Youth under the age of 21 charged with possession of alcohol face the following: Fines of $470 or more or 30 days in jail Loss of SC Drivers License for 120 days and possible loss of scholarships S.C. Code 63-19-2440-50 What are my options if I get caught with Alcohol and I am under 21? Youth under 21 charged with possession or other related alcohol charges may be allowed to enter a Diversion Program entitled Alcohol Education Program which allows the charges to be dismissed and the youth can apply to have their record cleared. In Spartanburg County, the Alcohol Education Program requires the following: • 8 hour educational class • Enrollment with the Spartanburg Solicitors Office • Alive @ 25 • 20 hours of community service Minors can or may be denied the opportunity to enter a Diversion Program. The only approved Diversion Program that allows youth to clear a criminal charge must be administered through the Solicitors Office SOUTH CAROLINA ALCOHOL LAWS FOR SELLERS AND SERVERS 1. It is against the law to sell any alcoholic beverages to anyone under the age 21. Failure to require identification to verify age will be used as evidence of the willful violation of the law SOUTH CAROLINA KEG REGISTRATION LAWS Section 64-4-50. Section 61-6-4080 2. Merchants and Servers can face civil liability (law suits) for providing alcohol to minors and/or for over- service to patrons 3. Drink specials often offered during “Happy Hour” can not be reduced less than 50% the regular price of that beverage.
