LRANY’s members include local and national businesses, entrepreneurs, healthcare providers, and taxpayers from across the state. Executive Summary This report analyzes spending by trial lawyers on state-level elected officials between January 1st, 2013 and December 31st, 2013. The report builds upon LRANY’s 2012 report, which is available at http://www.nylawsuitreform.org/wpcontent/uploads/2011/04/Trial-Bar-Campaign-Finance-Report-2012.pdf. This report relies on publically available information to examine the three main components of monetary influence: - Lobbying expenditures Campaign contributions by trial lawyer political action committees (PACs) Independent campaign contributions by law firms and lawyers Lobbying PAC Lawyers and Law Firms Influence 3 Notes on Political Influence in New York This report expresses influence as a product of lobbying and campaign contributions. While both mechanisms are commonly used to influence elected officials, they differ in several key respects. Lobbying is defined, broadly, as activities meant to influence the passage or defeat of any legislation by either house of the state legislature or approval or disapproval of any legislation by the governor. Lobbying, in short, involves legislation, orders, and rules. All persons or organizations which spend more than $5,000 in any given year must register as a lobbyist with the Joint Commission on Public Ethics (JCOPE) and disclose all lobbying-related spending publically. There is no monetary limit on lobbying spending in New York. Campaign contributions are defined, broadly, as expenditures expressly made to impact the outcome of an election of a public official. All campaign contributions are reported to the state Board of Elections. In New York, individuals and limited liability companies (LLCs) may make up to $150,000 in political contributions annually, incorporated businesses and nonprofits may contribute up to $5,000, and partnerships may contribute up to $150,000 per individual partner.1 Campaign contributions by special interest groups are typically made through an associated political action committee (PAC). The New York State Trial Lawyers Association operates the LAWPAC committee, and the New York Academy of Trial Lawyers operates the ATL PAC committee. These committees and their related organizations are used interchangeably in this report for purposes of convenience and clarity. It is important to bear in mind three important points about this data. First, this report analyzes only the monetary inputs2 into state politics – the report does not attempt to quantify the outputs resulting from or attributable to such activity (for example, the enactment of legislation which is beneficial to trial lawyers). Second, this report does not analyze mechanisms of influence which are not quantifiable in monetary terms or not publically disclosed. Lastly, this report assumes that elected officials’ sources of outside income, for example serving “of counsel” to a law firm, are legitimate.3 1 Because most law firms are organized as partnerships rather than corporations, their ability to make campaign contributions is substantially higher than other businesses of comparable size. 2 The reader is cautioned not assume that such monetary contributions are indicative of a quid pro quo arrangement between the contributor and the elected official. 3 On July 2, 2013, Governor Andrew Cuomo appointed the “Commission to Investigate Public Corruption” under the Moreland Act and Executive Law Section 63(8) to probe systemic public corruption in New York State. The Commission issued subpoenas seeking information on the clients of lawyer-legislators. However, as part of the 2014 Executive Budget negotiations, Governor Cuomo agreed to terminate the Commission before this investigation was concluded. 4 Summary of Findings Lobbying In 2013, the two trial lawyer special interest groups, the New York State Trial Lawyers Association (NYSTLA) and New York Academy of Trial Lawyers (NYATL), spent a record high $1,147,139 lobbying New York elected officials, representing a 9.7% increase over the previous year and a 37% increase since 2010. Campaign Contributions In 2013, trial lawyers as a whole1 made $1,280,639 in political contributions to state elected officials, including: - $500,085 from NYSTLA and NYATL political action committees $780,608 from individual trial lawyers and law firms associated with NYSTLA and NYATL In 2013, NYSTLA, the larger of the two trial lawyer special interest group in New York, contributed $457,685 to the campaigns of 69% of all the members of the legislature, including: - 79% of the Senate 65% of the Assembly In 2013, NYSTLA contributed $319,600 to party committee accounts: - $102,300 to the Democratic Assembly Campaign Committee $50,000 to the Democratic Senate Campaign Committee $102,300 to the Senate Republican Committee $25,000 to the Republican Assembly Committee $40,000 to the Senate Independent Democratic Conference committee In 2013, trial lawyers as a whole contributed $747,750 to statewide office campaigns, including: - $451,750 to gubernatorial candidates $265,750 to Attorney General candidates $30,250 to Comptroller candidates 1 Includes NYSTLA’s LAWPAC, ATL PAC, and contributions by individual trial lawyers associated with these groups. For more information see the “Methodology” section on the following page. 5 Methodology Sources Data for this report was aggregated from publically available reports. Figures for lobbying expenditures were obtained from the Joint Commission on Public Ethics (JCOPE), and totals for campaign contributions were calculated using New York State Board of Elections campaign finance disclosure reports. Total lobbying dollars were calculated as the sum total of all “reportable lobbying expenses” and “reportable lobbying compensation” reported on the JCOPE Client SemiAnnual Reports of the New York State Trial Lawyers Association and the New York State Academy of Trial Lawyers. Total trial lawyer PAC campaign contributions were calculated as the sum total of all campaign contributions to candidates by the two trial lawyer political action committees, LAWPAC and ATL PAC. In terms of total dollar contributions, LAWPAC is the dominant committee by an overwhelming margin. In the cases where ATL PAC did not make political contributions, only contributions by LAWPAC were analyzed. Contributions by law firms and lawyers were calculated by identifying contributions made to candidates by individuals and firms who also contributed to LAWPAC and ATL PAC. This process of reverse engineering contribution data is detailed in the graphic below, with the red arrow representing the contributions identified in this component. 