CITY OF NORFOLK, NEBRASKA
NOTICE IS HEREBY GIVEN that a meeting of the City Council of the City of Norfolk,
Nebraska, will be held at 5:30 p.m. on Monday, March 17, 2014, in the Council Chambers, 309
N. 5th St., Norfolk, Nebraska, which meeting will be open to the public.
The Mayor and City Council reserve the right to adjourn into closed session as per Section
84-1410 of the Nebraska Revised Statutes.

10. Consideration of approval to waive the $2.00 bicycle registration fee for the
annual Landon Bos Memorial Bike Rodeo on May 17, 2014 from 9:00 a.m.
to 12:00 p.m., to be held at the Norfolk Pedal Park located in the 300 block
of W. Benjamin Ave.
Motion
The event is to promote bicycle safety in honor of Landon Bos, who died in a
car/pedestrian accident in 2007. Landon was the son of Dave (Detective
Sergeant with the Norfolk Police Division) and Corrine (the House Supervisor
at Faith Regional Health Services). The rodeo is free to participants and
consists of helmet fitting, a mechanical check of the bicycles, licensing of the
bicycles, rules of the road presentation and a road course for the bicyclists to
drive. Elected officials have approved waiving the licensing fee for the event
since 2008.
11. Consideration of approval of permanent easement contract and permanent
easement deed from Steed, LLC for property along U.S. Highway 81 for an
amount of $21,275.00.

The permanent easement deed is for the construction and maintenance of a
sanitary sewer main for the Southwest Sanitary Sewer Interceptor Phase I
project. Staff request approval of this contract and deed from Steed LLC for an
amount of $21,275.00.

Rotary Club of Norfolk has requested the use of Skyview Park to hold four
music performance events on June 19, 2014; July 3, 2014; July 17, 2014; and
July 31, 2014, respectively. The Agreement permits alcohol consumption in a
designated, fenced-in or clearly-marked area of the park during the events. No
alcohol sales will be allowed in the park.

This project includes the reconstruction of Prospect Avenue with a 31-footwide concrete roadway from 4th Street through 7th Street, reconstruction of
sidewalk on the north side of Prospect Avenue, construction of ADA curb
ramps for existing sidewalk, and reconstruction of curb drainage inlets. A bid
letting is planned for April 10, 2014 with Council approval of apparent low
bidder at the April 21, 2014 meeting.

19. Consideration of approval of negotiating a contract with Elkhorn Paving
Construction Co., Inc. of Norfolk, Nebraska for the Concrete Improvements

There were two plan holders for this project and one bid was received at the
March 11, 2014 bid letting. Elkhorn Paving Construction Co., Inc. of Norfolk,

Nebraska, submitted a bid of $182,653.85, which exceeded the Engineer's
estimate on file. Enclosed is a bid tabulation.

Nancy Novak, project manager, will explain the space needs analysis that was
done and what resulted from that, including recommendations for total square
footage needed for a 20-year growth projection and a 10-year growth projection
and the costs associated with each of those projections. She will also present a
possible floor plan and renderings of what the outside of the building could
look like.

The property owner, Brian C. Gibbs, has requested that his property located at
1230 W Monroe Avenue be annexed in the city limits of Norfolk.
This property is currently located inside the County Industrial Tract and the
owners new tenant is a retail business. State statute does not allow retail
businesses in a County Industrial Tract.
Staff recommend approval of Ordinance No. 5285 annexing a tract of land
located in the South 1/2 of the North 1/2 of Section 34 and the Northwest 1/4 of
Section 34, all located in Township 24 North, Range 1 West of the 6th P.M.,
Madison County, Nebraska. Due to Nebraska Revised Statute 16-404 requiring
annexation ordinances be considered at three separate meetings, Ordinance No.
5285 was approved on first reading only at the March 3, 2014 City Council
meeting.

27. Consideration of Ordinance No. 5286 amending Section 2-5 of the City Code Ordinance No. 5286
to increase the fee for Municipal Solid Wastes received at the City of
Norfolk Transfer Station by $3.45 per ton to $56, with the change taking
effect June 1, 2014.
On January 21, 2014, the City Council approved the renewal of the
transportation contract that went into effect on February 3, 2014, which
increased the cost of shipping trash to the landfill. The increased cost of
shipping equates to an additional $62,275.00 for the remainder of the
2013/2014 fiscal year. A Public Works Subcommittee meeting was held on
February 27, 2014 and recommended forwarding a $3.45 increase per ton for
City Council to vote on, which would raise the cost of disposal to $56.00 per
ton. With current Government figures of each household generating 2 tons of
trash per year, the price increase would affect the average customer by an
additional $0.58 per month. This increase will not affect any waste that is not
destined for the landfill.

