SUMMARY
Economics
The State Treasury deposited $2,821,899,58 into the State General Revenue Fund directly from parimutuel wagering taxes from Fiscal Year (FY) 2004, a 1,04% increase from FY 2004, Total direct collections of
$81.182,522,52 from such taxes have been deposited to the State General Revenue Fund since Blue Ribbon
Downs, Oklahoma's first pari-mutuel racetrack, began racing on August 30, 1984 (15 months after the
Oklahoma Horse Racing Act was implemented),
Revenues to the Horse Racing Commission, apart from the pari-mutuel tax during FY 2004, for deposit
to the State General Revenue Fund were derived principally from fines, sale of Rule Books, and occupation and
organization license fees, In addition, local and county governments, and the State received racing revenues
from racetrack admission, sales, and property taxes,
Such taxes are collected by the Oklahoma Tax
Commission, A detailed accounting of Commission Revenue and Expenditures for FY 2004 is listed on pages
33 and 34 of this report,
Oklahoma State University (OSU) has reported the State horse population at approximately 400,000
which equates to one horse per 8,25 people, This ratio has established Oklahoma as the leading state in
horse population per capita,
As a result of a four-year study conducted by its departments of agricultural
econom'lcs and animal science, OSU released the following information on April 1. 1997 entitled OSU Current
Report-3918 A Demographics and Economic Impact of the Horse Racing Industry in Oklahoma,

Oklahoma'S combined horse racing enterprises make up an extremely large and important
contribution to the state's economy,

Economic demand based on the combined racetrack, production, and fan sectors of Oklahoma's
race horse industry total nearly $332 million,

42,000 horses are estimated to be involved in Oklahoma race production and use,

Owners of Oklahoma racehorses total about 3,700 persons, with average investments of
$250,000 in land, buildings, facilities, equipment, and animals, The 1,850 persons identified as
racehorse trainers had average investments of $183,000 in land, faCilities, machinery, tack, and
animals.

Gross state product for the combined racetrack production and fan sectors totaled nearly $189
million, Employment estimates suggest that these enterprises account for a combined total of
more than 11,800 full-time equivalent jobs,
Horse racing activities are only one of several equine-related enterprises in Oklahoma,
According to an
American Horse Council (AHC) study, estimates of the national horse industry's effect on the Oklahoma
economy suggest a $3,3 billion effect. The Oklahoma horse industry was estimated to produce goods and
seryices of more than $760 million during the AHC study period, The AHC study estimated that more than
214,000 Oklahomans are involved in the industry as owners, service providers, employees, and volunteers not
including the spectator effect of the industry,

