BIG RED SANTA WEEK
The Santa Central Sale forms part of an exciting
run of four Santa Gertrudis bull sales, dubbed the
“BIG RED SANTA WEEK”.
Over 400 bulls will be offered over a 3 day
period, which represents the biggest week of
Santa Gertrudis sales in Australia in 2013.
We look forward to welcoming visitors to the
series of sales which offers prospective buyers
the opportunity to view a large number of bulls
in a short period, confident of obtaining the
bulls they need without the extra costs
associated with attending sales that
don’t follow each other.
Also, the fact that these sales will be held
late in September means that the bulls are
being offered closer to the time when most
producers need them.

SALE INFORMATION
SALE BULL SELECTION:
All bulls offered at this sale have been inspected and selected by a Breed Society
classifier. Please note all herd bulls are also Breed Society Classifier Approved.
BREEDING SOUNDNESS:
All bulls offered for sale will have passed a semen test and soundness evaluation
by a registered veterinary surgeon and a certificate will be available on request.
SUPPLEMENTARY SHEET:
Each vendor will have their bulls scanned prior to the sale by a certified scanning
technician for eye muscle area, rump and rib fat, marbling (imf%). These results
will be available on a supplementary sheet available on sale day. The scanning
and weighing date for all bulls will be included on the supplementary sheet.
EBVs:
Those studs with Breedplan will display the Breed Society Group Breedplan
figures under each bull.

PERFORMANCE RECORDING
GROUP BREEDPLAN:
Often when selecting breeding cattle, producers consider sale
day weights; eye muscle area; scrotal size etc. While these figures
are helpful, especially when comparing cattle from within a herd,
they do not account for age or feed consumption variations.
Group Breedplan is designed to eliminate any environmental
differences and therefore can calculate the genetic merit of
an animal on a national across herd basis.
EBVs are calculated based on information from the animal’s own
performance plus the performance of all relatives (dam, sire,
sisters, etc), the relationship between these traits and the pedigree
links between animals and between herds.
HOW TO USE EBVS:
The first step is to decide which characteristics are important in
your particular breeding program, then select the EBVs that fit the
bill for your herd.
Birth Weight EBVs: Birth Weight is a major factor in calving
difficulty. The lower the EBV, the lighter the calves are expected to
be at birth.
200 Day Milk and Growth EBVs: The vealer producer should
place emphasis on 200 Day Growth. If the bull is used as a
terminal sire, growth is the most important. If a bull is used to
breed replacement heifers, then look at 200 Day Milk.
400 and 600 Day Weight EBVs: Steer and bullock producers
should place more emphasis on these. These traits are the
measure of an animal’s ability to produce progeny with heavier
weights from yearlings to bullocks.
Rump Fat EBVs: Positive EBVs indicate animals which will breed
progeny fatter (earlier finishing) than breeding average.
Eye Muscle Area EBVs: This EBV is analysed on an age constant
basis so that bulls with high growth with at least average muscling
will have the highest EBVs.
Scrotal Size EBVs: There is a strong correlation between Scrotal
Size and fertility in the male and female offspring. A positive figure
here is desirable.
EBV ACCURACIES: EBVs are an estimate of the true breeding
value of an animal. Clearly, the more information that is available
on an animal, the more accurate the estimate will be. The higher
the accuracy %, the more predictable is the EBV.
OPTIMUM EBVs: An increase in Breedplan figures is sometimes
promoted as the “improvement” that Breedplan can make to a
breed. If an increase in growth is not coupled with the desired
maturity pattern and reproductive and structural soundness, then
this increase may not mean a breed has actually improved.
Breedplan EBVs are useful tools to help select cattle but are only
a part of the total picture. We must remember that our cattle must
remain functional, suit their environment and have the ability to
meet target market specifications. Conformation, hair coat, skin
type and temperament must never be compromised.

