Attached you will find Budget Amendment #12 for fiscal year 2011-2012 in the amount of
$4,256.71 (checks attached) which represents payment of subsistence costs and booking fees
generated at the Detention Facility for the period of May 2012. The prisoner subsistence costs
were collected under Florida Statutes 951.033.
As approved by the Board, this will be placed in the appropriate line items to offset some
Prisoner costs within the Detention Facility.

WHEREAS the undersigned is the owner and holder of that certain Mortgage/Lien executed by
RICKIE L. GAYLOR and KAREN S. GAYLOR, husband and wife to COLUMBIA
COUNTY, FLORIDA to secure an original indebtedness of $10,000.00 dated AUGUST 31,
2006, and recorded in Official Records Book 1094, Page 2196, of the Public Records of
Columbia County, Florida, encumbering the following:

The guaranteed repurchase price quote constitutes an agreement between the equipment purchaser listed above and
Ring Power Corporation. This agreement becomes effective on the original delivery date of the equipment and shall
expire when either the machine ownership period or hours of usage indicated above have been exceeded. This
contract is not transferable unless otherwise agreed upon, in writing, by Ring Power Corporation.
To maintain the repurchase agreement the equipment owner agrees that each unit, upon its return, shall:
I.
Be in sound mechanical shape and be in good working order under full payload.
Have no missing sheet metal, glass or parts. Damages to machine shall not exceed $1,500.
Have no stnictural damage to frame.
Have all PM services up to date. A record of past services being completed following manufacturer
recommendations shall be provided with equipment return.
Shall be returned with any and all attachments, accessories or upgrades originally sold with unit; and
A) Have tires in safe and operable condition with a minimum of forty percent (40%) original tread life
remaining:
OR
B) Have a minimum of forty percent (40%) life remaining on all undercarriage components including track
shoes, links, pins and bushings, idlers, bogies, sprockets, carrier rollers and track rollers.
The condition of each unit shall be detennined by an inspection report completed by Ring Power Corporation prior
to its return. At the equipment owners discretion they may correct any deficiencies with in a reasonable period,
accept a lower repurchase price determined by Ring Power Corporation, or reimburse Ring Power Corporation for
necessary repairs to restore the unit to agreed upon condition.

Please find attached for your review and approval a RFP for leasing
approximately 10,742 sq. ft. of office space to house offices for The
American Red Cross, Veterans Office, Suwannee River Economic Council,
Tourist Development Council, and the Extension Office. The 10,742 sq. ft. is
exclusive of hallways, restrooms, common areas, and other non-usable
office space.
In addition to approval of the RFP, I am also requesting permission to
advertise for the space described.

The Columbia County Board of County Commissioners seeks the rental of office space in Lake City
Florida. The space will be leased for a minimum of two (2) years.
The office space must accommodate five (5) distinct operations. The American Red Cross consisting of
two (2) staff, Veterans office one (1) staff, Suwannee River Economic Council four (4) staff, the Tourist
Development Council four (4) staff, and the County Extension Office twelve (12) staff.
The total space required is approximately 10,742 sq. ft. A green space of approximately Y2 acre must be
available contiguous to the building.

The above space requirements are exclusive of common areas, elevators, hallways, restrooms, and
other non-usable office space.
The building must be in full compliance with the Americans With Disabilities Act, contain centralized air
and mechanical systems, wired with CAT 5 cable in all office areas to allow for integration with the
Columbia County IT system , and provide easy access for moving office equipment and furnishings.
Power sources must be sufficient to accommodate general office operations. Offices, conference rooms,
and classrooms must have both computer and phone ports. The reception area in the clerical area of the
Extension Office must have a minimum of 4 phone and 3 computer ports. Kitchens will be wired for
standard appliances. If not currently available, the above must be installed at owners expense.
Lessee will provide day to day janitorial maintenance for the building. Lessor will provide all other
maintenance and repairs for the facility.

and shall be completed within 60 days after permitted work has begun. If the beginning date is more than 60 days
from date of permit approval, then PERMITTEE must review the permit with the Columbia County Public Works
Director to make sure no changes have occurred in the transportation facility that would affect the permitted
construction.
The construction and maintenance of such utility shall not interfere with the property and rights of a prior
PERMITTEE.
It is expressly stipulated that this permit is a license for permissive use only and that the placing of utilities upon
public property pursuant to this permit shall not operate to create or vest any property right in said holder.
Pursuant to Section 337.403(1), Florida Statutes, whenever necessary for the construction, repair, improvement,
maintenance, safe and efficient operation, alteration or relocation of all, or any portion of said transportation facility
as determined by the Columbia County Public Works Director ancVor County Engineer, any or all utilities and
appurtenances authorized hereunder, shall be immediately removed from said transportation facility or reset or
relocated thereon as required by the Columbia County Public Works Director and/or County Engineer and at the
expense of the PERMITTEE.

