The people make the city
for Lake Village mayor
Mayor of Lake Village since 1991 and the new president of the League,
JoAnne Bush knows that the people she serves come first.

W
ith the Mississippi River within shouting distance and Louisiana just a few
miles down the road, Lake Village is
the gateway to Arkansas for anyone
coming from the Southeast. If you never stray from
Hwy. 65, however, you’ll never know just what this
city of just under 3,000 in Chicot County has to
offer, and no one knows this better than Mayor
JoAnne Bush, who was elected League president at
the 74th Convention in June.
Spend a day with Bush and her passion for Lake
Village and its people quickly becomes evident. In
fact, there’s so much going on that you may have to
spend several days in the Arkansas Delta city to fit it
all in.
Bush was born and raised in Lake Village, and
the city’s people aren’t just citizens to her, they are
friends.
At Rhoda’s Famous Hot Tamales, considered by
many to have the absolute best tamales anywhere,

“This is our Doe’s,” Bush says, referring to Doe’s
Mike’s Cafe, which was run by Bush’s family from 1946 until its
closing in 1998, holds a special place in Lake Village’s history,
and this MOCCA exhibit pays tribute.

Rhoda’s isn’t just a local favorite. Owner Rhoda
Adams’ tamales are a frequent subject of travel and

hanging from the tiny restaurant’s walls attest.
Adams also takes her tamales on the road, loading up a minivan and selling them in nearby cities
and towns.
“When I want to have some fun, I go with her,”
Bush says. “It’s like the ice cream truck.”
Bush is no stranger to the life of a small town
restaurateur. Her grandfather, Mike Pesaresi Sr.,
opened Mike’s Cafe at the corner of highways 65
and 82 in 1946, and until it closed in 1998, the
family-run business was a frequent stop for folks from
all over and renowned for its Italian spaghetti and
meatballs, whole fried catfish and fried chicken.

A convenience store and a Church’s Fried

food and conversation.
“All the world’s problems were solved there over
breakfast and coffee,” Bush says of her family’s
restaurant.
Bush has to cut short her visit with Rhoda to help
a local drugstore owner and a representative from
the state Highway Department settle a drainage
problem caused by eight inches of rain that fell the
previous day. It’s a reminder that for a mayor, there’s
no such thing as clearing your calendar. It’s a lesson
Bush learned early on.
When she was 19, Mayor Jack Rhodes Sr. approached Bush about taking a job with the city and
she accepted.
“Every day when I’d say, ‘Good morning, Mr.
Rhodes,’ I’d turn red, head to toe. That’s how bashful I was,” Bush says of her early days working the
front desk at city hall.
She went on to work with Rhodes for 18 years
and considers him her mentor. When he retired in
1990, she decided—with his encouragement—to try
and succeed him as mayor. She won the election
handily.
One great way to learn about the history of Lake
Village is to visit the place where many of its citizens, including Bush, were born. What was once
the Lake Village Infirmary is now the Museum of
Chicot County Arkansas, or MOCCA. The infirmary,
founded in 1911 by Dr. E.P. McGehee, was known
for a time as the “Mayo of the South.” Now the
building, which is on the National Register of His8
toric Places, is a showcase for historic medical
equipment and cultural artifacts from Lake Village
and the county. Each of MOCCA’s rooms tells a
story of the area and its people, says Penny Winsett,
museum docent and a former nurse in the former infirmary.
The Guachoya Cultural Art Center is another
point of pride for Bush. The center, named for the
Indian province in the area in the 16th Century,
features art and photography from Lake Village
and across the South.

building, which was formerly a nursing home, in
1999 with the dream of creating a space for local
artists to show their work. About five years ago, the
city purchased it from them and agreed to continue

the art center. Parts of the large building are rented
out to other local businesses, and the art center has
continued to be a great success.
Yet another successful city project is Mel’s
Market, a venue for local farmers to buy and sell
fresh produce. The Lake Village Economic Development Commission developed the idea of the market
as one way to revive downtown. The city partnered
with the Forestry Commission to plant trees at the
site.
To complete the project, City Clerk Lynette Graham contacted the railroad company about the possibility of donating an old boxcar for the location,
which is built where the city’s train depot once

about what they refer to as their “big project.” The
city was recently gifted the Tushek Building in the
heart of downtown. Completed in 1907, the structure, which is listed on the National Register of Historic Places, housed a jewelry store in the back and
a general store up front. Over the years it has also
been a boarding house and home to many different
retailers.

“We’re hoping it’ll be like the cornerstone of our
city,” Graham says.

stood. The railroad company obliged. The city went
on to hire a mural artist to paint the boxcar. The city
also secured grant money to run electricity to the
boxcar and install a refrigeration system for farmers
who need to leave produce overnight.
The market isn’t just for farmers, of course. Its
pavilion is also open to the public for meetings, picnics, music and more.
Lakeport Plantation just south of town, which
opened last fall, also continues to draw visitors to
the city. Buses of tour groups and students regularly
visit the 19th Century home, which is the last of its
kind in the region.
Back in town, the city continues to expand its
parks and recreation facilities. With a parks and
recreation grant, the city just opened a new multi-use
sports arena, tennis courts and ball fields, and plans
are already in the works to build even more. The city
is booked through 2010 for hosting various regional
youth sports tournaments, Bush says.

