NEWS 2 LEGISLATIVE REPORT By the time you read this the 26th Annual Safety and Awareness Rally will be history. I sure hope this was a great weather weekend with lots of bikers in attendance. Our DC Trip members will have returned home but not in time for the BOD meeting to give out a report. I believe this trip was a trip of very strong members who also met up with Kirk “Hardtail” Willard, president of the Motorcycle Riders Foundation (MRF) for what is turning into our yearly meeting with NHTSA. This is at least the 4th annual meeting (could be five, I lost count) we have had with NHTSA and not meaningless meetings either. We have had very good friends named LaHood who has opened those doors with the rusty, squeaky hinges to the NHTSA offices. This is the importance of keeping in good graces with legislators, both state and federal, after they leave office as you never know when they will reappear and in what capacity. Former Congressman, Ray LaHood, was asked by President Obama to be his Department of Transportation Secretary in his first term. WOW!! Ask the Good Lord for some assistance and look what happens!! That couldn’t have worked out better for us. We had a sit down with Sec. LaHood and also with Pres. Obama’s pick for heading up the National Highway Traffic Safety Association (NHTSA) who actually works and reports for the DOT. Now enters Darrin LaHood who won the race for the seat Aaron Schock once held and the tradition CONTINUES!! This is the 2nd year Darrin has gotten that door open for us and has stated he will CONTINUE to open that door for us. Who would have believed a bunch of “dirt bags” would be able to sit down and talk safety issues with Federal Bureaucrats? I would have as I know exactly about your resolve and determination for what we want and need for good safe transportation. My point for all of this is --- Remember our friends who have helped to make our lives easier, safer, and more enjoyable while riding in this great state/country. When they leave their office you never know where they will end up. Many go back to their homes and get involved with local or county politics and there are those that move on to other state jobs and they can be just as helpful on that level as they were on the state/federal level. There are many former state legislators out there that can be quite helpful to us and a few of them are Wayne Rosenthal – Director of IDNR, Rich Brauer – Assistant Director of IDOT, Susana Mendoza – Cook County Clerk, Tom Holbrook – St Clair County, Chris Lauzen – Kane County Board Chairman, and this list goes on and on, too many to mention. At our Legislative Day Reception I witnessed Ernie Steele and other members telling State Rep. Pat Verschoore (72nd), (who is not running again) thanking him for all his support throughout the years. Before all of the legislators take up their new seats we need to thank all of those that were our friends while we still have a chance. NEWS Brothers and Sisters, As I write this, we have had a pretty typical April. Some warm, good riding days, and some cool, rainy (or snowy) days that make me question if spring is really here. I hope you have been able to get out and enjoy some time in the wind. By this time of the year our calendars are filling up with rides and events, usually multiple to choose from every weekend. When you choose which one to attend, do you think about where your money is going or what you are supporting with your attendance? Not that its bad to help raise money for kids or cancer treatment, but why choose their event over the ABATE event? Authority and Accountability. Some call policing a necessary good, others will say it is a necessary evil, regardless it is necessary. Freedoms held dear in a democracy depend on order and justice. Those that hold the authority to enforce order and justice require accountability. Hello everyone! Hope you’ve all been able to get out your bikes for the first spring ride, the weather has been pretty hit and miss but it sure felt good to be riding. By the time you read this the Awareness Rally will be history and hopefully Mother Nature will have blessed us with a beautiful weekend. Plans are full steam ahead for the 5 ABATE is here for you. The funds raised at these ABATE events are used to further the motorcycling related legislative and educational efforts. The legislative efforts cover on-road and off-road issues, while the educational focuses on educating others on how to interact with us on the roadways and educating riders on making smart riding choices. If there is a specific event or ride you would like me to attend for your chapter, please email me the details. I will make every effort to attend, but cannot make any promises until I