The Mayor and City Council of the City of Norfolk, Nebraska met in regular session in the Council
Chambers, 309 North 5th Street, Norfolk, Nebraska on the 3rd day of March, 2014, beginning at 5:30
p.m.
Following a moment of silence and the Pledge of Allegiance to the flag of the United States of
America, Mayor Sue Fuchtman called the meeting to order. Roll call found the following
Councilmembers present: Dale Coy, Jim Lange, Rob Merrill, Shane Clausen, Thad Murren, Josh
Moenning, Dave Fauss, and Dick Pfeil. Absent: None.
Staff members present were: City Administrator Shane Weidner, Director of Public Works Dennis

Notice of the meeting was given in advance thereof by publication in the Norfolk Daily News,
Norfolk, Nebraska, the designated method of giving notice, as shown by affidavit of publication.
Notice was given to the Mayor and all members of the Council and a copy of their acknowledgement
of receipt of notice and agenda is attached to the minutes. Availability of the agenda was
communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All
proceedings hereafter shown were taken while the convened meeting was open to the public.

Councilmember Merrill moved, seconded by Councilmember Fauss, to award a contract to Oldcastle
Materials Midwest Co, d/b/a Omni Engineering of Omaha, Nebraska, for Street Overlay 2014-1
project for an amount of $1,179,368.87.
Assistant City Engineer Mark Dolachek stated eleven asphalt vendors received the bid notice but only
one submitted a bid. Dolachek explained most asphalt projects have substantial change orders at the
end of the project; however, even with a 15-30% change order increase, the project will still be within
the City’s budgeted amount.

A Council/Staff retreat was held by the Mayor and City Council of the City of Norfolk,
Nebraska, on Thursday, February 27, 2014 beginning at 3:00 p.m. in the Elkhorn Lodge, 1008
McKinley Avenue, Norfolk, Nebraska.
Mayor Sue Fuchtman called the meeting to order.
Roll call found the following City Council members present: Mayor Sue Fuchtman and
Councilmembers Shane Clausen, Dale Coy, Dave Fauss, Rob Merrill, Josh Moenning, Thad
Murren and Dick Pfeil. Absent: Jim Lange.
The media was represented by Greg Wees, Norfolk Daily News.

Financial Plan Review
Finance Officer Randy Gates provided a financial plan review including LB 840 Economic

Council Direction and Priorities
Councilmember Fauss moved, seconded by Councilmember Clausen to direct staff to negotiate
in the best interest of the City on the Hupp property located on McKinley Avenue. Roll Call:
Clausen, Coy, Fauss, Merrill, Moenning, Murren, Pfeil and Fuchtman. Absent: Lange. Motion
carried.
Councilmember Coy moved, seconded by Councilmember Fauss to move forward with the trails
project for planning purposes at this time. Roll Call: Clausen, Coy, Fauss, Merrill, Moenning,
Murren, Pfeil and Fuchtman. Absent: Lange. Motion carried.
Councilmember Coy moved, seconded by Councilmember Fauss to use $120,000 of council
priority dollars for street repair projects for planning purposes at this time. Roll Call: Clausen,

General consensus of elected officials is to keep money in the budget, for planning purposes at
this time, to identify and inspect dilapidated properties in the City.
Future Planning
Auditorium – Mrsny reviewed maintenance problems with the auditorium and auditorium
revenue vs. expenses. The City is losing approximately $37,390 annually on the City
Auditorium. The auditorium is in dire need of tuck pointing at an estimated cost of $20,000 for
the east side only of the building. The auditorium windows also need to be re-puttied and
repainted. Other maintenance costs include replacing/repairing of the wood floor, cracks in the
walls, seats and water damage. Estimated cost to demolish the building would be more than
$100,000.
Old City Council Chambers Building – Councilmember Coy moved, seconded by
Councilmember Merrill to authorize staff to move forward with disposition of the old City
Council building.
Roll Call: Clausen, Coy, Fauss, Merrill, Moenning, Murren, Pfeil and Fuchtman. Absent:
Lange. Motion carried.
Water Tower – The water tower is no longer used by the City of Norfolk except to support
antennas for telecommunications companies. Cost to repaint the tower is estimated at $300,000.
Cost to construct a new galvanized communications tower is about $200,000 with demolition of
the existing tower estimated to cost $25,000. A new tower would be more functional for
telecommunications companies and have less recurring maintenance issues.
Elected officials directed staff to proceed with tearing down the existing tower and construct a
new galvanized tower.