killed Arkansas Democratic Party
Chairman Bill Gwatney at party headquarters in Little Rock on the morning
of Wednesday, Aug. 13, the Arkansas Democrat-Gazette has reported. The gunman, later
identified as Timothy Dale Johnson, 50, of
Searcy, then led police on a 34-mile chase before confronting officers, who shot and killed him
less than an hour later.
A member of the state Senate for a decade
and the owner of three car dealerships, Gwatney, 48, died at 3:59 p.m. at the University of
Arkansas for Medical Sciences Medical Center.
Johnson was flown from where police shot
him in the Grant County city of Sheridan to Baptist Health Medical Center in Little Rock, where
he was pronounced dead.
Police are still investigating Johnson’s motive
in the shooting.
Condolences poured in swiftly after news of
the shooting spread. Gwatney, who was a superdelegate to the coming Democratic National
Convention, was a widely noted political figure
in the state and beyond. In 1997 the League
named Gwatney its Person of the Year for his
outstanding service to cities and towns during
the legislative session.
“Bill Gwatney was a very progressive
legislator and a tremendous friend of the
League,” Executive Director Don Zimmerman
said. “Arkansas has lost a great citizen and
someone who I thought would have probably
been Governor somewhere down the line.”
Jacksonville landfill to double
as habitat
W
aste Management will partner with
Audubon Arkansas to convert portions of the Two Pine Landfill near
Jacksonville into a habitat for native
plants and wildlife, the Arkansas Democrat-Gazette
reported Aug. 15.
The landfill’s massive hill of garbage will be
planted with native grasses and wildflowers. Trails
will give visitors a chance to view birds and other
local wildlife in the new habitat.
“How cool is this,” said Ken Smith, director of
Audubon Arkansas, of the plan. “We are going to
take this 500-acre site and use at least 300 acres of
it for conservation purposes.”
This first-of-its-kind partnership between Houstonbased Waste Management and Audubon Arkansas

began two years ago. While state regulations
already require that landfills have grass, trees and
wetlands to offset the loss of natural habitat, by partnering with the environmental organization, the company can choose the right mix of native flora to
attract wildlife.
The partnership with Audubon is just one of several of the company’s environmental initiatives. Also
at Two Pines Landfill, Waste Management is operating a plant that converts methane gas formed by the
waste into energy. That energy, converted to electricity, powers about 4,500 homes in North Little Rock.
The landfill collects about 2,000 tons of trash
per day from most cities in Pulaski County, part of
Saline County, and from Conway and Cabot.

Collective bargaining is no bargain

C
ongress is considering legislation, HR 980,
the Public Safety Employer-Employee Cooperation Act, which would use the power of
the federal government to impose unionism
and collective bargaining on state and local public
safety departments—police, fire and rescue—in
states, like Arkansas, that have had the good sense
to not give public sector unions monopoly bargaining
powers.
The proposal has several problems. First,
it is most likely an unconstitutional abuse of federal
power. Secondly, it is an unfunded mandate of enormous proportions. And, more importantly, it ignores
the anti public interest nature of laws giving unions
of government employees monopoly bargaining
powers.
Public sector bargaining proponents like to pretend that there is no reasoned argument against it.
This is far from the case. Many qualified scholars
have articulated these arguments. Unfortunately,
they haven’t had the political power of the public
sector unions, so their arguments have been all too
often ignored.
Unionism and collective bargaining as we know
it is a private sector institution based on qualities
unique to the private sector and not present in the
public. The national labor policy, the National Labor
Relations Act (NLRA), was designed for the private
sector and specifically excludes government employment from its coverage. Yet, virtually every public
sector bargaining law is modeled after the NLRA.
In order for public officials to present a case
against the imposition of unionism and collective
bargaining on the employer-employee relationship,
both to public employees and to the general public, it
is important to understand those essential differences.
The public sector—government—is by nature a
monopoly. There is but one police department and
one fire department. A developer who is dissatisfied
with the response to a request for a zoning variance
can’t shop the competition.

The private sector is by nature competitive. There
are many suppliers of goods and services.
Government provides services that are essential
to all citizens. The private sector provides non-essential services. Gray areas do exist, obviously. Some
might argue that government provides non-essential
services. This may be an argument against government involvement. Some private sector goods and
services, such as food, are essential. Governments
have developed programs for dealing with this without attempting to become the sole provider.
Government is politically motivated. The bottom
line is for votes. The private sector is economically
driven. Profit is the bottom line. No matter how politically popular a business decision, if it results in
losses, the business will fail.
Government is sovereign. It has the power to use
force. Only government has that power. This is most
obvious in law enforcement, but is just as much a
part of tax collection and issues concerning eminent
domain. A non-sovereign government is a contradiction in terms.
All activity in the private sector is governed
by free contract. When contracts are not honored,
private entities don’t take the law into their own
hands. They rely on the power of government to
enforce them.
These essential qualities of government are in
direct conflict with the unionization of public
employees.
On its surface, the Public Safety EmployerEmployee Cooperation Act is quite simple. Congress
enacts standards for unionism and collective bargaining in public safety departments. The Federal Labor
Relations Authority (FLRA) has 180 days to determine
whether state laws “substantially provide” similar
union privileges, in which case those states are exempt. The FLRA then has one year to issue regulations covering the remainder of the states and the
states have a year, or until the end of the first regular

onway’s phenomenal growth spurt has
consumed most of Mayor Tab
Townsell’s time in recent years, but,
he says, it’s time the city extended its
growth beyond the city limits and reach out to
international communities through a sister city
relationship.
The city already has informal relationships
with cities in Germany and Wales. For an official Sister City relationship, Conway is looking
at Essaouira, Morrocco, a fishing town on the
African nation’s Atlantic coast. Like Conway,
Essaouira is a small but progressive city, a pace
setter. And much like Conway’s Toadsuck Days
festival, Essaouira hosts an annual four-day musical celebration across the city.
As Conway continues to grow, the timing is
right to develop an international relationship,
Townsell believes. As the home of three institutions of higher learning, Conway also has much
to gain through educational and cultural exchanges.
The University of Central Arkansas, Central Baptist
College, and Hendrix College would welcome
further involvement with an international partner.
UCA already has an active student exchange program with the African nation of Tanzania.
Cultural and educational exchange programs
both contribute to the ultimate goal of continued
economic development for both sister cities, and
Townsell recognizes the importance of involving
every aspect of the city in developing such a
relationship.
The city’s institutions of higher learning, the
chamber of commerce, the advertising and promotion commission, and the city council have to be the
pillars on which to build a strong, workable sister
city program. Now is the time, minds are opening,
and a move toward international relations is the next
big step for Conway.

simulator, which will be available to member cities and towns as a training tool to help municipally employed drivers lower
accident rates in city vehicles. Construction is expected to be completed in January 2009.

