Mount Olive, NC - It was 1992 and
Kenny Moore was making the 30minute drive home after putting in
another 12-hour day at Andy’s, the
North Carolina burger chain he had
founded the year before at just age 28.
He had four stores. Three were losing
money. He was more than $30,000
behind in paying his food bills. Moore
knew he couldn’t work any harder, but
he also had no answers for turning
things around.
“The sky didn’t suddenly open, but I
had this clear thought that I was doing it
all wrong,” Moore recalled. “I was only
focusing on myself and my problems. I
wasn’t thinking about the people busting their tails for me every day. I made a
mental shift on the way home that night.
I’ll never forget it. I told myself it was no
longer going to be about me.”
Moore made an about-face in his
management style: He decided to meet
the needs of others before his own. It’s
known as the philosophy of “servant
leadership.”
“When I started doing that, Andy’s
started to turn around,” Moore said. “We
started to become very successful.”
Today, Andy’s Burgers, Shakes &
Fries – which celebrated its 20th
anniversary in March – has 100 stores in
North Carolina and enjoyed sales of
approximately $50 million in 2010.
Andy’s is known statewide for its
famous Cheeseburgers, casual ’50s-style
diner setting, family atmosphere and
first-class customer service that extends
to greeting customers as they walk in the
door. Now, with the recent launching of
an expanded franchising program,
Andy’s is looking to grow beyond its
state boundaries for the first time.
Andy’s expects to open a combination of 10 to 15 franchised and company-owned locations in 2011, with initial
franchising efforts targeted at the southeastern states of North and South
Carolina, Georgia, Tennessee, Alabama,
Mississippi, Maryland, Virginia, West
Virginia, Texas, Florida and Kentucky. By
the end of 2014, the 48-year-old Moore
envisions up to 500 Andy’s across the
country.
The “better burger” niche is among
the fastest growing in the restaurant
industry, yet still has plenty of room for
expansion. Moore definitely sees room
for Andy’s. Another big advantage:
Andy’s offers a fast-casual price point –
the average per-person bill is $6 – in a
full-service environment.
“I wouldn’t be worth my salt if I didn’t tell you that I think we’re a lot better
than some of these other people that
have had tremendous success,” Moore
said. “I feel like we’re uniquely positioned where we are and I think it’s time
to start sharing Andy’s with everybody.”
About half of Andy’s 100 stores –
almost all of which are located in the
eastern portion of North Carolina – are
corporate-owned. The remaining stores
are operated through what Moore called
an “in-house” franchising program, a
precursor to its present franchising initiative. Many of those store owners rose
through the ranks of Andy’s.
“We’ve produced more than 30
entrepreneurs,” Moore said. “We have
former minimum-wage cooks and
wait staff members who now own their
own businesses.”
Having started Andy’s with $500 to
his name, Moore is seeking franchisees
who are a dedicated lot, looking to control their own destiny while building an
organization consumed by a passion for
serving people… that idea of servant
leadership.
An engaging, high-energy individual
who was once an All American baseball
player in college, Moore hasn’t led
Andy’s to success from a corner office.
He has gotten his hands dirty like every
other prospective franchise owner. He
owns 51 Andy’s restaurants himself.
“I have done everything out there
that I am asking these folks to do,”
Moore said. “I have done every job,
including the disgusting ones. I’ve been