look at my calendar. Those holding authority should hold subordinates accountable. Thus, trust is compromised. NEWS non-motorcyclist father found out that he was riding and was very upset. He is very anti‑motorcycle and forbids our son from riding. The father claims that he can get a court decree prohibiting our son from riding. Can he get such a decree from the court? D-DAY REMEMBERING JUNE 6, 1944 - PLACES TO RIDE BEFORE YOU DIE: OMAHA BEACH -DOG GREEN SECTOR On my way over to ride the Pyrenees Mountains, I stopped and paid my respects to those that died at Omaha Beach in Normandy. It is unusual for me to ride anywhere but in my own country, but if you ever get the chance go there. And I promise that you will never forget what was done there. On June 6th, 1944, among the many units, Company from the hills of Virginia was to hit the beach at Dog Green Sector in a Higgins boat (the kind used for invasions)-not a good place to be. All 200 of them in that landing craft were from Bedford Virginia (a wonderful place to ride to if you are riding the Shenandoah Valley). They have a monument on the town square to the 176 men of Company A that died when the ramp of their landing craft dropped and exposed all of them to German MG 42 machine guns. At 1500 rounds per minute, the boys from Bedford didn't have a chance. The MG 42 sounds like a chainsaw when it is fired - probably the most dreaded sound at Omaha Beach. So distinctively terrifying was this machine gun that the Army developed training films to help our troops deal with the psychological trauma of facing this weapon. It made a sound like ripping cloth. Our boys called it crudely - Hitler’s zipper. It bothers me in that I am pretty sure the Bedford boys knew what they were in for when the ramp on that Higgins boat dropped. The thought of dying for my county is ok with me, but dying before I even had a chance to shoot back is not. I gathered some sand from Dog Green sector; I couldn't help it. I put that sand in an hourglass and set it on my desk to remind me of what they did and what a bad day is all about. After I left the beach, I had to visit the Colleville cemetery where some of the Bedford boys and many others are buried. It overlooks Omaha Beach and by any definition is a holy place. It is hard to talk there - draw your own conclusions. The gravestones are marked with the name and state of the fallen soldier. Indiana, Illinois, Ohio and Missouri are inscribed on too many. Before leaving, I thought Omaha Beach was a long way from home for those guys and I wondered how many of their folks were able to visit the graves before they too, passed on. That most of their loved ones didn’t get the chance to pay their respects is bothering. P.S. Our guide took us by the cemetery where the Germans are buried. I didn’t ask to go there and he did not ask if I wanted to go. If he had, I would have said no, after all I had lost family in that conflict. I learned there was a 13 year old German soldier buried there, and there was a marker that said, “Most here did not pick the fight or the cause”. I think, I am glad I went. WHEN THE EX HATES MOTORCYCLES Q. I am a member of ABATE and got your contact information from the monthly ABATE magazine. I have a question for you which will hopefully be an easy one to answer. I have a son whom I share joint custody with their father. This past summer, my son developed an interest in riding on motorcycles. As a single mom, I struggle in keeping him interested in activities that we can honestly share. He is fully equipped for rider safety. I am a very skilled and well trained motorcyclist and usually only allow him to ride with me. His A. You have asked a good and complicated question. [I am assuming you have sole custody of your son.] The court has considerable discretion in its ruling on this issue, but the judge should know that this activity is permitted by law, as is football, soccer, cheerleading, gymnastics, climbing and many other sports/activities - like flying in a small plane. First, I would make every effort to educate your ex with statistics demonstrating that motorcycle incidents involving minors are almost non-existent. This is so because of the extreme care most parents and others take when riding with a minor child. You will be able to show that incidents of injuries to minors from a motorcycle crash are less than with with football, gymnastics and other school sports. You could also argue that riding as a passenger on a motorcycle is safer than being a cheerleader, for example. As we know, injuries from that activity are eye opening. Educate him about the riding skills of others who may take your son riding. And let him know that those skills learned while riding will