The federal government’s plans for a nationwide
alert system that will send text messages to cell
phones and other mobile devices when an emergency occurs are beginning to take shape, Nation’s Cities Weekly has reported. The new
system will coordinate with existing state, local
and tribal alert systems to send messages to cell
phone users, alerting them to natural disasters,
child abductions, terrorist attacks and more. If a
rare disaster situation arises that impacts the
health and safety of all Americans, the president
can authorize a national alert to the country.
In the event of a local emergency, authorized
city, county or state emergency managers would
send notice to the federal contact point, which in
turn notifies wireless service providers. The service providers would then send the alert to customers in the affected geographic area.
Local first responders across the country have
been looking for better ways to send out emergency alerts, and Congress, having urged the
implementation of such a system for several
years, has made much progress recently in making the nationwide alert system a reality. The
Federal Communications Commission, Federal
Emergency Management Agency and the
Department of Homeland Security will work
together to implement the system, expected
to be operational by 2010.

tool unveiled
The U.S. Department of Labor has debuted the
First-Step Recordkeeping, Reporting and Notices
Advisor, an online tool that helps employers
determine which recordkeeping and notice laws
apply to them, the publication HR Specialist
Employment Law has reported.
The tool is part of the agency’s Web site’s
“eLaws” advisors. The free, Web-based tools,
designed to help employers and workers understand the major federal employment laws, are

legislative session after the date of enactment to
enact laws complying with the federal mandate.
Failure to do so will result in the FLRA administering
the unionization of public safety departments in
those states.
A major problem with the collective bargaining
process in public employment is revealed in the
language of HR 980. It says in the declaration of
purpose and policy that “it is the union that provides
the institutional stability as elected leaders and
appointees come and go.”
Some might think this to be an advantage, but
consider a situation where, for one reason or another, elected leaders have been too generous in negotiating a union contract. When the public elects
new leaders to correct the situation, since the contract is a legally binding document, they are powerless to reverse the mistakes of their predecessors.
That sort of “institutional stability” is completely destructive of our democratic form of government.
There is an element of deception in the proponents’ arguments for the bill. In testimony to a Congressional hearing on the bill, the bill’s author, U.S.
Rep. Dale Kildee, D-Mich., said that its purpose was
to “enable public safety employees to discuss work
conditions with their employers.” This ignores the fact
that there is a vast difference between being able
to discuss something and negotiating a legally
binding contract.
The language of the bill itself continues this
pattern. In its findings it says that the interests of
employees “may be furthered” through collective
bargaining and that the federal government is in a
position to “encourage” conciliation. Those words
are the velvet glove covering the iron fist of the bill’s
provisions, which are entirely mandatory.
The proponents have also promoted the idea that
the bill exempts political subdivisions with less than
5,000 population or fewer than 25 full-time employees. Putting aside the question of whether such a subdivision is likely to have a professional police and
fire department, the bill doesn’t contain such an exemption. What it does contain is an exemption for
state laws that contain such an exemption. In short,
the federal regulations will apply to these subdivisions and the only way a state can escape federal
regulation is to enact a law that “substantially pro16
vides” the powers given to unions by the federal law.
In addition to Arkansas, there are at least 13
states without laws mandating public sector collective
bargaining and granting government unions monopoly bargaining powers that would feel an immediate,
substantial negative impact from passage of this legislation. There are also several states with public sector bargaining laws that would clearly not qualify for
an exemption from federal regulation.
Ironically, the bill would give unions at the state
and local government level far greater powers than
Congress has given to federal employee unions.
There is no question that this legislation is an
unfunded mandate of enormous proportions. It is impossible at this point to determine the amount. There
is no question that collective bargaining, impasse resolution and contract enforcement are expensive
processes. Some of the cost and the way it is calculated will depend on whether states submit to the federal blackmail by enacting their own laws or decide
to follow the FLRA’s regulations.
A major difficulty in estimating the cost is not
knowing which state laws would be declared to “substantially provide” the union privileges of the federal
law. Some states may be complacent now but find
out later that they either have to make substantial
amendments to their laws or fall under the federal
mandate.
Needless to say that it would take hundreds,
perhaps thousands of bargaining units at the state,
county, municipal and even special district levels,
each one with its own contract and costs.
The U.S. House of Representatives approved HR
980 on July 17, 2007, by a vote of 314 to 97.
When it reached the Senate it was expeditiously put
on the General Calendar from which it can be
brought up at any time. The Senate version of the
bill, SB 2123, is authored by Republican Senator
Judd Gregg of New Hampshire and has 36 cosponsors, including Sens. Blanche Lincoln and Mark Pryor
of Arkansas.
One possible explanation for the level of support
the bill has received may be that Sept. 11, 2001,
created a kind of “halo effect” for public safety personnel. The International Association of Fire Fighters
has gone to great lengths to convince Congress that
the union’s interests and the firefighters’ are the same.

There is simply no doubt that there is something
heroic about a willingness to enter a burning building to save lives. It is worth noting, however, that the
vast majority—almost 75 percent—of firefighters are
volunteers. Admiring courage has little or nothing to
do with undermining democratic government.
A second consideration is that the bill is almost
certainly unconstitutional and members of Congress
can gain the advantage of having voted for a
bill supported by labor unions with a fair certainty
that their constituents will never feel the negative
consequences.
Beginning with passage of the Wagner Act in
1935, Congress has recognized that relations between state and local governments and their employees is properly the prerogative of the states.
The question of the bill’s constitutionality was an
issue on both sides of congressional testimony. Testifying in favor of the bill, William Banks, professor of
law at Syracuse University, concluded that the bill
would not violate the 10th Amendment because it
did not “commandeer” state or local regulatory
processes. He went on to explain, seemingly contradicting himself, “The bill does not require state or
local governments to enact or implement a federal
regulatory program. Instead HR 980 places the onus
on federal implementation through the Federal Labor
Relations Authority. If a state chooses not to enact a
program that meets federal requirements, the FLRA
steps in.”
On the other hand, noted labor lawyer
R. Theodore Clark Jr., representing the National
Public Employer Labor Relations Association, says
that “There is absolutely no doubt in my mind that the
Supreme Court today would hold Congress does not
have the constitutional authority under the Commerce
Clause to enact HR 980 vis-à-vis states and thereby
abrogate their 11th Amendment immunity.”
In discussing the 14th Amendment implications of
the bill, Clark goes on to note, “The right of public
employees to be represented for the purpose of bargaining collectively with their public employers, however, has never been recognized as a constitutional
right. To the contrary, the courts have uniformly held
that it is not a violation of the constitutional rights of
public employees for public employers to refuse to
engage in collective bargaining.”
The bottom line for elected officials, whether at
the federal, state or local level, ought to be whether
granting public sector unions monopoly bargaining
privileges is in the public interest.
This question was dealt with most eloquently
in a 1974 federal court case challenging North
Carolina’s law prohibiting contracts between labor
unions and government. The decision says, in part:
“Moreover, to the extent that public employees
gain power through recognition and collective bargaining, other interest groups with a right to a voice
in the running of the government may be left out of
vital political decisions. Thus, the granting of collective bargaining rights to public employees involves
important matters fundamental to our democratic
form of government. The setting of goals and making
policy decisions are rights inuring to each citizen. All
citizens have the right to associate in groups to advocate their special interests to the government. It is
something entirely different to grant any one interest
group special status and access to the decision-making process.”