Legislation
During the Second Session of the 49 th Oklahoma Legislature (2004), The State-Tribal Gaming Act,
Senate Bill 1252, passed through the Legislature and was signed by Governor Brad Henry.
Provisions of
Senate Bill 1252 required that, before the Gaming Act could become a law, a public referendum, Legislative
Referendum 335, State Question 712 would have to be passed. State Question 712 passed by a nearly 60%
to 40% margin in the General Election held November 2, 2004 and became effective law November 9, 2004
on certification of the election results. Among the provisions of the Gaming Act, Remington Park, Blue Ribbon
Downs and Will Rogers Downs are allowed to offer "authorized games" at their respective racetracks.
In
addition, Fair Meadows at Tulsa, although not allowed to conduct gaming, could become a "Recipient
Licensee" and thereby receive revenue for Fair Meadows and horsemen's purses from tribal gaming occurring
within 20 miles of Fair Meadows. The Horse Racing Commission is required by the Gaming Act to provide
regulation, implementation and enforcement of the authorized gaming at the racetracks.
Races. Purses. Incentives
Calendar Year (CY) 2004 was the twenty-first year of pari-mutuel horse racing in Oklahoma. The Office
of the Oklahoma State Auditor and Inspector reports that there were 136,993 official races (+14%) including
135,322 simulcast races (+15%) conducted by the three Commission-sanctioned pari-mutuel racetracks, on
which 425,428 race fans (-6%) wagered $127,197,354 (-9,4%). Attendance at organization licensees' offTrack wagering facilities in Oklahoma is not recorded by the racetracks and therefore not included in the above
attendance figure. The percentages of change shown above are in relation to CY 2003.
Wagering on simulcast races amounted to 73% of the total wagering conducted under the
Commission's authority.
Remington Park conducted 55,197 races (including 54,318 simulcast races), on which $71,005,856
was wagered. During 93 days of live racing $28,942,074 was wagered and during 176 simulcasting only days
$42,063,782 was wagered including $22,039,714 wagered at Remington Park's Off-Track Wagering facilities.
Horsemen at Remington Park ran for purses and stakes of $7,223,109 of which the percentages designated
to horsemen's purses from pari-mutuel wagering takeout totaled $5,464,564.00.
The balance of purses
consisted of added money, including nomination payments from prepayment races and $443,585 OklahomaBred purse supplements.
Blue Ribbon Downs at Sallisaw conducted 40,818 races (including 40,388 simulcast races) on which
$11,496,524 was wagered. During 61 days of live racing, $12,272,165 was wagered and during 278
simulcasting only days $7,099,594 was wagered. Horsemen at Blue Ribbon Downs ran for purses and stakes
of $1,706,040. of which the amount designated to horsemen's purses from pari-mutuel wagering takeout
totaled $964,003.62. The balance of purses consisted of added money, including nomination payments from
prepayment races and $172,490 in Oklahoma-Bred purse supplements.
The Tulsa Public Facilities Authority conducted the 8-day Tulsa County Fair Race Meeting at Fair
Meadows at Tulsa.
During this fair meet, 3,094 live races and simulcast races were conducted on which
$4,322,833 was wagered. Horsemen at the Tulsa County Fair ran for purses and stakes of $1,263,484 of
which the amount designated to horsemen's purses from pari-mutuel wagering takeout totaled $1,027,530.

The balance of purses consisted of added money, including nomination payments from prepayment races and
$80,780 in Oklahoma-Bred purse supplements.
The Tulsa Public Facilities Authority conducted the 22-day Tulsa State Fair Race Meeting at Fair
Meadows at Tulsa.
During this fair meet, 4,477 live races and simulcast races were conducted on which
$6,422,693 was wagered. Horsemen at the Tulsa State Fair ran for purses and stakes of $3,721,125 of which
the amount designated to horsemen's purses from pari-mutuel wagering takeout totaled $3,055,230. The
balance of purses consisted of added money, including nomination payments from prepayment races and
$177,780 in Oklahoma-Bred purse supplements.
During 260 simulcasting only days at Fair Meadows, (January 1. 2004 through December 31, 2004),
33,416 simulcast races were conducted on which $33,949,452 was wagered and $2,454,271 was generated
towards purses. The total wagered at Fair Meadows for CY 2004 was $44,694,978.
Combined purses and stakes (including Oklahoma-Bred purse supplements) earned during CY 2004
at the three Commission-licensed racetracks totaled $14,788,393. A strong incentive to horse breeding in the
State was provided through purse supplements awards totaling $874,635 from the Oklahoma Breeding
Development Fund Special Account earned by accredited Oklahoma-Bred racing stock at Commission-licensed
pari-mutuel facilities during CY 2004.
Broodmare awards earned totaled $473,532 and Stallion awards
earned totaled $214,987.
REPORT
This report reviews general activities of the Oklahoma Horse Racing Commission during CY 2004 and
fiscal activities during FY 2003 (July 1, 2003, through June 30, 2004).
Introduction
State Question 553 (Initiative Petition 315) adopted at an election held on September 21, 1982, authorized
the pari-mutuel system of wagering on horse races in Oklahoma.
The Oklahoma Horse Racing Act, Title 3A, Chapter 2 of the Oklahoma Statutes, was enacted with an
Emergency Provision and became effective March 22, 1983.

