On behalf of the New York State Thoroughbred Breeding and Development Fund Board of
Directors, I am pleased to present this annual report for 2010. This submission contains a
thorough analysis of Breeding Fund activities in what was a challenging year for the breeders,
racehorse owners and stallion owners served by the Fund.
At the same time, it was a year when stakeholders experienced very positive developments. The
underpinnings of New York's thoroughbred industry were stabilized when state leaders
embraced Genting New York as the operator of what will be one of the state's biggest
Racinos. When that facility opens at Aqueduct in 2011, NYRA will realize a reliable revenue
stream. It will also boost the Breeding Fund's incentive program.
By making these incentives more generous, we will be in better position to attract new people to
this exciting sport and form of recreation.
Horse racing and agriculture-related industries play a vital role in the overall state economy
and helps to preserve green space and bolster tourism in our state. The work by the Fund
helps assure that New York remains a preeminent racing jurisdiction.
The Fund's chief challenge in 2010 was tied to the demise of New York City OTB, which
historically provided roughly one-third of all Fund revenues. The corporation declared
bankruptcy in December 2009 and later stopped statutory payments owed to the Fund.
However, the Racing and Wagering Board secured a directive requiring 0113 to set aside
revenue for the Fund in segregated accounts. As a result, most of that set-aside money was
paid to the Fund by mid-December 2010.
Today, the future of New York racing appears far brighter than it did just one year ago. The
Fund is strong and weathered the storm. We look forward to another year of rising to the
challenges that come our way.

Executive Summary
To put a fresh twist on the slogan of the New York Thoroughbred Breeding and Development Fund
programs, New York-breds in 2010 still started with an advantage. Chief among those advantages: over
$9 million in awards earned by breeders, stallion owners, and race horse owners in 2010. These awards
help program participants pay feed bills, property taxes, and employees. Thus, the Fund continues to
serve as a catalyst for the preservation of the State’s thoroughbred industry and the retention of an
estimated 40,000 agri-business jobs in all parts of the state’s agricultural sector.
The 2010 report details highlights of NY-bred accomplishments at home and abroad, and provides a
detailed accounting of receipts and disbursements of the Breeding Fund’s three major incentive areas –
breeder awards, stallion awards, and open-company owner awards. Additionally, it contains the
performance results of New York-breds at the racetrack and an analysis of the success of the New York
State Thoroughbred Breeding Program regarding farm count, foal production, and New York-based
stallions and their progeny.
Among the highlights of 2010 were the accomplishments of New York-bred A Shin Forward, who won
the Grade 1 Mile Championship at Kyoto race track in Japan in late November. Horses born on New
York soil racked up international earnings totaling $69,289,272 in 2010. Bred by Edition Farm in
Waccabuc, A Shin Forward’s earnings now top $3.3 million, making him the second-highest NY-bred
earner behind famed Kentucky Derby winner Funny Cide.
Speaking of A Shin Forward, we would be remiss if we did not mention that the entire equine community
mourns the death of Henry “Harry” Malloy this past fall. Harry and his wife Vivien enjoyed running
Edition Farm together, and have campaigned horses on the New York circuit for nearly three decades.
The couple has passed on their love of horses to their five children and eleven grandchildren and stepgrandchildren. Mrs. Malloy told friends she believes Harry had his arms around the horse when A Shin
Forward crossed the finish line in stakes-record time.
The Malloys serve as a shining example of the kind of love and dedication to horses that drives so many
of our breeders to carry on during tough times. Add to that a devotion to their farm land that would rival
that of Gone With the Wind’s Gerald O’Hara (“Land’s the only thing in the word worth working for,
fighting for, worth dying for, because it’s the only thing that lasts”) and the reader will understand why
the state’s breeders stick with the program as they tighten their belts and look for signs of stability and
upswing in the equine economy. For many, stewardship of their land is something they look upon as a
duty, which fits perfectly with the Breeding Fund’s mission: to preserve, protect, and promote the
green-belt sector of NYS in order to foster the growth and expansion of NY’s thoroughbred
breeding industry.
We can look back on the Fund’s more than three-and-a-half decades of impact on the thoroughbred and
agri-business economies and see that the programs administered by the Fund are at the very heart of what

helps sustain the breeding of thoroughbreds here in the Empire State. Over 37 years, the Breeding Fund
has returned nearly $350 Million to our agricultural and equine economy.
Significantly, New York-breds have the opportunity to compete for good purse money in restricted
company on what is arguably the best circuit in the nation at Aqueduct, Belmont Park, and Saratoga Race
Track operated by the New York Racing Association. During last summer’s spa meet, NY-breds
competed for an average purse of $44,849. And New York-breds also have the “advantage” of the
opportunity to earn good money by running at Finger Lakes Gaming and Racetrack in the central part of
our state. New York-sired horses win approximately 60% of all races run at the racino, and about onethird of all stakes races. In addition, a 2007 study found that with 115 trainers and 475 full-time
employees, the racino has a $120 million economic impact annually on the surrounding region.
Because the New York Breeding Program has become the envy of other states, several locales have
pumped up their programs in an attempt to dethrone the acknowledged leader. The state of Indiana
bankrolled some $200,000 worth of advertising to lure breeders to the Hoosier State. New Jersey cut back
on racing dates, boosted purses, and generated an increase in total pari-mutuel handle of $123 million.
Those higher purses forced NYRA to compete for horses to fill the starting gate by raising purse money
for open-company races and cutting back on purses for NY-breds. Another challenge to breeders and
commercial boarding operations in NYS comes from our neighboring state of Pennsylvania, where $20
million annually is now disbursed through the PA program.
Most readers are aware that the 2009 bankruptcy of NYC OTB, its subsequent failure to make full
statutory payments to the Fund in 2010, followed by the failure of legislators to approve a settlement
worked out over many months by major stakeholders had a negative impact on the industry in NYS. Add
to that backdrop the fact that the Fund’s revenue is based solely on handle, which has been falling steadily
for several years,* and it becomes apparent why the Fund had to make adjustments so that it could
maintain its commitment to its core mission of preserving green space. Those adjustments included staff
reductions, an extension of 2009 changes to the awards structure, and additional duties for the field
inspectors who help maintain the integrity of the Breeding Fund Registry.
Looking forward, it’s clear that NY-breds will be starting with a NEW advantage that comes with the
delivery in mid-2011 of the long-promised VLTs at Aqueduct. Expected to be operational by July, the
handle from the VLTs will fuel purse increases at the NYRA tracks and generate additional revenue for
the Fund. For budgetary planning purposes, the Fund is estimating that each machine will generate an
average of $275 per day, a figure that NYRA believes to be conservative.
As you’ll see in the pages ahead, the roster of stallions standing in the state is a smaller but arguably
stronger group of studs than has been here in the past. Two major Kentucky farms have launched satellite
stallion operations by teaming up with farms that had already earned good reputations among the state’s
breeders.
The leading breeder in the nation, Adena Springs, teamed up in late 2010 with McMahon Thoroughbreds
in Saratoga Springs. The Vinery operation out of Kentucky is providing NY-breeders with access to the
Giant’s Causeway, Distorted Humor, and AP Indy sire lines as they add to the strong roster of stallions at
the old Empire Stud in Hudson.

Cornell University. When the 2010 report is published, the Fund will update this annual report to reflect
the latest equine research performed at Cornell with the support of $227,853 supplied by the Fund.