District court judges work for state
Opinion:

Requestor: Stone, Gail H.—Executive Director,

Should the district court judges affected by Act 663 of
2007 (codified in relevant part at 16-17-1103 and 16-171106) continue to be categorized as city or county elected
officials under ACA 24-4-521(a)(5) (elected public official other than governor), or should they be categorized
under ACA 24-4-521(6)(B) (elected public official under
the state division of the system)? Q2) If you determine
that they should now be under the state division of the
system, can these judges be switched from two-for-one
service credit to one-for-one service credit without violating the constitutional prohibition on the impairment
of contracts decided in Jones v. Cheney, 253 Ark. 926, 489
S.W.2d 785 (1973)? RESPONSE: Q1) Pending legislative
clarification, the judges are probably properly categorized
as public officials “under the state division” for purposes
of ACA 24-4-521, governing credited service. Q2) The
answer is unclear under current law because the Arkansas
Supreme Court has not addressed the “impairment of
contracts” proscription in the context of a retirement
plan such as APERS. This issue may require resort to the
courts for resolution.

Requestor: Whitaker, Ruth—State Senator
Does the Arkansas Code incorporate or require compliance with provisions of the federal Privacy Act of 1974, 5
U.S.C. sec. 552a, as amended? Q2) What Arkansas Code
provision protects the privacy rights of citizens of
Arkansas from the disclosure of social security numbers
and birth dates to third parties who are not listed as one
of the exemptions in the Privacy Act? Q3) May a city administrator release the social security number and birth
date of the spouse of a municipal employee to a private
audit firm engaged by the city to conduct a forensic audit
on the municipal employee? Q4) May a public agency
(airport commission) deny a citizen ready access to public records in accordance with the Arkansas Freedom of
Information Act (FOIA) by requiring the requestor to go
to the office of the public agency’s attorney to view
records selected by the agency and its attorney? RESPONSE: Q1) The Ark. FOIA (ACA 25-19-105(a)(1)(A))
is sufficiently broad to encompass the federal Privacy Act,

but that act generally applies to federal agencies, and not
state or local governmental entities. One section of the
Privacy Act pertaining to social security numbers does
apply to state and local agencies; but the applicability of
this act to prohibit the release of social security numbers
by state and local officials is somewhat unclear. Q2) ACA
4-86-107 provides that no person or entity may “publicly
post” or “publicly display” an individual’s social security
number. See also Administrative Order 19 of the Ark.
Supreme Court regarding court records. No single
Arkansas law comprehensively protects social security
numbers or dates of birth. Q3) Probably yes, but like the
city, the private audit firm would be bound by the FOIA
if it received a request for records of the city audit. The
FOIA generally requires the redaction of social security
numbers and birth dates from “personnel records.” Q4)
Consultation with legal counsel for the purpose of separating exempt from nonexempt information may be justified, depending upon the particular facts.
Chief due vacation, sick leave
Opinion:
2008-094
Requestor: Wilkinson, Ed—State Senator
Pursuant to state law, can the Hartford chief of police,
who is injured and currently drawing Workers’ Compensation benefits supplemented with accrued vacation and
sick leave, continue to accrue vacation and/or sick leave?
RESPONSE: In my opinion, to the extent the chief of police is still “employed” by the city, he is entitled to the annual vacation and sick leave awarded by state statutes.

Eureka Springs limited to only taxing hotels, motels, and

its advertising and promotions tax ordinance? RESPONSE: Q1(a). The statute expressly lists only hotels,
motels, and short-term condominium rental accommodations. Q1(b) The question of whether “cabins, cottages,

terms of the statute may depend upon the facts surrounding a particular lodging establishment. Legislative
clarification is warranted. Q2) Yes. As noted above, however, the scope of the statutory provision is not entirely

County may appoint fire service coordinator
Opinion:

Requestor: Key, Johnny—State Representative
Since the Board of Commissioners of the Fire Protection
District did not participate in designation of the Fire
Service Coordinator, as required by Act 833 of 1991
(ACA 26-57-614, 14-284-401, 14-284-403, 14-284-405),
does creation of county positions responsible for the duties ordinarily performed by the fire services coordinator
violate provisions of that Act? Q2) According to Act 833,
may each volunteer fire department and district designate different fire service coordinators for their departments or do they have to designate the same fire service
coordinator? Q3) Can a fire protection districts board of
commissioners designate a representative (such as the

in the quorum court or a fire improvement district. I
therefore see no conflict between Act 833 and an ordinance of this nature. Q2) No. The statute contemplates
one coordinator, and fire departments do not make the
designation. Q3) Yes, assuming that there currently is no
such county position, such that another existing county
employee is to be designated. Q4) No. Q5) No. See Ark.
Const. Amendment 55, Section 1(a) and ACA 14-14805(13).