CELAMBA
This year the Celamba Santa stud will be represented by 4
quality Bulls at its 6th annual Wandoan Santa Sale. When
raising young bulls we are looking for bulls that are performing
well, achieving good distribution of muscle and fat cover, a
well-balanced structure and a fine temperament. We use EBV’s
eye muscle appraisal and regular weighs to ensure accuracy.
The Taroom Veterinary Service has completed the morphology
testing and a BBSE Certified for our bulls. Our aim is to offer you
top quality versatile bulls that produce the progeny to suit most
trade markets.
This year you will see the Celamba Santa Stud is now based in
the Chinchilla district. This move of our stud has altered the
usual preparation we undertake for the annual sale of our bulls.
This and the dry weather have meant we have supplied the
bulls with sorghum hay as well as the usual bull mix we use
each year. This quality mix was prepared by Barry and Helen
Rich of the Feed Mill Co here in Wandoan.

CELAMBA SIRE
GREENUP DOWNPOUR D4 - DECEASED
Purchased from Rick and Alice Greenup for $27,500. His progeny
are consistent to type and mostly poll or scur. These two
Downpour bulls will be the only ones offered from my stud as I
only have 6 straws left and have not done an AI program this
year. We have no kept semen from the bulls allowing the
purchaser to have full benefit of his purchase knowing that their
progeny will be the first available on the market due to the
unfortunate loss of both dams and sire. Ruth died of snake bite
and due to an unfortunate accident we had to put Tash down.
Their bloodlines will not be replaced.

BULLAMAKINKA
The Hindle family’s Bullamakinka stud is represented this year
with 16 select classified “S” bulls that are aged between 21 –
28 months old with a good representation of the bulls polled or
scurred. They are nearly all sired by our stud’s leading sires,
Canowindra Gold Edition and Warenda Sentry (P) with one
sale bull by one of our AI sires, Top Gun (P) (US). The
Bullamakinka sale bulls have been carefully selected to present
a very consistent line of bulls with high growth for age and have
been finished on oats with very minimal supplementation of a
protein lick and will be presented in a fit condition, having
been fully vet checked and ready for work.
Our stud is based at “Bullamakinka”, a 5300 acre improved
brigalow belah property situated in the North Bungunya district.
We have expanded our stud operation last year with the
purchase of a 9000 acre improved property, “Cherry Park”
situated at Westmar. The Bullamakinka stud was originally
commenced with the grading up of Eidsvold Station females
and the purchase of select stud females from Erin Vale, Kelly
Wallah, Moongana, Santa Park, Douglas, Yarrawonga Waco,
Rosevale, Marston, Kolodong, Wave Hill, Warenda, Deepbank
and Cardona. This season, we will join approximately 700 stud
females with our leading purchased and home-bred sires with
implementing an AI program. We are committed to producing
high growth, soft santas with good fertility, muscle, frame and
bone, slick coated with good type. This year, Bullamakinka will
again hold a bull walk for our sale bulls to be inspected on
16th and 17th August following the first run of NSW santa bull
sales and we welcome your inspection of our stock. Our
website, www.bullamakinka.com.au will also preview our sale
lots including photos in late July.
Please note that these sale bulls will require vaccination
booster shots in Mar/April each year (7 in 1, 3 Day, Vibrio). In
addition, we have tested the sale bulls to be pesti virus

BULLAMAKINKA SIRES
WARENDA SENTRY (P)
Purchased in 2007 for $16000, Sentry has quickly established
himself as one of our leading sires. His sons are extremely
growthy with good bone, type and muscle and a good number
of our draft this year are Sentry sons. His females are equally as
impressive with very good udders. To date Sentry sons have
grossed over $300000 and are averaging over $7000 with a top
price of $17500.
CANOWINDRA GOLD EDITION
Purchased in 2009 for $28000, Gold Edition is our stud’s leading
sire and is producing very consistent progeny and we have been
joining him to approximately 100 cows each year and this year
and we are offering 31 high quality sons in the various sales
Bullamakinka is involved in this year including 10 sale lots of the
total of 16 at Wandoan. Last year, Gold Edition sons sold to a top
of $26000 with his top three sons averaging $20666.

