After many long hours of planning, designing, and picking apart
the old web site, the web site committee is excited to announce that
the Home Builders Association of
Northern Kentucky has a new, userfriendly web site. The site offers
valuable information for both members and consumers in an easy to
navigate format.

There are several improved features offered in the new site.
Our membership database is easily searchable from the home page allowing consumers and other members to find you! Members can log
into Builder fusion by typing in their username and password into the
member login section at the top of the home page. You can also view
and register for any CE class, meeting, or networking event from the
calendar section of the site.
The new site can also now be found using two web addresses. We still have www.hbanky.com, but we are also excited to begin
using www.homebuildersnky.com, which will eventually become our
association’s sole URL.

Is My Granite Countertop Safe?

Have any customers asked you, “Is there radon in my granite countertop?” or “Is my granite countertop safe?” As a granite fabricator, we get asked
these questions every week.
Recent media reports have questioned the safety of granite countertops
for residential installations. Most of these reports are fueled by the manufacturers
of synthetic products and are misleading and untrue.
In response to questions about the danger of radon gas in granite countertops, the EPA addressed this issue and its website states: “At this time, EPA does
not believe sufficient data exists to conclude that the types of granite commonly
used in countertops are significantly increasing indoor radon levels”.
The Marble Institute of America also addressed this issue and reported on
November 17, 2008 that in the largest scientific study of the product ever, it did
not find a single stone slab that poses a health risk. “Quantities of radon and radiation emitted by stones included in the analysis all fell well below average background levels commonly found in the United States. Compared to other radiation
sources in the home and outside, the risk to the home-owner from radioactivity or
radon gas emitted from a granite countertop or tiles is practically non-existent”.

New Lead-Based Paint EPA
Regulations

In April 2008, the federal Environmental Protection
Agency (“EPA”) updated its regulations regarding
renovations that may disturb lead-based paint. The first of
the new regulations became effective December 22, 2008.
Contractors must now educate themselves on the new leadbased paint regulations and adjust their business practices to ensure compliance.
The new regulations cover homes, child-care facilities, and schools that
were built before 1978. The regulations affect home improvement contractors,
maintenance workers in multi-family housing, painters and other specialty trades.
The new regulations contain three main components applicable to contractors working
on affected facilities. Such contractors now have a lead-based paint notification
obligation. Next year, such contractors will also have to meet EPA certification
requirements and protective work standards.
The first of the new regulations requires that a contractor who is performing renovations
in a covered facility must provide the EPA publication Renovate Right to the facility
owners and occupants before beginning the remodeling. The EPA has made this 20page informational pamphlet available for download on its website at http://www.epa.
gov/lead/pubs/renovaterightbrochure.pdf.
The more substantive components of the new regulations take effect on
April 22, 2010. On and after such date, contractors working in affected facilities will
have to be certified through an EPA accredited training course. Such contractors will
also have to follow certain work safety standards designed to eliminate potentially
dangerous practices involving lead-based paint hazards. Those standards include a
prohibition against open flame burning or torching of lead-based paint, a requirement
to post warning signs around the work area, the restriction of occupants from the work
area, the containment of the work area to prevent the spreading of dust and debris, and
the verification of a thorough and effective cleanup.
Applications for EPA accreditation for training providers may be sent to the
EPA as soon as April 22, 2009. Applications to the EPA by contractors requesting
certification may be sent as early as October 22, 2009. Contractors seeking certification
as renovators may begin accredited training as soon as it is available. Contractors will
have to apply for re-certification every five years.
There are several exceptions to the new regulations. The regulations
do not apply to: owner-occupied housing where children under six and
pregnant women do not reside; minor renovations that disrupt six square feet
or less of painted surface per room for interior projects or twenty square feet
or less of painted surface for exterior projects; and renovations determined
not to involve lead-based paint by a certified inspector or certified renovator
using an EPA test kit.
Contractors must immediately comply with the new notification requirement
and should likewise prepare for the upcoming EPA certification requirements and
protective work practices. A violation of the new EPA lead-based paint regulations
could result in penalties of up to $25,000 and/or imprisonment. If you are a contractor
affected by the new regulations, you need to make sure you are providing the required
EPA publication before starting work in an affected facility. You also need to prepare
your organization for the upcoming accreditation and protective work standard
requirements that will go into effect in 2010.

Brian Jones Nominated as National Associate of the Year
Former HBA Associate Council President, Brian Jones, C.K. Ash Insurance, has been nominated for the second time as Kentucky’s Associate of the Year NAHB nominee. He is one of only 50 Associate members throughout the nation to be nominated. He remains a nominee for
5 years and will be considered annually in the selection process.

