The deal is set to give Los Angeles Metropolitan Transportation Authority (Metro) permits to three digital billboards on city-owned property in exchange for eliminating all of their billboards along the railroad right of way. The issue with the deal lies in the billboard location on Norland Drive in Canyon Country. Previously, the area was designated as “Open Space.” A re-zoning amendment would declare it a “Business Park,” all for the purpose of the sole digital billboard. That, Brinton says, falls in direct violation of the Highway Beautification Act of 1965, which was outdoor advertising reform, passed as part of Lyndon Johnson’s Beautify America Initiative. The purpose of the regulation was to keep outdoor advertising away from environmentally sensitive and scenic areas and relegate it to those already zoned for industry and as business park land. Under no circumstance can a piece of open space be re-zoned as a business park solely for the sake of outdoor advertising. Any piece of highway that receives federal aid must comply with the law, Brinton said. “What happens is, the federal government will go to the offending state and withhold 10 percent of their Federal Highway money for not complying with the law,’’ Brinton said. “In this instance, since it’s California, we could be talking about $300 million.’’ Caltrans officials said they would carefully look over the permits for the digital billboards, if and when the proposal passes. Officials confirmed to the Gazette for this story that State Route 15, the site for the Norland Road billboard, is a recipient of federal aid. ‘’It is our job to make sure the law gets followed, and we take the regulations very seriously. We will be examining the permits,” said Mark Dinger, spokesman for Caltrans.