improve your son's skills when he starts driving. If you do wind up in court, then you must go through the same education process for the judge. Find out if the judge rides as many do. Be prepared to prove the riding experience of all of those involved. Bring in your driving and insurance records demonstrating your safe nature and prove it. Bring your son's safety equipment to court and show the judge. Check with your local motorcycle safety instructors who may provide helpful expertise to the court. In short, educate the court that your parental decision is within the norm of American life and that riding is part of that norm. If the judge rides – HE ALREADY KNOWS THIS. If you get into a jam or need statistics for the above, call me. MIRACLE RIDE Reminder - First Week End in June - NEARLY 5 MILLION RAISED FOR THE KIDS! Note from Rod: ABATE LEGAL has received questions relating to mobile home park restrictions on motorcycles. Here is the question: Q: I just moved into a mobile home park. I am on a very limited income and my motorcycle is a primary means of transportation. My bike has stock mufflers and is no louder than most of the vehicles in the park - actually a lot quieter than most of the trucks. The park rules bar motorcycles from the park at all times - no exceptions. Can they get by with this and do I have to comply? A: Let’s first determine if the streets of the park are public or private. This is very important in determining your approach to the park. If the streets are private, your burden is considerable. If the streets are public you will have an easy time in winning your point. Most states that have laws governing rules in mobile home parks and most require that the rules must be reasonable. The Illinois law can be found at 765 ILCS 745, the Mobile Home Landlord and Tenant Rights Act. In Illinois for example, such rules are valid only if the rules “promote convenience, safety and welfare of the tenants, preserve park property from damage or distribute park services and facilities to the tenants:” In Illinois, I would argue that a general prohibition of motorcycles is not enforceable unless your motorcycle runs afoul of these validity tests. For example, if your motorcycle complies with noise and safety issues, how can the park argue such a bar would promote the safety of tenants and preservation of park property, etc.? Accordingly, you should request a meeting to demonstrate that none of the prohibition rules apply in your case. Be armed with evidence that your motorcycle complies with all noise, safety and emission requirements. The gist of your points is that a general bar of all motorcycles is simply not reasonable. The law in most states require some connection to reason before a general bar to a legal means of transportation could be sanctioned. Most regulations like these are directed toward those who would disturb the peace of residents with motorcycles that are loud and speed. As to the latter, speed can be controlled by means other than a general prohibition, like fines or expulsion. Excessive noise can be controlled in a similar fashion. I smell a park owner who just does not want to deal with these issues. Use your powers of persuasion that motorcycles should be encouraged. For example, parking is less of an issue, and noise in many cases of smaller commuting motorcycle are almost stealth like. Help convince him that motorcycles are an advantage in the park if speed and noise rules are strictly enforced. Suggest that stiff fines could be the solution. The Indiana law can be found at Indiana Code 32-31-7, Landlord Tenant Relations. I.C. 32-31-7-5(5) states that a tenant must comply with all reasonable rules and regulations in existence at the time the rental agreement is entered into. A tenant must also comply with amended rules and regulations as provided in the rental agreement. Again, arm yourself with evidence that a rule prohibiting motorcycles is not reasonable. The Ohio law can be found at Ohio Revised Code Chapter 3733, Manufactured Home Parks; Recreational Vehicle Parks, Recreation Camps, Park-Camps, Marinas; Argicultural Labor Camps. In Ohio for example, such rules are valid only if the rules are not unreasonable, arbitrary, or capricious. So arm yourself with evidence that the rule against having motorcycles on property is unreasonable, arbitrary, and/or capricious. He may say “uncle”. There is also a provision that requires a resident to conduct yourself in a manner that will not disturb the other park residents peaceful enjoyment of the park., which may be the owner’s reason for the park barring motorcycles. Most laws also require certain notice provisions as set forth above. Call me if you did not get a copy of the rules and