MANAGEMENT
TERMS OF REFERENCE
1.0
INTRODUCTION
To create a standard for Port Klang Logistics Industry players by
finding an acceptable solution pertaining to container security.
2.0
MODUS OPERANDI
2.1.
Any registered association/ organization to submit the Letter of
Undertaking to Port Klang Authority duly signed by the authorized
person.
2.2.
Forwarding Agent/ Freight Forwarder/ Consignee shall register with
any registered association/ organization who has registered with
Port Klang Authority to participate in this scheme (Please refer to
Appendix I). PKA recognize registered Agents/ Consignee only.
2.3.
To register with registered association/ organization, the
Forwarding Agent/ Freight Forwarder/ Consignee shall comply with
the following terms and conditions:

To ensure that there is no outstanding payment (more than a
reasonable time) with any Shipping Lines/ Agents/ NVOCCs.
In the event, the ownership of the company has been
transferred or changed fully; the previous records will not be
taken into account. Evaluation will be done based on current
ownership and records only.
To have a valid Forwarding License from Royal Malaysian
Customs (where applicable).
The contracting parties under the Bill of Lading (BL) should
have proper insurance coverage for cargo and container.
Pertaining to any wrongdoing or negligence, the respective
party must have liability insurance to cover their services.
2.4.
PKA will publish the list of registered agent/ Consignee in PKA’s
website (www.pka.gov.my) after verified by Shipping Lines/
Agents/ NVOCCs.
2.5.
Shipping Lines/ Agents/ NVOCCs shall check the list provided by
PKA prior to releasing the Delivery Order (DO) to the Forwarding
Agent.
2.6.
After taking delivery of the container, if there is a dispute pertaining
to detention, container damage/ loss and washing charges,
Shipping Lines/ Agents/ NVOCCs/ Forwarding Agent/ Consignee
shall complain to PKA within 14 days via PKA website
(www.pka.gov.my – online services - complaint) upon
returning the container to empty depot. The complaint shall be
supported with the relevant documents (EIR Terminal, Haulier
Consignment Note, EIR Depot and Photographs) required by PKA.
2.7.
PKA will mediate the issue based on the agreed guidelines (please
refer to Appendix II, III & IV) and Institute of International
Container Lessors (IICL) guidelines within seven (7) working days
upon receiving the complaint. Meanwhile, if either party decides to
proceed with legal action or both parties agree to an amicable
solution then the issue will be regarded as settled.
2.8.
Any registered Agent/ Consignee who failed to comply with PKA’s
decision, will be indicated in the registered list as a ‘defaulter’
together with the reason. Registered association/ organization will
resolve the issue with the party concerned.
Note
TOR will be reviewed from time to time if deemed to be necessary by Port
Klang Authority.

APPENDIX II
MODUS OPERANDI FOR CONTAINER DELIVERY SYSTEM
1.
The Terminal Operator shall issue Container Damage Report (CDR)
when any damages are found on containers prior to or during
discharge of said containers from vessels. The CDR shall be duly
endorsed by the chief officer or agent of the vessel. The vessel’s
agent and the box operator shall be subsequently notified of the
damages to the container(s) by the terminal via email.
2.
Prior to the release of the container to the haulage company, the
driver and Terminal Operator shall jointly inspect the container. Any
damage discovered by either party during this inspection shall be
noted and endorsed accordingly on the EIR by both driver and
terminal surveyor. The haulage company shall then provide a copy
of the EIR to the Consignee or their agent.
3.
Immediately upon receipt, the Consignee shall check the condition
of the container to ensure that it is received in good condition. If
the container is found to be damaged, the Consignee shall record
the details of the damage in the Consignment Note and obtain an
endorsement to that effect from the Haulage Company.
4.
