We appreciate the time state officials spent with us and their willingness to share their views about these issues. The following is a brief summary of what our volunteers do for the SDCAA and its members during the legislative cycle and how they, and you, can effectively communicate with lawmakers. The work of our State Legislative Committee makes our organization more effective, but it is a major undertaking and requires commitment. The committee’s 10 members meet monthly to provide our staff and Sacramento lobbyists their analysis of bills as they are introduced and amended. The committee is under the leadership of Chair Kendra Bork and Vice Chair Christine La Marca, and it is staffed by Molly Kirkland, Director of Public Affairs. They work hard to understand how the legislation impacts property managers and owners. The committee reviews hundreds of proposals each year that might affect our industry. It receives input from our Sacramento lobbyists at Aaron Read & Associates; the staff, Terry McHale, Pat Moran, and Jennifer Tannihill, provides the committee information on the author’s intent, sponsors of the proposal, amendments in the works, and the concerns or interests other groups have with the proposal. The SDCAA Committee then votes on what position to take and communicates the position to our lobbyists. They then inform the author about our position and provide information, propose changes if appropriate, and begin contacting members on the legislative committee who will vote on the proposal - if necessary, they might publicly testify at the committee hearing. Several SDCAA members have asked me how they can help influence the outcome of these deliberations, how to communicate, and what to communicate with legislators. Those who wish to assist the committee are welcome to provide input to SDCAA staff on legislation it is considering. Knowledgeable input from those who are in the industry is always helpful and appreciated. In talking with legislators about proposals, do your homework on the proposal and be succinct in stating what you like or dislike about the proposed bill. Be sure to know the bill number, the name of the committee considering it, and the date of the hearing (Usually, the SDCAA staff provides such information by email). Timing is important, so try to contact your local legislator at a time that coincides with an upcoming committee hearing or floor vote in Sacramento by calling their district or the Capitol office. The legislator’s staff will usually take down the information you provide, including your name and whether you live or work in the local district, or you can send your message by email. You can send your letter by fax (facsimile). If you personally know the legislator, try to speak to him or her directly or make a request with his or her staff – but be aware that they are usually unavailable Tuesday through Thursday because of their committee schedule. Another option is to speak to them if they are at an event you attend. Many legislators are in their district offices on Friday and may be available to meet with you then. Don’t be reluctant to provide your views, whatever the circumstances – just be accurate, succinct, courteous, and provide relevant information so that the specific measure can be identified. A few timely constituent calls from the legislator’s district can be immensely helpful in encouraging a particular vote. The most convenient way to know which legislator(s) represents you or your company is to visit the SDCAA’s website, click the Legislation menu, and select the “Who Represents me” tab - you can find their address, telephone number, and email address on their website, or you can call the SDCAA at (858) 278-8070. Bob Nida RentalOwner May 2015| 3 F From the Executive Director's Desk irst I would like thank the presenters, the exhibitors, attendees, and anyone else who participated at this year’s Education Conference and EXPO. I would also like to congratulate all of the Maintenance Mania winners and competitors! Your participation and enthusiasm made it a spectacular event. When we come together at events like the EXPO, or attend our networking and education seminars - we build a community. When we have community, we have strength in numbers. Given the present situation, we need to act as a community to overcome present and long term challenges facing our industry. In my April message, I addressed some of the political and regulatory, past and present, challenges to the rental housing industry - Well, let’s add environmental challenges to the list. Recent actions taken by the Governor, State Water Board, and the Metropolitan Water District show the seriousness of the state’s drought and it has local agencies scrambling – which means more pressure on us to reduce our consumption. For now, we grin and bear it because we need to conserve water because the drought is serious - we, our employees, residents, and 4 | RentalOwner May 2015 properties need to use less water. While we grudgingly comply with the rules and hope the drought ends soon, we need to tell the state to get serious about increasing our water supply and allow our water agencies to produce more drinking water from new sources such as advanced water purification and desalination. Like any other challenge, as long we stay informed and act early, we will overcome adversity. The City of San Diego’s Code Enforcement Department provided us with a great and timely article titled, Code Enforcement 101, on the most common code violations and what to do if you are noticed with a violation on page 6. We have updates on