Are the arrest fees and daily housing fee imposed by
Ashley County Ord. No. 2007-13 and based upon an
average cost to the county, authorized by the provisions of ACA 12-41-505(a)? Q2) Does the above referenced Code section authorize the ordinance’s
assessment of costs for the county’s actual medical
and other out-of-pocket expenses paid for a defendant’s care? RESPONSE: 1) In my opinion a substantial question is presented as to whether a county is
authorized to establish a separate fee for arresting a
prisoner as an expense of “carrying him to jail”
under ACA 12-41-505(a). The exact method of calculating this expense is unclear under current law.
As for the daily housing fee, such fee is reasonably
encompassed with the parameters of “support” for
purposes of ACA 12-41-505(a). Q2) In my opinion
the imposition of actual costs for out of pocket expenses and medical expenses is authorized by ACA
12-41-505(a).
Workers’ Comp premium collections ongoing
Opinion:

Requestor: Reeves, Olan W.—Chair,
Workers’ Compensation Commission
Pursuant to provisions of ACA 11-9-303 and -306, is the
Commission authorized to collect the premium tax on
any additional risk assessments imposed at the end of the
policy year, or is the Commission limited to just the initial premium collection? Q2) If the Commission can collect the additional amount, can it specify in a rule or
regulation that the additional premium tax is to be collected and forwarded to the Commission pursuant to
ACA 11-9-306(f)? Q2) If the Commission can collect this
additional amount, can the Commission specify in a rule
or regulation how the additional premium tax is to be
collected and forwarded to the Commission pursuant to
ACA 11-9-306(f)? RESPONSE: Q1) In my opinion, this
written premium tax is based upon all of the premiums
collected by the carrier for the audited policy, and not
just the initial premium collection; but the tax on additional premiums paid to carriers after December 31 will
be collected in a subsequent year. See also 26-57-603.
This response would appear to render moot your remaining questions.

Sign ordinances:
Are they worth the trouble?
As more cities and towns consider ordinances regulating signs, proper planning
can help strike a balance between the desires of a community’s merchants, citizens
and public officials.

e descend, this month, into that particularly
vicious area of planning purgatory labeled “Regulating Signs.” We do so because sign regulations
are in such demand at present, not for any love of dealing
with them. They are one of the most controversial, complicated and contentious elements of modern zoning.
They are complicated because of the staggering
number of types, sizes, designs and potential locations available. They are contentious and controversial because they
can be both effective and hideous at the same time. It all depends upon which side of the sign you are standing. Planners, we admit, are partial to the side of restraint.

Having dealt with sign regulations in detail over the last
several years, we have come to one conclusion: The easiest
and most effective way of controlling signs would be simply
to say,“Here are the signs we allow, and we don’t allow any
others, so don’t ask.” This method is seldom feasible for
public officials working in a political arena. Consequently,
we must take a more complicated path, one that employs a
number of decisions. The first lists any signs that are simply
not allowed. Progressive cities, for example, prohibit billboards or signs that mimic traffic devices.
Another decision involves what type, if any, permitting
system will allow the city to monitor and control signs. This,

in turn, requires a listing of signs that don’t require permitting, say, real estate or political signs. The permitting process
also specifies fees and submittal requirements.
We must cover un-sexy requirements such as maintenance and non-conforming privileges. The same goes for
the treatment of temporary signs and portable signs, not to
mention banners, flags, pennants, whirligigs, and oh my, are
we getting dizzy already? Oh, and what about this modern
practice of painting signs on vehicles or long-haul trailers
and then parking them in conspicuous locations?
After dealing with all the above, we are finally ready to
specify the types allowed and restrictions upon signs allowed in each zoning district. An alien visiting our state
would surely conclude that the standard approach is “anything, anywhere, any time, in any place, and make them as
gaudy and visually jarring as possible. Oh, and we particularly want you to junk up our nicer views and corridors.”
That is perhaps the reason there is so much interest in
sign regulations at present. Municipalities are seeking to address and improve their appearance, but how?
It should start with planning. If a neat appearance for a
city is important to its citizens and public officials, this
should be stated in the plan. Then the ensuing regulations
aren’t simply punitive exercises but are tools that protect the
public safety and welfare by making the city more attractive
to visitors and investors.
Another key point is to remember that you are in
charge. National chains will change their signage to meet
your requirements. If you don’t believe this, spend a few
bucks and visit Alexandria, Va., or Germantown, Tenn. Neither city deserves any better treatment than your city. They
simply demand it.
Approaching sign regulations with so-called “formbased zoning” can also help. This approach places the design
of signs directly in harmony with the desired design of the
area in which they area located. In other words, the nature
of the sign befits the nature of its environment.
At about this point in the process, it becomes
obvious that what the residents may desire in terms
of aesthetics may not jibe with what merchants want

in terms of advertising their businesses. This is the critical
balance point of sign regulation. Residents want an attractive city. Merchants want more and bigger signs. We
contend, however, that signs can become so cluttered
and competitive that they inhibit effective advertising.

Finally, we must deal with ever-changing merchandising techniques. The latest fad in signage involves animated
signs, including so-called electronic billboards. The facts are
not yet in on such signs, but preliminary studies indicate
they may be distracting to the point of being unsafe. We will
keep you posted.
The control of signs is a community choice based on
how the people feel about their city. Does your municipal
plan contain findings about the link between signs and
community aesthetics, protection of corridor integrity, traffic hazards and orderly development? If so, this should be
reflected in its sign regulations. Sounds simple enough, eh?

hen Linda Sakiewicz was a small child, she
would often tell her parents she wanted to be
a “vegetarian” when she grew up.
“I knew I wanted to be a veterinarian before I could say it,” Sakiewicz remembered.