In case of non-compliance with the County's requirements in effect as of the approval date of this permit, this
permit is void and the facility will have to be brought into compliance or removed from the right of way at no cost to
the County.
It is understood and agreed that the rights and privileged herein set out are granted only to the extent of the
County's rig,ht, title and interest in the land to be entered upon and used by the PERMITTEE, and the PERMITTEE
will, at all times, and to the extent permitted by law, assume all risk of and indemnify, defend, and save harmless the
Columbia County Board of Comty Commissioners from any and all loss, damage, cost or expense arising in any
manner on account of the exercise or attempted exercise by said PERMITTEE of the aforesaid right and privileges.
During construction, all safety regulations of the County shall be observed and the PERMITTEE must take
measures, including placing and-the display of safetydevices that may be necessary in order to safdy conduct the
public through the project area in accordance with the Federal Manual on the Uniform Traffic Control Devices, as
amended for highways.
Should the PERMITTEE be desirous of keeping its utilities in place and out of service, the PERMITTEE, by
execution of this permit acknowledges its present and continuing ownership of its utilities located between
SW Tomoka Ter and
SR 247
within the County's right of way as set forth above. PERMITTEE, at its
sole expense, shall promptly remove said out of service utilities whenever Columbia County Public Works Director
ancVor County Engineer determines said removal is in the public interest.
Special instruction: Minimum cover of thirty inches (30") will be required at all locations. Columbia County
will not be fmancially responsible for any damage to facilities with less than thirty inch (30") cover. Cables shall not
be located within driveway ditches.

This PERMITTEE shall commence actual construction in good faith within _30_ days after issuance of permit,
and shall be completed within 90__ days after permitted work has begun. If the beginning date is more than 60 days from
date of permit approval, then PERMITTEE must review the permit with the Columbia County Public Works Director
to
make sure no changes have occurred in the transportation facility that would affect the permitted construction.
The construction and maintenance of such utility shall not interfere with the property and rights of a prior
PERMITTEE.
It is expressly stipulated that this permit is a license for permissive use only and that the placing of utilities
upon public
property pursuant to this permit shall not operate to create or vest any property right in said holder.
Pursuant to Section 337-403(1), Florida Statutes, whenever necessary for the construction, repair, improvement,
maintenance, safe and efficient operation, alteration or relocation of all, or any portion of said transportation facility
as
determined by the Columbia County Public Works Director and/or County Engineer, any or all utilities and
appurtenances authorized hereunder, shall be immediately removed from said transportation facility or reset or

relocated thereon as required by the Columbia County Public Works Director and/or County Engineer and at the
expense ofthe PERMITTEE.
In case of non-compliance with the County's requirements in effect as of the approval date of this permit, this permit
void and the facility will have to be brought into compliance or removed from the right of way at no cost to the County.
It is understood and agreed that the rights and privileges herein set out are granted only to the extent of the County's
right, title and interest in the land to b entered upon and used by the PERMITTEE, and the PERMITTEE will, at all
times, and to the extent permitted by law, assume all risk of and indemnify, defend, and save harmless Columbia
County, Florida from any and all loss, damage, cost or expense arising in any manner on account of the exercise or
attempted exercise by said PERMITTEE ofthe aforesaid right and privileges.
During construction, all safety regulations of the County shall be observed and the PERMITTEE must talce measures,
including pacing and the display of safety devices that may be necessary in order to safely conduct the public through
the project area in accordance with the Federal Manual on Uniform Traffic Control Devices, as amended for highways.
Should the PERMIT-TEE be desirous of keeping its utilities in place and out of service, the PERMITTEE, by
execution of this permit acknowledges its present and continuing ownership of its utilities located between

utilities whenever Columbia County Public Works Director and/or County Engineer determines said removal is in the