At the consignee premises:
a. If the container was found to be damaged upon arrival, the
consignee must inform the insurer, box owner, shipping line and
forwarding agent immediately or otherwise as agreed by all
parties concerned.
b. Upon opening/ unstuffing of the said container, if it is found
damaged internally, the consignee must stop unstuffing and
inform all parties for joint survey within 24 hours or otherwise
as agreed by all parties concerned.
c. Where there is evidence of the condition of the container by
means of still photographs or video it shall be taken immediately
and shall be forwarded to the party concerned for consideration
in deciding the degree of damages actually caused by the
respective party. The Consignee may also request the Shipper to
take photograph prior to stuffing the container for their records.
5.
Consignees who failed to adhere to the above procedures may be
liable for damages that may be claimed against them.
6.
The Haulage company shall perform a cursory visual inspection of
the exterior of the container for any obvious or abnormal condition
or easily noticeable damages before taking delivery of the MT
container from the consignee. The consignee is also obliged to
sweep the container without leaving debris. Failing to do so may
incur additional charges by the lines. Any exceptional cleaning/
washing should be justified.
7.
The consignee shall ensure that MT container is released to the
appointed haulage company, by recording details of driver and
vehicle in a log book, including checking consignee gate pass and
collection order/ consignment note.
Consignee who failed to adhere to the above procedures may be
held responsible for the loss and damages of container and trailer.
8.
Depot Operator:
a. Upon receipt of the MT from the Haulage company, the depot
shall check and verify that it belongs to their principal i.e.
Shipping Lines/ Agent/ Ship Owners/ NVOCCs/ Box Operators.
b. It should reject any container that does not belong to his
principal. Any container Depot Operator, who inadvertently
accepted a container that did not belong to his principal, shall
be responsible and liable for the all charges and consequential
damages suffered by the said container.
c. The damage remark should be made on the consignment note/
container receipt acknowledged by the driver (by signing it
indicating name and I/C).
Upon receiving the container, if damage is found the consignee/
forwarding agent should be notified in writing (e.g. e-mail/ fax)
immediately; not later than 48 hours.
d. A joint survey, if required shall be conducted within 48 hours
(week days) after the notification has been sent. In the event,
the empty container is not available for joint survey (e.g.
repositioned), Consignee will not be responsible for any
damages/ loss.
On the other hand if the consignee/ registered agent fails to
respond or to carry out a joint survey within the agreed time,
then the consignee/ registered agent shall be accountable for
the claim submitted.
e. Where there is evidence of the condition of the container by
means of still photographs or video it shall be taken for
consideration in deciding the degree of damages actually caused
by the respective party.
9.
Shipping Agent/ Box Owner
The Forwarding Agent/ Consignee shall inform the Shipping Agent/
Box Owner by email/ fax once the empty container is returned to
the designated depot. Nevertheless, the Shipping Agent/ Box
Owner is obliged to inform the Consignee/ Forwarding Agent if their
record showed that the empty container is not returned to the
designated depot within fourteen (14) days after delivery from the
terminal. Failure to do so will limit the claims to maximum fourteen
(14) days of detention charges.
APPENDIX III
GUIDELINES TO DETERMINE DAMAGE CAUSED BY WEAR AND TEAR
TO A MARINE CONTAINER (EQUIPMENT)
Wear and Tear means the unavoidable loss or deterioration in value or
damage sustained to the Equipment in the course of continual normal
use and which may affect the cosmetic appearance of the Equipment and
over a course of time may affect the integrity of the Equipment. Wear
and Tear shall include, but not limited to:
i.
Rust on metal components not due to contact with foreign
substances.
ii.
Delaminating or rotting of wooden components, such as
general deterioration of floors, including expansion, shrinkage or
warping arising out of normal use. Delaminating does not
include the separation of floor components.
iii.
Scratches and minor dents to metal.
iv.
General paint failure or fading not due to contamination.
v.
General deterioration of door gaskets and fittings, including
loose and corroded fittings or loose fittings arising from normal
deterioration of doors and not due to contamination.
vi.
General wear and deterioration of corner fittings.
vii.
Colour fading or adhesion failure of decals.