In 2010, 3,632 thoroughbreds bred in New York made 25,134 starts in North America,
earning total purses of $65,700,731. These New York-breds finished first 2,946 times,
second 3,027 times, and third 3,045 times, for a total of 9,018 top-three finishes and an
overall in-the-money rate of 35.9%.
In 2009, 3,856 thoroughbreds bred in New York made 26,755 starts in North America,
earning total purses of $70,194,634. These New York-breds finished first 2,944 times,
second 3,081 times, and third 3,234 times, for a total of 9,259 top-three finishes and an
overall in-the-money rate of 34.6%.
In 2008, 3,851 thoroughbreds bred in New York made 27,357 starts in North America,
earning total purses of $81,562,424. These New York-breds finished first 3,126 times,
second 3,324 times, and third 3,306 times, for a total of 9,756 top-three finishes and an
overall in-the-money rate of 35%. The total purses earned represents an increase of
over 6% compared to last year’s figure of $76,378,645, marking the eleventh
consecutive year of record earnings.
In 2007, a total of 3,934 thoroughbreds bred in New York made 26,292 starts in North
America, earning total purses of $76,378,645. These New York-breds finished first
2,974 times, second 3,148 times, and third 3,098 times, for a total of 9,220 top-three
finishes and an overall in-the-money rate of 35%. The total purses earned represents an
increase of nearly 4% over last year’s figure of $73,535,643, marking the tenth
consecutive year of record earnings. The total North American purse earnings by New
York-breds in 2007 represent an increase of nearly 72% over the 1997 figure of
$44,456,305.
In 2006, a total of 3,873 thoroughbreds bred in New York made 26,320 starts
worldwide, earning total purses of $73,535,643. These New York-breds finished first
2,956 times, second 3,180 times, and third 3,101 times, for a total of 9,237 top-three
finishes and an overall in-the-money rate of 42.4%, an increase of over 6 percentage
points compared to the figure for last year. North American earnings by New Yorkbreds increased to a total of $72,092,598 for 2006, marking the ninth consecutive year
of record earnings. The total North American purse earnings by New York-breds in
2006 represent an increase of over 62% compared to the 1997 figure of $44,456,305.
In 2005, a total of 3,591 thoroughbreds bred in New York made 24,495 starts in North
America, finishing first 2,940 times, second 2,949 times, and third 2,929 times, for a
total of 8,818 top-three finishes and an overall in-the-money rate of 36%. Total North
American purse earnings by New York-breds in 2005 reached an all-time high of
$71,907,213, surpassing the record set in 2004 by nearly $6.7 million. This marks the
eighth consecutive year of record-setting earnings by New York-breds.
In 2004, a total of 3,466 thoroughbreds bred in New York made 24,234 starts in North
America, finishing first 2,658 times, second 2,656 times, and third 2,852 times, for a
total of 8,166 top-three finishes and an overall in-the-money rate of 33.7%. Total

North American purse earnings by New York-breds in 2004 reached an all-time high
of $65,211,933, surpassing the record set in 2003 by over $7.5 million.
In 2003, a total of 3,187 thoroughbreds bred in New York made 22,053 starts in North
America, finishing first 2,550 times, second 2,634 times, and third 2,627 times, for a
total of 7,811 top-three finishes and an overall in-the-money rate of 35.4%. Total
North American purse earnings by New York-breds in 2003 reached an all-time high
of $57,674,759, surpassing the record set in 2002 by over $2.5 million.
In 2002, a total of 2,985 thoroughbreds bred in New York made 22,079 starts in North
America, finishing first 2,575 times, second 2,576 times, and third 2,617 times, for a
total of 7,768 top-three finishes and an overall in-the-money rate of 35.2%. Total
North American purse earnings by New York-breds in 2002 reached $54,963,235,
surpassing the record set in 2001 by over $1 million.
In 2001, a total of 2,880 thoroughbreds bred in New York made 22,019 starts in North
America, finishing first 2,585 times, second 2,641 times, and third 2,686 times, for a
total of 7,912 top-three finishes and an overall in-the-money rate of nearly 36%. Total
North American purse earnings by New York-breds in 2001 reached $53,860,329,
surpassing the record set in 2000 by nearly $1.25 million.

Performance of NY Stallions in 2010

For the first time since the 2002 season, two stallions standing in New York had over
$4 million in annual progeny earnings: Posse ($4,224,805) and Freud ($4,035,403). In
fact, a total of eight New York stallions (all living) topped $2 million – the highest
number of living annual multi-millionaire sires ever to stand in New York. A dozen
New York-based stallions had more than $1.6 million in 2010 progeny earnings, and
the 11 of those that are still living (one died in 2006) are all scheduled to remain in the
state for the 2011 breeding season. Freud, who entered stud in New York in 2002,
became the first stallion with more than $4 million in annual New York-conceived
progeny earnings since the late Cure the Blues achieved that distinction following his
death more than a decade ago.
Third-leading 2010 New York-based sire Repent ($3,016,624) and fourth-leading sire
Congaree ($2,904,673) both stood in the state in 2010, while Touch Gold ($2,894,002)
and Alphabet Soup ($2,605,414) arrived later in the year as part of the Adena Springs
contingent to stand at Joe and Anne McMahon's McMahon of Saratoga
Thoroughbreds. Golden Missile ($2,539,814) has stood at Dr. Jonathan Davis' Milfer
Farm in Unadilla since 2008, but Grade 1-winning miler Purge ($2,288,817) is another
late 2010 arrival to the Empire State, standing at Vinery New York in Hudson.
Catienus ($1,913,144) and New York-bred Read the Footnotes ($1,879,444) have both
stood substantial stretches of their stud careers in New York.
Among New York's new stallion arrivals for 2011 that have not been represented by
runners are two multiple Grade-1 winners of more than $2.3 million each: Tiago,
whose first foals arrive in 2011 and who stands at Adena Springs/McMahon, and
Marsh Side, who is entering stud under Questroyal Stud management. The trackrecord-setting Tiago (Pleasant Tap – Set Them Free, by Stop the Music) is scheduled
to stand for $5,000 (live foal) as the property of a syndicate. Marsh Side (Gone West –
Colonial Play, by Pleasant Colony), a stakes winner on both turf and Polytrack, is
owned by Robert Evans and stands at Silvernails Farm in Pine Plains for an
introductory fee of $2,000 (live foal).
Multiple Grade-2 winner Silent Name (Sunday Silence – Danzigaway, by Danehill),
whose first offspring are 2-year-olds of 2011, is another stallion on the Adena
Springs/McMahon roster and has a 2011 stud fee of $5,000 (live foal). Entering stud at
McMahon are graded winners Harlem Rocker (Macho Uno – Freedom Come, by Lit
de Justice) and Coal Play (Mineshaft – Wiscasset, by Kris S.) – the former as part of
the Adena Springs contingent, and the latter as the property of McMahon. Harlem
Rocker, who finished first in Aqueduct's Grade 1 Hill 'n' Dale Cigar Mile in 2008 but
was disqualified to second, has a 2011 stud fee of $3,500 (live foal), and Coal Play, a
standout miler, has a fee of $4,000 (live foal) for 2011. Entering stud at Vinery New
York is multiple Grade-2 winner Justenuffhumor (Distorted Humor – Justenuffheart,
by Broad Brush), who is a half-brother to Eclipse Champion Dreaming of Anna and
stands as a Darley Stallion for $5,000 (live foal).