GREENUP FRANCESCO Y38 (P)
Y38 (P) was injured in 2011 and this years’ crop of calves will be
his last. Y38 (P) progeny have a lot of frame, bone and volume
and he throws mostly poll cattle. Y38 (P) is a huge bull and was
joined off pasture to a mob of cows weighing 1362kgs. His
females have been especially good and are very fertile with
good udders and are breeding very well for us.

TOP GUN (P) (USA)
We acquired a small number of straws in Top Gun (P) and used
him in an AI program in 2010. Top Gun was a very successful bull
on the show circuit in the USA and was well bred with a poll son
represented here today that is a complete genetic out/cross.

WIGHTFIELDS
Wightfields Stud was formed in 1983. We started performance
recording in 1988 so we are one of the longest recorded herds
in the breed.
We have always selected our sire and replacement females
with a commercial focus in mind and have never chased the
fads and fancies of the showing. Our breeding objective has
always been to breed herd improving sires for the commercial
cattle producer. We select our cattle for high growth, early
sexual maturity and a combination of good EMA’s and easy
finishing ability and most importantly high fertility. We
selectively join our females to the bull we believe will most
improve the overall balance of performance in the resultant
progeny.
Our stud cattle are joined for 15 weeks and preg tested
annually with empties culled. As we are only a small stud with
220 females annually, we have always brought in new stud sires
this allows us to keep a wide genetic base in our herd. This
allows our valued clients to keep buying our bulls knowing they
are getting fresh genetics into their herds.
This year’s sale bulls have been vaccinated for 3 germ blood,
3 day sickness, vibrio, and 7 in 1. By sale time all the bulls
would have had 4months on oats.
We think this year’s draft is the best we have offered so far and
look forward to presenting them for your appraisal.

WIGHTFIELDS CRACKERJACK C75 (PS)
9 bulls are represented by C75, sold in 2008 for $26 000 to G.A.
Greenup and Co., Rosevale Santa Stud, we retained a semen
share in this bull because we rate him as one of the best bulls we
have bred to date. He is an early maturing bull with a heap of
muscle, extra finishing ability and with a trim underline.
24 sons of his have sold for an $8 000 average.

6 bulls are by our leading sire Rosevale ZinZan Z8 who is doing
a tremendous job for us. He really puts his stamp on his Progeny;
it is amazing how consistently he breeds quality calves to any
cows. They have tremendous growth, muscle, hindquarter, topline
and fine tropical coat. His EBVs rank him in top 1% of the breed for
200, 400 , 600 day weights, Carcase Weight, EMA, Retail Beef Yield
and both Dollar Index’s. 23 of his sons have sold in the last 2 years
for an average of $7 783, to a top of $35 000 for F69 (PS) to Orman
Family of Benelkay Stud.

Purchased for $16 000 at the 2009 annual Rosevale sale. Digger
is a high performing bull with good muscle-finishing ability. He is
doing a great job for us, was only little used in first year because
he got 3 day. He is out of one of Rosevale Best Dam’s having
also breed Rosevale Battalion who is doing a great job for the
Rosevale Stud, who is Diggers full brother.
His EBVs are in top 1% for all growth traits and both Dollar Index.

VALLEYVIEW
Valleyview Stud was established in 1975 with females purchased
from Yarrawonga, Elgin Downs, Bolinda Vale and King Ranch.
Sires were purchased from Eidsvold Station (our foundation sire)
further purchases of sires followed from Yarrawonga, Rosevale,
Kendara, Watasanta, Warenda and other leading studs in the
coming years. Majority of our females are polled and are
selected for temperament and fertility and all must calve each
year and perform to produce a classified calf. Our main focus is
producing soft well muscled correct to type, good temperament
and fertile bulls for auction each year.
Our bulls have topped Big S, Rockhampton, Casino Bull sales in
the 30+ years selling to $20 000 with good averages and
clearances. The stud is single sire mated so quality is paramount
which is also the same with our commercial herd. Sale bulls are
prepared on pasture, natural grasses, lab lab and oats with
limited sale pellets to sale time. All bulls have been vet checked,
semen checked, vaccinated 7 in 1, 3 germ blood vibrio, 3 day
sickness and tested negative for pestivirus.
Valleyview stud believes that the Santa Gertrudis Breed has a
lot to offer to cattlemen for cross breeding into British and
European based herds around the country for increased weight

