Concerns rising
Subdivision rules changing
Metro is looking at new rules for subdividing lots, which

A community meeting
Monday, Dec. 9, will let the
public hear about and comment on proposed new rules
on subdividing lots. The new
rules could be adopted as soon
as Thursday, Dec. 12, by the
Metro Planning Commission.
But at a Metro Council com-
mittee meeting this week,
Council members, property
owners and developers were
dismayed by new rules that
could, as one councilman said,
have
“unintended
consequences.”
“Rules can change as long
as they are far enough ahead.
This could be devastating for
some” owners and investors

planning to subdivide property and build housing, said Yogi
Dougher, a real estate financial agent and developer. New
rules should be adopted with
implementation delayed at
least six months, he said.
Neighborhoods could also
be blind-sided by the proposed
rules, said Metro Councilman
Carter Todd. The new rules
distinguish between areas as
residential maintenance and
residential evolving. It would
be more difficult to subdivide
in maintenance areas than
evolving.
Under the proposed rules, a
request to subdivide a lot in a
neighborhood maintenance
area would require that its lots
be comparable in size as well
as the character of the neighborhood. But the evolving area
would not weigh comparability with adjacent properties.
But, Todd said, most people
are unfamiliar with the community plans that designate
those areas. In his Green Hills
district, very similar areas are
designated very differently. “It
may be time to re-evaluate
what is neighborhood evolving
and what is neighborhood
maintenance. I think when
those plans were done people
didn’t realize how important it

An incident this past weekend shows the risk that law
enforcement officers face during
traffic
stops.
On
Thanksgiving afternoon, Metro
Police arrested John Vogt, 59,
on DUI charges after he struck
a Belle Meade patrol car making a traffic stop for speeding
on Harding Pike.

near Davidson Road. Howell
had to jump out of the way to
avoid being hit. Her patrol car
was struck on the driver’s side
in the rear then knocked into
the stopped car. The city’s
Police Chief Tim Eads said
“Officer Howell was shaken by
the incident and had to take the
rest of the night off. She had a
close call.”
Vogt told officers he swerved
into the patrol car to avoid hitting a car on the other side.

Porter Flea and West Elm
Nashville artisans show off wares at holiday markets
Jenny Upchurch
Associate Editor
Two of the season’s artisan
crafts fairs will offer Nashville
shoppers a chance to purchase
unique, handcrafted gifts.
• The Portland Flea Holiday
Market will be 10 a.m. to 6 p.m.
Saturday, Dec. 7, at 4th Avenue
and Chestnut.
• A Maker’s Market at the
West Elm store in Green Hills
will be from 10 a.m. to 6 p.m.
Saturday, Dec. 21.
Among the 85 artists selected
for the Portland market is
Nashville
artisan
Chris
Johnston and his lamps made
from vintage kerosene Coleman
lanterns. He will also be at the
West Elm show.
Johnston said that he gets a
warm glow when he views one
of his creations. He remembers
camping with the iconic greentop Coleman kerosene lanterns
as a boy with his family and
now with wife, Katie.
“You really can’t have a bad
feeling about a Coleman
lantern,” Johnston said.
Johnston got the idea after
seeing a generic kerosene
lantern wired for electricity.
“We had a Coleman lantern on
the porch to restore. I saw it in
pieces and had the idea to put
the bulbs in it,” he said. “The
biggest challenge was hiding
the wiring.”
Typically, Johnston doesn’t
do more than clean up the
Coleman lanterns he buys at
flea markets and estate sales.
“It’s cooler to see and imagine
where they’ve been” to get the
scratches and dents.
“I just love the craft of it. I’m
not comfortable unless I”m
making something. Lots of (the
lanterns) don’t work so it’s fun
to bring them back to life.”
Chris Johnston holds one of his rewired Coleman lantern
lamps, which will be featured at artisan market in Green
Hills on Saturday, Dec. 21.

