COUNCIL MINUTES: OCTOBER 28, 2013 Minutes of a meeting of the Council of The City of Prince Albert held in the Council Chamber, City Hall, on the above date at 5:04 p.m. 1. CALL TO ORDER: Mayor G. (RPT#PW-13-84) Trillium Terry Hayes, Sr. Administrator, Developments, requested that Council use fairness, and consider a reduction to the Service Charges to assist in their mission to provide affordable housing. 0769. Ring: That the Report from Manager of Capital Planning and Strategic Services dated October 10, 2013, with respect to Prior to Application Service Charges - Trillium Developments be received ; and , that the following recommendations of the Manager of Capital Planning and Strategic Services, as amended, be approved: 1. That the request from Trillium Developments for The City's forgiveness of $31 ,195.87, of existing Prior-toService-Application charges, be denied; and, 2. That the Report from Manager of Capital Planning and Strategic Services dated October 12, 2013, with respect to Prior to Application Service Charges Trillium Developments be referred back to Administration for further review and report and a Policy to deal with Prior to Application Service Charges. That the Report from Manager of Capital Planning and Strategic Services dated October 10, 2013, with respect to Prior to Application Service Charges - Trillium Developments, be received and referred back to the Planning and Development Services Department and Financial Services Department for further review and report. 11.7 0771 . Reports from Planner 1 dated October 11 and 23, 2013, both with respect to 131h Street West Subdivision. (RPT#PDS-13-117 and RPT#PDS-13121) Moved by Councillor M. Ring, Seconded by Councillor C. Miller. AND RESOLVED: That the Reports from Planner 1 dated October 11 and 23, 2013, both with respect to 13th Street West Subdivision be received; and, that the following recommendations of the Planner 1, as contained therein, be approved: "1. That the original report on the 131h Street Subdivision, being RPT#PDS-13-117, be disregarded and replaced with the new report, being RPT#PDS-13121; 2. That the Subdivision Consolidation Application for the lands legally described as Lots 15 - 19, Block 3, Plan No. P4175 be approved; 3. That the Applicant be required to enter into a Servicing Agreement with The City, and that the Mayor and City Clerk be authorized to execute the Agreement, on behalf of The City, once prepared; and , 4. That the Mayor and City Clerk be authorized to execute the Final Plan of Survey, and any other necessary Agreements, on behalf of The City, once prepared." CONSENT AGENDA: 10.1 Report from Planner 1 dated October 9, 2013, with respect to Zoning Bylaw Amendment - R5 - Multi Unit Dwelling to P - Park. (BYLAW NO. 43 OF 2013 -1sT READING) (RPT#PDS-13-115) That the Report from Planner 1 dated October 9, 2013, with respect to Zoning Bylaw Amendment- R5 - Multi Unit Dwelling to P - Park - Bylaw No. 43 of 2013, be received; and, that the following recommendations of the Planner 1, as amended, be approved: 1. Report from Development Coordinator dated October 15, 2013, with respect to Demolition of Building - 18 - 15th Street East. (RPT#PDS-13118) Moved by Mayor G. Dionne. AND RESOLVED: That the Report from Development Coordinator dated October 15, 2013, with respect to Demolition of Building - 18 - 15th Street East be received; and, that the following recommendation of the Development Coordinator, as contained therein, be approved: "That the Development Application for a Demolition Permit for the property located at 18 - 15th Street East, formally known as Suzie Cue's, be approved." That Administration provide a Report on whether the $42,000 amount listed on Page A-77, regarding the payment to Miller, Dicksenson and Blais was brought in and where the funds were spent. Councillor R. Orr resumed the Chair at 5:50 p.m. 11 .2 0782. Report from City Clerk dated October 1, 2013, with respect to 2014 Executive Committee & City Council Meeting Schedule. (RPT#CORPCLK-13-21) Moved by Councillor M. Ring. AND RESOLVED: That the Report from City Clerk dated October 1, 2013, with respect to 2014 Executive Committee & City Council Meeting Schedule be received; and, that the following recommendations of the City Clerk, as contained therein, be approved: "1. That the 2014 Executive Committee and City Council Meeting Schedule, as outlined on the attached list, be approved; 2. That a departure from the regular meeting scheduled for the Executive Committee meeting in February be approved to accommodate the attendance of mem.bers of Council at the Annual Saskatchewan Urban Municipalities Association Conference on February 2- 5, 2014, in Regina; 3. (RPT#CORP-IT-13-03) Moved by Councillor M.D. Tweidt AND RESOLVED: That the Report from Information Technology Manager dated October 11 , 2013, with respect