DESCRIPTION OF DECISION
Defendant filed an omnibus pretrial motion, requesting that the Court suppress evidence
obtained as a result of a seizure of Defendant’s clothing without a warrant. Defendant
argued that the seizure was unlawful under the Fourth Amendment to the U.S. Constitution and Article I, Section 8 of the Pennsylvania Constitution. Defendant further
requested that the Court suppress a statement secured from him while incarcerated at
the Northampton County Prison on unrelated charges. Upon suppression of the physical evidence and his statement, Defendant contended that the court should dismiss the
charges against him because the Commonwealth could not meet its prima facie burden for
the alleged crimes. The Commonwealth responded that the evidence was not unlawfully
obtained because the officer believed that Defendant was a victim, not a suspect.
Finding that the Defendant sufficiently established that he retained a reasonable expectation of privacy in his clothing while being treated at a hospital, the Court held that
the investigating officer was required to obtain a warrant prior to seizing the items. Thus,
the clothing evidence was suppressed. Alternatively, the Court found that Defendant’s
statement was not the result of the illegally obtained evidence, and as such, suppression
was not proper. Lastly, the Court found that the Commonwealth had provided sufficient
factual averments to make its prima facie case.

DESCRIPTION OF DECISION
Plaintiff filed a Complaint, including a claim for legal malpractice, alleging that Defendant failed to properly advise her of her rights under the Pennsylvania Automobile
Insurance Law or advise her that filing a “small claims” action would preclude her
from brining any other lawsuits relating to her injuries or future economic loss. Plaintiff
averred that such acts constituted professional negligence.
Defendant filed preliminary objections, contending that Plaintiff’s complaint failed
to set forth sufficiently specific facts under Rule 1019(a) of the Pennsylvania Rules
of Civil Procedure. Defendant further alleged that Plaintiff had improperly alleged a
claim for breach of contract.
Finding that Plaintiff averred sufficient facts giving rise to an inference of an attorneyclient relationship between the parties, the Court found that Defendant’s preliminary
objection based on failure to plead sufficient facts lacked merit. Thus, Defendant’s
preliminary objection under Pa. R.C.P. 1016(a) was denied. Alternatively, noting that
the Plaintiff stipulated that she did not intend to plead a claim for breach of contract,
the court sustained Defendant’s preliminary objection on that matter.

DESCRIPTION OF DECISION
Plaintiffs filed a petition for injunctive relief seeking to enjoin Defendants from discharging firearms at their residence in Bethlehem, Pennsylvania. Plaintiffs alleged
that defendant Richard Seruga has repeatedly discharged firearms on his property, and
that such actions constitute a violation of a Lower Saucon Township Ordinance, pose
a risk of potentially catastrophic injury, and have hindered them from reasonable use
and enjoyment of their property.
Defendants opposed Plaintiffs’ request, asserting that Plaintiffs proffered insufficient
evidence to conclude that Defendants’ target shooting posed a risk of unreasonable
danger or noise and that such an order would violate their constitutional right to bear
arms. Defendants further averred that Plaintiffs had not established that they had no
adequate remedy at law, and as such, injunctive relief was improper.
The court found that Plaintiffs sufficiently established that the harm caused by
Defendants’ conduct could not be remedied by the mere award of damages and that
greater injury would occur if the injunction was not granted than would be caused by the
granting of the injunction. The court also found that plaintiffs did not have an adequate
remedy at law for prohibiting defendant’s frequent and repeated discharge of weapons,

as demonstrated by his continued violations of the Lower Saucon Ordinance despite
repeated citations from the police. Therefore, the court entered a preliminary injunction
enjoining defendants from discharging firearms on their property.