President/CEO Carol Dover made an
announcement that the first ever Online
Foodhandler Training program for hospitality industry workers is now online.
Foodhandler Training, a requirement
by the Florida Department of Business
and Professional Regulation (DBPR) for
employees working in Florida’s over
45,000 restaurants, has traditionally
been offered in a group or one-on-one
setting. This new online feature allows a
more convenient and flexible option for
this mandatory training.
“The Florida Restaurant and
Lodging Association is proud to offer
an online training option to Florida’s
nearly one million food service
employees in order to keep residents
and tourists safe throughout their dining experience,” said Carol Dover,
President/CEO of the state’s largest
hospitality industry association. “In
today’s technologically advanced
society, it was incumbent upon us to
provide cutting edge tools to allow
for convenient and comprehensive
instruction via the Internet.”
The Florida Department of Business
and Professional Regulation
(DBPR) recognizes the FRLA
as its contracted provider
through the SafeStaff®
program. FRLAs SafeStaff® Education &
Training program is
Florida’s restaurateur’s
source for quality products and services to educate employees and meet
regulatory compliance standards for Food Manager Certification
and Employee Foodhandler Training.
Upon employment in a DBPR
licensed foodservice operation, an
employee has 60 days to be trained.
Any food service establishment
employee who receives, prepares,
stores, or serves food, or handles food
contact surfaces, must complete this
training. The online cost for each
restaurant employee is $14.95.
FRLA members enjoy significant discounts on
educational products
and services.
Once the restaurant employee completes the online
training course, a certificate of completion is
awarded. The certificate is
valid for three years and the
individual may reprint this certificate as needed.

A new report released by
Technomic examines the menus
of 100 independent restaurants
across the U.S. to identify new
food and beverage trends currently taking shape. The report
finds these restaurants preparing
dishes in innovative ways, one of
which involves the use of cola or
other beverages as a primary
ingredient. Coffee, tea, beer, soda
and spirits are all being featured
on independent restaurant
menus in new and unique ways.
These beverages are contributing spicy,
sweet, tart and savory flavors to dishes,
and operators are taking advantage of
the flavor recognition from these beverages when used as ingredients. "Chefs
have long been using flavored drinks in
various preparation methods, but the
way beverages are being used on today's
independent menus is helping to redefine the boundaries between comfort
food and gourmet cuisine," says

The bakery cafe segment, which accounts
for $5 billion in annual
sales and over 3,600
units nationwide, has been able to successfully navigate the middle ground
between quick- and-full service restaurants to outpace industry sales and
unit growth for each of the past three
years. Total bakery cafe units increased
4.2 percent, and bakery cafe sales
increased 12 percent during
those three years. A new
study by Technomic finds
consumers fueling growth
in this fast-casual sub-segment by visiting bakery
cafes in larger numbers
and by becoming frequent
customers once they do
visit. 71 percent of consumers have now visited a
bakery cafe, up from 43
percent in 2008, and nearly
three quarters of those consumers say they visit bakery cafe
concepts at least once a month.

My cousin Bob who was responsible for me joining the Army many
years ago asked if I would join him at
Olive Garden for dinner with our
wives. I never have considered my military service as special but looking
back on it I guess I did make a substantial commitment of time to the military
so I decided to accompany him and
celebrate our service.

After fourteen years of writing this
column a new topic is sometimes hard
to come by. The one topic that remains
constant is that this industry is hospitality driven and if you don’t like people and dealing with them, you’re in
the wrong business. A smile or caring
about your customers could make or
break your next sale.
As an owner of a restaurant or any
other business you must take a step
back every once in a while and take a
look at your staff and see how they
interact with your customers. During
this economic recession or depression,
you pick, people are stressed out and
can choose to buy from many companies offering the same product.
Something as simple as answering the
phone or greeting a guest could be the
cause of turning customers away.
Always train your staff to be friendly,
helpful and well-informed.
Keeping up with current events and
the mood of the public is a very important component to presenting your
business in a positive light. Recently
we celebrated Veteran’s Day and many
restaurants including Applebee’s,
Golden Corral, Denny’s and Olive
Garden were honoring Vets and current servicemen and women by offering them free meals for their sacrifices
in defense of this country.

inherent strength in convenience, efficiency and 24/7 availability, convenience stores are rolling out their own,
branded foodservice programs that
return higher margins while also
improving food quality and healthfulness, according to “Convenience Store
Foodservice Trends in the U.S.” by market research publisher Packaged Facts.
In the process, convenience stores are
going head-to-head with established
restaurant players, seeking to take a
slice out of the limited-service restaurant pie while also keeping in mind
their customers' broader on-the-go
purchasing needs.
“By enhancing foodservice quality
and variety, we believe convenience
stores are poised to benefit from
increased sales of gasoline and other
merchandise, as consumers seek to
consolidate their purchases in the interest of efficiency,” says David Sprinkle,
publisher of Packaged Facts. “Because it
is so well positioned, we anticipate that
convenience store industry foodservice
sales growth will outperform the retail
and restaurant foodservice industry
average through 2013.”
Several factors are driving convenience store companies' efforts to