Metro/State
Commentary

MTSU Business Professor
Former Metro Councilman
BURNT has had impact
on Nashvilleʼs greeness
Bring Urban Recycling to
Nashville Today (BURNT), a
not-for-profit public interest
group dedicated to a clean and
safe environment, was organized in December 1988. With a
fledgling band of knowledgeable and passionate adherents,
BURNT faced a number of challenging environmental issues
in Nashville. The odds were
against BURNT’s success, but
this did not stop the zeal and
determination of its members.
When
BURNT
started,
Nashville was burning 800 tons
of garbage on Nashville’s
downtown riverfront near
lower Broadway. There were
plans for a $200 million expansion for the incinerator to burn
even more garbage. BURNT
was initially started to fight
this proposed expansion. Later,
BURNT targeted the $100 million solid-waste processor on
Rolling Mill Hill designed to
clean the waste for the incinerator (in those days, usually
referred to as the Downtown
Thermal Plant).
Also, at its inception,
BURNT fought against the rendering
plant
in
North
Nashville. The plant, by its processing of meat oils, heavily
polluted Germantown, East
Nashville, Metro Center, and
downtown. Its noxious odors
adversely affected the areas of
downtown,
South
Broad
(SoBro), and East and North
Nashville.
Moreover, in the beginning,
BURNT faced a permitted
incinerator in Madison near
the Bridgestone tire plant and a
liquid hazardous processor in
Cockrill Bend.
Working
with
the
Cumberland Green Bio-Region
Council, the Metro Council, the
Metro
Public
Health
Department, and the Health
Board, BURNT ultimately
helped stop the garbage processor and the rendering plant.
However, the bulk of BURNT’s
energies in its early years was
focused on the downtown incinerator.
BURNT used three strategies
against continued use and
expansion of the incinerator.
First, it railed against the air
pollution spewed by the incinerator. Second, it pushed recycling in lieu of burning
garbage, in order to create jobs.
Although neither of these
strategies yielded much success, BURNT’s argument that
burning garbage on prime
riverfront downtown property
was poor land use (not good economically) began to make sense
to Nashville’s decision-makers.
Bruce Wood, the president of
BURNT, is intelligent, shrewd,
and hard-working. He touts the
benefits of BURNT’s successes
as: “Billions of dollars in construction, architecture, banking, building supply, legal and
other expenses were generated
by closing the polluters.
Stopping the rendering plant
allowed Metro Center to grow
and LP Field and the Titans
practice facility to be built.
Apartments, condos and major
office buildings in North
Nashville and SoBro need clean
air. Nashville leaders expanded
the riverfront parks on the east
and west banks. Two hundred
garbage trucks making round
trips every day to a garbageburning
incinerator
and
processor would have driven
out plans for the Schermerhorn
Symphony Center, Pinnacle
Bank and Music City Center.”
After the incinerator was
stopped, BURNT began work to
eliminate unsafe pesticides in
Metro schools and buildings, as
well as to control pesticide use
in mosquito spraying.
Now BURNT’s primary
interest is generating more
recycling and composting. By
composting, or separating wet
from dry waste, which results
in enormous amounts being
diverted from landfills, both
Metro and the state could save
big bucks.
During my 12 years on the
Metro Council, I worked with
BURNT on a number of environmental
issues
facing
Nashville. Whatever BURNT
advocated, it did it well, always
offering research-based and
positive solutions. And I regard
Bruce Wood, BURNT’s president, as one of Nashville’s most
effective lobbyists for the public
good.