Ending Balance – Finance Officer Randy Gates explained the Government Finance Officers
Association (GFOA) recommends a 16% minimum of general fund unrestricted cash reserves.
Ordinance No. 3577 requires the City of Norfolk to have a minimum of $1 million as an ending
balance. If the City would have kept up with inflation, the ending balance should be
$1,965,681.
General consensus of elected officials is that the increase in ending balance can’t be solved in
one year and this can be brought up again at budget time.
Library expansion/infrastructure – The Legislature gave municipalities the ability to raise
sales tax by another 1/4 to 1/2 cent to a maximum of 2%. The additional sales tax has a 10-year
sunset and could be used for the library expansion project and/or infrastructure projects. The
City of Norfolk currently imposes a 1 1/2 cent sales tax. Weidner stated the City of Norfolk can
only raise additional revenue by increasing property tax, increase sales tax, cut services, grow the
tax base, or pass a “new” occupation tax, i.e. wheel tax.
General consensus of elected officials is for staff to work with the economic development
subcommittee members to pursue solutions to a possible library expansion project and/or street
improvements and/or trails with an additional sales tax as allowed by state statutes. Elected
officials would also like to have a citizens’ forum to get direction on increasing the sales tax in
Norfolk.

WORK SESSION
JOINT GOVERNING MEETING
The Mayor and City Council of the City of Norfolk, Nebraska met with representatives from the
Northeast Community College Board of Governors, the Norfolk Public School Board and the
Madison County Commissioners on Thursday, March 6, 2014, beginning at approximately 12:00
p.m. at the Lifelong Learning Center, Suite B, 801 East Benjamin Avenue, Norfolk, Nebraska.
Dr. Mike Chipps called the meeting to order.
Roll call found the following City Council members present: Mayor Sue Fuchtman and
Councilpersons Merrill and Moenning. Absent: Coy, Clausen, Fauss, Lange, Murren and Pfeil.
A quorum of the Norfolk City Council was not present at the meeting.
Staff members present were City Administrator Shane Weidner and City Clerk Beth Deck.
Others present were:
Norfolk Public Schools – Sandy Wolfe and Dr. Jami Jo Thompson
Madison County -- Lee Klein, Jerry McCallum, Christian Ohl, Nancy Scheer and Dick Johnson
Northeast Community College – Dr. Mike Chipps, Dr. John W. Davies, Dirk Petersen and Diane
Reikofski
Also present at the meeting was Bob Wehrer, Chairman of the Board, Hadar, Nebraska
Notice of the meeting was given in advance by publication in the Norfolk Daily News, and
notice of the meeting was given to the Mayor and all members of the Council prior to the
meeting.
Dr. Chipps informed the public about the location of the current copy of the Open Meetings Act
available in the meeting room and accessible to members of the public.
Roundtable Updates
Madison County – Last phase of the Northeast Industrial Highway project was bid and work
should begin prior to April 1, 2014. The Lindsay hard surfacing road project is progressing
well. It was suggested the legislature needs to review the judicial system regarding housing of
inmates.
City of Norfolk –The City is doing a lot of infrastructure projects; community housing issues
was discussed as well as potential revenue sources, e.g. increase in sales tax by 1/4 or 1/2 cent
which would need approval by voters, can only be used for infrastructure and would sunset in 10
years. Also discussed was the City Auditorium which operates at a loss of over $37,000
annually. The City Auditorium is in need of repairs which are expensive; parking is an issue; it
competes with private business; restrooms are not sufficient for large crowds; and possibly
offering for sale in the open market. The City is also working on a possible library
expansion/significant remodel; expanding trail system; Norfolk 101: Citizens Academy began;
and demolishing the water tower on North 25th Street and rebuilding a telecommunications