“We spent about $2 million to roll it
out a few years ago and it now represents about eight percent of sales,”
Moore said. “Our ice cream sales are
phenomenal. But that’s just one part of

service. Though it’s still a small segment
— comprising 6 percent of the restaurant industry — its influence is great.
With origins in once-innovative concepts such as Fuddruckers and Koo Koo
Roo and the “home meal replacement”
trend; and prime development seen in
chains like Chipotle Mexican Grill,
Panera Bread and Five Guys Burgers and
Fries; the fast-casual sector has evolved
and expanded. The old terminology
“adult fast food” is no longer an adequate definition.
“Watching the success of fast-casual
concepts, quick-service restaurants have
adapted by improving menu items and
adding fresh positioning. Leading QSRs
like McDonald’s and Wendy’s are upgrading to fast-casual like decor and
Chick-fil-A is testing table delivery,” says
Technomic EVP Darren Tristano, who
has been studying the fast-casual phenomenon since the early ’90s.
“Full-service restaurants have integrated elements of fast-casual too, such
as Pizza Inn’s recent launch of the Pie
Five Pizza Co. concept and Denny’s
Fresh Express,” says Tristano. “But innovative fast-casual concepts continue to
evolve, adding full-service elements like
table service in the evening and quickservice convenience like drive-thrus
and delivery, defying the typical ‘fastcasual’ definition.”

"Our surveyors' support for the display of health department letter grades
has grown as fast as support for the
smoking bans a few years ago," said Tim
Zagat, Co-Founder and Co-Chair of
Zagat. "By requiring restaurants to
maintain sanitary environments, these
laws are benefitting the overall safety of
the consumer."
Dining Out Stabilizes: The national
average of meals out per week held
steady at 3.1 – the same as last year, but
still down from 3.3 pre-recession. Texans
eat out the most, with Houston (4.0),
Austin (3.8), Dallas/Ft. Worth (3.6) and
San Antonio (3.5) leading the national
pack, while diners who eat out the least
hail from the east coast, e.g. Washington,
DC/Baltimore (2.6), Philadelphia (2.5)
and Boston (2.5).
Spending and Tipping: This year,
27% of diners report spending more per
meal compared to a year ago, while 14%
report spending less. On average, U.S.
diners are spending $35.65 per meal, a
slight increase from last year's average

Noisy Neighbors: While service
again tops the list of dining-out irritants (cited by 66% this year), the
Survey shows a rise in complaints
about noise/crowds, which is now at
16%, up from 12% five years ago. When
asked what they would do if seated
next to noisy neighbors, 54% of diners
surveyed would ignore them, 32% say
they would ask to be moved and 10%
would ask the manager to speak to
them. Only a bold 4% would confront
their neighbors and ask them to quiet
down. While 36% of diners said they
avoid communal tables, an equal 35%
said they love meeting new people and
would chat with their neighbors, 19%
said they would only chat with their
neighbors if they overheard something
interesting and 10% would "pretend
there was an invisible wall."
Chef Spotlight: Surveyors are split in
their opinions of celebrity chefs – 40%
say a famous chef makes them more
likely to dine at a restaurant, while 57%
say that has no effect. Still, many of this
year's restaurant premieres are associated with well-known names, including
Boston's Menton (Barbara Lynch),
Chicago's Next (Grant Achatz), Atlantic
City's Scarduzio's (Chris Scarduzio),
Miami's DB Bistro Moderne (Daniel
Boulud) and Makoto (Stephen Starr),
NYC's The Dutch (Andrew Carmellini)
and Red Rooster (Marcus Samuelsson)
and San Francisco's Michael Mina.
That's Amore: Although French and
Japanese claim the top food spot in
more than one-third of the 45 markets
covered in the Survey, Italian is the most
popular cuisine, with 27% of respondents nationwide citing it as their
favorite, followed by American (18%),
French (12%), Japanese (10%) and
Mexican (10%).
Extra Bites: When dining at a restaurant that does not take reservations, a
full 67% of surveyors nationwide would
be willing to wait no more than 30 minutes for a table, while 12% said no more
than an hour. Regarding restaurants
with "cash-only" policies, 40% of diners avoid them while 12% say it makes
them spend or tip less. And despite the
proliferation of group buying sites,
56% of say they rarely/never engage in
these programs.