page 16 regarding how to help the state conserve water during the drought – don’t forget that our Water Conservation Information Packet and new door hanger template about conserving water are now available on the SDCAA’s website, www.sdcaa.com. CODE ENFORCEMENT 101: Residential Rental Properties By Michael S. Richmond, Deputy Director, Code Enforcement Division, Development A s an owner of residential rental property, you may or may not be familiar with the Code Enforcement Division (CED) of the City of San Diego’s Development Services Department. CED is tasked with responding to complaints regarding a wide variety of alleged zoning, building, and housing violations that get reported each year. CED’s main mission is: “To work in partnership with the people of San Diego to maintain a safe and desirable living and working environment; to improve the quality of San Diego’s neighborhoods through education, enforcement and abatement; and to respond to community concerns and attain code compliance while maintaining high professional standards and continually seeking improvement and innovation.” At first glance, the enforcement process seems simple and straight forward. After necessary property research is completed, the case investigator conducts an inspection, identifies violations, selects an appropriate remedy, issues a notice or citation containing a reasonable time frame for compliance, then returns to the property to inspect for compliance, case closed. However, due to the complex nature and unique characteristics of each property, the code enforcement process can sometimes seem daunting and overwhelming. Many regulations come into play including the San Diego Municipal Code, State Building Codes, and State Health and Safety codes, to name a few. Another unique factor applicable locally is the variety of types and ages of our housing stock in San Diego. Many neighborhoods have residential properties that were built in the early 1900s which have undergone minimal transformation as to upgrades and maintenance. This often creates a challenge to property owners when it comes to ensuring that the residential units they are leasing are meeting the minimum requirements of a safe and healthy dwelling unit. 6 | RentalOwner May 2015 © Lisa F. Young | Dreamstime.com So how can you, as the landlord, do your part to ensure that Code Enforcement investigators don’t come knocking on your door? Probably the most important way to start is to carefully interview, screen, and conduct thorough background checks of prospective tenants. Along with your responsibility as a property owner to repair and maintain your unit in a safe and working manner, the tenant shares a responsibility to keep the unit clean, monitor the behavior of guests, and timely report any maintenance issues that require repair by the owner. Also included in the equation is the provision of responsible onsite managers, when required, to be responsive to any issues requiring immediate owner attention. Another very important way to avoid Code Enforcement is to regularly inspect your rental unit for compliance with basic compliance items as well as checking on how your tenant(s) are maintaining the residence. What are the most common violations found when inspecting residential rental units? The following list contains the “Top Ten” most commonly found violations found during the course of code enforcement inspections of rental dwelling units: 1. Missing smoke and carbon monoxide detectors. 2. Plumbing deficiencies: lack of water, lack of hot water, drain line leaks, improperly installed water heaters. 3. What should I do if I am contacted by Code Enforcement regarding alleged violations at my residential rental property? First and foremost, 8 | RentalOwner May 2015 communication is the key to getting resolution to any problem and Code Enforcement is no different. Each Code Enforcement case is assigned to an investigator. It is important to have an on-going dialogue with that investigator throughout the process. Your cooperation with providing lawful notice to your tenant(s) to arrange for an inspection and being willing to discuss any violations observed with the investigator is a great start. Remember that the main goal in the process is to achieve voluntary compliance by correcting the violations in a reasonable amount of time. By achieving voluntary compliance, you will avoid costly fines or penalties. What are some of the more serious violations? More serious cases involve properties that contain illegally created dwelling units, many of which exceed allowable zoning density. Also, when substandard housing units are found, as defined in California Health and Safety Code Section 17920.3, compliance will often require that tenants be vacated and relocated by the property owner while the property is either repaired to a habitable condition or, in some cases, demolished. These more egregious cases are often referred to the Code Enforcement Unit of the City Attorney’s Office for prosecution. Perhaps things will return to the way it has always been for Independent Rental Owners. Certainly we have experienced pent–up rental demand and short supply of rentals in the past. We have been through our share of economic cycles. It’s nothing new for us to receive unsolicited offers by brokers to list and/or actual offers to purchase by hungry investors. However informed we are by local history, if we stop at what we know from the past we miss the real differences in this next cycle that spell a marketing opportunity depending upon how we choose to conduct our rental business. Indeed, for