Todd said.
West Meade residents are
facing such an issue. There has
been strong opposition about a
proposed development of eight
homes at Sedberry and Post
Road on two single-family lots.
So far, the plan for The Rail at
Post Station has sailed through
the

commission
because it was designated as a
neighborhood evolving area in
the West Nashville community
plan.
The overall goal of the new
subdivision standards is to balance a desite for infill housing
with preserving established
neighborhoods’ character, said
Doug Sloan, deputy director for
the planning staff. However, it
will not prevent teardowns of
homes to rebuild and it won’t
affect a single home on a lot that
is actually platted as two or
more.
District 12 Councilman Steve
Glover questioned if the new
rules would supersede cluster
home guidelines, which allow
greater density if some of the
property is left as green space.
Sloan said it would not.
But Glover said that he is
still concerned about the rules

many of the objects that Galileo

with first observing through the
newly invented telescope. Just
after sunset, observers with a
good view of the southern horizon will see a white "star." This is
the planet Venus, the brightest
object in the sky except for the
Sun and Moon. With his telescope, Galileo observed Venus
go through phases — evidence
that the Earth was not the center
of the universe. Today's skywatchers can observe Venus for
all of December. At first, Venus
will appear as a thick crescent.
As it continues to pass Earth,
Venus will be moving closer and
almost directly between us and
the Sun. By month's end, Venus
will appear as a very thin crescent about 50 percent larger.

the planet Jupiter with his telescope. He noted what looked to

The eight-day Hanukkah

Taxing
Matters
By Jim Wilson, CPA
IRS Tools for Tax Collection
— None in Your Favor
Do you owe back taxes? A
levy of your bank accounts may
be looming in your future. The
best way to avoid such action is
to seek some agreement with
the Internal Revenue Service
before you receive notice of a
levy. There are options allowed
in the Taxpayers’ Bill of Rights.
First, you must be current. If
you are employed, you must
have made adequate tax payments for the current year. The
Service will not “make a deal”
if you owe current unpaid
income taxes.
Next, analyze your ability to
pay. A ridiculously low offer to
pay small amounts on large tax
balances will be met with opposition. Assuming you have
made provisions for your current year’s taxes, a common
solution is an extension of time
to pay the balance in full.
Extensions can give the client
up to 120 days to pay the balance and avoid a levy.
If you can not pay with an
extension,
an
installment
agreement allows you to make
monthly payments. Remember,
while you are paying the
monthly payments, your interest and penalty for failure to
pay the taxes when due continue, and will often absorb the
payments you make without
any reduction in the balance of
tax you owe. If you are unable
to pay, due to some reasonable
cause, you may use the strategy
to request to have your account
placed on a “currently not collectible status,” which classifies you as temporarily unable
to pay. Requests for both of
these agreements suspend levy
actions.
If you request the deferral of
payment method, the Service
will revisit your account annually to determine your ability to
pay status.
An installment agreement
will protect you from issuance
of a levy, unless you miss a payment. If a payment is missed,
you are back to square one,
except the process is more difficult. Your credibility will have
been compromised.
If you owe federal taxes and
you have neglected or refused to
pay, a federal tax lien arises for
the amount owed, including
penalties and interest. The lien
affords the Service a legal claim
to any and all property you
own. A Notice of Federal Tax
Lien may be filed at a local
courthouse and is a public
record. A recorded federal tax
lien establishes the government’s right of priority all of
your assets as a priority to all
third parties (to protect its
interests). In extreme cases, it
is possible to have property sold
for payment of delinquent
taxes and the taxpayer continues to owe the mortgage.
The Service may formally
file a Notice of Federal Tax
Lien when a notice and demand
for payment is sent and the
recipient ignores the demand
or refuses to make a payment
within 10 days. The Service will
usually send multiple notices
before filing a tax lien, but I
would not bet on it. I have seen
cases where the Service sends
one notice and follows with a
threat to file a lien or to levy the
assets of the taxpayer.
If you are in peril of losing
your property or fear that
enforcement is imminent, call
us immediately. Do not ignore
the problem. It will only get
worse and it will not go away.