Impressive Lineup of New Stallions Standing in NY

A review of the trimmed-down list of registered New York stallions suggests that the
needs of mare owners have dictated a retreat to quality for those studs standing in the
state. Looking back to the year 2000, 134 stallions were holding court for mares. Just
68 owners registered stallions for 2010, and by the end of January 2011, 70 stallions
had fulfilled the requirements of registration to stand stud duty in New York in 2011.
The owners of these horses can anticipate collecting stallion awards from purses
enriched by the long-awaited unveiling of Video Lottery Terminals at Aqueduct.
Certainly the two major Kentucky operations – Adena Springs and Vinery – that sent
stallions to New York in late 2010 to stand for the 2011 breeding season believe that
New York breeders will welcome the chance to breed their mares to in-state sires when
those stallions are quality performers from good families and represent desirable sire
lines. As Dermot Carty, Director of Sales for Adena Springs, put it, “The slots
initiative in the state of New York is very compelling. The prospect of improved
purses as well as stallion and breeder’s awards was a strong motivation for Adena
Springs Farm to support the New York State program with our stallions.”
Adena Springs topped its roster of studs standing at McMahon Thoroughbreds in
Saratoga Springs with proven sire Touch Gold. The son of Deputy Minister has
already sired 10 graded stakes winners and, with a $10,000 stud fee, figures to attract
some of the state’s top mares whose owners are looking for Northern Dancer
bloodlines.
Listed alphabetically, the other Adena stallions that are new to New York are
Breeders’ Cup Classic winner Alphabet Soup; Withers S. [G3] winner Harlem
Rocker, who brings the Macho Uno sire line to New York; Silent Name (JPN), a dual
G2 winner by top Japanese sire Sunday Silence out of a graded stakes-winning
daughter of Danehill; and Tiago, the son of Pleasant Tap who earned $2.3 million
dollars while notching wins in such prestigious Grade 1’s as the Santa Anita Derby,
The Goodwood Stakes and the Oaklawn Handicap, and who offers an outcross
pedigree free of Raise A Native/Mr. Prospector and Northern Dancer.
Vinery made a seamless move into New York by taking over Empire Stud in Hudson.
Having made its first foray into the NY stallion ranks in 2010 by sending popular sires
Posse and Repent to the Hudson operation, Vinery took some more well-measured
steps by sending three more graded stakes winners to the state for the next breeding
season.
First-year sire Justenuffhumor, a son of Distorted Humor, won two Grade 2’s on the
turf at Saratoga Race Course in 2009: the Bernard Baruch Handicap and the Fourstar
Dave Handicap. Charlie Boden, head of sales at Darley, which campaigned
Justenuffhumor, said, “The New York breeding program is poised to become one of
the most lucrative places in the country to raise a horse. We think Justenuffhumor will

be well-received by New York breeders given his race record and world-class
pedigree.”
Vinery is also bringing the Gone West sire line to the state in the form of Kensei, a
Grade 2-winning son of Mr. Greeley who is a half-brother to 2010 Eclipse Champion
three-year-old Lookin at Lucky. Like Justenuffhumor, Kensei also proved he had a
fondness for racing at Saratoga, though Kensei did his best running on the dirt,
breaking his maiden at Saratoga in 2008 and coming back in 2009 to win the Jim
Dandy [G2].
Purge is also making a new home in the Empire State. This A.P Indy sire-line horse
also loved the Spa, as he broke his maid here in 2003 and came back to score an
impressive victory in Grade 2 Jim Dandy at three. The son of Pulpit nailed his lone
Grade 1 win at four with a smart victory in the Cigar Mile at Aqueduct. Vinery
President Tom Ludt says, “We think Purge will be well-received with New York
breeders. He’s in the top of his crop in every category, is a son of emerging sire of sires
Pulpit, and on top of that he’s a very attractive individual.”
Questroyal Stud looks to bring durability, a top sire line, and a quality female family as
it offers the Gone West son Marsh Side to breeders. The multiple Grade 1 winner
earned more than $2.3 million dollars in a 31-race career that began at age 3 and drew
to a close at age 7. His Grade 2-winning dam Colonial Play is by stamina influence
Pleasant Colony, and she is a full sister to the dam of Eclipse Champion 2-year-old
filly Pleasant Stage. Marsh Side will stand at Silvernails Farm near Pine Plains.
Other newcomers included in the New York Stallion Registry, which is published by
New York Thoroughbred Breeders Inc. with the financial support of the Fund, include:
Coal Play: The only son of 2003 Horse of the year Mineshaft at stud in NY will stand
at McMahon Thoroughbreds. Coal Play’s trainer, Hall of Famer Nick Zito, says, “Coal
Play could carry his speed over a mile, winning wire-to-wire in four of his five wins.
Coal Play has tremendous conformation, a tremendous body and brilliant speed. He
has the ability to make a terrific stallion.”
Magical Forest: This five-year-old son of Forest Camp is out of the precocious Silken
Magic. He raced 15 times and won three stakes, including the G3 Barbaro S. at
Delaware Park.
Malibu Moonshine: His sire, Malibu Moon, stands for $60,000 in Kentucky. This
horse, owned by Joseph Forrest, will stand for $3,000 at Carlland Stables in Avon, NY.
Talk about durable: Malibu Moonshine launched his race career with three wins as a
two-year-old, including the St. Nick Stakes at Charlestown. He went on to race 59
more times through age 8, amassing a record of 62 - 12 (7 stakes) - 5 (3) - 8 (4) with
earnings of $597,370.
Relato Del Gato: Another durable runner, this son of Tale of the Cat, who stands for
$30,000 at Ashford Stud in Kentucky, won the Phoenix Gold Cup H. at age six and
notched a second in the Grade 3 Morvich Handicap that same year. He stands for a
private fee at the Cohn Farm in Ferndale, NY.

Sternman: This Mr. Prospector-line stallion loaded in the starting stall 66 times,
winning his final race at age 9. The son of Idabel stands for $1,250 at the Coxon-Parent
Farm in Fort Ann.

In the sales rings, three young females in November were 2010's highest-priced New
York-breds: Fit Right In (in foal to Curlin), the 8-year-old dam of Rightly So, sold for
$1,050,000 at Keeneland, and 2010 Grade-1 winners Rightly So and Franny Freud sold
for $600,000 and $560,000, respectively, at Fasig-Tipton Kentucky. The unraced Fit
Right In, who produced Rightly So as her first offspring, was purchased by Katsumi
Yoshida, who was also the buyer of Franny Freud. Rightly So, who had been a fairly
pricey 2-year-old in training at the Ocala Breeders' Sales Company's 2008 February
select sale, going to Zayat Stables for $220,000 with Becky Thomas's Sequel
Bloodstock as agent, was purchased by Patinack Farm.
Among the 385 New York-bred yearlings that sold at auction in 2010 for prices
totaling $9,956,500 were 19 that brought six-figure prices, headed by a Tale of the Cat
colt out of Valdivia, by Pleasant Colony that was purchased for $325,000 at
Keeneland's September sale by Fox Hill Farm. That colt, named The Thinker, was bred
by Empire Equines, LLC.
A higher proportion of New York-bred 2-year-olds in training brought six-figure sales
prices in 2010 compared to New York-bred sales yearlings, as 132 juveniles bred in
the Empire State grossed $5,082,300 at auction, including 12 that went for six-figure
bids. Top-priced among the dozen was a filly by Henny Hughes out of Open Window,
by Trempolino that was purchased for $275,000 by Thoroughbred Futures at FasigTipton Florida's select sale at Calder. That filly, named Midnight Visit, was bred by
Dr. Jerry Bilinski.
New York-bred weanlings sold at auction in 2010 totaled 46 that brought aggregate
final bids of $1,369,500, and the two that went for six-figure prices included a colt by
Rock Hard Ten out of Regard, by Fusaichi Pegasus, purchased for $300,000 by
Westrock Stables, LLC at Keeneland's November sale. Named Taken for Granite, the
2010 colt was bred by Berkshire Stud.
An interesting common characteristic of the top-priced yearling, 2-year-old, and
weanling among New York-breds sold at auction in 2010 was that all three had
unprepossessing catalogue pages. None were out of dams that had won or placed in
stakes competition (two of the dams were winless), and none were out of dams that had
produced stakes winners. Other factors – appearance, racing and earning opportunities
available, or perhaps the under-tack workout performance of 2-year-old Midnight Visit
– must have enhanced their attractiveness to buyers.