Jacksonville Animal Shelter after seven years of service.
“I was raised in a family where loving animals was part
of life,” Sakiewicz said. “We always had hunting beagles and
rabbits, so I learned early on the concepts of animal health
and care.”
Rather than go to veterinary school, the Jacksonville
High School graduate decided to “get right to it” and began
working entry-level jobs at local clinics.
“I loved it, but I needed benefits,” Sakiewicz said. “I had
tried other office jobs, and didn’t love it enough. I knew
working at the shelter would offer me a chance to follow
my dreams and earn benefits.”
In 2001, Sakiewicz became an animal control officer.
“I loved the shelter more than any vet clinic and was
very excited but had a lot of self-doubt,” she said. “I wondered if I could handle all the cruelty and suffering but immediately realized I could help make a big difference for
both the animals and the city. I found out that you get a
real adrenaline rush when you save a dog from the road or
get a vicious dog under control. I was hooked.”
Though she’s handled thousands of animals, Sakiewicz
said there are some experiences she’ll never forget. On her
third day at work, a dog “head-butted” a shelter window
and jumped out.
“It was a yellow lab, and I thought I would lose my job
on the third day,” she said. “Even before my first paycheck.”
And how do you handle a 400-pound hog that’s running loose in the city?
“It took all four animal control officers,” Sakiewicz said.
“But [Animal Control Officer] Cheryl Wood lassoed it, and
I got the catch pole on, and it barely fit. It kept lashing
around, bending the pole, and we all picked it up and put it
in the back of a truck.”
When Sakiewicz became shelter manager in 2003, she
said she had “a million things to adjust to, but I have to give
a lot credit to Jacksonville Public Works Director Jimmy

Oakley, who really believed in me. I’ve had the opportunity
to work with wonderful people, and the public is so
appreciative when you find a lost pet or find one a
‘forever home.’”
Sakiewicz proudly lists many improvements to the department that have happened under her watch. She’s struck
deals with local vets for discounted sterilization of shelter
animals. She’s written ordinances, opened the shelter on
Saturdays, has never lost a case while representing the city
in court, and changed the shelter’s euthanasia policy.
“We don’t place time limits on animals,” she said. “We
do adoptibility assessments instead. Sometimes it is necessary because we run out of space, but the shelter is not just
there to hold and euthanize animals.”
Sakiewicz also credits Jacksonville city officials for their
roles in helping the shelter budget for heartworm tests, vaccinations, cruelty investigation and software that helps
track the 2,000 to 2,500 animals that are handled by the
shelter each year.
Her replacement, Sakiewicz said, “should take it day by
day, follow the ordinances, and know that your public
works director is very supportive and fair. You’ll be serving
the citizens and answering to the mayor and city council.”
Sakiewicz will now work for the Sebastian County Humane Society, which cares for 400-500 animals each day,
has a staff veterinarian, and operates solely on donations.
“It will be a much different environment,” she said,
“but my motto is ‘if I’m not learning, I’m not living.’”
With new challenges ahead, Sakiewicz said she would
miss the people she’s worked with every day. She’ll never
forget citizens like the Larsons, a Jacksonville couple who
had a troublesome raccoon problem. They befriended
Sakiewicz after she answered the call and became big supporters of the shelter.
“All that support, all those friendly faces, all my friends
and the rescue groups, they’ve helped us be where we are
today. I have so much gratitude to Jimmy and Mayor
Swaim and Vickie Williams and the council. They’ve all
taught me so much,” Sakiewicz said.
“I’ve been told by umpteen million people how good
the shelter is, and we’ve all made it that way. It’s been everybody.”

Mulberry scores loan for water
Mulberry has secured a $936,000 federal loan to
fund construction of an elevated water storage tank,
The Fort Smith Times-Record reported Aug. 6. Mayor
Betty Feller said the city has been working for more
than a year to get the Department of Agriculture
Rural Development loan after learning it did not
qualify for a federal grant. The municipal water
system serves about 800 households.
“We’ve still got a long way to go,” Feller told the
Times-Record. Public meetings will be held, bonds
sold, and bids advertised and awarded before work
begins on the 500,000-gallon tank.

The tank will replace a smaller tank that has
served the city since the 1960s. Mulberry built a
new water treatment plant in 2001.
Brownfields grant aids
Camden cleanup
The U.S. Environmental Protection Agency has
awarded $200,00 to the Camden Port Authority to
help clean up a former stave mill and auto repair center, the Arkansas Democrat-Gazette reported Aug. 13.
The funds are part of the agency’s Brownfields Program, which encourages redevelopment of abandoned and contaminated waste sites. The Camden
site, at 739 Adams Avenue, is contaminated with benzene, toluene and other petroleum products.

Levee certification a flawed mandate
Levee districts must foot the bill for FEMA’s levee certification program, like it or not.

he Federal Emergency Management Agency
publishes flood insurance maps for urban
and developed areas of the United States. The
maps designate the 100-year flood elevation
and designated floodways, where water must flow to
alleviate flooding.
In existence now for more than 20 years, FEMA’s
mapping program is still incomplete. Some areas,
however, have been updated and revised because
of frequent flooding.
Years before FEMA produced its maps, levee districts
formed along the nation’s major waterways built and
maintained levees to reclaim flooded acreage and make
the land useable. These levee districts were funded by
assessments on the reclaimed land.
From the 1950s to the 1970s, floods became somewhat more manageable when the U.S. Army Corps of
Engineers began construction of locks and dams along
our major waterways and began building water impoundments for flood water storage, recreation and
power generation.
Between FEMA’s flood mapping and the USACE
flood containment efforts, the system has worked well.
The 2005 flooding of New Orleans, brought on by
Hurricane Katrina’s heavy rains, reverse waterway flow,
inadequate pump stations and a breach in the levee, has
led to FEMA issuing a mandate that we have our levees
certified by the USACE. Levees that fail certification will
not be included on the new flood maps.
To date there is no official levee certification procedure. An interim procedure was produced in 2004. Some

of the issues that must be addressed during the certification process are: proper construction of the levee, geology of the substrate, hydrology, assurance that the levee
has a three-foot freeboard, and proper maintenance.
The cost to cities and towns undertaking the certification won’t just involve paying an engineering firm. For
starters, the fee would double just because of the
USACE’s review and approval process. The certification
process would require subsurface investigation consisting
of drilling, extracting soil samples and running permeability tests in a soil lab. It would also require some type
of groundwater study to determine if seepage is occurring under the levee.
How can you certify a three-foot freeboard above the
100-year flood elevation when you can’t rely on any other
levees in the floodway and the flood elevation is subject
to change?
Levee districts must also be able to pay for levee
maintenance, which would include manpower and
equipment at the least.
The certification program has many flaws that, unfortunately, can only be worked out on the federal level.
In the meantime, cities and towns affected by the program have little choice but to go through the certification
process.