This PERMITTEE shall commence actual construction in good faith within _30_ days after issuance of permit,
and shall be completed within 90__ days after permitted work has begun. If the beginning date is more than 60 days from
date of permit approval, then PERMITTEE must review the permit with the Columbia County Public Works Director to
make sure no changes have occurred in the transportation facility that would affect the permitted construction.
The construction and maintenance of such utility shall not interfere with the property and rights of a prior
PERMITTEE.
It is expressly stipulated that this permit is a license for permissive use only and that the placing of utilities upon public
property pursuant to this permit shall not operate to create or vest any property right in said holder.
Pursuant to Section 337-403(1), Florida Statutes, whenever necessary for the construction, repair, improvement,
maintenance, safe and efficient operation, alteration or relocation of all, or any portion of said transportation facility as
determined by the Columbia County Public Works Director and/or County Engineer, any or all utilities and
appurtenances authorized hereunder, shall be immediately removed from said transportation facility or reset or

relocated thereon as required by the Columbia County Public Works Director and/or County Engineer and at the
expense oflhe PERMITTEE.
In case of non-compliance with the County's requirements in effect as of the approval date of this permit, this permit
void and the facility will have to be brought into compliance or removed from the right of way at no cost to the County.
It is understood and agreed that the rights and privileges herein set out are granted only to the extent of the County's
right, title and interest in the land to b entered upon and used by the PERMITTEE, and the PERMITTEE will, at all
times, and to the extent permitted by law, assume all risk of and indemnify, defend, and save harmless Columbia
County, Florida from any and all loss, damage, cost or expense arising in any manner on account of the exercise or
aftempted exercise by said PERMITTEE ofthe aforesaid right and privileges.
During construction, all safety regulations of the County shall be observed and the PERMITTEE must take measures,
including pacing and the display of safety devices that may be necessary in order to safely conduct the public through
the project area in accordance with the Federal Manual on Uniform Traffic Control Devices, as amended for highways.
Should the PERMITTEE be desirous of keeping its utilities in place and out of service, the PERMITTEE, by

Dear Dale:
Please find enclosed two copies of the proposed Administrative Services Agreement between the
Planning Council and the County. This Agreement provides for the Planning Council to render technical
assistance services for a fixed fee amount of $65,000 for the administration of the above referenced
agreement with the Florida Department of Economic Opportunity.
As provided for in State rules and regulations and the Procurement Procedure for the Neighborhood
Stabilization Program, services can be obtained from another unit of government by "noncompetitive
negotiation". Please have the Board of County Commissioners consider the Agreement for approval.
Following approval of the Agreement by the Board of County Commissioners, please have both copies of
the Agreement signed and retum both signed copies to me for Planning Council signatures.

BETWEEN THE
BOARD OF COUNTY COMMISSIONERS OF
COLUMBIA COUNTY, FLORIDA
AND THE
NORTH CENTRAL FLORIDA REGIONAL PLANNING COUNCIL
THIS AGREEMENT is entered into this
day of
2012 by and between the
Board of County Commissioners of Columbia County, Florida hereinafter referred to as the Purchaser,
and the North Central Florida Regional Planning Council, hereinafter referred to as the Planning Council.
THIS AGREEMENT/CONTRACT IS ENTERED BASED ON THE FOLLOWING FACTS:
The Purchaser has applied for and has been awarded a grant under the Florida Small Cities
Neighborhood Stabilization Program 3 from the Florida Department of Economic Opportunity, formerly
the Florida Department of Community Affairs, hereinafter referred to as the Department, in furtherance of
its duties under Title III, Division B of the Housing and Economic Recovery Act of 2008 (Public Law
110-289); and
The Purchaser has entered into an agreement, Contract Number 12DB-Q5-03-22-01-F04, with the
Department; and
The Purchaser in furtherance of said agreement with the Department, desires to engage the
Planning Council to render certain technical or professional services; and
The Planning Council possesses the qualifications and expertise to perform the services required.
NOW, THEREFORE, the Purchaser and the Planning Council do mutually agree, as follows:
(1)
SCOPE OF WORK
The Planning Council shall provide administrative services as described in Attachment A - Scope
of Work, of this Agreement, which is incorporated by this reference, necessary for or incident to the
performance of work as set forth in the above referenced agreement between the Purchaser and the
Department. In performing said administrative services, the Planning Council shall be bound by the
terms and conditions of the above referenced agreement between the Purchaser and the Department.

