Mumbai: The recent Fire episode
which took the life right from
the Chief Fire Officer, Second and
third in command of the Mumbai
Fire Force Fire and the case of City
Kinara Restaurant, Kurla which
took eight young lives, was a heartwrenching scene at Ghatkopar’s
Rajawadi hospital. In all these case
major reason for fire is the careless
attitude and neglect of fire safety
advisory by the people who manage
the hotels and establishments.
In most of the fire cases it is
evident that the fire is spreading
through AC duct and improper
installation and illegal connections
which in turns, lead to serious fire
hazards. As the rubber hose which
used to connect the cylinder and
gas stove often catches fire due
to faulty tubes. The gas pipe gets
melted and gas leaked into the all the members in the matters
air-conditioned room and the fire concerning safety of the employees
and patrons said President Shri
Adarsh Shetty.

Section 33A of Mumbai Police and
instructing the Mumbai Police to

Supreme Court Allows Dance Bars To Reopen In Mumbai

NEW DELHI: Dance bars
will be back in business soon
in Maharashtra following the
Supreme Court’s stay on a law
banning dance performances in
bars, hotels and restaurants in
the state.
However, the court did give
power to licensing authorities
to regulate indecent dance
performances. It said that the
state must ensure that the dignity
of women artists is protected.
Maharashtra’s law - that
banned dance performances
-- was very similar to a
previous law that was declared
unconstitutional by the apex
court, said a bench of Justice
Dipak Misra and Prafulla C Pant.
The apex court had, in 2009,
struck down a similar law saying
that banning dance performances
was unconstitutional. After that,
the state government passed
another law in 2014 with similar
provisions.
The court however added a
rider to its interim order and
allowed the licensing authorities
in the state to regulate indecent
dance performances at bars and
other places.
“However, we have a rider that
no performance of dance will
be remotely expressive of any
kind of obscenity…The licensing
authority can regulate such dance
performances so that individual
dignity of woman performer is
not harmed,” the bench said.

Tushar Mehta, appearing for
Maharashtra said at the outset
that interim relief may be
granted to the Association and
added that 2014 amendment in
the Act is distinct by its nature.
The Maharashtra government
had brought an
amendment
in
2005 — the Bombay
Police Act — which
was
challenged
in high court by
an asso
ciation
representing
restaurants
and
bars.
The Bombay High
Court on April 12,
2006 had quashed
the
government’s
decision
and declared the provision as
unconstitutional saying that it
is against Article 19(1)(g) (to
practise any profession, or to
carry on any occupation, trade or
business) of the constitution.
However, the state government
had moved the apex court against
the high court’s order that same
year.
On July 16, 2013, the Supreme
Court upheld the Bombay High
Court verdict quashing the
state government’s order and
had said that the ban violated
the constitutional right to earn
a living. The state assembly
however, on June 13, 2014,
passed the
Maharashtra Police (second
amendment)
Bill
which
prevented licenses for dance
performances in three star and
five star hotels.

Hotel City Kinara fire incident an eye opener
MUMBAI: The recent fire incident in which
eight promising young lives from seven of
them from Don Bosco College were lost due to
the fire in Kurla restuarant; an urgent college
project submission proved a blessing for their
friends, who were about to join them for
lunch.
Hotel City Kinara a Chinese food joint
located opposite Holy Cross School, around
1.30 p.m. While the restaurant had a valid
eating house licence, locals claimed that the
mezzanine floor, where the fire broke out,
was illegal. The deceased were seated on the
mezzanine floor, which was used as a family
seating room.
The police findings about the cause of
fire lead to two cylinders on the mezzanine
floor. One of them was empty. Gas was
being supplied to the ground floor through a
pipeline. Prima facie, it appears that the pipe
developed a leak and caused a spark. The fire
then spread all over the restaurant,” said a
fire official. The victims were taken to BMCrun Rajawadi hospital, where they were
declared dead on arrival.
The tragedy could have been worse as
many students were at the college. The
ground-plus-one-storey
restaurant
was
old and crowded, but its inexpensive menu
appealed to most students struggling with
shoestring budgets.
Expensive food at the canteen had, in fact,
pushed many other students to eat at the
more economical City Kinara.
The conclusion is that most of the fire and
ceiling collapse happening due to improper
fitting of furniture and fixtures.
AHAR as a responsible organization has
advised its members to get timely fire
and electric audit and display the same
prominently at a visible location that the
eating house is fire compliance.
BMC action on Restaurants
The BMC has initiated
action in most of the wards
where it demolished illegal
extensions of hotels and
seized unauthorized gas
cylinders and unguarded
items that can be fire
hazardous. They have
also taken action for not
exhibiting licences, lack of
NOC from fire department
& health licences, seized
counters of Pav Bhaji in
front of the restaurants.
The BMC has also been demanding
NOC from Environment dept. While
the Environment dept. says that they
have stopped issuing NOCs since last
few years.
In these circumstances AHAR has
asked all its members to strictly
follow the guidelines issued by Fire