tower. Also discussed was Tejas Tubular locating in Norfolk and natural gas line expansion;
Housing Task Force; LB 840 funds, possible improvements to Johnsons Park, and possible
purchase of additional property for Ta-Ha-Zouka Park expansion.
The group agreed it is important to inform citizens that other things need to happen to help move
the community forward, including new funding sources and keeping citizens informed.
Norfolk Public Schools – The Board adopted a comprehensive facilities plan; is looking at
making changes with the alternative high school/career academy; and considering remodeling
the central office building. NPS applied for a $2.3 million learning community grant to provide
after-school programming for middle school and junior high school students. Two central office
staff retired which provides an opportunity to reorganize and hire a human resource officer.
Northeast Community College – Items discussed included the O’Neill expansion project; new
agreements with Bellevue College; dual tuition with Norfolk Public Schools; student successes;
resident hall project; Associates of Occupational Studies degree program; and international
educational opportunities.
There being no further discussion, the meeting adjourned at 1:28 p.m.

It is agreed and understood that the BUYER is hereby granted an immediate right of entry upon the premises
described above.
The above payments shall cover all damages caused by the establishment and construction of the above
project except for CROP DAMAGE, if any, which will be paid for in an amount based on the yield from the balance
of the field less expenses of marketing and harvesting. CROP DAMAGE shall mean damage to such crops as
are required to be planted annually and which were planted at the time of the Signing of this contract and which
are actually damaged due to construction of this project, but in no case shall damages be paid for more than one
year's crop. The OWNER agrees to make a reasonable attempt to harvest any crop so as to mitigate the crop
damage.
If any other party shall hold any encumbrance against the aforementioned property at the time of delivery of
the aforementioned property, such payments as are due under this contract shall be made to the OWNER jointly
with the party or parties holding such encumbrance, unless said party or parties holding such encumbrance shall
have in writing waived their right to receive such payment.
Expenses for partial release of mortgages will be paid by the BUYER, if required.
This contract shall be binding on both parties as soon as it is executed by both parties, but should none of
the above real estate be required, this contract shall terminate upon the payment of $10.00 by the BUYER to the
OWNER.
This contract may be executed in more than one copy, each copy of which, however, shall serve as an
original for all purposes, but all copies shall constitute but one and the same contract.

INTERLOCAL AGREEMENT
FOR BUILDING INSPECTION SERVICES (2014)
THIS AGREEMENT is made and entered into by and between the City of Norfolk,
Nebraska, hereinafter referred to as “Norfolk,” and the Village of Hadar, Nebraska, hereinafter
referred to as “Hadar”, WITNESSETH:
WHEREAS, Norfolk presently maintains and provides building inspection services in
conjunction with its fire division services; and
WHEREAS, Hadar is desirous of entering into an interlocal agreement whereby Norfolk
provides to Hadar such building inspection services on a contract basis; and
WHEREAS, Norfolk is willing to perform the building inspection services for Hadar; and
WHEREAS, Norfolk and Hadar are desirous of entering into an Agreement pursuant to
the Nebraska Interlocal Cooperation Act (Nebr. Rev. Stat. §§ 13-801 through 12-827) as the
same may from time to time be amended, for the purposes of describing the terms and conditions
under which Norfolk will provide building inspection services to Hadar;
NOW THEREFORE, in consideration of the foregoing recitals and the terms and
conditions hereinafter set forth, the parties hereto agree as follows:
1. The term of this Agreement shall commence on the date of this Agreement and shall
terminate five (5) years thereafter. Either party may terminate this Agreement at any time within
thirty (30) days after delivering written notice to the other party.
2. In consideration of the building inspection services provided, Hadar agrees to
compensate Norfolk as billed by Norfolk following jobs actually performed. Norfolk shall bill
Hadar at the rate of 1.5 times the hourly rate for the inspector(s) actually performing the
inspection services plus mileage per mile traveled to conduct such inspection services at the
current reimbursement rate for mileage paid by Norfolk.
3. As soon as practicable after receiving notification from Hadar of the need for specific
inspection jobs, Norfolk shall inspect all new building construction, all old building remodeling
projects, and such other jobs as Hadar may request. The inspection territory under this
Agreement shall be limited to within the city limits of Hadar, Nebraska, as well as within the one
(1) mile zoning jurisdiction outside such city limits.
4. Following inspection jobs performed by Norfolk, Norfolk shall report back to Hadar
with its findings on specific jobs. All inspections and reporting shall be based on, and pursuant
to, the following codes published by the International Code Council, Inc. which have been
adopted by Norfolk and shall be adopted by Hadar prior to the execution of this Agreement: The
International Building Code, 2006; the International Plumbing Code, 2006; the International
Mechanical Code, 2006; the International Residential Code, 2006; and the International Property