PERIOD OF AGREEMENT
This Agreement shall begin on effective date of the above referenced agreement between the
Purchaser and the Department and shall end on termination date of the above referenced agreement
between the Purchaser and the Department, or such time as the period of agreement for the above
referenced agreement between the Purchaser and the Department may be extended whichever is later,
unless terminated earlier in accordance with the provisions of Section 11 of this Agreement. Any
allowable costs incurred by the Planning Council during the period covered by this Agreement in
providing services in performing the work described in Attachment A - Scope of Work, of this
Agreement, which is incorporated by this reference, are eligible expenses chargeable to the Purchaser.
However, if this Agreement is not executed by both parties, the Purchaser shall not be liable for any such
costs incurred by the Planning Council.
INCORPORATION OF LAWS, RULES, AND REGULATIONS
Both the Planning Council and the Purchaser shall be governed by applicable laws, rules, and
regulations, including but not limited to: Sections 290.0401-290.049, Fla. Stat. as amended; Public Law
93-383, as amended; 24 Code of Federal Regulations Part 570; and Chapter 9B-43, Fla. Admin. Code;
and Office of Management and Budget Circulars, and 24 Code of Federal Regulations Part 85.
FUNDING AND COSTS
The Planning Council shall be paid by the Purchaser a fixed fee of Sixty-five
(a)
Thousand Dollars and No Cents ($65,000.00), subject to federal Neighborhood Stabilization Program 3
funds being made available to the Purchaser by the Department to support this amount, for services
provided in completing the Scope of Work described in Attachment A, which is incorporated by
reference.
METHOD OF PAYMENT
Payment to the Planning Council for services rendered in accordance with the
(a)
Scope of Work described in Attachrnent A of this Agreement, which is incorporated by this reference will
become due within thirty (30) days following receipt by the Purchaser of a requisition for payment.
Requisitions may be made on a monthly basis.
PROCUREMENT STANDARDS
The Planning Council shall comply with procurement standards prescribed in
24 Code of Federal Regulations Section 85.36; Rule 9B-43.014(1), Fla. Admin. Code; and relevant state
laws applicable to the procurement of supplies, equipment, construction and services.
RECORDKEEPING
The Planning Council shall maintain records and supporting documents as

prescribed in 24 Code of Federal Regulations Section 570.506 "Records to be maintained"; and 24 Code
of Federal Regulations Section 570.508, "Public access to program records"; and
24 Code of Federal Regulations Part 85.

All records pertinent to this Agreement shall be retained by the Planning Council
for six (6) years following termination of this Agreement, with the following exception: If any litigation,
claim, or audit is started before the expiration of the six (6) year period and extends beyond the six (6)
year period, the records will be maintained until all litigation, claims or audit findings involving the
records have been resolved.
All records, including supporting documentation of all program costs, shall be
sufficient to determine compliance with the requirements and objectives of the Neighborhood
Stabilization Program 3 and all other applicable laws and regulations.
The Planning Council shall allow access to its records at reasonable times to the
Purchaser, its employees and agents, to the Department, its employees and agents, and to United States
Department of Housing and Urban Development, its employees and agents. "Reasonable" shall be
construed to mean during normal business hours of 8:00 a.m. to
5:00 p.m. on Monday through Friday. "Agents" shall include, but not be limited to, auditors retained by
the Purchaser, the Department or United States Department of Housing and Urban Development.
DELEGATES AND CONTRACTORS
The Purchaser, by this written Agreement, designates the Planning Council to provide
administrative services to the Purchaser as described in Attachment A of this Agreement, which is
incorporated by this reference, necessary for or incident to the performance of work as set forth in the
above referenced agreement between the Purchaser and the Department.
LIABILITY
The Planning Council shall be solely responsible to parties with whom it shall deal in carrying out
the terms of this Agreement and shall save the Purchaser and the Department harmless against all claims
of whatever nature by third parties arising out of the performance of work under this Agreement, to the
extent allowed and required by law.
ASSIGNABILITY
The Planning Council shall not assign any interest in this Agreement, and shall not transfer any
interest in the same (whether by assignment or novation), without the prior written consent of the
Purchaser; provided, however, that claims for money due to become due the Planning Council from the
Purchaser under this Agreement may be assigned to a bank, trust company or other financial institution
without such approval. Notice of any such assignment or transfer shall be furnished promptly to the
Purchaser.
TERMINATION
The Purchaser may terminate this Agreement for cause upon such written notice
(a)
as is reasonable under the circumstances. Cause shall include, but not be limited to, misuse of funds;
fraud; lack of compliance with applicable rules, laws, and regulations; failure to perform in a timely
manner; and refusal by the Planning Council to permit public access to any document, paper, letter, or
other material subject to disclosure under Chapter 119, Fla. Stat., as amended. The notification shall
make specific reference to the cause of termination. The Planning Council is entitled to a period of ten