BREMERVALE
Bremervale Santa Gertrudis stud has 50 years of purebred Santa
Gertrudis breeding in their herd. Bremervale runs 700 purebred
Santa females and is owned by Matthew & Cathy Wainwright and
family, based at Warwick, with properties at Texas, Inglewood and
below Cunningham’s Gap at Rosevale.
The Bremervale Stud has strong commercial focus with our stud
breeding. Sires are selected for growth rate, structural soundness,
temperament and carcass characteristics. One of our most important
breeding objectives is fertility, which requires our breeders to calf
each year or be culled. Bremervale also operate a feedlot where
the bulk of the progeny are finished in our own feedlot and sold to
the highly competitive Woolworths market. Our goal is to breed thick
set, growthy, well muscled and highly fertile bulls.
Bremervale Stud is based on Yarrawonga, Rosevale, Canowindra,
Goonoo and Wave Hill bloodlines. Our sires currently in use include
Canowindra Ironman (P) ($13 000), Wave Hill Z47 (P) & Wave Hill
Z45 (PS).
BREMERVALE SIRES
WACO SEBASTIAN
In 2006 we secured the purchase of Waco Sebastian by Yarrawonga
Omen (P) for $32 000. We purchased Sebastian for his rare
combination of high growth, high muscle and high scrotum size traits,
which is linked with high fertility. Weighing over 1,000 kg and having
an eye muscle of 125cm2 at only 23 months of age places Sebastian
as one of the high performance sires to be sold at auction that year.
This is backed up by his high EBV figures. His EBVs place him in the
top 1% of the breed for all growth traits and carcass weight, he is in
the top 5% of the breed for Eye Muscle Area and retail meat yield
as well as being in the top 20% for scrotal size. He is the complete
package and is ranked 6th out of all published sires for the Domestic
Production Index and in the top 1% of the breed for Export
Production Index. His female progeny are highly regarded in our
stud. They are high volume females with strong breed character.

Rosevale Ambassador (P) was the highest price Santa Gertrudis bull
sold in 2008 for $60 000. We feel he is the best bull offered at
auction for some time and his calves are not letting us down. We
have had some good poll bulls by him showing a lot of length and
frame, with the most impressive attribute being the consistency of his
calves. They are all like peas in a pod and overall quality of his
calves is outstanding, we are looking forward to offering his sons for
sale.