Provisions
The seven-member Commission is appointed by the Governor with confirmation by the State Senate
for six-year terms. Initial appOintments allowed for two-year staggered terms. During 2004, Commissioners
and their terms were as follows:

The Oklahoma Horse Racing Act provides that horse racing under the pari-mutuel system of wagering may be
authorized by a majority of voters in a county voting in an election called for that purpose. At least fifteen such
elections have been held.
Voters in twelve counties have voted to authorize pari-mutuel horse racing
(Beckham, Comanche. Creek, Garfield, Lincoln, Love, Marshall, Oklahoma, Okmulgee, Rogers, Sequoyah, and
Tulsa). Voters in Atoka County voted once not to authorize, and voters in Carter County voted twice not to
authorize.
The Oklahoma Horse Racing Commission has plenary power to promulgate rules and regulations for
the forceful control of race meetings held in the State so as to:
i.
Encourage agriculture and the breeding of horses in this State; and
2.
Maintain race meetings held in this State of the highest quality and free of any horse
racing practices which are corrupt. incompetent, dishonest, or unprincipled; and
3.
Dissipate any cloud of association with the undesirable and maintain the appearance as
well as the fact of complete honesty and integrity of horse racing in this State; and
4.
Generate public revenues.
OPERATIONS
Policy
Policy is established by the Commission. Officers and members as of December 31,2004, are listed below:

The Commission held nine monthly meetings during CY 2004.

Administration
The Commission maintains its principal office at 2401 N.W. 23,d Street, Suite 78, Oklahoma City, Oklahoma,
73107. In addition, the Commission maintains license offices at each of the licensed racetracks.
Commission operations were administered through Gordon L. Hare, Executive Director. Mel Webb was the
Commission Director of Law Enforcement. Other agencies of State government which have direct involvement
in Commission operations are the Office of the Attorney General, the Oklahoma State Bureau of Investigation,
the Oklahoma Bureau of Narcotics, the Department of Central Services, the Oklahoma Tax Commission, the
Office of State Finance, the Office of Personnel Management, the Alcoholic Beverage Laws Enforcement
Commission, the Office of the State Auditor and Inspector, and the Office of the State Fire Marshal. There were
15.10 full-time employees (FTE) and 15.8 permanent part-time employees (PPTE) or 31 employment positions
utilized by the Commission during FY 2004.
In addition to full-time employees, the functions of the Commission's permanent part-time employees are
briefly described below:
Stewards: Three Stewards are appointed to be present at each licensed racetrack as a Board of Stewards to
supervise and judge all matters of fact with respect to the conduct of a race meeting and file reports with
the Commission. They are employees of the Commission and responsible ultimately to the Commission.
Official Veterinarian: One Doctor of Veterinary Medicine (D.V.M.) is appointed by the Commission at each
racetrack and is an employee of the Commission. The Official Veterinarian determines which horses are
deemed unsafe or unsound to run; supervises the taking of equine urine and blood samples for drug
testing; supervises the Veterinarian Assistant, the Racing Veterinarian, Test Barn Assistants, Test Barn
Escorts, and licensed veterinarians practicing within the enclosure; and treats horses in the event of an
emergency.
Veterinary Assistant: One Veterinary Assistant is on duty in the Test Barn at Remington Park on allotted race
days and other assigned days to provide support services for the Official Veterinarian.
Horse Identifier: One Horse Identifier is employed by the Commission at each racetrack to ensure proper
identification of all horses starting in a race and to file race reports with the Commission.
Licensing Personnel: One Chief Clerk and Assistant Clerk(s) are on duty at license offices at a racetrack on
allotted race days and other assigned days to fingerprint applicants and to issue and verify occupation
licenses which entitle persons to own, train and ride horses and to perform in other occupations within the
racing enclosure.
Stewards' Clerk: A Stewards' Clerk is on duty in the Stewards' office on allotted race days and other assigned
days to provide support services for the Board of Stewards.
License/Registrv Clerk: A License/Registry Clerk is on duty at either a racetrack or in the Oklahoma-Bred
Registration Department of the Commission office to provide typing, data entry, and clerical support to
Licensing Personnel and the Oklahoma-Bred Registration Department.