2010 Registry Compliance Report
The underlying theme for the registry compliance team at the New York State
Thoroughbred Breeding and Development Fund in 2010 is one that will sound familiar
to those working under economic constraints at every level from farm to state agency:
doing more with less.
This was the first full year that the Fund’s field representatives worked under a 2009
directive from the Board of Directors to keep a watchful eye on the health and welfare
of thoroughbreds. It was a duty added in the wake of the 2009 rescue of dozens of
animals from the Greene County farm of breeder Ernie Paragallo.* Mr. Paragallo was
subsequently convicted in March 2010 on 33 counts of animal cruelty, and was
sentenced in May to 2 years in prison and fined $33,000. He was released on bail the
following month to appeal his sentence. Of the 96 horses taken from his Center Brook
Farm in Climax, 6 had to be euthanized and the Columbia-Greene Humane Society
cared for or found responsible homes for the remainder.**
To maximize the effectiveness of the field team (currently consisting of Tom Conley
and Tom Reynolds), Investigator Sue McDonough (State Police, retired) was invited
by Executive Director Tracy Egan to review Article 26 of the Agriculture and Markets

Law. Inv. McDonough shared that in her 26 years as a trooper, and now as an animal
advocate, the majority of problems she has witnessed lie in the category of negligence
resulting from ignorance, a lack of interest, or financial problems. She said that the
first thing she does to help a horse is to help the owner understand that there’s a
problem and to try to help them rectify the situation.

Regular Duties of the Field Representatives
To the many people who live and work on farms across the state, the field
representatives serve as the public face of the Breeding Fund. Typically, the “field
reps” visit each of our more than 300 farms at least once per year. In the photo below,
field rep Tom Conley demonstrates to Executive Director Tracy Egan how he confirms
the identify of a mare residing at High Cliff Farm in Delanson, Schenectady County.
During farm visits, they check each mare’s tattoo numbers or the identifying markings
written on the mare’s Jockey Club papers, to enable them to document an individual’s
status as a resident or non-resident broodmare. They not only count the number of
mares at each farm, they also note whether each mare is in-foal and, if so, to which
stallion and whether it is a New York or out-of-state stallion. The inspectors keep track
of barren mares as well. In addition, if a mare (whose file travels with inspectors such
as Tom Conley, as shown in the photo below) no longer resides on the farm, inspectors
will mark down whether she left the state, moved to another farm in the state, or is
deceased, retired, sold, or has been given away.
The information gathered at the farm level is logged into spreadsheets that are used by
the Registrar and by the Fund’s central office to confirm that an individual horse is
eligible to be registered as a NY-bred. This registration adds tremendous value to a
horse as a sales prospect and can return award money to the hard-working breeder, so
the work performed by the field team is crucially important to protecting the vast
majority of breeders who understand and abide by the strict rules of the NY-bred
program.

Because green space is so important to the mission of the Fund, the inspectors also take
note of acreage, number of buildings, barns, stalls, and fenced paddocks. In spite of
the decline in the number of farms in the state to 307, the field representatives estimate
New York breeding farms still encompass some 35,000 acres.
Field Reps Promote the Program
The field representatives have proven time and again that they are able communicators
when it comes to spreading the word about the strength of the New York State
Thoroughbred Breeding and Development Fund Program. They travel armed with a
thorough understanding of how our program works and stay informed about challenges
facing the Fund, such as the 2009 bankruptcy filing of NYC OTB (the Fund’s largest
contributor) and its closure in late 2010. They offer to leave brochures provided by
NYTB, Inc. that promote both the Fund programs and the benefits of trade-group
membership, so that farms can pass along the promotional information to current or
potential customers.
In 2010, the Fund also provided representatives with brochures to distribute concerning
the issues of unwanted horses and responsible horse ownership.
Budget Crunch Hits Field Team
The financial statements included in this report detail how a decline in handle hurt
revenue streams to the Fund. Due to such circumstances, the Board of Directors
furloughed the newest member of the field team from September through December.
At its December meeting, the third position on that field team, held by Jim Zito, was
eliminated. We are grateful to Jim for his years of service to the Fund and the people
we serve, and wish him well in his future endeavors.
*In 2010, the Board formally instituted a new rule that awards will be temporarily withheld from
persons accused of animal abuse, and would not be paid to anyone convicted of felony animal abuse.
** In the summer of 2010, the Fund’s Executive Director visited two farms that helped the ColumbiaGreene Humane Society rehabilitate the rescued horses. All of the horses appeared to be in good health,
with plenty of body weight, shiny coats, and trimmed feet.

2010 – The Odyssey of New York-Breds Enters a New Era

Despite adversity on a variety of political and economic fronts away from racetracks,
breeding farms and auction pavilions, in 2010 the New York Breeding and Racing
Program achieved unprecedented success in racing, sales and the acquisition of stallion
talent. For the first time ever, four New York-breds won Grade/Group 1 races in a
single season, as 5-year-old horse A Shin Forward, 4-year-old colt Haynesfield, 4year-old filly Rightly So and 3-year-old filly Franny Freud captured top-level events.
Rightly So's unraced New York-bred dam was sold for $1,050,000 at Keeneland, and
563 New York-bred weanlings (46), yearlings (385) and 2-year-olds in training (132)
brought prices totaling more than $16.4 million during 2010.
Two New York-based stallions – Posse and Freud – had 2010 progeny earnings
topping $4 million, three had offspring earnings exceeding $3 million, and eight (all
scheduled to stand in the Empire State in 2011) boasted progeny bankrolls of more
than $2 million each in 2010.
Worldwide in 2010, there were 3,781 New York-bred starters, and they earned
$69,289,272. Two New York-breds – Haynesfield and Monmouth turf icon Get
Serious – became new millionaires in 2010.
The onslaught of New York-bred open stakes success in 2010, when 25 state-breds
won black-type stakes in unrestricted company and nine tallied 17 times in
graded/group events, began on the weekend of February 27-28. That Saturday, Jeff
Fletcher and Hamilton Hale's 3-year-old son of state-based sire Catienus, Dont Blame
the Cat, won Laurel's seven-furlong Miracle Wood Stakes, and Alan Brodsky's 4-yearold filly Don't Forget Gil captured Tampa Bay Downs' 1 1/16-mile Wayward Lass
Stakes. On Sunday, Eishindo Company's New York-bred millionaire A Shin Forward
scored his first group-level victory in the seven-furlong Hankyu Hai on Japanese turf.
The following Saturday (March 6), Chester and Mary Broman's New York homebred
3-year-old filly Khancord Kid took Gulfstream Park's graded Herecomesthebride
Stakes at 1 1/8 miles on turf. About two hours earlier, New York-bred Castaneda had
romped by three lengths in a front-running effort for Team Stallion Racing Corp., John
Moirano, and Harold Lerner in Aqueduct's six-furlong Fred "Cappy" Capossela Stakes
for open 3-year-olds. Five days later (March 11) at Aqueduct, Blue Bison Stable and
Stewart Hoffman's New York-bred daughter of in-state sire Congaree, Shine Upon,
took the Dreamy Mimi Stakes for open 3-year-old fillies going a mile and 70 yards.
In April, New York-breds invaded Kentucky and came away with three graded stakes
victories. On April 7, the amazingly versatile Franny Freud, a semi-homebred daughter
of in-state sire Freud racing for Paul Pompa Jr., Stephen Yarbrough, and breeder
Anthony Grey, scored by 4 ¾ lengths in Keeneland's Grade 2 Beaumont Stakes for 3year-old fillies going just beyond seven furlongs on Polytrack. Three days later on
Keeneland turf, Michael Dubb and High Grade Racing Stable's 7-year-old Silver
Timber registered the first of back-to-back graded grass sprint wins in April by taking
the 5 ½-furlong Shakertown Stakes. On April 30, Silver Timber was on Churchill