to Bring Your Own Cell be received ; and, that the following recommendations of the Executive Committee, as amended, be approved: 1. That the Bring Your Own Cell program and its associated reimbursement rates for all City Employees, who choose and are approved to use their personal cell/smart phones for City of Prince Albert business, be approved; and, 2. That the Bring Your Own Cell Program and its associated reimbursement rates be available for Elected Officials, subject to the necessary Public Notice in accordance with the provisions of City Council's Public Notice Policy being Bylaw No. 5 of 2003. AND RESOLVED: That the Report from City Assessor dated October 16, 2013, with respect to Tax Exemption Request - Northern Prairie Arts and Cultural Studio Inc. be received; and, that the following recommendation of the City Assessor, as contained therein, be approved: "That the request from Northern Prairie Arts and Culture Studio Inc. for a 2013 and 2014 tax exemption for the properties located at 969 - 1st Avenue East and 80 - 10th Street East, be denied." 11 .10 Report from Fleet Manager dated October 18, 2013, with respect to Tender No. 122 of 2013 - Single Axle Truck complete with Gravel Box. AND RESOLVED: That the Report from Fleet Manager dated October 18,2013, with respect to Tender No. 122 of 2013- Single Axle Truck complete with Gravel Box be received ; and , that the following recommendation of the Fleet Manager, as contained therein, be approved: "That Tender No. 122 of 2013 for the purchase of an International 4300 single axle truck, complete with a Lanau Industries SM gravel box, from Maxim Truck and Trailer, for the total amount of $98,031, less the trade in value of $38,000 for Unit 92, plus applicable taxes, be approved." Dionne, AND RESOLVED: That the Report from Committee of the Whole Council lncamera dated October 28, 2013, with respect to Appointment of City Manager - Bylaw No. 46 of 2013 be received; and, that the following recommendations of the Committee of the Whole Council lncamera, as contained therein, be approved: 12. 0789. "1. That James Victor Toye be appointed as City Manager of The City of Prince Albert effective January 2, 2014; 2. That Bylaw No. 46 of 2013 be given three readings; 3. That consideration of Bylaw No. 46 of 2013 be laid on the table and brought up under the Order of Business "Introduction and Consideration of Bylaws"; and , 4. That the Mayor and City Clerk be authorized to executed the Employment Contract, on behalf of The City." UNFINISHED BUSINESS: Moved by Councillor M. Ring, AND RESOLVED: That the Report of the Committee of the Whole be adopted. 13. MAYOR & COUNCILLORS FORUM: OCTOBER 28, 2013 PAGE13 CITY OF PRINCE ALBERT 14. INQUIRIES: 14.1 Inquiry from Councillor C. Miller to the Director of Public Works: "Could the curb at 18th Street and 6th Avenue West be inspected, as it is too high to drive on and could cause damage to vehicles." The Director of Public Works, in responding to the Inquiry, indicated that this is being worked on, however some curb will be necessary for drainage purposes. 14.2 Inquiry from Councillor T. Scharkowski to the Acting Director of Community Services: "The trees at 121h Avenue and 22"ct Street East near the Golf Course need attention, as they pose a hazard to pedestrians." The Acting Director of Community Services, in responding to the Inquiry, indicated that a site meeting with Councillor Scharkowski is required to make sure the correct area is being looked at and once this is determined the trees will be dealt with. 14.3 Inquiry from Councillor M. Ring to the Director of Public Works: "What is the status of Garden/Yard Refuse pick-up, as people need to know, and the website needs to be updated. Also, please advise members of Council the date of the final pick-up for the year." The Director of Public Works, in responding to the Inquiry, indicated that the last date of yard pick up for the year is November 14, 2013, and the City's website has been updated. Orr to the Director of Public Works: "Could the Transportation Project Manager investigate whether a Bus Shelter could be located in front of the Columbian Centre at 205 - 131h Street West. Also, could the trip hazards on the sidewalk and ramp at the front door of the same location be addressed." Councillor R. Orr assumed the Chair at 6:18 p.m. Mayor G. Dionne to the Director of Public Works: "Can The City get insurance for the sidewalk damage on 1st Avenue East, as a result of SaskTel Work, and can the repairs be done as soon as possible." Mayor G. Dionne to the Director of Financial Services: "Can the Executive Assistant in Financial Services assist the Mayor to provide a Report on all building and property leases that The City has in the City, for consideration at the November 18, 2013 Committee of the Whole Councillncamera meeting." 0791 .