Weekly
QuickBooks
QuickTip!
By John Sawyer
Hi QuickBooks Users!
Last week we explored the
Customer Center of the
QuickBooks “Home” page.
Following the blue line (aka
the “Yellow Brick Road”)
through the middle of the
Customer Center was determined to be the “Secret of
Success” for satisfied QuickBooks users. Staying on the
thin blue line takes the business owner from “Estimates” to “Record (Bank)
Deposit” in a simple, safe
and logical manner allowing
entrepreneurs to focus on
generating sales, not bookkeeping them!
Today, let’s move through
the “Vendor Center” at the
top left section of the
“Home” page. The Vendor
Center is how one enters
bills into QuickBooks. Some
people just keep their bills
stacked up on their desk in
date order with the next bill
due on the top of the stack.
The theory there is simple –
all you have to do is watch
the one bill on top of the
stack and you will never be
late in paying your bills. I
call that the “land mine” approach to cash basis accounting. I suppose that works if
cash flow is not an issue and
you’re not really concerned
about understanding where
your business truly stands
on an accrual basis.
My only question is this –
why not let QuickBooks do
the tracking work for you?
You already own the software – put it to good use to
make your life simpler. Not
only will it readily track and
age your payables, but it will
also generate electronic bill
payment checks for you at
the touch of a button! Let’s
all admit one thing that
everybody can agree on – sitting down, writing checks,
paying bills, stuffing, licking
and stamping envelops, is a
drag! It takes “FOREVER”
(sounds like a teenager saying “WHATEVER”) and
there’s never a convenient
time to do it! Did you know
that QuickBooks can generate over 20 checks in less
than 2 minutes?
Simply
amazing!
So in the upper left portion of the home page, you
will see the vertical “Vendor
List” icon or “Totem Pole” –
simply left click thereon and
your list of vendors will be
displayed. To the right of the
Vendor list, you will see the
“Enter Bills” icon. By left
clicking on “Enter Bills”
icon, you can enter vendor
bills – I realize this seems
painfully obvious, but that’s
how simple QuickBooks
makes it! Then, if you follow
the blue line (aka the “Yellow
Brick Road”) to the right, the
next icon is the “Pay Bills”
icon. By left clicking on the
“Pay Bills” icon, QuickBooks
displays a list of all bills in
the system. You then choose
the bills you want to pay and
how much you want to pay
on each bill. Payment checks
are placed automatically in
the “Print Queue” or you
may choose to hand write
your bill payment checks!
From Page One
Tennessee’s “Move Over
Law,” passed in 2006, requires
motorists to move over into the
adjacent lane of traffic or slow
down for emergency vehicles.
Tennessee was the 30th state
to establish a Move Over Law to
give emergency personnel a
safety zone on the highway. The
penalty for violating the “Move
Over Law” in Tennessee is a
maximum fine of up to $500 and
up to 30 days in jail.
The state Department of
Safety reports 107 Move Over
citations in Davidson County
from 2006 through 2012.
One well-known incident
resulting in loss of life for a
police officer occurred in 2004.
Hermitage
Police
Officer
Christy Jo Dedman was struck
and killed by the driver of a
tractor-trailer. She was assisting a motorist on the side of
Interstate 40 near the Stewarts
Ferry Pike ramp.
Officer
Dedman and the motorist were
standing in front of the driver’s
side of the police car, which displayed flashing blue lights,
when struck from behind by a
tractor-trailer traveling at over
80 miles per hour.
The
Hermitage
Police
Precinct building is dedicated
to her memory as was a portion
of Highway 100.
So, here’s this week’s
QuickTip # 111 … Paying
bills brings closure to the full
business cycle – it’s a
dreaded task, but it always
feels good to get it done!
QuickBooks takes the drudgery out of paying bills – its
two step process is so simple
it’s ridiculous. Each day,
when you get your mail, separate the bills and IMMEDIATELY enter them into
QuickBooks and let QuickBooks do the work of tracking and paying bills – it’ll
take about 10 minutes per
day – surely you’ve got time
to do that each morning with
that first cup of coffee …
read on and we’ll explain
how!
And please remember, the
second Friday every month,
a small group QuickBooks
seminar, limited to six attendees, is offered at The Boardroom (2400 Crestmoor Rd.) in
Green Hills covering the essentials of QuickBooks for
your home or business! The
next class will be next Friday,
12/13/13. The cost is only $50
for the four hour training
session which begins at 01:00
PM – please call 615-397-9933
for complete details!