an entire array of businesses that are related or supported by this essential rental housing part of the local economy we need to connect some important pieces of data; understand the details behind the current housing behaviors; and what can legitimately be predicted about rental ownership and operation. Then we can strategically plan our marketing advantage. Readers of this publication will want to study and understand the stats that come from the semi-annual vacancy survey. The San Diego region is home to 1.1m households; nearly half of which are rental households. So, it is imperative that the “status quo” be replaced with “best practices” for operating rental property including: technological integration, investment in human capital, modern marketing, and customer relations. These are all welcome changes in an industry badly in need of a paradigm shift. We need to prove to our customers that our credentials, training, oversight and offsite support are in place giving them confidence that “their home which is central to their lifestyle” is at the core of our “business plan”. There is only one path forward. It is through a gauntlet of consumer protection and thorny customer relations. Our renters will not stand by during a property improvement that impairs or makes their life less convenient without your acknowledgement and compensation. Paying rent is going to be paid in a last minute, secure fashion that suits the rental customers, not your custom. Lack of communication on an unresolved issue will not be tolerated. If your ownership does not include being a full time operator with business hours it will not be your renter that is inconvenienced or feeling discriminated against. The real estate industry has traditionally been dominated by the real estate transactional value of buying income property and holding it for price appreciation allowing the investor to trade up. Property operations are necessary between transactions creating a need to manage; mostly by controlling expense and vacancy. The millennial vision is one of an ongoing competitive business providing an essential bundle of product and services by professionals that are supported by management systems and technologies. I see the next 5 years as a renaissance of the independent rental owner as an essential housing provider and a savvy business owner in the local community. This is an intelligent investor that is building wealth and providing for retirement in a practical way. The tired public notion of “landlords” taking advantage of captive “tenants” will be replaced with entrepreneurial leadership that attracts a community encouragement for private investments in improved housing and new life for established neighborhoods. RentalOwnerMay 2015 | 11 Local Update Legislative • State and MWD issue tidal wave of new water conservation measures • Mayor Fulconer releases new budget and proposal to go after bad landlords • City of El Cajon's incentive program on 5% discount on delayed sewer billings State and MWD issue tidal wave of new water conservation measures The Governor, state water agencies, and the Metropolitan Water District approved new water conservations measures for San Diego water agencies and their customers. The measures not only require water agencies to reduce water usage, but the region will receive less water than previously promised. Governor Jerry Brown signed Executive Order B-2915 requiring all water agencies statewide and their customers to decrease their water consumption by 25 percent of 2013 levels. The executive order came one 12 | RentalOwner May 2015 day after the governor signed a $1.1 billion legislative package that issues bonds for water projects and grants emergency funding to communities affected by the drought. The executive order asks state and local water agencies to launch a new initiative to replace 50 million square feet of turf with drought tolerant landscaping; commercial, industrial and institutional properties need to immediately reduce potable water use by 25 percent, and water agencies need to implement ordinances that increase water efficiency standards for new and existing landscapes. Newly constructed homes and buildings will be prohibited from using potable water for outdoor irrigation, and bans the use of potable water for ornamental turf on public street medians. Water agencies must change their rate structure and adopt penalties and surcharges to maximize water conservation. At the same time, the Governor’s order gives priority review and approval of infrastructure projects and programs that increase local water supplies, and suspends California Environmental Quality Act (CEQA) review for certain actions. The State Water Resources Control Board (SWRCB) issued water reduction targets to each water district statewide. Most of the water districts in the San Diego region receive the reduction target of 25 percent or the maximum of 35 percent – only a few cities like San Diego and Oceanside received a 20 percent reduction. In response to the Governor’s order, the Metropolitan Water District (MWD) Board of Directors voted to reduce water deliveries by 15 percent to all of its water agency members – which includes the San Diego County Water Authority and its members. If the drought continues, the MWD might withhold more water which could pose a serious challenge to properties that have adopted indoor and outdoor water efficiency technology and techniques. The SDCAA strongly encourages member to conserve water, and pass along the information with your employees and residents. Mayor Faulconer releases new budget