DUNDEE
The Dundee Stud was established 27 years ago with Pampoola cows
purchased from Kym McMaster’s grandfather Felix Schmidt, her Uncle,
Noel Schmidt and her parents Lester and Barbara Schmidt who then
had a share of the Yarrandoo Stud.
Noel Schmidt also loaned Dundee a top Bull, Pampoola 82H, who was
by King Ranch D9.
From this great start and further use of Pampoola bloodlines and King
Ranch sire 199N, bought at the King Ranch Dispersal Sale, a top line of
females were produced.
In 1996 Dundee, purchased Rosevale T329 a heavily muscled, long
framed, polled bull who had an incredible impact on their Stud.
Rosevale T329 consistently produced well-muscled, early maturing bulls
that had great growth for age and plenty of fertility. His daughters are
highly fertile, feminine, soft and well muscled. Pampoola Nato(P) was
purchased in 2000, he has added frame and smoothness to the Dundee
cattle while retaining the polled gene and tidy sheaths. Nato has
crossed well over the Rosevale females, producing a slightly bigger
animal with a smoother top-line and plenty of depth and fleshing.
Kendara Uni was purchased in 2005 for $11 000, he was selected for
his massive weight gaining ability, his temperament, his fleshing, his
tidy sheath and his tropical coat type. Uni is also extremely fertile with
semen morphology of 92% at 2 year old and a 98% pregnancy rate
over the last 5 years. In 2009 Kendara Zinger was purchased for
$10 000. A polled son of Dundee Larriken, one of Kendara’s most
influential Sires, Zinger was purchased for his doing ability,
temperament, clean tropical coat and his pre-potent genetics. He has
been joined to many of Nato’s cows and Uni’s heifers and is producing
top calves. Dundee Ulysses (P) is our current top sire, he is one of Nato’s
better sons and was retained for stud duties due to his fantastic figures,
temperament and doing ability. Dundee Extra, one of Ullysses first drop
of sons, sold for $13 000 in 2011 to the ‘Fishington Stud’ and another
Dundee YMCA sold to the Rowanlea Stud’ for $12 500 in 2012. In 2011
we also purchased ‘Moongana Gothic’ a polled son of Dunlop Gothic,
his first sons are looking great and will be for sale in 2014.
All of our cattle are Breedplan registered. We select our females firstly
on fertility; all must have a calf each year, and secondly on
performance; each female must consistently produce a calf that will
classify. Failure to meet these criteria leads to a short trip to the
meatworks. Consequently we have a high pregnancy rate each year
and very high classification rates 80%+.
As we were a single sire herd for many years our cows are all related
and their offspring are very similar. The Bulls we are producing are a
popular type and their pre-potency has been a major contributing factor
in our success.
For the past 25 years the Stud has shown and has had increasing
success, winning Champion Interbreed ribbons at many Darling Downs
Shows and Champions at the Toowoomba Royal. Dundee Tapestry was
the Grand Champion Female at the 2010 Toowoomba Royal Show and
Dundee YMCA was Junior Champion Bull in 2012. We have had
tremendous success with our commercial cattle as well, winning the
‘Replacement Heifer’ class at the Inglewood Show for four consecutive
years before retiring gracefully, and our Santa cross weaners have
made sale yard records many times.

The Bull Sales have been excellent with an average of $4 000 over the
last seven years.
In 2004 a grandson of Rosevale T329 and a son of Nato, sold to the AA
Company for $19 000. In 2012 we averaged $6 000 for the 12 bulls we
sold at open auction.
Every year we contact all of our clients and assess our bull’s
performance and our client satisfaction and to date we have had very
positive feedback.
Our commercial clients are keen to put muscle and weight for age
improvements into their herd and repeat buyers have been impressed
by the fertility of the bulls, their temperament and their doing ability. All
of the Bulls, including the Show Bulls, are prepared on oats and summer
forage and not grain. We have made a real effort to select for easy
doing cattle that have good feet and high fertility, three things that can
be affected by too much grain. DUNDEE BULLS ARE PREPOTENT

TRIPLE S
Triple S stud was established by the Bruggemann family in 2008 and
is based at Wandoan. We have been breeding purebred Santas
since 1994, starting with Eidsvold Station and Lake Nash Cows. Up
until 2008 we were purely commercially focussed on growth, weight
gain, fertility, temperament and structural correctness ie: all the
things that make you money. From this proven commercial herd of
350 purebred cows we have graded up around 100 registered cows
and bought 27 registered cows from Swan Hill Stud at Blackall. With
this quality base of cows we are now using a number of high quality
bulls including: - Hardigreen Park Mountain (PS) $35 000,
Dangarfield Thunder $30 000, Waco Soldier (PS) $12 000, Wave Hill
Foreman (PS) $14 000 and Waco Utility[P] $10 000, as well as a
number of other high quality bulls. By using these bulls we aim to
produce correct bulls with weight gain, bone and muscle, good
temperament and high fertility. Breed character is also very
important to us and we have a set type we are aiming for. We want
to breed bulls that produce more beef efficiently with a minimum of
inputs and make a difference to people’s bottom line.
This year Triple S Stud will be represented at Wandoan by 22 bulls
including 7 classified “S” bulls and 15 classifier approved herd bulls.
There will be 6 of first release sons from Hardigreen Park Mountain
(PS) and 7 quality bulls by Waco Soldier (PS).
All Bulls have been fully vaccinated and tested free of Pesti virus
and will require booster shots for 7 in 1, Vibrio and 3 day sickness
in August each year prior to joining.