(10) days in which to correct the cause of termination. In the event that the cause is not corrected within
the ten (10) day period, this Agreement may be terminated. Failure of the Purchaser to exercise this right
shall not be considered a waiver of such right in the event of any further cause for suspension or
termination. Upon termination as provided by this Section, the Planning Council shall be reimbursed for
all its actual costs incurred in providing services hereunder as the same as defined in Section 4 of this
Agreement in accordance with Attaclunent A - Scope of Work, of this Agreement, which is incorporated
by this reference. All fmished or unfinished documents and other materials prepared by the Planning
Council pursuant to this Agreement shall become the property of the Purchaser.
Either party may terrninate this Agreement without cause by providing fifteen
(b)
(15) days written notice to the other. Upon termination as provided in this Section, the Planning Council
shall be reimbursed for all its actual costs incurred in providing services hereunder as the same as defined
in Section 4 of this Agreement in accordance with Attachment A - Scope of Worlc, of this Agreement,
which is incorporated by this reference. All finished or unfinished documents and other materials
prepared by the Planning Council pursuant to this Agreement shall become the property of the Purchaser.
AMENDMENT
The Purchaser or the Planning Council may request amendments to this Agreement. Such
amendments which are mutually acceptable to both parties shall be incorporated in writing as
amendments to this Agreement.
ASSURANCES
Interest of Certain Federal Officials. No member of or delegate to the Congress
of the United States, and no Resident Corrunissioner, shall be admitted to any share or part of this
Agreement or to any benefit to arise from the same.
Interest of Members. Officers, or Employees of Purchaser. Members of Local
Governing Body, or Other Public Official. No member, officer, or employee of the Purchaser, or its
designees or agents, no member of the governing body of the locality in which the program is situated,
and no other public official of such locality or localities who exercises any function or responsibilities
with respect to the program during his or her tenure or for one (1) year thereafter, shall have any interest,
direct or indirect, in any contract or subcontract, or the proceeds thereof, for work to be performed in
connection with the program assisted under this Agreement. The Planning Council shall incorporate or
cause to be incorporated, in all subcontracts a provision prohibiting such interest pursuant to the purpose
of this Section.
Nepotism. The Planning Council agrees to abide by the provision of Section
116.111, Fla. Stat. pertaining to nepotism in their performance, under this Agreement.
Assurances. The Planning Council shall comply with the assurances set forth in
Attachment B, attached hereto and incorporated by this reference.

NONDISCRIMINATION
In carrying out the work of this Agreement, the Planning Council shall not discriminate against
any employee or applicant for employment because of race, creed, color, sex, national origin or
handicapped status. The Planning Council shall take affirmative action to ensure that applicants are
employed, and that employees are treated during employment, without regard to their race, creed, color,
sex, national origin or handicapped status. Such action shall include, but not be limited to the following:
employment, upgrading, demotion or transfer; recruitment or recruitment advertising, layoff or
termination; rates of pay or other forms of compensation; and selection for training, including
apprenticeship. The Planning Council agrees to post in conspicuous places, available to employees and
applicants for employment, notices setting forth the provisions of this nondiscrimination clause. The
Planning Council shall incorporate the foregoing requirement of this paragraph in all subcontracts for
services covered by this Agreement.

SPECIAL PROVISIONS
All invoices for fees or other compensation for services or expenses shall be
submitted by the Planning Council in detail sufficient for a proper pre-audit and post-audit thereof.
All travel expenses incurred by the Planning Council shall be in accordance with
Section 112.061, Fla. Stat., as amended.
The Purchaser shall have the right to unilaterally cancel this Agreement for
refusal by the Planning Council to allow public access to all documents, papers, letters, or other material
subject to the provisions of Chapter 119, Fla. Stat., as amended, and made or received by the Planning
Council in conjunction with this Agreement.
No funds or other resources received by the Planning Council in connection with the
Agreement may be used directly or indirectly to influence legislation or any other official action by the
Florida Legislature or any state agency.
The Planning Council shall comply with mandatory standards and policies relating to
energy efficiency which are contained in the state energy conservation plan issued in compliance with the
Energy Policy and Conservation Act (Public Law 94-163).
(16)
VENUE AND JURISDICTION FOR LITIGATION BETWEEN THE PARTIES
This Agreement shall be construed according to the laws of the State of Florida. Venue shall be
exclusively in Columbia County, Florida for all litigation between the parties and all issues litigated
between the parties shall be litigated exclusively in a court of competent jurisdiction in Columbia County,
Florida. If any provision of this Agreement is in conflict with any applicable statute or rule or is
otherwise unenforceable, then such provision shall be deemed null and void to the extent of such conflict
and shall be deemed severable, but shall not invalidate any other provision of this Agreement.