Law Enforcement/Occupation Licenses
In CY 2004, the Commission issued occupation licenses to 6,766 persons, including identification
badges, Some 32 classes of licenses were issued (e,g" Owners, Trainers, Owner/Trainers, Jockeys, Grooms,
Mutuel Clerks, and Vendors), In addition, the Commission processed 788 multiple ownership registrations,
Occupation licenses are issued annually except that certain license categories (Owner, Trainer, Owner/Trainer,
Jockey, Apprentice Jockey, Blacksmith, and Veterinarian) may purchase triennial licenses (licenses valid for
three years),
Two FTE licensing personnel were employed in the main Commission office during 2004, In addition
to processing all license applications including those received by mail, these staff members made all computer
licensing database entries.
In order to better serve horsemen and racing in general, these FTE licensing
personnel occasionally assisted in licensing offices at the racetracks.
The North American Pari-Mutuel Regulators Association (NAPRA) consisting of twenty-six member
jurisdictions, maintains a computer-based information service.
This information is accessible to the
Commission through a secured Internet website. The file contains the names, addresses, other identifying
characteristics, and racing rule violation records of persons who have been issued occupation licenses by the
NAPRA member jurisd·,ctions. Since 1984, the Commission has entered Oklahoma data on license issuances,
denials, suspensions, revocations and fines into such a computer file. In this way, data is brought together for
occupation licensees from participating racing jurisdictions which enable the jurisdictions to better maintain
the integrity of racing through reciprocity acknowledgment of a licensee's racing record.
Commission license offices at the racetracks utilize a dial-up computer program which enables
retrieval of license information on a 24-hour basis from the license database at the Commission office in
Oklahoma City and from the NAPRA database, The NAPRA licensing database program provides fast retrieval
regarding licensure and ruling information.
It is also possible to link a specific license with other areas of
activity in which a person may be involved, such as lease agreements, multiple ownerships, or dual licenses.
The Oklahoma Horse Racing Act and the organizational plan adopted by the Commission provides for
a Law Enforcement Division which is responsible for conducting investigations relating to the proper conduct of
horse racing and the pari-mutuel system of wagering, including but not limited to barring undesirables from
horse racing, undercover investigations, fingerprinting persons licensed by the Commission, and reviewing
license applications. A 2004 activity report and some prior year comparisons for the Division follows:

Race Meetings
Except as otherwise provided by Commission rule, applications from organization licensees or
applications for Original Organization License requesting race days are required to be received by the
Commission by June 1, a given year to conduct race meetings in the following calendar year.
The Commission allotted 184 live pari-mutuel race days for calendar 2004.
Aoplications for Organization Licenses
to Conduct Pari-Mutuel Racing and Simulcasting in 2004
The Commission received, investigated, conducted public hearings as required, deliberated and made
determinations regarding applications from the following pari-mutuel organization license applicants to
conduct live race meetings and simulcasting during CY 2004.
1.
Remington Park, Inc., (RP), in Oklahoma County was granted a Conditional Organization License
and allotted 93 live race days for two race meetings in Oklahoma City during 2004, as follows: a
Quarter Horse, Appaloosa, and Paint Race Meeting (28 live race days), and a Thoroughbred
Meeting (65 live race days).

Backstretch, L.L.C., d/b/a Blue Ribbon Downs (BRD) in Sequoyah County was granted a
Conditional Organization License and allotted 61 live race days for two Mixed Breed Race
Meetings in Sallisaw during 2004 as follows: a Quarter Horse, Appaloosa, and Paint Race Meeting
(30 live race days), and a second Quarter Horse, Appaloosa, and Paint Race Meeting (31 live race
days).