HBA Recognizes Top Performers
Three members of the Home Builders Association of Northern Kentucky (HBA) were honored at the Organization’s 54th Inaugural Ball
on January 17, at the Drees Pavilion in Covington.
John Yeager, President of Ashley Development, received the HBA’s
Donald M. Wiedeman Lifetime Achievement Award. He served
as President of the HBA in 1992 and Chairman of the Board of the
Northern Kentucky Chamber of Commerce in 2005, and was named
Northern Kentuckian of the Year in 2006. Additionally, John has served
as President of The Point (formerly NKAR), on the Kenton County
Airport Board, St Elizabeth Medical Center Foundation Board, Forward Quest Board and St. Charles Care Center Board. He started Ashley Construction in 1980, which has grown into one of the region’s
largest custom home builders. The firm is also involved in commercial
building and remodeling. The award is named for the HBA’s long-time
executive director.
Dan Corbin, President of Corbin Custom Builders, was named the
HBA’s 2008 Builder of the Year. Known as the HBA’s “go to guy,”
because he has organized or participated in virtually all of the organization’s recent community service projects. Corbin heads one of the
region’s top remodeling companies located in Florence. Over the past
year, his company has coordinated the renovation of the Covington
Garden of Hope, contributing significant amounts of labor and facilitating material donations. Through his tireless efforts, storm- damaged
structures on the site have been rebuilt. His company was also a significant contributor to the HBA’s House of Hope in Ludlow. The new
home is nearing completion and will be provided at no cost to Housing Opportunities of Northern Kentucky (HONK) for a disadvantaged
family. Over the years, Corbin has also participated in the building of
several handicapped ramps for disabled persons in the community.
Cheryl Stegman, owner of Newport-based Stegman Kitchen Showcase, was honored as the HBA’s 2008 Associate of the Year. The Ft.
Thomas resident has served in numerous capacities with the Organization including chairing membership and retention efforts; serving as
president of the Associates Council, and currently as president of the
Women’s Council for Community Action. Stegman has also served on
the HBA’s board of directors, finance and executive committees. She’s
been a frequent participant and facilitator of HBA community service
projects including blood and clothing drives, student scholarship fundraisers and contributions for senior citizens.
Paul Bogenschutz, of Edgewood-based Ashley Construction, was installed as the 2009 President of the HBA during the evening ceremonies.

KY Offers Home Energy Efficiency
Credits in 2009
Homeowners in the Commonwealth are
eligible for up to a $500 tax credit for the
installation of energy-efficient windows,
doors and insulation. Commercial properties,
including office locations, are eligible for up
to a $1,000 credit. The one-time credit can
be applied to the 2009 and 2010 tax years.
Construction of an Energy Star home allows
the taxpayer (builder or owner) to take
an $800 state tax credit. For more details
contact your tax advisor. The energy savings
resulted from passage of HB 2 in the 2008
Kentucky General Assembly, which was
heavily supported by the HBA.
EPA Accepting Comments on New
Stormwater Guidelines
The U.S. Environmental Protection
Agency (EPA) is currently accepting
written comments on the first national
effluent limitation guidelines (ELG). These
guidelines will provide federal requirements
to states on stormwater runoff from
construction sites. Builders and developers
would have to meet EPA’s technologybased “floor” on most sites by installing and
maintaining a range of erosion and sediment
controls that “are generally recognized and
accepted as effective” best management
practices (BMPs). Construction sites
disturbing 10 or more acres of land at a time
on the allowable level of turbidity would
apply to sites of 30 acres or more located
in rainy areas where the soil has high clay
contents. Visit www.epa.gov/waterscience/

submit written comments. It’s anticipated
that the Kentucky Division of Water’s new
general construction permit will be adopted
and become effective for 5 years, allowing
the federal requirements to be delayed until
the DOW permit expires in 2014.
Boone Co. Offers Foreclosure Assistance
Boone Co. hopes to decrease last year’s
34 percent increase in foreclosures by
partnering with the Brighton Center to offer
counseling to those homeowners at greatest
risk. Funds for the program will be provided
by the Kentucky Housing Corp., U.S. Bank
and $17,000 from the Boone Co. Fiscal
Court. The program began on February 1
and will continue until June 30. For more

New HBA Community, Housing and
Land Use Policies Approved
The Board of Directors of the HBA recently
approved amended policy statements,
as recommended by the State & Local
Government Committee. A copy of the

amended document is included as an insert
in the March issue of the Northern Kentucky
Builder magazine. New policies have been
added for Building Codes, Sediment &
Erosion Control, Historic Preservation,
Impact Fees/Property Taxes, Plan Review/
Building Permit Fees, Hillside Development,
State Taxes, Housing, and Fire Sprinklers. A
copy of the new policies can also be obtained
at www.hbanky.com.
New Lead Notice Remodeling Booklet
Copies of the new EPA-required “Renovate
Right” booklet can be downloaded at no cost
from www.epa.gov/lead. Contractors are
required to distribute a copy of this booklet
to any customer who owns a home that was
built prior to 1978. Language addressing
this issue will soon be added to the HBA’s
standard Registered Remodeler contracts.