The list of improvements trees bring to a community is long, and partnering
with your local energy provider and other agencies can help bring more trees
into your city or town.

to lower energy demand in residential areas.
According to research conducted by the Department of Energy, three shade trees strategically
planted around a house can reduce air conditioner use by
approximately 30 percent in some cities, and a nationwide shade program could reduce air conditioner use by
at least 10 percent. Shade trees also help to:
• Improve public health and air quality by absorbing
particulate matter;
• Store carbon dioxide to help slow global warming;
• Reduce the risk of flooding in urban areas by
absorbing stormwater runoff;
• Improve private property values and increase
residential aesthetics;
• Preserve public infrastructure, such as streets
and sidewalks.
On April 22, U.S. Rep. Doris O. Matsui (Calif.) introduced the Energy Conservation through Trees Act of
2008. The Act establishes a grant program to assist retail
power providers with the establishment and operation of
energy conservation programs using targeted residential
tree-planting and for other purposes. It is designed to
help lower utility bills, improve air quality and reduce
outside temperatures in urban areas and is patterned
after a successful model established by the Sacramento
Municipal Utility District (SMUD).
“Today, we are tasked with reducing our dependence
on foreign oil, stabilizing our energy grid and improving
air quality,” Matsui said. “By harnessing the enterprising
spirit of Americans and utilizing a diverse range of innovative approaches, we can accomplish this goal.”
SMUD, the sixth-largest publicly owned utility in the
country, has partnered with the Sacramento Tree Foundation, a 501 c(3) non-profit organization, to plant
strategically placed shade trees through the Shade Tree
Program. Each year, SMUD invests more than $1 million,
distributes over 4,000 trees to shade public places and
involves thousands of volunteers in the planting and care

of the trees. The Sacramento Tree Foundation has 40
full-time employees, 16 of whom are dedicated to the
Shade Tree Program.
SMUD is responsible for marketing the project,
which includes making initial contact with interested
homeowners, and the Sacramento Tree Foundation is
responsible for the trees. These homeowners are required
to fill out paperwork and view an instructional video on
how to properly plant and maintain trees. A foundation
representative then evaluates the site and determines how
many trees are needed to provide the home with the
most energy savings. The homeowner can receive
up to 10 trees produced at local nurseries that have
met Sacramento Tree’s standards.
“This program has succeeded in planting more than
400,000 trees, which will help conserve enough energy to
cool 9,000 homes in Sacramento. In addition, these trees

will contribute to the fight against global warming by
absorbing an estimated two billion pounds of carbon
dioxide. They will absorb five billion gallons of rainwater
as well and will eliminate or avoid the production of
about 61 million pounds of air pollutants,” Matsui said.
The idea of partnerships between utility companies
and non-profit tree organizations is not limited to
California. Branching Out, a partnership between Alliant
Energy, Trees Forever and Iowa communities, is designed
as a catalyst for qualifying communities or organizations
that need trees and have citizens willing to work cooperatively for the long-term benefit of their communities.
Every Branching Out project focuses on long-term tree
care with a special emphasis on energy efficiency and
conservation.
In Arkansas, partnerships are not uncommon. Our
own Arkansas Urban Forestry Council has partnered
with Chesapeake Energy, First Electric Cooperative,
Conway Corporation and Entergy. They have sponsored
various conferences and workshops, provided meeting
spaces, trees for Arbor Day ceremonies and Arkansas
ReLeaf projects.

planted trees to conserve energy: National Arbor Day
Foundation, Alliance for Community Trees, Pacific Gas
and Electric Company, American Forests, Sacramento

Staph infections on the rise
Knowing the risk factors can help you fend off the antibiotic-resistant
and potentially deadly strain of community-associated Staphylococcus.

t happens all the time: Beach towels are shared
among friends, razors are left in the shower for roommates to take turns using, and common sores and
cuts are often left uncovered, perhaps even during a
high-contact sporting event.
What’s the harm among friends and teammates, right?
What you probably don’t know is that those are some
of the most common instances that give a potentially
deadly form of Staph infection new life. Whereas a
common Staph infection is kept at bay with antibiotics,
Methicillin-resistant Staphylococcus aureus, better known
as MRSA, is a strain of Staph that’s immune to the antibiotics that are usually prescribed to control it, which makes
it extremely invasive and sometimes fatal.
MRSA is to blame for nearly 100,000 annual lifethreatening infections that are spreading in communities
at an alarming rate. According to the most recent statistics
from the Centers for Disease Control (CDC), more people
died in the United States in 2005 from MRSA (18,650)
than from AIDS (16,000). So the sooner MRSA becomes a
household name, the better off we’ll be in fighting it.
I
Not your typical strain
While most people still associate Staph infections as
being contracted in health care settings, communityassociated MRSA, or CA-MRSA, is affecting young and
otherwise healthy people who have not been hospitalized
or recently undergone a medical procedure.
The percentage of MRSA infections resulting from
a common Staph infection, according to the CDC, has skyrocketed from 2 percent in 1974 to 63 percent in 2006. It
can be picked up by anyone and is often related to serious
skin and soft tissue infections along with dangerous bouts
of pneumonia.
MRSA infections in the community are usually manifested as skin infections, such as pimples and boils.
Prevention and treatment
The good news is that community-associated strains
of MRSA are still responsive to some oral antibiotics. And
while most cases are treated simply with antibiotics, some
instances require draining the wound, oral antibiotics and
follow-up care.
However, the more deadly hospital-associated strain is
invading the community, and infection can require hospitalization. Risk factors include residency in long-term care
facilities and hospitalizations or surgery.

Important risk factors common to both strains
include participation in team contact sports, where
bacteria spreads easily through cuts and abrasions and
skin-to-skin contact, or living in crowded or unsanitary
conditions.
The most important prevention techniques are to
wash your hands often or use an alcohol-based sanitizer;
keep wounds washed frequently and as covered as possible;
and keep your personal items like razors, linens and athletic equipment to yourself. Communal items should be
cleaned and sterilized regularly. It’s important to use antibiotics as directed until the entire prescription is gone.
If there’s a wound or skin infection, always ask your
doctor about being tested for MRSA, which can avoid
delays in effectively treating your infection.