JAMALLY
Jamally Santa Gertrudis stud was established in 2006 as stud
number 2024. The stud is based in the Taroom district where we
have both been brought up. The foundation Jamally herd was
established through the purchase of cows from Gyranda,
Dangarfield and Santa Park. The Becker family have been breeding
Santa’s in the Taroom district for two decades, which is where
Jamie’s passion for the breed developed.
Our breeding goals are to provide quality bulls that possess growth,
fertility, and constitution. We also place a huge emphasis on
temperament in not only our bulls but our breeders as well.
The principle sire being used by Jamally is Yarrawonga Volvo who
was purchased in 2008. Volvo is a son of Yarrawonga Matrix (P). He
has proven to be a very valuable contribution to the herd. In the
paddock he is a bull that commands respect. He has tremendous
breed character, with length and muscle to match. These traits are
visible in the bulls on offer this year. Volvo is also leaving his mark
of quality on his daughters who possess exceptional growth and
character whilst maintaining softness and femininity.
In 2011 we purchased a new sire Yarrawonga Aldo F200 (PS). Aldo
was purchased for his constitution, breed character and
temperament. We are very happy with his first drop of calves and
are keen to see how they progress.
This year we are proud to offer three bulls at the Wandoan Santa
Sale. These bulls have had good preparation in a decent season.
They were weaned onto oats with the remainder of their lives spent
on buffel with a grain supplement in a buffel paddock for the days
leading up to the sale.

LOCH-RANZA
Loch-Ranza Santa Gertrudis Stud (stud number 1068) was
established in 1978 by the late Norm and Merle Nock on coastal
country near Biggenden in Queensland’s North Burnett Region. The
Stud was originally commenced with the grading up from Hereford
and Brahman females with bulls from Eidsvold Station, Gyranda and
Craiglea studs giving us straight Santa Gertrudis. Bulls were
purchased from Kabunga West, Yarrawonga Waco, Rosevale,
Cumberland, Diamond H, Deepbank and Bullamakinka studs. Over
the years Ian and Alan have purchased females from Ashfin Park,
Tara, Pinaroo, Santa Park, Yarrawonga Waco and Warneda female
sales. Our policy with females is if they can’t produce a calf as good
as themself or better are culled.
In 2011 the Loch-Ranza breeding enterprise was split between
Kayleen, Ian and Letitia and Alan and Jocelyn. Since we drafted the
cows, Ian and Letitia manage the Biggenden operation. In 2012 Alan
and Jocelyn were offered the opportunity to purchase stud Females
privately from David and Virginia McCord, Deepbank Santa Gertudis
Stud. Alan and Jocelyn purchased 80 cows and calves from the
McCord family and run them on an agistment block at Flinton.