dining in the nation is in Las Vegas, with
an average meal cost of $47.53. Looking
at the twenty most expensive restaurants in each city, NYC leads with an
average cost of $163.34.

covering 1,578 of the nation's top
restaurants across 45 major markets.
The new guide incorporates the votes
of over 156,000 food lovers who dined
out an estimated 25 million times in
the past year, i.e., 3.1 times per week.
The Survey results are available in
bookstores, at ZAGAT.com and on
Zagat's mobile products.
Easy as A-B-C: Echoing the overwhelming support in cities like New
York and Los Angeles, 81% of surveyors nationwide are in favor of restaurants being required to post their
health department letter grades.

major cities report that letter grades
influence their dining decisions and
most will eat only at restaurants that
earn a B or better (88% in NYC, 84% in
San Francisco, 92% in Los Angeles).

Restaurant owners - negotiate your commercial lease

For many restaurant owners, negotiating a good lease or lease renewal
against an experienced landlord or their
agent can be a challenge. While a restaurateur thinks of marketing, managing
and menus, savvy real estate agents and
brokers are specialized sales people.
Their job is to sell restaurant tenants on
leasing their listing at the highest possible rental rate.
Restaurant tenants may go through
the leasing process once or twice in their
entire lifetime – yet they have to negotiate against seasoned professionals who
negotiate leases every day for a living.
Whether you are negotiating a lease
renewal or leasing a new location for the
first time for your restaurant, these are
some tips for tenants:
Negotiate to Win: All too frequently,
restaurant tenants enter into lease negotiations unprepared and don’t even try
winning the negotiations. If you are not
negotiating to win, you won’t. With big
commissions at stake, you can be sure
the landlord’s agent, on the other hand,
is negotiating fiercely to win. Restaurant
researching multiple properties, try to
deal directly with the listing agent for
each property, rather than letting one
agent show you around town or show
you another agent’s listing. Your tenancy is more desirable to the listing agent
if he can avoid commission-splitting
with other agents.

Be Prepared to Walk Away: Try to set
aside your emotions and make objective
decisions. Whoever most needs to make
a lease deal will give up the most concessions. A good restaurant in a poor
location will become a poor business.

are paying for rent or what incentives
they received will position you to get a
better deal. Ask the right questions.
Consider that your landlord and his
agent know what every other tenant in
the property is paying in rent, so you
must do your homework too.
Whoever most

a lease deal

Brokers … Friend or Foe? Real
estate agents and brokers typically
work for the landlord who is paying
their commission. It is not normally
the agent’s role to get the restaurant
tenant the best deal – it is their job to
get the landlord the highest rent, the
biggest deposit, etc. The higher the
rent you pay, the more commission the
agent generally earns. If you are

Even if the first offer seems reasonable, or you have no idea of what to
negotiate for, never accept the leasing agent’s first offer. In the real
estate industry, most things are
negotiable and the landlord fully
expects you to counter-offer.
Calendar Events
Ask for More Than You Want: If
you want three months free rent,
then ask for five months. No one ever
gets more than they ask for. Be prepared for the landlord to counteroffer and negotiate with you as well.
Don’t be afraid of hearing “no” from
the landlord – counter-offers are all
part of the game.
Negotiate the Deposit: Large
deposits are not legally required in a
real estate lease agreement. Deposits
are negotiable and, more so than anything else, often serve to compensate
the landlord for the real estate commissions he will be paying out to the
realtor. If you are negotiating a lease
renewal and your landlord is already
holding a deposit of yours, negotiate
to get that deposit back.
Measure Your Space: Restaurant
tenants frequently pay for phantom
space. Most restaurant tenants are paying their rent per square foot, but often
they are not receiving as much space as
the lease agreement says.