DESCRIPTION OF DECISION
Plaintiff filed a petition to set aside a post-nuptial agreement, asserting that the agreement was entered into without Defendant’s full disclosure of his financial assets, that
Defendant materially breached the terms of the post-nuptial agreement, and as such,
Plaintiff is discharged from any obligation of performance, that Defendant fraudulently
induced Plaintiff’s consent to the post-nuptial agreement, and that a condition precedent
to the contract—Defendant’s move back into the marital home—was not met, thereby
negating the post-nuptial agreement.
Defendant disputed that the post-nuptial agreement was invalid, asserting that the
contract was entered into by two consenting and informed adults, represented by legal
counsel, and that Plaintiff entered into the agreement by her own choice. Defendant
refuted any notion that he attempted to deceive Plaintiff regarding his relationship with
his girlfriend or that he did not intend to attempt to reconcile with Plaintiff. Defendant
further argued that because the parties had been separated for seven years, the court
should enter an order bifurcating the economic issues from the balance of the divorce
issues.
Finding that Defendant failed to resume cohabitation, or—at a minimum—to make
a good faith effort at returning to the marital residence, the court found that the postnuptial agreement cannot be enforced. Citing the doctrine of necessary implication, the
Court found that the post-nuptial agreement was entered into to promote Defendant’s
resumption of cohabitation in the marital residence, and that Defendant’s failure to
make a good faith effort to do so constituted a material breach of the agreement. Thus,
the court found that the contract could not be enforced against Plaintiff.
The Court further held that Defendant had not made sufficient arrangements to protect
Plaintiff’s economic interests, and as such, bifurcation of the divorce was not proper.

DESCRIPTION OF DECISION
Plaintiffs filed an amended petition for review of the Bethlehem Area School District’s
October, 2006, decision to expel Plaintiff Saul from the school district until the conclusion of the 2007-2008 school year. Plaintiffs allege that Defendant’s decision to expel
Plaintiff Saul was not fair and impartial because the attorney who represented and
advised the school board during the expulsion proceedings is a member of the same
law firm as another attorney who represents the school board in other educational matters. Plaintiffs also alleged that the school board failed to proceed with the expulsion
in a timely manner, failed to hold an informal hearing, and represented that Plaintiff
Saul would not be expelled if she performed well in the fall of 2006. Plaintiffs allege
that they were denied due process because they were lulled into non-resistance to the
school board’s expulsion proceedings by the representation that expulsion would not
occur. Finally, Plaintiffs alleged that they were entitled to a hearing de novo because
the record made before the school board could not be complete as they presented no
evidence, were unrepresented by counsel, and did not require the school board to pre­
sent more than a mere summary of evidence to be presented.
Defendant filed the instant preliminary objections contending that Plaintiffs’ averments were legally insufficient to support a cause of action for violation of the law and
that Plaintiffs’ claims lack the required specificity under the law. Defendants further
opposed Plaintiffs’ demand for a hearing de novo, arguing that the record made before
the school board was complete, and that Plaintiffs’ choice not to present or require the
school board to present evidence was voluntarily made and any argument to the contrary
was not raised before the local agency.
After reviewing Plaintiffs’ amended petition for review, the Court found that the petition was sufficiently specific to defeat Defendant’s preliminary objection. The petition
alleged that a conflict of interest was present throughout the expulsion proceedings and
such allegations raised an inference of bias in favor of the school board. The Court further
found that Plaintiffs adequately stated a claim on which relief may be granted because
they averred that one of the essential elements of due process had been denied.
Upon review of Plaintiffs’ demand for a hearing de novo, the court found that the
threshold issue of whether Plaintiffs were, in fact, lulled into non-resistance by representations made by school and school board officials must first be addressed. Thus, the
parties were directed to praecipe this matter for non-jury trial.

DESCRIPTION OF DECISION
In April, 2006, counsel for the parties presented an agreement to the court, which was
accepted and adopted as an order of court. The agreement required, among other items,
that Plaintiff make a lump-sum cash payment to Defendant. Plaintiff characterized
this payment as being a final settlement of all issues arising from the parties’ divorce.
Defendant contested this interpretation of the agreement, and one day after the adoption
of the agreement by the court, reported that her understanding was that the agreement
resolved only issues of spousal support under the parties’ ante-nuptial agreement.
Plaintiffs filed a petition to enforce the agreement as a full and final resolution of all
claims arising out of the divorce.
On review of the evidence, including the testimony of both parties, their legal
representatives, and the agreement stated in the transcript before the court, the court
found that the asserted settlement was not binding. The court found that no meeting of
the minds occurred that day, as Plaintiff and his counsel believed the agreement was
in full and final resolution of all claims, while Defendant and her counsel believed that
only the issue of spousal support was being discussed. Because the transcript of the
agreement presented to and adopted by the court did not conclusively establish that
the agreement was intended to be a resolution of every possible issue arising from the
divorce, the court found that no meeting of the minds occurred and the agreement was
unenforceable.