Maintenance Code, 2006. If Norfolk adopts future revisions or editions of these codes, Hadar
shall also adopt the same revisions or editions, as nearly as possible considering the statutory
differences between the respective parties.
5. Hadar agrees to name Norfolk as an additional insured on its general liability
insurance policy having liability limits of not less than $1,000,000.00 per occurrence or a
$2,000,000.00 aggregate and agrees to provide to Norfolk a certificate of insurance evidencing
compliance with this provision. Hadar also agrees to indemnify and hold Norfolk harmless from
any claims against Norfolk that result from any error or omission of Norfolk in performing the
inspections provided pursuant to the terms of this Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement in duplicate

AGREEMENT
This Agreement is made and entered into the ______ day of ___________, 2014, by and
between the City of Norfolk, Nebraska, a Municipal Corporation, hereinafter referred to as
“CITY”, and Rotary Club of Norfolk, a Nebraska Nonprofit Corporation, hereinafter referred to
as “ROTARY”, WITNESSETH:
In consideration of the mutual covenants contained herein, and for other good and
valuable consideration, CITY agrees to allow ROTARY to use the CITY’s facility at Skyview
Park for musical performances which will include allowing alcohol in a portion of the park,
subject to the following:
1. FACILITY. CITY, being the owner of the park facility commonly known as Skyview
Park, is willing to allow the park to be used in conjunction with ROTARY’s purpose of holding
four separate musical performances in the Park.
2. DATES. This Agreement shall be for the days of June 19, 2014; July 3, 2014; July 17,
2014; and July 31, 2014, respectively. ROTARY shall be responsible for cleanup from the
events and shall complete said cleanup on the same day that each event is held.
3. STAGE. CITY shall allow ROTARY to place a temporary stage in Skyview Park at a
location approved by CITY’s park and building maintenance superintendent. Trucks and flatbed
trailers shall only cross the sidewalk in a location approved by CITY’s park and building
maintenance superintendent. In the event that ROTARY utilizes the concrete pad that has been
constructed at Skyview Park for that purpose, ROTARY shall comply with any loading
instructions that are identified on the canopy covering the concrete pad stage and shall be
responsible for any damage to said canopy as a result of ROTARY placing their equipment on it.
4. ALCOHOL. Alcohol consumption is prohibited on CITY-owned property by Norfolk
City Code Section 3-11 without prior authorization of the Norfolk City Council. This Agreement
hereby grants the authorization for alcohol to be consumed in the park from 6:00 p.m. to 9:00
p.m. on the respective dates of the events set forth in paragraph 2, only in the designated area
shown on the attached Exhibit “A”. That area of the park shall be clearly delineated by a fence to
be erected by ROTARY as shown on Exhibit “A” or by a non-permanent chalk line or similar
marking to be placed by ROTARY around the area depicted in red on Exhibit “A”. This
authorization shall not in any way affect the applicability of City Code Section 3-13, which
prohibits open containers of alcohol in any areas of the park outside the designated area where
alcohol consumption is allowed. This Agreement does not allow the sale of alcohol in the park.
5. CHANGE OF LOCATION. In the event that inclement weather causes the park and
building maintenance superintendent to change the approved location for placement of the
temporary stage pursuant to paragraph 3 hereof, then the park and building maintenance
superintendent shall be authorized to designate an alternative location in the park where alcohol
consumption is permitted pursuant to paragraph 4 of this Agreement.
6. SECURITY. ROTARY shall, at its own expense, provide adequate security guards
for crowd control for its event.

