Pursuant to A.R.S. § 38-431.01 (G), the Board of Adjustment may make an open call to the public during a public

discuss or take legal action on matters raised during an open call to the public unless the matters have been properly

ADDITIONAL INFO: This request is for a variance to exceed the maximum allowed
signage area from 75 square feet to 136.94 square feet on the
General Commercial District. The dealership’s variance request is for
their show room and service department buildings. The dealership
will represent three entities: GMC, Chevrolet and Buick signatures
and emblems in addition to the dealership’s name.
The variance request should not be detrimental to the surrounding
property owners or to the neighborhood in general. Staff
recommends approval subject to conditions.

COMMENTS:
This request is for a variance to exceed the maximum allowed signage area from 75 square feet
to 136.94 square feet on the General Commercial District. The dealership’s buildings will
represent three entities: GMC, Chevrolet and Buick signatures and emblems in addition to the
dealership’s name.
The building frontage for the service department is approximately 41’-6 ½” linear feet. The
applicant is proposing 1 sign for the service department frontage, Certified Service at 33.8
square feet.
The applicant has stated that corporate office has certain sizes for signs and based on the size
of the building, tenant space and use the need for additional signage is justified.
ZONING:
The current zoning on the subject property is GC, General Commercial Zoning District. This
district is designed for the central retail marketing function of the Nogales trade area. The district
constitutes a more intensive district use than neighborhood and local commercial and includes most
business trade that does not qualify as industrial manufacturing type trade. The district regulations are
designed to insure district integrity, to promote its primary purpose, and to protect the district from
incompatible use. According to City of Nogales Development Standards Code, Article 1, Section
708 (c)1 Wall Signs, a variance is required if the total square footage of the sign exceeds the
maximum allowed area for a wall sign from 75 square feet must obtain approval from the Board
of Adjustment.

The building frontage for the show room is approximately 102’-3 5/8” linear feet. The applicant is
proposing 5 separate signs for the show room business frontage, Cropper’s at 29.54 square
feet, Chevrolet Bowtie at 13.37 square feet, Chevrolet signature at 35.37 square feet, GMC
signature at 12.39 square feet, and Buick emblem at 12.47.

Santa Cruz County Assessor Parcel No. 102-01-037A, this parcel, at present time, contain a \
retail space services.

PUBLIC INPUT:
Notice letters of this request were mailed to the surrounding property owners within 300 feet of
the subject properties. Up to the time of this report Staff has received no concerns.
Up to the time of this report, no concerns have been expressed to Planning Staff.
Evaluating the variance application, the request appears to pass the tests as listed in the
Development Standards, Ordinance 20-X, listed below:
Variance Application Tests
A. The City of Nogales Development Standards Code and Arizona State Law, requires that
an application for a variance must meet the following criteria before it can be presented
to the Board of Adjustment for their consideration.
1. That there exist special conditions and circumstances existing which are
peculiar to land, structure or building involved in the application, and
which are not applicable to other lands, structures, or buildings in the same
district (size, shape, topography, location or surroundings); and
2. That the literal interpretation of the provisions of the zoning ordinance would
deprive the applicant of rights, commonly enjoyed by others properties in the
same district under the terms of the Ordinance; and
3. That the alleged hardship(s) caused by a literal interpretation of the
provisions of the zoning ordinance include more than personal/business
inconvenience and more than a personal/business financial hardship,
and do not result from the actions of the applicant; and
4. That granting the variance requested does not confer upon the applicant any
special privilege that is denied by the zoning ordinance to other lands,
structures or buildings in the same district; and
5. That granting the variance request does not interfere or injure the rights of
other properties in the same district.

Based on Planning Staff analysis, existing conditions of the subject site, as proposed with this
application, the sign variance request does meet the overall intent as required by the
Development Standards, Ordinance 20-X and the intent of Nogales’ General Plan. Staff
recommends approval with conditions.
