August 2, 1920 Continued from 2A September 21, 2006 Instead, the town obtained a letter of credit from the developers, which expired five years ago. A surety bond would have held the developers (through a surety company) financially responsible for the needed improvements in the development. If the Town of Mooresville takes over the Morrison Plantation streets before the developers complete the needed repairs, the estimated cost would be $1.5 million, or a 4.5-cent increase in the property tax rate. The stoplight alone would cost significantly less than that, but Commissioner Chris Carney – whose district includes Morrison Plantation – said this week that the town can’t pick and choose what it wants to take over in the development. It’s all or nothing, he said. “The light is only one problem,” Carney said. “If it was just the light, the town would take the streets over today.” Many residents at Thursday’s meeting asked the town to close down Morrison Plantation Parkway, barricading at the least its entrance from Brawley School Road. They said such a measure would prevent throughtraffic along the four-lane divided Parkway and its intersection with Plantation Ridge Drive. During the meeting, Janet Bush’s daughter, also a Morrison Plantation resident, pointed to a poster-size picture of her mother that had been placed on a mantel behind the town officials earlier in the meeting. “If you turned around and that was your mother, your daughter, your sister, would that road still be open today?” she asked. Town staff delivered barricades and orange cones to the Parkway entrance from Brawley School Road before Thursday’s meeting in anticipation of a possible blockage by town officials. Any hope of that happening was squelched this week, however, when the N.C. Department of Transportation said it would not permit the town to revoke the driveway permits at the Parkway’s intersections with state-controlled roads, including Brawley School Road. Carney said DOT officials initially approved the town’s plan to barricade at least one entrance but balked when town officials pressed for the authorization in writing. The town is still looking at placing a moratorium on building in Morrison Plantation, said Carney. He said to do that, however, the town “would have to prove eminent threat, which is very difficult to prove.” He said Town Attorney Steve Gambill and outside attorneys hired by the towncontinue to research the town’s legal options. Residents on Thursday weren’t satisfied with the town’s response that it had no control over the development. One resident said in summary that the residents are disadvantaged for some reasons because they live on a private road, but they’re disadvantaged for other reasons because the road will eventually be public. “They’re stuck in the middle,” Carney said of the residents this week. “We’ve always said that.” He suggested to the residents last week that they Edna Frances Rinehardt, 86, of Mooresville, died Thursday, Sept. 21, 2006. Funeral services were held at 3 p.m. Sunday, Sept. 24 at the CavinCook Funeral Home Chapel in Mooresville. Go online with the Mooresville Tribune at www.mooresvilletribune.com should seek legal counsel. He said they likely have more legal options than the town to force the developers to make improvements within the development. One resident asked if the town and the homeowners could work together on a lawsuit against Kale. At-large Commissioner Frank Rader suggested to the residents that they write not only to Kale, but to his partners, bankers, builders, realtors and attorneys. After pondering the idea of withholding homeowners fees to pursue a lawsuit against Kale – then blocking the Parkway with a line of cars – the homeowners voted to write Kale a letter, asking him to close the Parkway. But in speaking with the developers earlier this week, the homeowners decided that closing the road raises too many safety concerns and is “just not a viable option,” Thompson’s letter to the town reads. Instead, it states, the homeowners and developers agreed that adding temporary speed bumps would slow traffic through the intersection until a permanent solution can be implemented. “We, the interim homeowners association, appreciate (the developers’) commitment to making Morrison Plantation Parkway safer to travel as quickly as possible,” Thompson said Tuesday. 40096255_aen 40076427_kb1 Edna Rinehardt Steven Knuth MORRISON CHEMICAL CH EMICAL FREE Spray Green Landscape Fertilization 704-402-9654 1-888-59-GREEN www.spraygreen.net Our product is safe for the environment, you, your family and pets!