Downs' lawn, where he shouldered top weight to win the graded Churchill Downs Turf
Sprint in a stakes-record clocking of 55.45 for five furlongs.
Another daughter of Freud, Repole Stable's 5-year-old Lights Off Annie, gained her
first open-company black type on Preakness Eve (May 14) with a 5 ½-length romp in
Pimlico's six-furlong Skipat Stakes. She had previously won the latest two renewals of
Aqueduct's Broadway Stakes for New York-bred fillies and mares. The next day at
Delaware Park, owner-trainer Wesley Ward's first-out-winning (at Keeneland) juvenile
New York-bred filly, Final Mesa, registered a facile 4 ¾-length triumph in the fourfurlong Polly Drummond Stakes on conventional dirt. Eight days later on May 23,
Anstu Stables' 2009 New York Thoroughbred Breeders (NYTB) juvenile male
champion, Ibboyee, won Monmouth's Spend a Buck Stakes at a mile and 70 yards for
3-year-olds.
New York-breds captured five stakes at four different tracks in New Jersey,
Pennsylvania, Virginia and Ontario (Canada) during June, beginning with Silver
Timber's third consecutive stakes tally of 2010 while under top weight in Monmouth's
Wolf Hill Stakes at about 5 ½ furlongs on turf on June 5. Three days later, Everything's
Cricket Stable's multiple turf sprint stakes-winning 6-year-old mare Ahvee's Destiny
got her first synthetic-surface black-type victory in Presque Isle Downs' Satin and Lace
Stakes at 5 ½ furlongs over the Tapeta strip. On June 12, perennial New Jersey
standout Get Serious, a 6-year-old New York-bred racing for James Dinan, Jacques
Moore and Phantom House Farm, was inexplicably overlooked in the graded
Monmouth Stakes at 1 1/8 miles on turf but won anyway against eight rivals – four of
them favored over him. A week later, Benchmark Racing Stable's Lady Rizzi, a 7-yearold always-improving New York-bred mare, gained her first black type by winning
Colonial Downs' 5 ½-furlong Buckland Stakes on turf over 10 rivals, despite breaking
from the tenth post. On the final Saturday of June, Final Mesa improved to three-forthree with a 7 ¾-length laugher in Woodbine's My Dear Stakes at five furlongs on
Polytrack. (She's for real; on January 5, 2011, she won Gulfstream's graded Old Hat
Stakes at six furlongs on dirt for newly-minted 3-year-old fillies.)
Turtle Bird Stable's 2009 NYTB Horse of the Year, Haynesfield, won Belmont's
historic Grade 2 Suburban Handicap at 1 1/8 miles on July 3 by 2 ¾ lengths , marking
his fourth consecutive victory and second score of 2010 following an overnight mile
tally at Belmont 20 days earlier. On July 4, Franny Freud took Belmont's Grade 1
Prioress Stakes at six furlongs, stamping herself as arguably the best 3-year-old sprint
filly in North America and becoming the only 2010 stakes winner at that time on dirt,
synthetic, and turf. On the Monday, July 5 holiday of the Independence Day weekend,
Zayat Stables' Rightly So, a 4-year-old daughter of in-state sire Read the Footnotes, led
throughout under top weight in Belmont's graded Bed o' Roses Handicap at seven
furlongs, capping probably the best three-day span ever for New York-breds.
On July 17, another unbeaten New York-bred juvenile stakes winner emerged at
Woodbine – a la the aforementioned Final Mesa – in Martha Gonzalez's Glory Game,
who won the $142,215 (in U.S. funds) Colin Stakes at six furlongs on Polytrack by two
lengths over a prohibitive odds-on (and stakes-winning) favorite. On July 30,
Obviously NY Stable's three-time NYTB champion of 2009 (older female, turf female

and sprint female), the 5-year-old Canadian Ballet, captured Penn National's six-figure
Jenny Wade Handicap at five furlongs on turf in 55.64 while under top weight.
Get Serious scored his second of three graded turf victories of 2010 in Monmouth's 1
1/16-mile Oceanport Stakes on August 1. Six days later, Landsdowne Stables' New
York-bred Sharp Secretary won Woodbine's $147,118 (in U.S. funds) Duchess Stakes
for 3-year-old fillies going seven furlongs. The next day, JMJ Stables' New York-bred
son of Read the Footnotes, Out of Respect, won Monmouth's Select Stakes for 3-yearolds by daylight over the 1-to-2 favorite (by New York-based sire Posse) who was
coming off five consecutive stakes victories. On the final Saturday (the 28th) of
August, Rightly So became the second New York-bred Grade 1 winner of the summer
with a four-length gate-to-wire domination of Saratoga's seven-furlong Ballerina
Stakes, advancing to the head of the class among 2010's female dirt sprinters.
Get Serious returned to Monmouth turf for his third graded victory and fourth win (in
five starts) of 2010 on Labor Day eve (Sunday, September 5), capturing the one-mile
Red Bank Stakes under top weight at odds-on and bettering his own course record – set
in 2009 – by clocking 1:32.37. That victory, registered over five foes carrying five to
seven pounds less than the New York-bred winner, and coming despite his stumbling
and bumpy start, boosted Get Serious' earnings to $1,000,691, making him the 23rd
millionaire bred in the Empire State.
Another New York-bred NYRA stakes winner outside state-bred company emerged
from the New York Stallion Stakes program when Aliyu Ben J Stables' homebred
Freud colt, Lubash, took Belmont's one-mile Fifth Marine Stakes for eight 3-year-olds
on yielding turf while carrying co-top weight on September 17. The next evening,
Hillwood Stable's first-out-winning (on turf) New York-bred Bandbox cruised to a 9
½-length triumph in the six-figure Charles Town Juvenile Stakes at a two-turn seven
furlongs on dirt for his second of three consecutive wins.
In Belmont's historic Grade 1 Jockey Club Gold Cup on October 2, Haynesfield did
what no other horse – not even future Hall of Famer Zenyatta – could do in 2010,
beating eventual Eclipse Champion Blame "handily" by four lengths in that 1 ¼-mile
weight-for-age event. The victory made Haynesfield the 24th New York-bred
millionaire, and eight weeks later he boosted his bankroll to $1,166,981 by placing a
close second – beaten a head – while under co-top weight among nine in Aqueduct's
Grade 1 Hill 'n' Dale Cigar Mile Handicap. A week later, Silver Timber got his fourth
turf stakes victory of 2010 and third graded tally of the year by beating 10 rivals in
Keeneland's 5 ½-furlong Woodford Stakes while carrying top weight. On October 29,
Patsy Symons' New York-bred Gitchee Goomie proved that her solid third-placing at
almost 22-to-1 among seven in Belmont's grassy Grade 1 Garden City Stakes 41 days
earlier was no fluke when she won Belmont's 1 1/8-mile Topicount Stakes for 11 open
3-year-old fillies on turf.
A flurry of New York-bred open stakes successes highlighted the six-day span from
November 20 through Thanksgiving. Majesty Stud's homebred Stormy's Majesty, who
had won Saratoga's Albany Stakes for state-bred 3-year-olds in August, captured
Aqueduct's graded Discovery Handicap at the Albany distance of 1 1/8 miles on
November 20, scoring by two lengths over six rivals. Three weeks later, that first

offspring produced by New York-bred mare Raffie's Dream (by in-state stallion and
NYTB champion Raffie's Majesty) faced older foes in Aqueduct's graded Queens
County Stakes at 1 3/16 miles and placed second, missing by a head to a 5-year-old
carrying five pounds less weight.
On November 21, another standout produced by a New York-bred mare, A Shin
Forward, beat 17 rivals to win the Group 1 Japan Mile Championship (1,600 meters on
turf) in a stakes record 1:31.80, boosting his 2010 bankroll to $2,273,386 and
surpassing Funny Cide's single-season New York-bred earnings record. Now with
career earnings of $3,374,068, A Shin Forward – who had been purchased for
$290,000 at Fasig-Tipton Florida's 2007 select sale of 2-year-olds in training at Calder
– is within less than $200,000 of Funny Cide's total record earnings for a New Yorkbred.
On the same Sunday as A Shin Forward's Group 1 triumph in Japan, Lubash scored by
2 ½ lengths over seven rivals in Aqueduct's Monarch's Maze Stakes for open 3-yearolds going a mile on turf, getting his fifth victory (four on turf, one on dirt) of 2010.
Winning by two lengths under equal top weight of 129 pounds in Aqueduct's graded
Fall Highweight Handicap on Thanksgiving (November 25) was Vincent Scuderi and
James Riccio's New York-bred 6-year-old, Endless Circle, who clocked the six
furlongs in 1:09.79. It was Endless Circle's 11th career victory and eighth tally of 2010
(two others in stakes for state-breds) on the NYRA circuit, punctuating an exceptional
season for the durable sprinter.