IMPORTANT NOTICE
All bids shall be treated as offers made upon
1. The highest bidder shall, subject to Conditions 2, be the purchaser provided that the vendor
reserves the right to bid either by himself or through his agent or auctioneer and should any
dispute arise among the bidders for any lot, during or immediately after sale of the lot, it shall
be settled at the auctioneer’s absolute discretion who may, should one of the disputants
advance, put the lot or lots up again. The bidding from time to time shall be regulated by the
auctioneer and no bid shall be retracted.
2. The sale will be conducted on a “Sale” or “No Sale” basis, whereby the lot for sale shall be
knocked down to the highest bidder, but the sale will be subject to the acceptance of the
highest bidder such bidder will have the right of first refusal of the lot at the vendor’s nominated
price for one hour after the lot has been passed out of the ring on the Terms and Conditions
herein set forth in so far as they shall apply.
3. The details of the purchaser, the purchase price and the lot sold as recorded by the Sale Clerk
for and on behalf of the auctioneer shall be equally binding on both purchaser and vendor.
4. The auctioneer expressly reserves the right, without giving any reason therefore to:(a) Refuse to acknowledge any bid;
(b) Withdraw any lot or lots before or during the sale;
(c) Exclude any person from the auction venue should it think fit.
5. Each lot in all cases shall be at the risk and expense of the purchaser, upon acceptance of his
bid by the vendor or upon acceptance of the highest bidder’s offer by the vendor whichever
shall be the earlier.
6. Except as expressly provided in these Terms and Conditions of Sale no guarantee or warranty
shall be given in respect of any lot sold under these conditions as made before or at the time
of the sale, or from any circumstances of the sale, but in all cases where a guarantee is
intended the same shall attach and be enforceable only if reduced to writing before delivery
of the lot and signed by the vendor or by the auctioneer acting as agent for the vendor, and
the absence of such writing shall be conclusive evidence in case of dispute that no guarantee,
warranty or condition whatsoever was given or implied.
7. In the event of any dispute in respect to the sale of any lot:(i) The purchaser shall nevertheless be obliged to pay to the auctioneer the full purchase price
and any other moneys or interest payable by the purchaser in accordance with these Terms
and Conditions;
(ii) The vendor and the purchaser shall resolve the dispute between themselves;
(iii) The auctioneer shall have no liability or responsibility in regard to the dispute; and
(iv) No lot shall be returned to the auctioneer and the purchaser shall indemnify the auctioneer
for all costs, expenses and damages which the auctioneer is put to or incurs by reason of the
purchaser so doing.
8. The name of the vendor for whom the auctioneer acts is acknowledged to have been furnished
to purchasers prior to sale and further particulars will in all cases be furnished to a purchaser
if required. In the case of any dispute the remedy of the purchaser shall be against the vendor
only and in no case or under any circumstances against the auctioneer who is to be regarded
for all intents and purposes as agent for a disclosed principal.
9. (a) PAYMENT - Unless prior credit arrangements have been made in writing with the auctioneer
the full purchase price for each lot shall be due and payable to the auctioneer in cash upon
acceptance of the highest bid or the highest bidders’ offer by the vendor and prior to delivery.
Notwithstanding that delivery is given to ar possession obtained by the purchaser or his
representative prior to the payment of the purchase money in full the property in any lot which
is sold shall not pass to the purchaser until the full purchase price and cheques, promissory
notes, bills of exchange, acceptance orders or drafts given in connection with such payment
have been paid and liquidated and until property shall pass, the purchaser shall hold such lot
as Bailee, provided that in all cases should such payment not have been made and liquidated
within 14 days of the date of the sale the auctioneer reserves the right to:’
(i) Rescind the contract on behalf of the vendor and repossess and resell any lot;
(ii) Recover from the purchaser interest upon the purchase price at a rate per annum
which aggregates the AMBA Bill Rate and two percentum. For the purposes of this
condition, the expression “The AMBA Bill Rate” is the rate published by the Australian
Merchant Banker’s Association in good faith as at the date of the sale as its Bill Rate for
180 day Bills of Exchange expressed as a percentage per annum. If at any time the AMBA
Bill Rate becomes unavailable for any reason, the auctioneer shall determine and advise
the purchaser for the interest rate to apply for the purpose of this condition.
9. (b) The auctioneer is selling as the del credere agent of the vendor and the full purchase price
of any lot sold shall be payable by the purchaser to the auctioneer and be fully recoverable
by the auctioneer in its own name.
10. If the purchaser shall neglect or fail to comply with any of the within conditions any lot
purchased by him may be immediately resold by Public Auction or Private Contract, with or