and proposal to go after bad landlords San Diego Mayor Kevin Faulconer released his proposed $3.2 billion city budget for FY 2015-16 on April 13. The budget asks for expanding operation hours for city recreation centers and libraries, and paving 1,000 miles of roads over the next five years. The city predicts the city’s revenue will rise from property taxes, and transient occupancy taxes - the mayor RentalOwnerMay 2015 | 13 also proposes to update nine community plans. Also in the Mayor’s budget is the addition of four new code enforcement officers to tackle problem landlords. Responding to recent news articles about a landlord who faced numerous complaints from his tenants regarding substandard housing and habitability issues, Faulconer promised that he would target problem landlords who are not complying with local and state law. The new officers will be sent out to investigate complaints – cost for the positions will be $333,891. If the Council's Budget & Government Efficiency Committee approves the proposal, it will be voted on by the full council this June. Again, the SDCAA strongly encourages owners and property managers to comply with city codes and statewide habitability standards. The billing provider under contract with El Cajon was not prepared to handle the task and as a result, the City amassed a serious backlog of sewer billings to its customers. El Cajon is resolving the issue and has been mailing the delayed sewer bills to customers to get up to speed. The City is encouraging their customers to pay their delayed sewer bills in full as soon as possible using a new incentive. El Cajon is currently offering a one-time financial incentive to all of its customers to get their past due sewer billings paid in full. Customers that have received all of their delayed sewer billings and pay the total balance within 30 days may contact the city and request a 5% discount on the total delayed charges. The answer may come in the form of a practice that the City of San Diego has been on the forefront of-making tenants responsible for water usage. Not only will this protect your bottom line from rate increases, it will promote significant conservation. As detailed below, when a tenant pays for water, he uses up to 39% less. This type of decrease in water consumption may prove significant enough to protect your property from penalties and increased rates that are likely to be imposed on buildings that are not able to conserve. The State, and most local cities and water providers, have or are in the process of implementing water restrictions that will affect your property. These range from restrictions on irrigation, car washing, fountains, etc. You may be limited in watering landscaping on certain days of the week and at certain times of the day. Unless we see the skies open up with rain, these restrictions are only going to increase. A current list of City enforced water restrictions can be found at www.sandiego.gov/water/conservation/ drought/prohibitions.shtml costs is almost universally lauded as a significant conservation tool. Government agencies across the country have studied this phenomenon and have concluded that submetering (and other forms of billing) result in unmatched conservation benefits. For example, citing water conservation as an effective response to rising water shortage risks, the EPA acknowledged submetering as an “effective but little-used tool to support water conservation” (EPA, 2003). In addition, the EPA noted, “the use of submeters to measure water consumption is a necessary prerequisite to achieving full cost and conservation pricing” (EPA, 2003). Written by Industrial Economics, Incorporated for the National Apartment Association and the National Multi-Housing Council, the study “Submetering, Rubs, and Water Conservation” provides that tenants who pay for the will use less, reporting that submetered properties used 18-39 percent less water than those properties that billed water service in rent. San Diego fully adopted this approach in 2010 when it approved the San Diego Submetering Ordinance. Recognizing that almost 50 percent of the city’s population live in multi-family or mixeduse buildings that are not separately metered, the Submetering Ordinance requires the submetering of all new construction post June 1, 2010. California is not far behind as the legislature is now attempting to mandate water submeters on new construction (see Senate Bill 7). Under an occupancy rubs method, for example, tenants pay for water and sewer costs based on the number of occupants in their units compared to the number of occupants at the property. The less water all tenants use, the lower the costs should be for all units. • Although you can currently use any reasonable allocation method agreed to by your tenants, it is important to note that methods solely based on square footage have been banned in Texas and other areas. Occupancy based rubs method have therefore become much more common in our City. • Knowing that their actions can lower their water bill, tenants are much more likely to take shorter showers, combine laundry loads and notify management of leaks or running toilets (which will also help you with long term maintenance issues). The NAA/NMHC study referenced demonstrated that rubs properties use up to 27% less than properties where tenants do not pay for water. Note, such savings have NOT been found in flat rate billing programs and such programs are often discouraged. A tenant needs to know that his consumption behavior can affect his bill (and this connection is missing with flat rate billing