The Tulsa Public Facilities Authority in Tulsa County was granted a Conditional Organization
License and allotted 9 live race days for the Tulsa County Fair Mixed Breed Fair Race Meeting at

'Al the November 20, 2003 meeting. the Commission approved Fair Meadows' request that the June 16 race date be changed
to July 14, changing one Wednesday to another Wednesday, to avoid a major conflict with the Tulsa AA baseball team. This
change resulted in the Tulsa County Fair being 8 live race days in length and the Tulsa State Fair being 22 live race days in
length.
2At the March 18, 2004 meeting, the Commission approved Remington Park's request for the cancellation of nine race days
(July 30, 31; August 1, 2, 9; October 2, 9, 16, 23) and the addition of nine substitute race days (October 1, 8, 15, 22, 29;
November 22; December 3, 4, 5) during its Fall Thoroughbred race meeting.

23, and 30) for the first Mixed Breed race meeting due to short fields over a three day weekend, hurting handle and purses for
overnight races.
6Remington Park advised the Commission 7/30/04 that it had inadvertently shown in its advertising and schedules that
Monday, August 9,2004, would be a live race day (rather than deleting it as approved at the March 18,2004 Commission
meeting) and had inadvertently not listed November 22, 2004 (rather than adding it as approved at the March Commission
meeting). The Commission Executive Director approved the requested change in the two days on 8/5/04 rather than place the
matter on the agenda for the next Commission meeting scheduled for August 27 since the meeting will occur after the August
9 live race date and the total number of live race days (65) for the straight Thoroughbred race meeting did not change.

Race meetings generate infractions of OHRC Rules of Racing. Rule violations that occur during race
meetings require Boards of Stewards to conduct hearings, to make Findings of Fact. Conclusions of Law, and
to issue Stewards' Orders. During 2004, Boards of Stewards issued 248 Orders. Of those Orders, one was
appealed or referred to the Commission for Commission determination. Appeals to the Commission, when
they occur, are costly in terms of time and expense to the Office of the Attorney General. as well as to the
Commission and the respondents, but nonetheless provide protection of individual due process rights.

Equine Drug Testing
The Oklahoma City Police Department Laboratory performed all routine equine drug testing for
Commission-sanctioned racing from January 1990 through June 30, 2000, Upon dissolution of the OCPDL
equine drug testing program, Truesdail Laboratories, located in Tustin, California, being the successful state
primary laboratory contract bidder, began performing these drug tests effective July 1, 2001. Texas Veterinary
Lab at Texas A & M University and Industrial Lab of Denver perform split sample drug testing under state
contract. CY 2004 Commission-sanctioned raCing activity resulted in the following 51 positive drug reports,
including 10 Furosemide overages and 25 Phenylbutazone overages,

Oklahoma-Bred Program
(3A O.S., Section 20S et seq.)
Pursuant to provisions of the Oklahoma Horse Racing Act, the Oklahoma-Bred Program is
administered by the Commission and is the State of Oklahoma's financial incentive to the breeding and racing
of accredited Oklahoma-Bred horses.
The Commission authorizes the types and minimum number of accredited Oklahoma-Bred races, as
well as the amounts of added purse money and stallion and brood mare awards paid to recipients.
The
Program is funded through revenue generated by all breakage and unclaimed ticket proceeds from wagering
handle, and from a direct percentage of wagering handle, funds generated pursuant to Legislation enacted in
1991 (SB 198) and continued in 1995 through the provisions of SB 111. Senate Bill 198 and Senate Bill 111
reduced the State's tax percentage of takeout from wagering handle and increased the percentage to
horsemen's purses and to the Oklahoma-Bred Program. 2004 was the twelfth full year in which additional
purse funds were generated in accordance with this legislation.
All Oklahoma-Bred Program proceeds are
remitted directly to the Commission for deposit with the Office of the State Treasurer to the credit of the
Oklahoma Breeding Development Fund Special Account.
Since the first Oklahoma-Bred race was run on August 30, 1984 and through CY 2004, the
Commission has paid added purse money, and stallion and broodmare awards amounting to $37.1 million to
eligible owners of accredited Oklahoma-Bred racing stock, broodmares, and stallions.
The Commission assumed the duties and functions of the official Registering Agency by electing to
bring the Oklahoma-Bred registration process in-house and off state bid contract effective January 1, 1992.
The Registering Agency registers accredited Oklahoma-Bred racing stock, stallions, and broodmares for
eligibility to receive purse supplements and stallion and brood mare awards as authorized by the Commission
from the proceeds of the Oklahoma Breeding Development Fund Special Account. Registration fees for horses
in the Oklahoma-Bred Program, which are among the lowest in the nation, are set by Commission rule and
were deposited by the Commission into the State General Fund through June 30, 1999. SB 1365 amended 3A
O.S. § 208.3 to provide that the registration fees be deposited into the Oklahoma Breeding Development Fund
Special Account, effective July 1, 1999. The following fee schedule was in effect during 2004.