• Groups of individuals with poor hygiene

• Soft skin tissue infections, like boils or pimples that
are red, swollen, painful and often referred to as
“spider bites”
• Shortness of breath
• Fever

Realistic budgets win grants
Studying successful grant proposals can help you create a realistic budget
for your own project and help woo granting agencies.

ities and towns continually face the struggles created when financial resources do not keep up
with growing municipal demands. This is why
the grant-writing process is so important. The
federal and state government, as well as private corporations and foundations, offer many funding programs for
which municipalities and community-based organizations
can apply. Each Arkansas municipality should keep this in
mind and develop a grant-seeking and writing component
as an integral part of its strategic planning process.
Each municipality should ensure that it has done the
necessary legwork for receiving grants. This includes conducting a thorough community needs assessment and a
community blueprint. In addition, there are other tips and
techniques to keep in mind when applying for a grant.
To recap some of the tips listed previously we must remember that it is important to get to know the organization or agency from which you are requesting funds.
Become familiar with their priorities, successfully funded
projects and their long-term mission. Be certain that your
grant application clearly identifies and substantiates the
problem and offers creative solutions for addressing it. Remember to collaborate with strategic partners in offering
solutions to challenges the grant is designed to address. In
addition, it is key that you are persuasive, compelling, specific and factual in your narrative.
There are a few more tips that you can add to your
checklist when writing a grant application. First, your
budget must be well-researched and detailed. It is crucial to
keep in mind that in requesting for funding, you are informing the granting agency that you are aware of a problem they care about, that you have a creative and effective
solution but lack the financial resources on your own to
cause this solution to be realized. Your request is above all a
request for funds. Consequently, your budget is a very important aspect of your grant. A budget is a financial planning tool and all granting organizations recognize that it is
subject to change. The goal is to provide a budget that is realistic, organized and categorized in a standard format.
When developing your budget, review the budgets of
similar projects in scope and size to the one you are proposing for funding. You should also review the budgets of
successful grant proposals. This can give you insight to format and structure preferred by the agency. It is also important that you carefully review and heed all budget

guidelines. For example, many grants will specify nonfundable items, caps for certain services or benefits and
other limitations or expectations. Your budget should
demonstrate clear adherence to these restrictions and
guidelines. You should also research the market for comparable mainstream costs that are considered reasonable. This
would apply to services sought, travel, salaries and benefits,
as well as capital purchases.
Your budget should also include a strong evaluation
component. You must be able to articulate how you and the
funding agency will know that your program is working
and has achieved success. This means the grant proposal
should set and describe clear and tangible benchmarks to
be met as well as a timeline that describes the time period
in which each goal will be achieved. In addition, it is important that the application describe what specific tools and
methods will be utilized in order to measure and quantify
the results and impact of the grant. This will become a key
component for securing additional funding for future cycles or phases of this program or project.
Lastly, it is important to have your grant application
proof read. Finish the application in time to allow others
on staff or in the community review it for cohesiveness, factual errors, readability, mathematical errors and narrative
improvements. You should also consider having someone
outside of your community review the grant as an independent reviewer. This is one of the services provided by

Above all it is important to be thorough in the entire
process. Grant funding is available and grant writing is not
beyond the reach of your community. Take advantage of

Consulting. Your challenges and needs for funding are not
disappearing so neither should your grant efforts. Put these
tips to use today and see your grant writing skill and successes go up and up.

Obituaries
Ruth Kuelper, a Gentry alderman since 1997, died July 21.
Bill Edwards, 1928-2008
To his many friends and fellow city officials, Bill Edwards, the longtime
Hot Springs city board member who died June 1 at the age of 79, a servant,
hero and a gentleman, The Sentinel-Record reported on June 3.
“Nobody ever worked harder than Bill Edwards,” said Hot Springs
Mayor Mike Bush, who served with Edwards for eight years.
In 1991, Edwards suffered a massive heart attack and shortly after underwent a heart transplant. Still he refused to slow down.
“My uncle has a saying. ‘If you keep mowing, you keep going,’”
Edwards said in a 1998 city employee newsletter.
City Manager Kent Myers considered Edwards a great ambassador for
his city.
“I had the opportunity to go with him to a number of meetings and conferences out of town and he was always touting Hot Springs and always encouraging people to visit and see the city’s assets. He wanted the city to put on a
good face so he was constantly pushing through policy and regulations that
would help beautify the community. He traveled the city every day—countless
miles—looking at different issues and would bring to our attention what
needed to be addressed.”
Myers said Edwards was a caring individual and cared about the city’s

“He always asked about them and probably knew a majority of our employees on a first-name basis,” Myers said. “I think our employees appreciated his care and the attitude he
reflected at all times.”

Edwards was a “staunch
supporter of the individual, the little person.
“I always considered myself a little person,” she said. “Bill was in the corner of the underdog. I always knew
that if I didn’t have a friend in the city anywhere, Bill Edwards was in my corner and I could call him.
“But, I also felt that he was my city director, and if I had a problem or need in my area, I could call him and if
he felt I was right, he was going to dog it until he got it taken care of. His theory was, ‘Don’t tell me why we
can’t.’ It was, ‘Help me figure out how we can.’ That was the way Bill was; he was a fighter and if he felt he was
in the right and believed in it, he fought to the end.”

s parents, it’s difficult to watch a
child going through tough times.
How long should you muddle
through on your own, supporting
your child as best you can? At what point
does concerning behavior cross the line into
scary behavior?
Questions bring more questions: “If I
take my child for mental health help, will he
be on drugs for the rest of his life? Will she
be doomed to carry a label throughout her
school years? Where will it end?
David Streett, MD, offers words of
reassurance: “Most of the kids we treat are
just briefly deviating from their normal,
healthy developmental path. If they get
help early on, chances are they’ll never need
it again.”
This father of three is a psychiatrist
specializing in the care of children and
adolescents. He serves as the Medical
Director at Pinnacle Point Behavioral
HealthCare System, Little Rock’s premier
provider of outpatient and inpatient mental
health services for children and teenagers.
Most kids, he says, will do fine with
outpatient treatment. Therapy and perhaps
medication will get them back on track.
“The key,” he says, “is early intervention.”

possibly-broken limb, Dr. Streett urges
parents to trust their instincts. “If you
think something is wrong, do something
about it,” he advises. “Call us. One of our