6 Findings Lobbying Aggregate reported lobbying expenditures between January 1, 2013 and December 31, 2013 totaled $1,147,139, which includes $1,057,139 for NYSTLA and $90,000 for NYATL. This represents a 9.7% increase over the previous year and a 37% increase since 2010. This was the first year on record during which NYSTLA spent over $1 million on lobbying. Lobbyists In 2013, NYSTLA spent a total of $950,217 to retain three contract lobbyists and employ nine registered lobbyists on staff. NYATL spent $90,000 to retain one lobbying firm. Patrick Jenkins Self-employed Compensation Focus $300,000 Executive Branch $400,000 Senate Summary NYSTLA pays this former congressional wife a substantial sum to lobby the Governor. Former Chief Counsel to indicted Senator Majority Leader Joe Bruno, Riddett only has one client and his primary focus is the Senate. $95,000 NYC/Minority Paid to focus on NYC and sway the powerful Black and Hispanic Caucus, Jenkins publically discloses Caucus only that he is lobbying on “legislation.” New York State Academy of Trial Lawyers Lobbyist Compensation Focus Evan Stavisky Parkside Group $90,000 Medical Malpractice Summary Son of a sitting New York state senator, Stavisky represents the NY Academy of Trial Lawyers, and focuses heavily on medical malpractice issues. Campaign Contributions Total campaign contributions by trial lawyers between January 1, 2013 and December 31, 2013 totaled $1,280,693, which includes: - $487,185 from LAWPAC $12,900 from ATL PAC $780,608 from individual lawyers and law firms 7 Exploring the Influence Overview This section explores, to the extent possible, the recipients of trial lawyer money. Lobbying expenditures are not attributed to individual elected officials - only campaign contributions have traceable beneficiaries.1 Therefore, this analysis focuses on campaign contributions by PACs and individual law firms and lawyers. Executive Branch New York’s three elected statewide positions – Governor, Attorney General, and Comptroller – serve four year terms and are not subject to term limits. Governor/Lieutenant Governor In 2013, LAWPAC contributed a total of $10,000 to Governor Andrew Cuomo. ATL PAC did not make any contributions. Individual lawyers and law firms affiliated with NYSTLA and NYATL contributed $441,750. Attorney General In 2013, ATL PAC contributed $1,000 to Attorney General Eric Schneiderman. LAWPAC did not make any contributions. Individual lawyers and law firms affiliated with NYSTLA and NYATL contributed $264,750. Comptroller In 2013, LAWPAC contributed a total of $19,500 to Comptroller Thomas DiNapoli. ATL PAC did not make any contributions. Individual lawyers and law firms affiliated with NYSTLA and NYATL contributed $10,750. 1 Lobbying reports disclose which bodies the organization has lobbied, and the number or description of any specific legislation or regulation lobbied. During 2013, both NYSTLA and NYATL reported that they lobbied the Governor and both houses of the state legislature. 8 Party Committees In addition to contributing to campaigns directly, NYSTLA also supports candidates by making contributions to party committees. These committees may receive up to $102,300 annually1 per individual or partnership, up to $5,000 annually from a corporation, and may make unlimited contributions to candidates. Between 2006 and 2013, LAWPAC made substantial contributions to party committees, frequently reaching the legal maximum. Limits vary by year. 9 The Legislature Much of the New York State Trial Lawyers Association’s campaign contributions are directed to members of the legislature. In 2013, 69% of state legislators received campaign contributions from LAWPAC, totaling $457,685. Legislative Committees All legislation must be reviewed by the appropriate legislative committees before being considered for a vote by the full house. Our analysis of campaign finance data reveals that NYSTLA makes substantial campaign contributions to the committees which consider legislation relating to civil law (Judiciary and Codes, in the Senate and Assembly), as well as the powerful Rules and Finance/Ways and Means committees. The graphics on the following pages highlight the extent of these contributions for the respective committees during the 2013. 10 Rules Committees The Rules committees are chaired by leaders of each house, the Senate President Pro Tempore and the Assembly Speaker respectively, and are populated by the senior members of each party. The Rules committees have broad influence over the flow and passage of legislation. Accordingly, a majority of the members of the Rules committees receive campaign contributions from NYSTLA. Senate Rules Received contributions from LAWPAC and/or ATL PAC Assembly Rules Received no contributions from LAWPAC or ATL PAC Finance Committees The Senate Finance committee, and its equivalent, the Assembly Ways and Means committee, are responsible for approving all legislation which has a fiscal impact on the state. These committees are also responsible for reviewing the Governor’s Executive Budget and proposing changes. The Finance and Ways and Means committees are chaired by senior members, and like the Rules committees, receive substantial contributions from NYSTLA. Senate Finance Received contributions from LAWPAC and/or ATL PAC Assembly Ways and Means Received no contributions from LAWPAC or ATL PAC 11 Judiciary Committees The Judiciary committees are responsible for considering legislation which affects the civil practice law and rules. As these committees focus on legislation which directly impacts the practice of law, members of these committees frequently receive sizeable campaign contributions from NYSTLA. These committees also occasionally consider legislation with civil impacts as well. Between January 1, 2013 and December 31, 2013, the individual lawyers and law firms made $780,608 in political contributions to state-level candidates. The data indicates the following: - - - Trial lawyers are a highly influential special interest group in state-level politics, as evidenced by the high overall level of spending on lobbying and campaign contributions. Aggregating individual contributions by NYSTLA and NYATL contributors reveals that the trial lawyer political influence is far greater than is commonly reported – these contributions are more than double the total monetary contributions by lawyer political action committees. NYSTLA has sufficient resources to seek influence in a targeted manner through contributions to key leaders and legislative committees, and in a broad manner through contributions to a majority of the legislature as a whole. While this report does not explore the specific outcomes of trial lawyer political and lobbying spending, the scale and scope of the spending shows that trial lawyers as a whole expend considerable resources to promote their agenda of increasing profits for their members.