Matt Davis whizzed to a winning finish in the wheelchair
division at Thanksgiving’s
Boulevard Bolt, his fourth on
Belle Meade Boulevard.
Davis has raced in 37
marathons, including races in
Japan and China. He’s participated in the Boston Marathon
four times.
Davis, who has spina bifida,
started competing as an undergrad at Western Kentucky
University with the support of
a school official who helped
him acquire a racing chair.
“The first time I ran a race, I
couldn’t believe I was going to
do it,” Davis said. “When it was
over, I only wanted to know
when I could do it again.
Davis is coordinator of
Student Disability Services at
Western Kentucky University
in Bowling Green. He was racing in the Boulevard Bolt for
Achilles International, which
helps people with disabilities
get active with running or
wheeling. Davis is president of
the National Wheelcats, a
Tennessee-based group that
provides funding and awareness programs for adaptive
sports and exercise programs.

Cloister’s foundations are just
that: foundations costing now

this figure anyway?
AMP in Hillsboro Village
I've got an idea about where
to situate the AMP. Apparently
the idea behind the AMP is not
to facilitate travel for Nashville
residents, but rather to force
drivers off West End Avenue
and Harding Road. Therefore I
suggest that the route go down
21st Avenue. Since the AMP
requires three lanes to operate
and Hillsboro Village politics
requires that parking be available on 21st Avenue, commuters
would be totally prohibited
from traveling on 21st Avenue

Pledge & pray in school
There has been a recent
recall of the pledge to the flag
by a man who has served in the
military. He is concerned this is
not being asked for in many of
our public schools. In discussing this I have heard they
want to preserve freedom and
liberty in the public schools.
Our nation has been built on
this type of things, especially in
the “under God” statements. If
you want to know our wonderful history in this regard go
online. Isn’t it more important
that we honor God and we
honor the most important
things in our nation than we
overlook people who may be different? I know there are many
reasons for students to go in

the day. It would be so simple to

Tennessean’s charges
I am ticked off at The
Tennessean. I just got my bill
and they are charging us $2
more for the Thanksgiving
issue. They are charging extra

lucky people are taking their

Extra charges unwanted
I am ticked off that The

I’m upset The Tennessean

Children left in car
I want to report a blue gray
Honda. A woman got out of it at
the Green Hills Kroger. Parked
wrong to begin with, blocking
some other cars. She left her
small children in the car while
she went in to make a return.
Now, I wish the Metro Police
would look into this. Whatever
needs to be done whether Child
Protective Services. She went in
to return something. You don’t
leave your children in the car
with the motor running. OK.
Even though she locked the
doors. It is not acceptable. Not
in this day and time. I wish the
police would go to her house
and talk to her about it.
Hungry child ate soap
Reading about the hungry
child that ate soap. Kind of
made me sick in my head. If
you don’t like it you don’t have
to buy it.
Why was child alone?
This is for the person who
wrote in about how their hungry child ate soap. First of all,
why would you have a two-yearold .in the bathroom washing
her hands without supervision.
Why would your child be that
hungry that she’d actually
drink soap water. Why? Looney
Tune.
A right to their opinion
This is a response to callers
who were dissing the CMA people for saying what they
thought about Obamacare.
Well, they have a right to their
opinion. I’m not sure why people think other people should
not express their opinions. I
think these people have a right
to say what they think too. They
are missing a big part of the
equation. Obamacare is not
about insuring the poor. If it did
that then there’d be no denial
for pre-existing conditions and
putting on 26-year olds. They
could have done that in three
pages instead of 3,000. This is
about an Obama takeover of all
of our health care and about us
losing our health care. If more
people get it more people will
lose it. This is about funding.
The government gets more
money. Remember people will
have to pay fines to the government if they are without insurance. We have to pay more for
our premiums. These people
need to see the story about the
single mother who wrote
Obama a great letter praising
him because she was going to be
able to have insurance. A single
mom with her own business but
it turns out she can’t afford the
insurance. People aren’t realizing the deductible on this insurance is over $6,000 for a single
person and $12, 500 a year for a
family in out-of-pocket expenses. They can’t afford that so people aren’t looking at the bigger
picture. Callers, you have the
right to say what you think but
you were wrong.