Promotion and Advertising
In 2010, for the second year in a row, the New York State Thoroughbred Breeding and
Development Fund used NYTB, Inc. as its “sole source provider” for promotional
services. New York Thoroughbred Breeders, Inc. is a trade and lobbying group that
claims hundreds of NY breeders, owners, and stallion and farm owners as members. It
does direct e-mailing to more than 4,000 individuals, and hosts or co-hosts events for
established members of the racing community as well as newcomers and potential
participants in New York racing.
During 2010, the Fund paid out a net amount of $226,500 to NYTB Inc. Please review
the NYTB promotional summary below.

The bulk of NYTB’s advertisements were placed in the Thoroughbred Daily News,
which bills itself as the “Wall Street Journal for the Thoroughbred Industry
Worldwide.” TDN is e-mailed daily to an estimated 6,000 people who are intimately
connected with horse racing and breeding. The NYTB ads were placed on Tuesdays.
Advertising was light in the first half of the year, when there was still uncertainty about
VLTs and the effect of NYC OTB’s bankruptcy on the Breeding and Development
Fund. However, if you followed the ad campaign through the remainder of the year,
you saw that it trumpeted the positive news about VLTs as well as the
accomplishments of New York-breds. Here, we “start spreadin’ the news” about the
VLTs being a done deal.

This next ad trumpets the fact that NY-bred Rightly So’s Grade 1 win at Saratoga
punched her ticket to the Breeder’s Cup, and that yearlings of 2010 will be the first
crop to race for VLT-enhanced purses in New York.
The Fund would like to point out that in response to requests from some breeders to
counter the advertising campaign funded by the Indiana program, the Fund paid half
the cost (NYTB paid the other half) to place a “cover tip” ad in The Blood-Horse
magazine.

As luck would have it, the ad just happened to be on the Zenyatta (Breeder’s Cup
Classic winner and eventual 2010 Horse of the Year) commemorative edition, so it is a
promotion that should have lasting effect.

There were many more ads that ran over the course of the past year, and the Fund
looks forward to collaborating with NYTB, Inc. in 2011 as we help promote the
responsible breeding and ownership of quality New York-breds.
Additionally, the Fund gave its website a new, updated look and, we hope, made it
more user-friendly. In early 2011 we will be moving back to our original web address,
www.nybreds.com, where we will continue to keep members of the industry informed
about the issues affecting breeding and racing in New York State.

Breeding Programs in Other States
By Executive Director Tracy Egan
The merit of breeding programs in other states, and their ability to compete with the
New York breeding program, was closely tied in 2010 to how each state’s breeding
and racing interests fared in their interactions with their respective state lawmakers.
Here, we look at some of some of the factors affecting breeding programs in other
states.
The state of INDIANA seemed solidly behind the efforts of ITOBA, the Indiana
Thoroughbred Owner’s and Breeder’s Association, to attract more business to the
state. ITOBA had a $200K advertising budget to buy cover tips on industry magazines
and place commercials in which they boldly attempted to recruit breeders and owners
to the state. As previously mentioned in this report (in the Promotions and Advertising
section), many Empire State breeders felt that this was a direct challenge to our
primacy and asked that we respond with a highly visible cover tip. While the tagline
“Check out why IN-breds for all your thoroughbred ownership questions” on the
ITOBA website may make many smile, the organization is making a serious run at
attracting industry dollars to their farms, training centers, and racetracks. The
supportive attitude and funding of ITOBA allowed Indiana to offer a $4,000 increase
in the award cap, bringing it to $14,000 for awards earned in restricted stakes races.
(Note that NY awards are capped at $10k.) Prior to 2009, the minimum level to
qualify for Out-of-State Breeder Awards was a claiming tag of $7,500 or higher, but
that level has since been increased to $10,000. (Note that the New York program does
not pay awards on any category of race run outside of NYS.)
As bright as things appeared for the ITOBA programs in 2010, Blood-Horse
commentator Tom LaMarra suggested in one of his columns that there may be clouds
on the Indiana horizon, saying that “Indiana (is) poised to join Delaware,
Pennsylvania, and West Virginia as states that have taken gaming revenue from racing
and breeding to fund state programs.”
PENNSYLVANIA, which placed 62,000 slot machines across the state starting in
2006, resurrected the state’s racing and breeding industries, but the state has since
reached back in to take a share of the windfall for other state programs.
Despite having to share their newfound wealth, PA horsemen and women still benefit
from the lion’s share of the original statutory amount of 12% of slots revenue, which is
directed to increased purses, improvements at racetracks, and the state’s breeding
program. When lawmakers adopted a budget in October 2009, it included a siphoning
of 17% of the breeding and racing program money over the next four years. To put it
another way, the PA programs are taking a hit of $2.7 million a year through fiscal
year 2012-2013.

Still, the positive impact of slots on the racing industry in PA cannot be overstated.
Richard McGarvey, spokesman for the Pennsylvania Gaming Control Board, was
quoted on 12/29/10 by a suburban Chicago newspaper, The Daily Herald, as saying “It
has certainly taken an industry that was flat on its back and revitalized it. You’re
seeing more racing dates in Pennsylvania. You’re seeing more breeding in
Pennsylvania, more barns opening that weren’t here before.” That same gaming board
put out a report in Nov. 2010 demonstrating that live racing helps stimulate slots
gambling, and therefore revenue for the state. Gross terminal revenues go up by an
average of $56,000 on race days. While many racing fans complain that some
racetrack casinos make it difficult to even find the racetrack, the Pennsylvania numbers
demonstrate that while slots were meant to help racing, a live racing product also
helps slots revenue.
The significance of New York’s Southern Tier neighbor funding a $23-million
campaign to turn Pennsylvania into “Kentucky East” lies in the fact that their foal crop
is climbing higher as New York’s has been dropping. For example, in 2008
Pennsylvania reported 1,510 PA-breds, just 378 fewer foals than were dropped on NY
farms. As 2010 drew to a close, the 2009 PA registered foal crop stood at 1,277, with
more registrations expected. The Fund reports 1,788 foals born on farms in New York
during that same year.*
Clearly, the PA program is taking a first-time Lasix, first blinkers, apprentice-jockey
approach (in the form of a hipper website, YouTube videos, blogs, and a multi-media
ad campaign), as they try to outpace the Breeding Program leader: the New York
Thoroughbred Breeding Program.
LOUISIANA boasts a breeding program that began back in 1963, when just 146 foals
were reported born on the state’s dirty dozen: a variety of 12 soil types, most of which
were enriched by sediment deposits courtesy of the Mississippi, Ouachita, and Red
Rivers. And LA breeders sure like raising horses: in 2008, the most recent year for
which figures are available, 2,500 colts and fillies pushed their way out of their dams
in the Pelican state.
When it comes to mares bred in North America, Louisiana climbed to number two
with a reported 3,093 mares sent to the breeding shed in 2010. Only Kentucky
reported more mares bred as the decade came to a close. This prompts some to point
to the Pelican state as the best program in the nation. However, sheer numbers of foals
and high purses don’t tell the whole story when comparing programs.
According to the Louisiana Thoroughbred Breeders Association, “Louisiana's racing
and breeding industry plays an important role in the state's economic well-being and
contributes a significant source of state revenue. The combined impact of both racing
and breeding and their related industries generates nearly $930 million annually and
employs nearly 9,000 people.” In contrast, the racing and breeding industries in New
York State add an estimated $2.4 billion to the state’s economy and employ roughly
35,000 people.

