly weapon
or dangerous instrument or serious physical injury; or (c) Any conduct that poses a
threat of death or serious physical injury to employees, students or anyone on the
property of the school. An employee may report any other suspected crime.
Child Abuse
All employees are required to report to law enforcement when he or she learns
information in the course of employment that causes the employee to reasonably
believe a minor has been the victim of neglect, physical injury, abuse, child abuse or
other offenses. See Policy JLF for information concerning the procedures for such a
report.
Use of Physical Force
Against Students
Employees may use reasonable and appropriate physical force upon a
student to the extent reasonably necessary and appropriate to act in self
defense, defense of students and/or in defense of property. An employee
who uses physical force upon a student shall submit a written account of
the incident to his/her supervisor within twenty-four (24) hours of the
incident. The supervisor shall submit the incident report to the
appropriate assistant superintendent within two (2) working days of
receiving it from the employee.