7. VEHICLE PARKING. Parking of vehicles in the park shall be restricted to currently
existing parking areas and to such other areas as are approved for parking at the sole discretion of
the CITY’s park and building maintenance superintendent or his designee. The parties
acknowledge that the areas approved for parking are subject to change up until the time of the
events and may depend upon precipitation or other variables not within the control of the parties
to this Agreement.
8. TRUCK PARKING. ROTARY agrees that no trucks or other vehicles shall be
allowed to be parked on the sidewalk surrounding Skyview Lake.
9. VEHICLE TRAFFIC. CITY’s preference is that no trucks or other vehicles be driven
on, across, or parallel to and within 15 feet of the sidewalk at Skyview Park. However, if trucks
or other vehicles are driven on, across, or parallel to and within 15 feet of the sidewalk,
ROTARY agrees that said trucks or other vehicles shall not be allowed to drive on, across, or
parallel to and within 15 feet of the sidewalk at any location other than where designated by
CITY’s park and building maintenance superintendent. In the event that trucks or other vehicles
damage any sidewalk at Skyview Park, even at the location designated by CITY’s park and
building maintenance superintendent, CITY shall repair the damaged sidewalk and ROTARY
shall be responsible for paying the cost of same. CITY and ROTARY shall together inspect any
location of the sidewalk designated for vehicular traffic both prior to and after the event and
ROTARY shall be responsible for any damage to said sidewalk that occurs between the two
inspections.
10. DAMAGE. Any damage resulting from parking or driving in approved or
unapproved areas of the park will be repaired by CITY and the cost thereof will be paid by
ROTARY.
11. ALL TERRAIN VEHICLES. ROTARY shall be allowed to utilize all-terrain
vehicles, four wheelers or other similar vehicles in the park for utility purposes during the event
under the condition that ROTARY’s insurance certificate contains the following language:
“The Rotary Club of Norfolk’s general liability insurance policy
noted above includes coverage for the operation of the insured’s
all-terrain vehicles, four-wheelers or other similar vehicles while
being used on City of Norfolk property.”
12. EQUIPMENT REMOVAL. ROTARY agrees to have all equipment, including but
not limited to trucks or semi-trailers, removed from Skyview Park no later than 10:00 a.m. on the
day following the respective date of the events set forth in paragraph 2 unless removal would
cause damage to the park due to rain in which case it should be removed no later than 24 hours
after CITY’s park and building maintenance superintendent requests its removal.
13. ROADWAYS IN THE PARK. ROTARY agrees that all roadways in the park shall
be open to two-way traffic for vehicles entering and leaving the park at all times during the term
of this Agreement.

14. NO VENDING. Pursuant to Section 18-10 of the Official Code of the City of
Norfolk, Nebraska, no vending shall be allowed in the park without first obtaining permission
from the Mayor and City Council.

In addition, ROTARY shall name CITY as an additional insured. The policy issued shall
cover all activities sponsored by ROTARY for the event with no exclusions. Said certificate
shall be filed with the Norfolk City Clerk upon execution of this Agreement. In the event the
certificate of insurance is not filed, then this Agreement shall be voidable at the option of CITY's
operations manager.
In the event ROTARY does not provide CITY with a certificate of insurance including
medical expense coverage as provided above, then ROTARY agrees to self-insure for medical
expenses in the amount set forth above and agrees to indemnify CITY and its insurance carrier
for any and all claims for medical expenses made to CITY or its insurance carrier or paid by
CITY or its insurance carrier that are incurred as a result of any of the activities while ROTARY
is exercising any rights under this Agreement.
ROTARY agrees to provide the required insurance for its use of all-terrain vehicles, fourwheelers and other similar vehicles in the park as set forth in paragraph 11 of this Agreement.
16. INDEMNIFICATION. ROTARY herewith agrees to save, hold harmless, indemnify
and defend CITY, its agents and employees from any loss or damage or claim of loss by any third
party from damage that arises from any of the activities, or attending or accessing any of the
activities while ROTARY is exercising any rights under this Agreement.
17. COPYRIGHTED MUSIC. ROTARY agrees that it either has or will secure any
necessary licenses required for the performance of copyrighted music at the activities being
conducted by ROTARY and expressly agrees to hold CITY harmless and indemnify CITY from
any cost or liability that may result to CITY as a result of the contemplated ROTARY activities
being held on property owned by CITY.

20. COLLECTION OF DONATIONS. Pursuant to Section 60-6,157 of the Nebraska
Revised Statutes, ROTARY is specifically prohibited from the collection of donations on any
City street.
21. SIGNS. ROTARY agrees that no temporary signs shall be placed in the public right
of way or on any public property and that any temporary signs related to this event shall comply
with all provisions of the Norfolk City Code. In the event any temporary signs are placed in a
manner that is not in compliance with the provisions of the Norfolk City Code, the signs shall be
subject to removal and ROTARY shall be subject to being fined as provided in the Norfolk City
Code.