REPRESENTATIVES FOR THE PARTIES
In all matters relating to the performance of this Agreement, the County Manager of the
Purchaser shall represent and act for the Purchaser and the Executive Director of the Planning Council
shall represent and act for the Planning Council.

COMPLETE CONTRACT
This Agreement, including Attachment A, Scope of Work, Attachment B, Statement of
Assurances and Attachment C, Certification Regarding Lobbying, of this Agreement, which are
incorporated by reference herein and considered as an integral part of this Agreement, constitutes the
entire contract between the parties, and any changes, amendments or modifications hereof shall be void
unless the same are reduced to writing and signed by the parties hereto.
THIS AGREEMEN'T and its attachments (Attachment A, B and C), embody the entire
Agreement of the parties.
IN WITNESS WHEREOF, the parties hereto have duly executed this Agreement on the day and
year first above wriften.

SCOPE OF WORK
DESCREF'TION OF
NEIGHBORHOOD STABILIZATION PROGRAM 3
ADMINISTRATIVE SERVICES
The Planning Council will administer the Purchaser's Neighborhood Stabilization Program 3 as
established in the Purchaser's agreement with the Department. This will include Program Set-Up,
Program Implementation and Program Close-Out.
Specifically, under the area of Program Set-Up the Planning Council will:
Remove environmental and nonenvironmental conditions, if any, on use of grant funds;
Assist in establishing procedures for financial management of the grant funds;
Coordinate the citizen participation process to ensure conformity with all applicable State
and federal laws, rules and regulations;
Update, if necessary, project milestones and implementation schedules;
Establish program and project files; and
Prepare appropriate reports required by all applicable State and federal laws, rules and
regulations.
Under the area of Program Implementation, the Planning Council will:

Prepare requests for reimbursement of grant funds from the State;
Develop and implement professional and construction selection procedures to ensure
conformance with all applicable State and federal laws, rules and regulations;
Develop and implement construction contract procedures that comply with all federal
labor standards and provisions and compliance procedures, if applicable;

By signature of this Agreement, the Planning Council hereby certifies that it will comply with the
following applicable federal and state requirements.

It possesses legal authority to enter into this Agreement, and to execute the proposed program.
(b)
It will comply with the regulations, policies, guidelines, and requirements of 24 Code of Federal
Regulations Part 85, Office of Management and Budget Circulars Numbers A-87, A-122 and A133 as they relate to the use of federal fimds under this document.
(c)
It will comply with:
Section 110 of the Housing and Community Development Act of 1974, as amended, 24
Code of Federal Regulations Section 570.605, and State regulations regarding the
administration and enforcement of labor standards.
The provisions of the Davis-Bacon Act (40 United States Code Section 276 a-5) with
respect to prevailing wage rates (except for projects for the rehabilitation of residential
properties of fewer then eight units);
Contract Work Hours and Safety Standards Act of 1962, 40 United States Code Section
327 etq., requiring that mechanics on federally assisted contracts be paid wages of not
less than one and one-half times their basic wage rates for all hours worked in excess of
forty hours in a work week;
requiring
Federal Fair Labor Standards Act, 29 United States Code Section 201 et
that covered employees be paid at least the minimum prescribed wage, and also that they
be paid one and one-half times their basic wage rates for all hours worked in excess of
the prescribed work week; and
It will comply with the Anti-kickback (Copeland) Act of 1934, 18 United States Code
Section 874 and 40 United States Code Section 276a, which outlaws and prescribes
penalties for "kickbacks" of wages in federally financed or assisted construction
activities.

112.313 and Section 122.3135, Fla. Stat. and 24 Code of Federal Regulations Section 570.611.