regulations prior to signing the lease. If you have been a tenant for more than 30 days, let’s find out if the park owner was considering a motorcycle prohibition at the same he was selling you on the park. This is especially important if he had knowledge that you owned a motorcycle when you signed the lease as this could be a form of fraud if he slipped this past you at the time you signed on. WHEN TREES GET YOU DOWN WHAT TO DO AND WHO TO NOTIFY Q: I was in a bike accident Monday. A tree was hiding the stop light and I didn't see it until the last minute. I locked it up but ended up sliding through the stop light 6 and hitting a car. I was given a ticket for running the red light. The officer told me that I could go to court, plead my case about the light being hidden and get the ticket dropped. He basically admitted that the light was hidden. Now, people are telling us to sue. We are not sue happy people but if the tree had been trimmed this would not have happened. What can I do? ABATE member. A: Ther e ar e a number of things you can do to help yourself out and preserve facts for your case. You are like a lot of folks in this country that have never filed a lawsuit and understandably want nothing to do with that process. Sometimes a case like yours can be resolved simply by making a request to the court that is well documented and compelling. In order to get to that position, get a series of photos approaching the light from the lane in which you were riding. A simple camera photo will do. If the city has already cut the branches, get photos of their recent modification. Statements of the adjoining property owners and others witnessing the trimming by the City should be obtained as soon as possible. These witnesses demonstrate that the City had notice of the hazard. You will have the burden to prove that the light was obscured at the time of the crash. If the City (you need to make sure they had the responsibility for trimming the tree) has not trimmed the branches yet, a notice by you to them is in order. A copy of the cell phone photos should be emailed to them immediately. RoadHazard.org sent a notice, which should help. If you have a copy of the police report, send it to us. If not, we will order one for you. That will be useful in both locating the police officer who responded, as well as identifying how he documented the accident. He may have listed critical witnesses who can confirm our facts. You will need a statement from him admitting that the tree obscured the light asap before he forgets about your case. You must also notify your insurance carrier of your crash in writing. And send them a copy of your photos and a copy of the crash report. When you are making a claim against a government entity, you will need to make sure you place them on notice of the accident. Most states, including Indiana, require that a specific notice be given to the government entity within a certain time of the incident. If you fail to do that properly you can lose your claim. In Illinois, suit must be brought against the government entity within one year of the incident. In Ohio, there is no notice requirement, but the suit must be brought within two years. Good luck and if you have any questions call us. ROADHAZARD.ORG Well the weather has finally broke (unless you’re in Indiana, I’m sure we’re due for snow any day now) and motorcycles are once again prevalent on our roadways. One thing that we are sure to come across with the passing of winter… POTHOLES! Please do your fellow motorcyclists a favor and report potholes and dangerous roadways to RoadHazard.org. We pride ourselves on getting problem areas fixed and safe for riders. Thank you from your fellow riders and safe travels. NEWS REGION COORDINATOR REPORT Hello from your NW Region Cocoordinators Sandy Murrell and Bud Lein. The weather is getting better and better for riding, so lets’ hope it continues. May is Motorcycle Awareness month. We want everyone to be safe so we need to ride on the defensive at times, as there are obstacle’s out there that could hinder us. Some chapters have signs/banners they put up in their region so the general public is aware that riding season for riding motorcycle is here. Some of us have already ridden, so I hope you have T-Clocked your bike so there won’t have to worry about problems occurring with your bike. Other things we need to be careful about is sand on the roads, especially at the intersections and those nasty pot holes. I know they are all over, but up in the northern part of the state it seems they are the worst. Just watch out for them and be extra careful. Don’t forget that some chapters are doing Summer Fun Run books, so if you want to do some destination rides that you