without notice, at the risk of the former purchaser, who will be held responsible for all loss and
expenses arising out of such resale, and shall not participate in any profit accruing therefrom.
11. Any vendor or purchaser removing the Sale Number from any lot after it has been sold will fully
indemnify all affected parties for any loss, costs or damages should the lot be wrongly
delivered.
12. The purchasers, if more than one, shall be jointly and severally bound by these Terms and
Conditions and shall jointly and severally carry out and perform sale.
13. Any person who advances a bid on a lot shall do so on the expressed condition and
understanding that should that person’s bid be the highest bid and such bid is accepted by
the vendor, then that person will be held personally liable for the price so agreed upon,
regardless of the fact that that person may be acting on behalf of another party, either
disclosed or undisclosed to the vendor or the auctioneer, provided however that this condition
shall not in any way negate the vendor’s right to claim against any principal and in such case
the bidder’s liability shall be construed to be by way of guarantee.
14. The auctioneer may, should it think fit, make arrangements on a puchaser’s behalf, for the
feeding, watering, trucking, shipping of and general attendance to any lot after sale but no
responsibility will be accepted by the auctioneer and all such service will be at the purchaser’s
risk and expense.
15. No lot will be delivered until the sales invoice has been checked and signed by the purchaser
or his duly authorised representative.
16. (a) Each lot in all cases shall be sold with all faults, if any, and excepting those conditions and
warranties implied by the Trades Practices Act or any applicable State legislation which cannot
be contractually these Terms and Conditions of Sale, any express or implied condition,
statement or warranty, statutory or otherwise, is hereby executed. The auctioneer is not liable
in respect of any error, misdescription or omission shall entitle the purchaser to annul the sale
or reject the lot or claim any compensation, damage or abatement in price.
16. (b) Each lot will be sold subject to passing all veterinary tests required by the law of the State
or country to which the purchaser intends to transport that particular lot such tests to be
undertaken at the purchaser’s expense and concluded immediately following the sale. In the
event of a lot failing to pass these tests, the sale shall be null and void, any purchase moneys
paid by the purchaser shall be refunded and property in the lot shall revert to remain with the
vendor.
17. In the event of a dispute as to whether a lot is a breeder, such dispute shall be resolved by
the vendor and the purchaser, and the auctioneer, while he shall use his best endeavours to
assist, shall have no liability or responsibility in that regard. In the event that a lot is alleged
or proved not to be a breeder, the purchaser shall nevertheless be obliged to pay the
auctioneer the full purchase price and any other moneys or interest payable by the purchaser
in accordance with these Terms and Conditions.
18 (a) Each lot shall be at the risk of the vendor in respect of any damage or injury, whether by
disease, accident or otherwise, for the period that the lot be in the custody of the auctioneer,
PROVIDED THAT the auctioneer, its servants, agents and employees shall use all reasonable
care to protect and control the lot while it is in the auctioneer’s custody AND PROVIDED
THAT when a lot has been sold, it shall be at the risk of the purchaser in all respects.
18 (b) If any vendor brings to the premises any lot which is dangerous, or infected with any
disease, that vendor shall be liable for all injury, damages, costs, losses or expenses which
the auctioneer may sustain, incur or be put to either directly or indirectly as a result of the
vendor so doing. The auctioneer reserves the right in its absolute discretion, to exclude from
the sale venue or dispose of any lot which in its opinion shows signs of any disease, whether
infectious, contagious or not, or of any serious fault or of being dangerous.
19. DELIVERY. Except at the discretion of the auctioneer, no lot shall be delivered to the
purchaser unless payment of the purchase money together with any additional charges
incurred including those expenses incurred by the auctioneer, pursuant to Condition 14 hereof,
is first made by the purchaser to the auctioneer. Release of lots may be withheld by the
auctioneer until personal cheques are cleared.
20. In these Conditions:(a) References to “auctioneer” shall be taken to mean as the contest so admits, the Selling
Agent or any member, subsidiary or related corporation or body, officer, agent or employee
thereof, authorised by the vendor to conduct the sale of the lot.
(b) “Purchaser” shall have the meaning ascribed to it in Condition 1.
(c) “Vendor” shall mean the person or corporation upon whose account lots are offered for
sale and where a stud or farm is named shall mean the proprietor of that stud or farm.
(d) “Lot” shall be taken to mean the animal offered for sale and/or sold by the auctioneer on
behalf of a vendor.
IMPORTANT NOTICE The Vendor and the Selling Agent, its members, subsidiary or related
corporations, officers, agents and employees for themselves and for those for whom they act while
exercising due care provide all information without responsibility and give no guarantee whatsoever
as to its accuracy.
All persons who attend the sale do so entirely at their risk and the Vendor and the Selling Agent,
its members, subsidiary or related corporations, officers, agents, employees and its principals, for
themselves and for those for whom they act, do not assume or accept any responsibility or liability
of whatever nature for any injury or damage whatsoever which may occur.
The hammer price is exclusive of GST but GST will be applied to the final hammer price and
included on the invoice.