As in Pennsylvania, the purses in Louisiana are pumped up by slots revenue. The LAbred program can brag that the average purse for races run in Louisiana in 2009 was
$25,000.
For example, an article in the Times-Picayune quotes the owner of Le Mesa Stallions
as pointing out a flaw in his state’s program: “We – I mean the state as a whole – we
have rewarded mediocrity.” Brett Brinkman looks at LA largess and concludes that
low-quality runners compete for too much money. Bottom-level LA-bred claimers
chased after $12,000 in purse money when they ran at the Fair Grounds in 2010.
Brinkman is again quoted, saying “The overproduction of the lesser breed and the
lesser quality has always been an issue in Louisiana.” Critics like Brinkman conclude
that where purses are fueled by slots revenue, breeders should try to breed betterquality horses. The danger of having an overpopulation of lesser horses is that they
won’t find a buyer or make an impact at the entry box, and therefore on state handle
coffers. Since most breeders can’t afford to race even a few of their homebreds, buyers
are an absolutely crucial element of a successful breeding program. Steely-eyed
realists know they probably won’t find a pot of gold at the end of the finish line, but
they’d like to come close to breaking even and to have fun along the way. New York,
which will probably see the first slots-enriched purses in the later half of 2011, would
do well to listen to Mr. Brinkman’s cautionary note about his own program: “We’ve
grossly, as a racing program, catered to the cheaper horses.”
FLORIDA: For the past decade and a half, breeders didn’t have to check with the
Jockey Club to know that Florida is the perennial Avis to Kentucky’s Hertz in terms of
the broodmare population in North America. This was not so in 2010. As mentioned
above, Florida lost its second-place status to Louisiana. The 3,076 mares covered in
2010 reflects a 23.9% decline from the year before, when 4,041 bred mares resided in
the Sunshine State.
Industry leaders across the nation can point to the struggling economy near decade’s
end for many of the problems in racing/breeding. In Florida, the problems have led to
some finger-pointing at the group that represents the breeders and owners in the state,
the Florida Thoroughbred Breeder’s and Owner’s Association. Member Gordon Reiss,
who also represents other breeders who were not happy with the leadership of the
FTBOA, was quoted in a Dec. 1, 2010 article at Ocala.com, saying “You can only
blame the economy for so much. We had the biggest drop in number of mares bred in
the country since 2008. We have mares and stallions leaving the state for Louisiana
and other parts of the country with better incentive programs. What happened? Why
are we lagging far behind?”
For its part, FTBOA is on the record as defending its lobbying efforts on behalf of
breeders in the State Capital. In fact, in 2010 the membership group was able to
convince lawmakers to lower taxes on slot-machine revenue from 50% to 35%. This
allowed the group to add some flexibility to its awards system. In the past, Florida
only paid awards at the win level. It’s expected at this writing that the state will
approve a change such that awards will be offered for horses finishing first, second,
and third.

In addition, FTBOA expects to be able to pay out-of-state breeders’ awards for
Florida-breds that win one of the most popular betting events of the winter race season,
the Sunshine Million races in California.
On the promotion front, the Florida breeding program joins its Department of
Agriculture in paying for ads that proclaim: “Florida…the Best State to do Business.”
Among the positives mentioned in the ads:

Perhaps the crowning achievement in 2010 for the Florida horse industry is the fact
that three Florida-breds won Breeders’ Cup races: Dubai Majesty, Awesome Feather,
and Big Drama. New York-breds did not make the winners circle this past year;
however, a record five were entered. The New York Thoroughbred Breeding and
Development Fund is confident that seeing the likes of Canadian Ballet, Deciphering
Dreams, Haynesfield, Rightly So, and Silver Timber earning the right to compete on
racing’s biggest stage set an example of excellence that will inspire other New York
breeders to dream big and adjust their breeding programs accordingly, to reach racing’s
highest level with the Empire State’s product.
* In 2001, before Pennsylvania launched its effort to boost purses, gambling revenue, and agricultural
income, as well as to lure tourism dollars to the Keystone State, just 901 thoroughbreds were foaled
there. That’s fewer than half the number born in NY that same year, when the Fund registered 1,985
foals.

Finger Lakes Racing in Farmington has a significant economic impact because their roots
run deep into area towns and counties. “This is a community track. “We have about 115
trainers here. Nearly all of them live here, they have farms here.” “They absorb most all
the hay and straw around here for a hundred miles.” “There are hundreds of farms that
supply goods and services to the track. That pours money into the economy.”
Additionally, local businesses that include service stations, farm equipment, waste
management, manufacturers, and restaurants benefit from racing.
A 2007 study showed Finger Lakes’ economic impact on the region to be $120 million
annually. That’s was based on the earnings and spending of 475 track employees and the
1,298 working independently in racing.

offer the following, which you may share with the Chairman's committee or anyone else:
Replicating Florida's example of discontinuing stallion awards for departed stallions
would be: A) ill-conceived, B) illogical, and C) counter-productive.

A) Building a stallion base in the state is certainly one facet of the industry that the Fund
has the ability to influence. By touting stallion awards, it has the bully pulpit to
successfully argue that it would be indeed a profitable venture for any stallion owner or
manager. However, by forcing any stallion owner or syndicate to remain in the state to
collect awards from foals already produced is a disincentive that only sullies the
credibility of the program, and hence foster skepticism. Therefore this measure would
be ill-conceived.
B) It is illogical because you are punishing one group among the breeder's and
rewarding another, at the formers expense. Why not stop paying breeder's awards from
mares that likewise leave the state?
C) It is counter-productive because NY is considerably smaller than Florida and their
paradigm is irrelevant (not that I would argue that they are right, on the contrary). No
doubt Florida was used as a proving ground for stallions because of the vast amount of
mares that professional horsemen bred, then broke, trained and raced or sold their
progeny. Florida, with its 12 month training climate, and the vast amount of training
tracks proved invaluable to facilitate the development of 2 yr-olds, and hence the quick
boost to first and second year sires. This made the hot young stallions ripe to be
relocated to Kentucky, or even now abroad, as they were given a jump-start. Mr.
Prospector immediately comes to mind. Of course Florida did not have the deep
pockets within the breeding community to protect a great young sire, and hence the
stallions followed the market, as they should.
NY's situation is not comparable, because of the relatively small population of mares,
and the longer time that the average NY Bred takes to get to the races. Our gene pool is
so small that it would be most beneficial to every breeder to circulate stallions through
the state, not incarcerate them in it.
Example: A new farm locates within our borders and brings a flashy, well-bred, newly
retired G1, maybe eventually a classic winner to stand. The farm sends nearly all it's
mares to support the horse in years 1 and 2. Other in-state breeder' flock to the stallion
in those first two years. Then what happens? Anyone with good mares and good
sense breeds their mares to other stallions after that. Who will be left to support that
stallion? The stallion manager will be fighting for his financial survival because of the
incredibly small amount of mares remaining that have not been bred to him in the first 2
years, most of which would be inferior to the mares previously bred. His CI would drop
precipitously. The stallion manager needs to be free to market any stallion where it is
most in demand, without punitive damages assessed after the fact, for work already
done, and future bonuses already earned.
In fact, a case could be made that it would be more beneficial to all breeder's if
additional rewards were given to any stallion that departs the state after standing for 2
years (tongue-in-cheek). The breeders of the state would be much better served if we
had revolving stallions, shuttling from state to state, ala Catienus, or state to other
countries. If the stallion awards were predicated on stallions remaining in the state in
perpetuity, it would be difficult to construct such revolving stallion deals,

Having bred and raced numerous homebred over the last 30 years, we felt we should
weigh in publicly on the subjects being addressed by this committee.
YES-the fund should seek as commitment from NYRA to run a minimum number of
races for NY-breds.
YES- the awards for open company owners should be bumped up
YES-stop paying awards to stallions that have left the state
NO!!-award payments on low-level claiming races should not be eliminated- ALL ny bred
races should pay awards to the breeders
We, as a state breeding organization, should continually look around and learn from
states such as Florida, Pennsylvania, and other entities. It is financially punishing
enough to breed and raise horses in New York State. Doubly punishing to race in NY.
The industry is important to all of us on all levels. Getting something back from
enterprises that make huge profits from our products is important.
Thanks for working for us, keep trying to get our share of this huge business.