have never been to before, contact the following chapters who are doing them: Freeport, Kishwaukee, Thunder Rock and Open Roads. I am sure they would be glad to sell you one. There are rewards at the ends, so it may be worth a good investment. Want a destination ride during during the week????Every Wednesday night starting April 6 and running until October 5 Freeport Chapter is promoting Bike Night at Logans Bar & Grill, Freeport, IL from 5:00 p.m. to 8:00 pm. Come up, over or Hello again. Wasn’t it lovely to have a couple of warm days before the cold returned? Someone should smack that prophesying rodent with a shovel. Don’t call PETA on me; I’m just kidding. Sort of. The Freeport chapter celebrated our 30th anniversary with a great shindig. The food was good, the music was grand, and the company was even better. We had a wonderful turnout and hope everyone enjoyed themselves. There was speechifying by some of our officers as well as Freeport’s Mayor Gitz and State Representative Bri- down to Freeport and help promote this. SAVE THE DATE: Convergence Run, Saturday, September 24, 2016. Would love to see a good turnout. The date was changed, but we wanted to accommodate as many as we could, as it would have fallen on the same weekend as State Party. See flier for details, or call Sandy or Bud if any questions. Freeport Chapter had their 30 Year Anniversary celebration on Saturday, March 19 at the Masonic Temple in Freeport. What a great milestone to celebrate!!!! Not only did their own chapter members attend, but there were people come from other NW Region chapters to help them celebrate. We are all brothers and sisters and should support each other. The food was good and the band was wonderful. It was fun night for all. Thanks to those that attended. MAY CHAPTER EVENTS: Freeport Chapter- Memorial Ride, Saturday, May 14, 2016. You’re out riding on a beautiful Saturday afternoon, hopefully we’ll get one of those pretty soon, you pull into a gas station, you see a couple of people on their bikes at the pumps fueling up, what do you do? Do you pull up to a pump, nod in their direction, fuel up and go on your merry way? Or do you get off your bike, walk over to them and ask them if they are ABATE members? I have another question for everyone. Did you know that you now only need to sign up 5 NEW ABATE members to earn a FREE membership? Just 5, that’s all! A handful of membership applications doesn’t take up that much room in your saddlebag, keep them handy, so the next time you run into folks that may not know what ABATE does, talk to them, hand them an application, what have you got to lose, the worst they can do is tell you they’re not interested. (Don’t forget to write your name on the application where it says “Where did you hear about ABATE?”, so that you get credit for signing up a new member.) If you need applications, talk to your chapter president or contact me and I will be happy to supply you with some! Diana Rebechini, Legislative Southern DuPage Chapter drinking ] + All the traffic is going in the same direction! No need to street race. Be safe. Hello from So. Suburban, Historically, Illinois has always gone hand to handlebar. In the middle of the nation with mostly flat land to ride through there is plenty of motorcycle things happening. The racing season is in full swing rain or cold. In the past there was a big time Hill Climb in Cary [ I seen pictures ] now I go to Polo, Il. For the Rock River Riders hill climb on Fathers Day. How about the Peoria TT Races [ what a great track ] Many great drag race tracks like Byron or Cordova. Well into the 50’s the Springfield Mile was the race track to win. All flat track motorcycle races led up to this mile for the season final. If you won THIS race you were champion of the YEAR. It is still one of the fastest dirt tracks in the world and they have 2 major races on major Holiday weekends. The idea here is to pick a venue, pick a date, pick a route, pick up your friends… and go for a RIDE. Many of these and other tracks like ‘Blackhawk Farms’ also have race training days or grudge matches where anyone can go racing if you pay a fee, pass tech inspection, wear proper race gear and have the right attitude. [ no Short and sweet this month, folks: The book run books should be available for purchase in any of our stops. Respectfully Submitted, John Faulhaber VP, Will County Chapter MAY 2016 ABATE OF ILLINOIS, INC. NEWS River Valley ABATE May is Motorcycle Awareness Month!!! River Valley Brothers & Sisters, We had a GREAT meeting last month. I want to thank everyone who came out and especially those that braved the cold and winds to bring their bikes and signed up for the Summer in the Saddle Contest. Remember, if you