programs). As you can see, almost all properties can utilize some sort of water billing program. The next question you should ask is “how do I implement such a program?” The good news is tens of thousands of units in San Diego already use such programs, some of which have been in place for over 20 years. Any billing program should be described specifically in the lease and agreed to by the tenant. The water bill should contain specific items that are required by the State and the City. Get your staff and residents excited about the programshare the conservation benefits and consider rewarding behavior. Consider implementing a utility management program where your utility billing company will pay, audit and monitor all bills at your properties. This data can often be used to identify leaks or other anomalies at your property. One property was recently able to identify leaks and running toilets with this type of program and reduced consumption by 45%-with a combination of conservation from the tenant billing program and the repairs. The House actually passed a solution to one of the toughest issues they have avoided for years – the Medicare payment standard for doctors – and it appears the Senate will follow suit in just a few weeks. I know you are as shocked as I am at the behavior of our Congress before they left for their spring break recess. Just when you thought they could do nothing more to surprise us, to stop us in our tracks, to make us question all that we know and thought we understood about our legislative process, they do something crazy. They actually brought up, debated and voted on legislation! But wait, there’s I’m reminded of the scene from “A Few Good Men” where Tom Cruise, an attorney who prefers to negotiate plea agreements rather than actually try cases, steps into where his clients will be tried and says, “So this is what a courtroom looks like!” There are members of Congress who really don’t know what the legislative process is supposed to look like since it’s never actually been used during their tenure. Let’s hope this is the start of a new normal for our political leaders. The apartment industry also benefitted from this great awakening in the political process. Two bills of significant importance were passed by one of the two chambers; critical steps toward ultimately becoming law. In the House, the “Tenant Income Verification Relief Act of 2015” was passed under suspension of the rules, meaning that the support was so strong that only a voice vote was necessary. This legislation would reduce the administrative burden under the Section 8 Housing Choice Voucher program by requiring income verification every three years instead of annually for voucher holders who are on fixed incomes. Miraculously, this bill has the support of both property owners and tenant activists and we hope that an equally quick path can be found in the Senate. In the Senate, the “Energy Efficiency Improvement Act” (also known as “Tenant Star”) passed the Senate by voice vote at the very end of a marathon debate on the federal budget and immediately before the chamber adjourned for the spring break recess. This legislation directs the EPA to create an incentive similar to its Energy Star program for use by tenants in commercial real estate. This marks the first time the issue of split incentives in energy efficiency between building owners and tenants has been addressed. The 2015 NAA Capitol Conference also took place this past month and the apartment industry once again showed its power and broke all previous records for lobby day participation. Four hundred RentalOwnerMay 2015 | 21 owners, operators, property managers, C-suite executives, suppliers and affiliate staff stormed the Hill and lobbied Congress on enhancements to the Section 8 program, reform of the nation’s tax system and needed federal leadership on immigration. An estimated 250 to 300 Congressional offices were visited over the course of the day which is an impressive show of force for any industry. It’s worth noting that the Tenant Income Verification Relief Act mentioned above and passed by the House was a specific bill on which the apartment industry lobbied during the Capitol Conference. Grassroots advocacy works! Of course, we will wait to see if this new found collegiality leads to other legislative successes for the Congress. There are plenty of hills left to climb, some symbolic, some substantive. For example, the House and Senate Republicans will have to reconcile the differences between their two budget blueprints. The budget has no force of law but does guide the activities of the appropriations committees and so issues like how much to spend on defense versus how much to sacrifice to the national debt reduction gods will be at the forefront. On the other hand, the nation’s debt limit is a real thing. We actually reached our borrowing limit in early March, but the Treasury Department has several measures it can take to keep us afloat for several more months. Still, this cannot go on forever and Congress will have to increase that limit at some point in the very near future. 