Owen Co. Judge Executive Convicted
Owen Co. Judge Executive Billy O’Banion
resigned in January after admitting to theft
of services and two counts of first-degree
official misconduct. Charges ranged from
charges of personal ambulance fees to theft
of county training funds. Carolyn Keith,
former Owen Co. Circuit Ct. Clerk, has been
named the new Judge Executive, replacing
O’Banion. She will serve the remainder of
O’Banion’s term which ends in 2010.
Municipalities Apply for Foreclosure
Funds
Several cities in Northern Kentucky have
submitted applications for federal funding
to rehab vacant foreclosed homes. The state
of Kentucky has received $37.4 million.
Newport has applied for $4 million, while
Covington has requested $15.5 million.
Others also plan to make similar requests.
The money can be used to buy, rehab and
sell foreclosed homes. The homes will then
be sold at a reduced price to low-income
families. The Kentucky Dept. of Local
Government is responsible for distribution
of the federal funds.
Union Appoints Planning Commission
Member
Jim Longano has been appointed to a 3-year
term by the City of Union to the Boone Co.
Planning Commission. He replaces Patrick
Reynolds. He is employed by the University
of Cincinnati.

Members of the Boone Co. Planning
Commission have agreed to forgo their
stipend for the first six months of 2009.
Commissioners receive $35 per meeting. The
move will save the Planning Commission
approximately $2,500.
Regional Consensus Committee
Appointment
Adam Chaney, Chairman of the HBA’s State
&Local Government Committee, has been
appointed to serve on the 2009 Northern
Kentucky Consensus Committee. This
committee is responsible for prioritizing
and recommending regional capital projects
for funding to the Northern Kentucky
Legislative Caucus.
New Boone Co. Building Permit
Requirement
The Boone Co. Building Dept. now
requires a separate permit for each unit in a
condominium building. This will allow the
agency to issue a certificate of occupancy
for each completed unit, rather than waiting
for the entire building to be completed.
This change does not apply to multi-family
buildings or duplexes used for rental

NAHB’s Green Building Standard
Approved by ANSI
The National Association of Home
Builders Green Building Standards have
been approved by the American National
Standards Institute (ANSI) which effectively
means that they will be included in the next
version of the International Residential
Code. The standards apply to singlefamily homes, apartments and residential
remodeling. The HBA’s Build Green
Kentucky Program is closely modeled after
the NAHB standards. It is the first and only
green building rating system approved by

New I-9 Form Required in April
The Department of Homeland Security
plans to implement a new version of the I-9
employment verification form for new hires
beginning April 3. Failure to use the new
Form I-9 after this date can result in federal
civil fines and penalties. To identify the
newest version of the required form look for
“Rev. 04/03/09” on the top of the document.

Key Housing Provisions Included in Stimulus Legislation
The recently passed American Recovery and Reinvestment Act of 2009 contains several components that will help small businesses and bolster the housing market.
Key Provisions of the American Recovery and Reinvestment Act
Tax Provisions
• $8,000 first-time home buyer, true tax credit (no repayment) for the purchase of a principle residence between January 1 and December 1, 2009, up
to 10 percent of the purchase price. Recaptured if home is sold within three years. Removes the restriction on the use of tax credit proceeds with
Housing Finance Agency-issued tax exempt mortgage revenue bonds. Credit applies to individuals with income of less than $75,000 and couples with
incomes of less than $150,000. More information on the first-time home buyer tax credit can be found at www.federalhousingtaxcredit.com.
• Short-term gap financing for Low Income Housing Tax Credit (LIHTC) projects:
1. Provision allowing states to turn in portion of 2009 LIHTC allocations for cash.
2. Special appropriation of $2 billion in HOME funds.
• Up to a ten-year deferral of tax from business debt cancelled as part of a repurchase or restructuring
• 5-year carry-back of 2008 net operating losses for businesses with gross receipts of less than $15 million (three year average).
• Extension of enhanced bonus depreciation.
• Extension of increased small business expensing.
• Enhancements to the section 25C program for energy efficiency remodeling improvements to existing homes.
• One-year patch of the Alternative Minimum Tax.
• Increase New Markets Tax Credit allocating authority for 2008 and 2009.
• Delays for one year the start of 3% government contractor withholding requirement.
Appropriations Provisions
• $2 billion for full year payments to owners of Section 8 project based rental assistance properties.
• $2.25 billion through HOME program and Low Income Housing Tax Credit program to fill financing gaps.
• $1 billion for CDBG.
• $2 billion for Neighborhood stabilization program.
• $1.5 billion for homelessness prevention activities (help with rents, etc).
• $250 million for energy retrofitting and green investments in HUD assisted projects.
• $1 billion for Section 502 direct loans under the Rural Housing Service.
• $10.4 billion for Section 502 guaranteed loans under the Rural Housing Service.
• $27.5 billion for highway spending.
Other Key Provision
• Increases in FHA, Fannie Mae and Freddie Mac loan limits to 2008 levels.