Consulting with the State Historic Preservation Officer to identify properties listed in or

by the proposed activity; and
Complying with all requirements established by the State to avoid or mitigate adverse
effects upon such properties.
It will comply with all parts of Title I of the Housing and Community Development Act of 1974,
as amended, which have not been cited previously, as well as with other applicable laws.
(i)
It will abide by the provisions of Section 116.111, Fla. Stat., pertaining to nepotism in its
performance under this Agreement.
(k)
It will comply with Section 319 of Public Law 101-121, as provided in the "Governmentwide
Guidance for New Restrictions on Lobbying; Interim Final Guidance" published in the December
20, 1989 Federal Register, which prohibits recipients of federal contracts or grants from using

who requests or receives a federal contract or grant, and their subrecipients, disclose lobbying

On August 3, 2011, the Florida Rural Water Association recommended an Agriculture Rate for
Columbia County. t this time, the Utility Committee is recommending rhe Board of County
Commissioners adopt an \griculture Rate. According to Ordinance No. 2010-1-1 Section 1.01,
when setting utility Fees, "the amount of these fees, charges and assessments shall be established At
properly advertised public hearings conducted by the County And shall he set by resolution of the
Board of County Commissioners".
\Ve recommend that the Board of County Commissioners call For a Public ffearing to hear a
Resolution Approving Agriculture Rates on May 17, 2012. A draft of the Resolution is attached.

WHEREAS,
Florida Statutes provide for financial assistance to local government agencies to
finance the construction of drinking water facilities; and
WHEREAS,
Florida Administrative Code rules require authorization to apply for financial
assistance, to establish pledged revenues, to designate an authorized
representative; to provide assurances of compliance with program
requirements; and to enter into an agreement; and
WHEREAS,
the State Revolving Fund priority list designates Project Number DW 120410. as
eligible for available funding; and
WHEREAS,
Columbia County, Florida, intends to enter into an agreement with the
Department of Environmental Protection under the State Revolving fund for
project financing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Columbia
County, Florida, as follows:
SECTION I.
Columbia County, Florida is authorized to apply for financial assistance to finance
the project.
SECTION II.
The revenues pledged for the repayment of the loan are net water and sewer
utility system revenues. Furthermore, the State Revolving Fund priority list
designates Project Number DW 120410 as a 100% principal forgiveness loan.
SECTION III.
The Chair of the Columbia County Board of County Commissioners is hereby
designated as the authorized representative to provide the assurances and
commitments required by the application. The Chair of the Columbia County
Board of County Commissioners is hereby designated as he authorized
representative to execute the agreement which will become a binding obligation
in accordance with its terms when signed by both parties.
SECTION IV.
The Chair of the Columbia County Board of County Commissioners is authorized
to represent Columbia County in carrying out responsibilities under the
agreement. The Chair of the Columbia County Board of County Commissioners is
authorized to delegate responsibility to appropriate staff to carry out technical,
financial, and administrative activities associated with the agreement.

Project Background: Contractor's Employees cover 503.57 miles of county maintained
roadways throughout Columbia County on a PER CYCLE BASIS. The Contractor collects, on
average, approximately 30 tons of roadside litter ANNUALLY by hand for proper disposal at the
County maintained Landfill.

5 CONTRACTUAL - Subcontractors should provide the same infomiation required by this budget form, with the following exceptions: (a) when professional services are provided at a pre-existing approved rate or fee shown on the
budget; or (b) the subcontract is to be obtained competitively. For either (a) or (b), show an estimated maximum amount and provide an attached explanation as to how it was determined. Contractual servias other than fixed price
will be compensated by the DEP on a cost-reimbursement basis.

COST ANALYSIS INSTRUCTIONS
A cost analysis must be completed for any non-competitively procured agreernent in excess of Category H, as well as any amendments that affect the amount of compensation and/or the level of services provided.
Each separate line item must be evaluated to determine whether the cost is allowable, reasonable and necessary. Eadi miscellaneous cost must be specifically identified.
2 To be allocated to a program, a cost must be related to the servicEs provided. If the cost benefits more than one program, a deterrnination must be made that the cost is distributed in a reasonable and consistent manner across a
benefiting programs.
3 To be allowable, a cost must be allowable pursuant to state and federal expenditure laws, rules and regulations and authorized by the agreement betweei the state and the contractor/grantee.
4 To be reasonable, a cost must be evaluated to determine that the amount does not exceed what a prudent person would incur given the specific drcumstances.
5 To be becessary, a cost must be essential to the successful completion of the project