22 | RentalOwner May 2015 One issue with a firm deadline is the Highway Trust Fund. This is the pot of money that is used to pay for federal and state infrastructure – roads, bridges, rail, ports and a lot more – and it runs out on May 31. Congress needs to agree on how to replenish the fund – increase the gas tax, place a one-time levy on untaxed foreign earnings or as part of broader tax reform. It also needs to find a way to get a longterm deal in place to increase the certainty in the system. This will not be easy and will be the next major test of the ability of Congressional leaders to thread the needle and move critical legislation that the country desperately needs. RentalOwnerMay 2015 | 39 New Water Heater Regulations for Southern California By Susan Adams, ASAP Drain and Plumbing M ore stringent energy efficiency standards for residential hot water heaters have just taken effect. All DHW heaters manufactured for use in the United States after April 16, 2015 must meet new U.S. Department of Energy requirements. So they actually apply throughout the country. What does that mean for me? For the next few months, nothing; it will take that long before existing inventories are sold. After that, if you need a new heater you can expect to pay a bit more (actually a lot more if you're replacing an electric unit) and you may have trouble accommodating a bigger unit because of it's thicker insulation. If you're on a tight budget and need a replacement, now is the time. But remember you'll be trading lower up-front costs for higher energy bills for years to come. Let's look at the requirements, and discuss some options that you have for after the new regulations have taken effect and old inventories are gone. High Efficiency Water Heater Regulations Water heater efficiency improvements are just a part of a broader heatingperformance law with significant longterm economic and ecological benefits. Over the next 30 years they are projected to deliver $10 billion in energy savings and keep 164 million tons of carbon dioxide out of the air. Plus there will be reductions in mercury and nitrogen oxide emissions. 40 | RentalOwner May 2015 All together it's the equivalent to taking some 46 million cars off the road. But you keep your car! For many people the changes will be minor. If your current heater has a tank smaller than 55 gallons a replacement will have more insulation and be a few inches taller and a few inches wider. For these smaller heaters initial costs are expected to increase 15 to 35%. For units with 55 gallon and larger tanks the required changes go much further. Gas fired heaters must incorporate a special condensing tank, at a significant extra cost. Replacing an electric heater requires a whole new technology. Nearly all existing electric DHW heaters use electric resistance -- a simple element similar to the burner on an electric stove. Electric water heaters manufactured after April 16, 2015 must use heat pump technology. That's a bit like an air-conditioner run backwards, and can cut electricity use in half or even more. But heat pump units can cost as much as three times more. You'll still have plenty of hot water, and if you're able to go below a 55 gallon tank your cost savings could be very significant. Tankless Water Heaters Another option is to get rid of the tank completely. A tankless water heater heats water only as you use it and is very small. They're often installed right at the point of use so you get instant hot water without waiting for it to run from the heater through your pipes. They can often cut energy use in half. Gas-fired tankless water heaters have lower energy costs but require special venting as part of their installation and require annual maintenance. Electric units have relatively low installation costs and negligible maintenance costs. If your current water is in a small closet or outdoor locker and barely fits, your biggest expense may actually be "remodeling" to accommodate a larger heater. Limited Space? Here are a couple of options if your main difficulty is limited space. • Reduce the tank size and use a higher-output burner. • Reduce the tank size, set the thermostat higher, and install a mixing valve for safety against scalding. How do I do A Yes, the landlord may provide a 30 Day Notice of Change of Terms of Tenancy stating the security deposit is increased to the new amount. Now there are exceptions. As for example, the resident must not be in the middle of their lease term. If the resident is on a month-to-month agreement, the landlord simply provides a 30 day written notice. Remember that the maximum security deposit (adding all 48 | RentalOwner May 2015 security deposits together) a landlord may charge is two times the monthly rent for an unfurnished apartment or 3 times maximum the monthly rent for a furnished apartment. Q What is considered regular wear and tear for carpets? The carpet had been in the unit for five years prior to the current tenants, but it was in great condition, now it is full of stains, can I charge the full costs since I will need to replace the carepet? A No, you will not be able to charge the outgoing residents the full replacement cost of the carpet. You may not obtain a windfall. If the prior residents maintained the carpet in great condition that is great for them and you. If they would have stayed you might still see some life in that carpet. Five years is typically the life, expectancy of carpet. But I would check with your carpet vendor and ask them for the life expectancy of the particular brand and model of the installed carpet. If the life expectancy is 5 years, then the usefulness of the carpet has met its life. You will not be able to charge the outgoing residents for the new carpet. If the life expectancy is 7 years, and the carpet cannot be cleaned but must be replaced, you may then charge the outgoing residents for an additional 2 years of carpet life. That is, you may charge the outgoing residents 29% of the cost of the damaged carpet. You had expected to obtain another 2 years worth of life of the carpet...