The Commission's Oklahoma,Bred registration department, the official Registering Agency, receives
registration applications, reviews each application for completeness and eligibility, and subsequently registers
qualifying horses into the Program. The Registering Agency also keeps abreast of current breed registries'
requirements (Quarter horse, Thoroughbred, Paint, Appaloosa, Arabian, and Pinto).
During CY 2004, 2,782 (5% increase from CY,2003) horses were registered into the Oklahoma,Bred
Program and during FY,2004 $123,342 (compared to $130,059.75 in FY,2003) in Oklahoma,Bred registration
and ownership transfer fees were collected by the Commission and deposited to the Oklahoma Breeding
Development Fund Special Account. Of the horses registered into the Oklahoma,Bred Program during 2004,
1,827 were Racing Stock, 867 were Broodmares and 88 were Stallions.
All payments from the Oklahoma Breeding Development Fund Special Account to breeders and
owners are made by the Commission, as has been the case since 1984. Upon receipt of race day reports from
the Commission, the Registering Agency verifies the accredited Oklahoma,Bred eligibility of win, place, and
show racing stock and of brood mares and sires of those horses. Upon final Commission verification, claims for
the authorized amount of purse supplements, stallion and broodmare awards are prepared by Commission
staff; and state vouchers (checks) are distributed by the Commission directly to eligible recipient owners and
breeders. During 2004, the Commission processed 5,975 checks to eligible recipient owners and breeders.

In addition to purse supplements, stallion and broodmare awards, statutory authority is provided to the
Commission to authorize monies for equine research through State institutions accredited for same. The
Commission approved a grant to the College of Veterinary Medicine at Oklahoma State University (OSU) of
$45,000.00 from the Oklahoma-Bred Program funds for the Veterinary Medical Diagnostic Program.
The
Oklahoma Horse Racing Act also authorizes the Commission to approve expenditures from the Fund for
marketing, promoting, and advertising the Oklahoma-Bred Program; for the Commission's (State's) costs of
administration of the Oklahoma-Bred Program; and for an annual audit of the Oklahoma-Bred Program
conducted by the Office of the State Auditor and Inspector.

All revenues and expenditures are accounted for through standard State accounting procedures. The
system was designed with the assistance of the Office of State Finance and the Office of the State Treasurer.
The Office of State Auditor and Inspector conducts the annual audit of the Oklahoma Breeding Development
Fund Special Account and Agency Audit.
The Office of the State Auditor and Inspector inspects pari-mutuel wagering machines and audits the
distribution of pari-mutuel wagering handle procedures at Commission-licensed racetracks and Off-Track
Wagering Facilities on behalf of the Horse Racing Commission and furnishes reports to the Commission. The
Tax Commission collects pari-mutuel taxes and sales taxes due the State directly from the racetracks and
provides official reports (excepting sales tax information) to the Horse Racing Commission.