from the regional Nashville

In August, the AMP project
was approved for the “Project
Development” phase of the federal Small Starts funding program, which means the Federal
Transit
Administration
believes it is a worthwhile
investment supports further
work on the project.
But late last month, the
state’s budget omitted any
funds for the AMP. Tennessee
Department of Transportation
Commissioner John Schroer
pointed to an $8 million backlog of projects and possible federal government cuts of $850
million. Shroer said the AMP
would have to compete for dollars like any other project
across the state.
The AMP would begin operating in 2016. It would use a
dedicated center lane on West
End Avenue for stations and
bus travel. Riders could expect
a bus every 10 minutes during
peak times and every 15 otherwise. Supporters, including
Nashville Mayor Karl Dean,
argue residential and commercial development will over-

whelm West End’s capacity for
vehicle traffic if the Amp is not
built.
A spokeswoman for the
mayor’s office said work is
ongoing for the AMP on
Tuesday, Dec. 3. “We certainly
are. The process is still in early
stages, and we have a new project team working closely with
TDOT administrators and engineers on the Amp, and we continue to seek public input,”
said Holly McCall.
While it would be ideal to
have participation at the local,
state, and federal level, McCall
said, “we are considering every
option. Statewide, we will all
continue to face the same traffic congestion Nashville faces
and this will continue to be a
growing
challenge
for
Tennessee.”
Metro is first looking toward
a final answer on the federal
funding, which would be in
2014, before seeking to gain
state money in the upcoming
legislative session.
The AMP Coalition is circulating a petition urging Metro,
state and federal officials to go
forward with the bus rapid
transit project. The group has a
goal of 2,000 signatures. By
early Tuesday, it had more than
700 signatures.
The project has run into stiff
opposition from residents
along the West End route who
fear losing a traffic lane and
restrictions on left turns will
propel drivers onto their side
residential
streets.
Rick
Williams,
whose
group
StopAMP.org has planted red
“Stop AMP” signs in hundreds
of yards, said Monday, Dec. 1,
that “Our position is plain and
simple that there is not enough
local support for this project for
Mayor Dean to continue to pursue it.”
The state’s funding omission
raises the issue of whether
Dean will ask the Metro
Council to fund the state’s portion and Metro’s, a total of $100
million, Williams said.
The group questions the fiscal sense of spending $7.5 million this year for AMP planning
with funding uncertain. It also
wants details on who will pay
for the projected annual $4 million dollars in operating costs.
“So for all of the above reasons, we ask that Mayor Dean
scrap his proposal for the AMP
and let us all sit down and have
a deep discussion about mass
transit for Nashville and truly
plan for the best public transit
system we can afford that centers on the riders’ needs and
geographic locations at a cost
we can afford," Williams said.

Woman’s Club Bazaar
photos by • David Hodgson
The Woman's Club of Nashville held its annual Holiday Bazaar at
the organization’s headquarters on Hillsboro Road in Green Hills.
Susan Shumaker was the event chair and Judi Medford is president of the Woman's Club.
In addition to various vendors selling clothing, handbags, jewelry
and crafts and a bake sale at the bazaar, the ground floor of the beautiful house was open to the public.
The house was built around 1927 by Judge Beauregard Daniel; it is
a lofty, white columned Greek revival. Some of the original furnishings remained with the house when the Woman's Club purchased it in
1957.
The Woman's Club is a non-profit organization whose membership
consists of women committed to enhancing the quality of life in the
community by promoting civic, cultural, educational and social activities, while providing opportunities for service and fellowship.
Each year several events are held to benefit charities, as well as the
house preservation fund to maintain the building, which is on the

Historic Sites.