AGREEMENT
This Agreement is made and entered into the ______ day of ______________, 2014, by
and between the City of Norfolk, Nebraska, a Municipal Corporation, hereinafter referred to as
“CITY”, and Nebraska USSSA Baseball, LLC, a Nebraska Limited Liability Company,
hereinafter referred to as “USSSA”, WITNESSETH:
WHEREAS, CITY is the owner of Ta-Ha-Zouka Park in Norfolk, Nebraska, which has
baseball fields located within the park; and
WHEREAS, USSSA is desirous of utilizing the baseball fields in Ta-Ha-Zouka Park to
hold a baseball tournament May 31, 2014 and June 1, 2014; and
WHEREAS, CITY is desirous of allowing USSSA to hold said baseball tournament in
Ta-Ha-Zouka Park.
NOW, THEREFORE, in consideration of the foregoing recitals, and the terms and
conditions hereinafter set forth, the parties hereto agree as follows:
1. FACILITY. CITY shall allow USSSA to utilize the baseball fields in Ta-Ha-Zouka
Park May 31, 2014 and June 1, 2014 to hold a baseball tournament. USSSA’s use of the baseball
fields shall be exclusive for the dates set forth in this paragraph.
2. FEES. USSSA shall pay fees to CITY in an amount equal to ten percent (10%) of
total tournament entry fees for the use of the baseball fields in Ta-Ha-Zouka Park. Said fees shall
be paid to CITY at the Norfolk City Clerk’s Office, 309 North 5th Street, Norfolk, Nebraska, by
4:30 p.m. on May 30, 2014.
3. EXTRA FIELD PREPARATION. In the event USSSA desires to have CITY re-drag
and re-chalk the baseball fields midday during the tournaments, USSSA shall pay extra fees to
CITY in the amount of $25.00 per field per occurrence. If USSSA desires this extra service,
USSSA shall notify CITY and pay the fees for the same by May 23, 2014 at the time facility use
fees are paid.
4. INSURANCE. USSSA shall provide CITY with a certificate of general liability
insurance in the following minimum amounts:

In addition, USSSA shall name CITY as an additional insured. The policy issued shall
cover all activities sponsored by USSSA while using CITY’s baseball fields at Ta-Ha-Zouka
Park with no exclusions. A certificate of insurance shall be filed with the City Clerk’s office
upon execution of this Agreement. In the event the certificate of insurance is not filed, then this
Agreement shall be voidable by CITY’s operations manager.
5. HOLD HARMLESS/INDEMNIFICATION. USSSA agrees to indemnify, defend and
save harmless CITY or its representatives, agents, or employees from and against all claims,
demands, suits, actions, loss, claim of loss, payments or judgments arising from any negligent
act, or omission, of USSSA or its representatives, agents, volunteers, or employees during
performance of this Agreement or use of CITY’s baseball facilities.
6. CANCELLATION. Notwithstanding any other provision of this Agreement, CITY
retains the right at any time to cancel any activities scheduled on CITY property due to inclement
weather or for any other reason.

WHEREAS, April 11, 2014 marks the 46th anniversary of the passage of the
U.S. Fair Housing Law, Title VII of the Civil Rights Act of 1968, as
amended, which enunciates a national policy of Fair Housing without regard

Re: Proposed Relocation Project for Norfolk, NE Main Post Office
Dear Mayor Fuchtman,
As we discussed recently, the United States Postal Service (“Postal Service”) is considering relocating
the Norfolk Main Post Office located at 401 N 4th Street to the USPS Processing & Distribution Center
located at 1100 S Pine Industrial Road. The current Main Post Office is a leased facility and the
Processing & Distribution Center is owned property with excess space available. As part of this project
the Postal Service will renovate the Processing & Distribution Center to accommodate the Main Post
Office and continue to provide the same services to the Norfolk community.
The Postal Service is facing the most critical period in its history. Despite significant cost reductions, the
Postal Service continues to experience a net loss. Our mail volume continues to decline because of
increased electronic communication.
As part of a national effort, the Postal Service has been engaged in re-evaluating its facilities. As a selfsupporting government agency that receives no tax dollars for its operating expenses, the Postal Service
must rely on the sale of postage, products and services to generate revenue. In the face of
unsustainable deficits the Postal Service must seek ways to cut costs and reduce the size of its
infrastructure.
The Postal Service wishes to work in partnership with you and your community regarding this project.
We thank you for allowing us to present the details of this project as an agenda item at the next regularly
scheduled City Council meeting. We look forward to meeting you, City Council members, and citizens of