couldn’t get your bike to the April meeting, you can bring it to any membership meeting up to and including the September meeting. Final mileage will be taken at the October meeting, and your bike MUST be present. Prizes will be awarded to the 1st, 2nd and 3rd place winners at the November meeting. (Cash prizes will be determined by the amount of bikes registered) At the last meeting, the members asked if it was possible to have more weekend meetings. It is definitely possible for next year. We are committed to our schedule for 2016, but I will look into scheduling more weekend meetings for 2017. I am thinking that the majority of the weekend meetings will take place during the riding season, that way we can finish the meeting and, weather permitting, take a ride afterwards. A few months back, I took on the responsibility of NE Region Coordinator. I was worried that this new job would interfere with my main focus, the River Valley Chapter. In some ways it has. I find myself getting bogged down with the little things, like returning phone calls, e-mails and such. One of my officers, Paddy Brennan, saw that I was getting a little overwhelmed and he graciously offered to assist me with these things. I am happy to announce, that Paddy Brennan, current River Valley Membership Co-Coordinator, is now also the River Valley Chapter Vice President. Thank you Paddy for stepping up!! If you find it difficult to reach me or I do not return a call or e-mail, please reach out to Paddy, you can find his contact information on our chapter website: www.rivervalleyabate.org. Speaking of the NE Region, I cannot express enough how important it is for all of us in the NE Region to support each other. Each chapter has events coming up throughout the year. Some of these events are just for fun and some of the events are that chapter’s main fundraising event for the year. Whatever the case, consider attending other chapters’ events and show your support. Just this weekend, Dave and I attended the South Suburban Bunny Bar Hop and Adult Egg Hunt. This event was free to attend and we had a great time!! I haven’t been on an Easter Egg Hunt for many (many) years, and I had a blast looking for eggs and excited with the prizes that I won. (Especially my little light up rubber ducky!). ABATE stands for A BROTHERHOOD AIMED TOWARDS EDUCATION. So let’s put a little more BROTHERHOOD into the NE Region! River Valley will have an information/ membership booth set up at the May 1, 2016 Peotone Swap Meet from 10 am – 4 pm. (Please note that the date has changed for this event. It was on the calendar for May 7, 2016) Come on out and see us, and remember that Mother’s Day is the following Sunday. Can you think of a better Mother’s Day gift than an ABATE of Illinois Membership? I certainly can’t…. By the time you read this, the 3rd Annual River Valley Spaghetti Dinner will have come and gone. I will have a report next month. Did you know that you can earn a FREE Membership from ABATE of Illinois? Yes, I said FREE. How you ask? Easy! Sign up just 5 NEW ABATE members between January 1, 2016 and December 31, 2016 and you will earn yourself a FREE 1-year membership. FYI, members are NOT required to own a motorcycle or even ride one, they only have to be passionate about preserving and protecting our motorcycling FREEDOMS, so please keep that in mind when recruiting new members. (When you give out membership applications, please make sure you write your name in the line that reads “Where did you hear about ABATE?” to make sure that you receive credit for signing up that member.) If you need applications let me know, I have plenty to spare! The next River Valley Membership Meeting is: Wednesday May 4, 2016 7 PM Beef O’Brady’s 547 Main St Bourbonnais (Next to the Jewel/Osco on Route 102) I look forward to hearing from River Valley Members. As in the past we are running around Shelby County in March and April reaching out to each of the mayors in Shelby County so that they, like our governor can proclaim May as “Motorcycle Awareness Month”. I would like to say congrats to Julie Pratt for wining the Walther 9mm in the E.C.R. gun raffle. Something else all of us A.B.A.T.E. members need to work on is MEMBERSHIP!!! Numbers are really dropping down state-wide. I can't imagine why people would not want to be an A.B.A.T.E. member with all we have to offer. We all need to get our numbers up by getting new members and old ones back and getting people involved. I don't even want to think about what it would be like having restrictions. So whatever kind of sales pitch you have to get people to join and get involved best start using it. We have a lot of good people in our chapter and I want to thank them for being apart of it.