CATSKILL — In the winner’s circle at the Saratoga Race Course Friday, the county’s top
prosecutor was congratulated for convicting one of the thoroughbred industry’s most
dastardly.
Greene County District Attorney Terry Wilhelm was presented with a plaque for professional
excellence in the successful prosecution and conviction of horse breeder Ernest Paragallo.
Paragallo was found to have 177 malnourished thoroughbreds at Center Brook Farm in the
town of Coxsackie, which were seized by the Columbia-Greene Human Society/SPCA on April
9, 2009.
Following a seven-day bench trial in March, Paragallo was found guilty of 33 misdemeanor
animal cruelty counts for improper sustenance. He was sentenced to two years in jail and a
$1,000 fine for each charge, the maximum allowed by law.
The incident — and subsequent conviction — sent shockwaves throughout the thoroughbred
and horse racing industries, and continues to redefine appropriate conduct for horse breeders
throughout the state.

Wilhelm was presented the award on the eve of the Travers Stakes and in the company of
some of the sport’s top competitors.
He expressed gratitude during a phone interview Saturday and said he felt “humbled” after
being presented the award.
“It was just a wonderful day and I felt honored,” said Wilhelm. “This case seems to have had
an effect on the regulatory agencies to increase monitoring of this type of activity. It’s so
gratifying to think that our little trial is having such a profound impact on the industry.”
The award was presented by the New York State Police, who conducted an extensive
investigation in the case, the New York State Racing and Wagering Board, who has stripped
Paragallo of racing and owners’ privileges, the New York State Racing Association, who has
banned Paragallo from racing or visiting tracks, and the Columbia-Greene Humane
Society/SPCA, who cared for and facilitated the adoption of nearly all the malnourished
thoroughbreds found at the farm.
Wilhelm acknowledged the help of his colleagues, particularly State Police Sgt. Lisa Herdman,
who provided priceless amounts of thoroughbred and animal cruelty knowledge to assist in the
prosecution, and veterinarian Dr. Jerry Bilinski, who worked for hours with Wilhelm to learn
about the proper care, treatment and ownership of thoroughbreds.
“A lot of cases have little special twists you have to be ready for,” Wilhelm said, “so I became
immersed in the feeding, care and treatment of thoroughbreds. Those guys spend hours with
me on this case.”
Since the Center Brook Farm incident, new regulations adopted by state Thoroughbred
Breeding and Development Fund have resulted in more comprehensive inspections before
awarding funds to breeders and suspension or revocation of funds to anyone implicated in
horse cruelty.
Paragallo faces further fines by the state Racing and Wagering Board in the amount of $5,000
for each of his cruelty convictions.
He was released in June from serving his two year jail sentence in Greene County Jail pending
appeal.

EQUINE RESEARCH
The New York State Thoroughbred Breeding & Development Fund Corporation gives
two percent of its total annual revenue to the Harry M. Zweig Memorial Fund at the
Cornell College of Veterinary Medicine in Ithaca, New York. In 2010, the Fund remitted
the sum of $228,000 (preliminary figure).
The board of directors of the Harry M. Zweig Memorial Fund consists of Dean Michael
Kotlikoff of Cornell and of representatives of New York’s thoroughbred and harness
racing industries. The New York State Thoroughbred Breeding and Development Fund
is currently represented on the Zweig Board by two members of the New York State
Thoroughbred Breeding and Development Fund’s board: John Sabini, Chairperson, and
Dr. William B. Wilmot.
At the annual meeting of the Zweig Fund, various equine research proposals are reviewed
and evaluated. The Board then decides which proposals will be funded and at what level.

Investment Policy

In 1983, in accordance with the requirements of Chapter 383 of the Law of 1983 (Public
Authorities Law), the Fund duly adopted the following resolution.
RESOLVED that, in accordance with requirements of Chapter 838, Section 25 of the
Laws of 1983, the New York State Thoroughbred Breeding & Development Fund
Corporation, a public benefit corporation, hereby approves and adopts the following
investment guidelines:
A) All funds of the corporation available for investment shall be deposited
in interest-bearing accounts or certificates of deposits with banks in
New York State for the shortest possible period and at the highest
available interest rate; or in United States Treasury short-term bills or
notes at the highest available rate.
B) There shall be no other form of investment.
C) Certificates of deposit shall be fully secured.
D) The independent auditors of the corporation shall annually review and
examine the corporation's investments, and shall immediately report to
the directors of the corporation any variance from the foregoing
requirements.

Interpretation
The rules in this article shall be administered by the Fund and questions of
interpretation and intent shall be determined by the Fund.
Administration
Procedures for establishing compliance with or satisfaction of such rules shall be
established by the Fund and administered by its Executive Director.
Registration and
de-registration
Sanctions
New York-bred
No horse shall be considered a “New York-bred” thoroughbred unless such
horse is so registered by the Fund. Should the Fund be satisfied that grounds
exist to cancel or void a registration, it may so determine and order any monies
of the Fund due any person as a result of such questionable registration held and,
if paid, to be returned to the Fund for proper disposition. In addition, pending
such determination, the Fund shall be empowered to order retention of such
monies as may be payable as a result of any questionable registration, for proper
disposition, upon its final determination.
For good cause shown, the Fund may order that any individual shall be disqualified
from participating as a beneficiary of such Fund for such time as it may determine
appropriate.
(a) Definitions - as used in this article, the following terms shall mean:
1. Fund: The New York State Thoroughbred Breeding & Development Fund
2. Thoroughbred: A horse registered or qualified for registration as a thoroughbred by
the Jockey Club
3. Horse: Except when from the context it appears otherwise, shall mean horse,
stallion, mare, gelding, ridgling, colt, or filly
4. Foal: The offspring of a sire and dam, having been born
5. Foaled: Born
6. Sire: The male parent of a horse
7. Dam: The female parent of a horse
8. Breeder: The owner of the mare (dam) at the time it foals a New York-bred
9. “New York Stallion”: A thoroughbred stallion standing in New York State and
registered with the Fund in accordance with the law
For requirements and regulations regarding your foals, please contact our offices.
For foals of 1996 and beyond (1995 and subsequent breeding seasons), for a foal to qualify as a
registered New York-bred, the dam of such foal must:
A. Be continuously in residence in the State of New York from no later than 90 days after her
last cover in the year of conception and thereafter remain in residence until foaling in New
York State; or
B. Foal in the State of New York and be bred back to a registered New York stallion and
thereafter remain in New York for a continuous period of 90 days after giving birth to such
foal.
These simple rules effectively create two categories of mares – resident mares and transient or
“visiting” mares – and should more participation in the Fund program more attractive for prospective
breeders and owners.
