$15,000.

Access Network (RAN) Board Funding in the Amount of $65,000 for
Personnel Costs Associated with Los Banos Jail Community Service Officers

$65,000.

ACTION MINUTES - These minutes are prepared to depict action
taken for agenda items presented to the City Council. For greater

CALL TO ORDER: Mayor Villalta called the City Council Meeting to order at the hour
of 7:01 p.m.
PLEDGE OF ALLEGIANCE: The pledge of allegiance was led by Police Commander
Reyna.
ROLL CALL - MEMBERS OF THE CITY COUNCIL PRESENT: Council Members
Deborah Lewis, Scott Silveira, Elizabeth Stonegrove, Mayor Michael Villalta; Absent:

PRESENTATION - PROCLAMATION RECOGNIZING THE ATHLETIC CLUB OF LOS
BANOS TERREMOTOS 2013 BOYS SOCCER TEAM. Mayor Villalta presented the
proclamation to the Athletic Club of Los Banos Terremotos 2013 Boys Soccer Team
members and coaches present at the meeting.

VALENTINE, Los Banos, spoke regarding the Kiwanis Club's 30th Annual Christmas
Dinner on December 24, 2013 from 11 :00 a.m. to 2:00 p.m. and thanked the Los Banos
Fire Department for their support of this annual event; ANN McCAULEY, Los Banos,
reminded all the reason for the season and to keep that in mind, spoke regarding
upcoming Pearl Harbor Day, how the American Legion Auxiliary is still working on to
setting up a chapter in Los Banos and would like to do the Wreaths Around America
Project; ERIC LIMON, representing Allied Waste Services, spoke regarding the garbage
service they provide to City residents and also recycling, recognized Denny's for their
recycling efforts, and the awesome job the Public Works Department is doing with our
streets and thanked them for the job they do; ELI VELOZ, Los Banos Parks &
Recreation, invited all to the Breakfast with Santa event at the Community Center on
December 14 at 8:30-11:30 a.m.; SANTA CLAUS too invited all to come to the
Breakfast with Santa event; GENEVA BRED, Los Banos, spoke regarding the Coats
for Children Program and how Century 21 is having an event on December 7,2013 that
if you bring in a coat and canned good you can have your picture taken with Santa and
bobsled, reminded all that the Los Banos Downtown will be having a shopping event on
December 4,2013 and the Christmas Parade is on December 5,2013 at 6:00 p.m., Los
Banos Chamber of Commerce will be moving to their location and how they will be
selecting a permanent Executive Director soon, she noted that this is her last Council
Meeting as Chamber President and thanked the City for all their support. No one else
came forward to speak and the public forum was closed.
CONSIDERATION OF APPROVAL OF CONSENT AGENDA. Motion by Silveira,
seconded by Stonegrove to approve the consent agenda as submitted: Check Register
for #144528 - #144753 in the Amount of $1,070,807.72; City Council Minutes for the
November 20, 2013 Meeting; City Council Resolution No. 5536 - Approving an
Amendment to Division 5 - Personnel Benefits, Division 5-A - Tuition Reimbursement
Policy and Division 13 - Business and Travel Expenses of the City of Los Banos Policy
& Procedures Manual; City Council Resolution No. 5537 - Approving the Acceptance of
$40,400 Awarded by the State of California Homeland Security Grant Program and
Amending the Fiscal Year 2013/2014 Budget by Increasing the Appropriation Amount
for Revenues and Expenditures in the Amount of $40,400; City Council Resolution No.
5538 - Awarding the Bid for the Purchase of One (1) New 2014/2015 Heavy Duty

PRESENTATION REGARDING THE CITY'S IJI.'EBSITE. This item was removed from

ADVISEMENT OF PUBLIC NOTICES. (NO REPORT)
CITY MANAGER REPORT. City Manager Carrigan spoke regarding how cold it is
getting and how the Warming Shelter at the Miller & Lux Building on 6th Street will be
opening up from 5:00 p.m. - 8:00 a.m. starting tonight, and spoke regarding the efforts
being taken to get rid of the birds downtown.
CITY COUNCIL MEMBER REPORTS.
TOM FARIA: Absent
DEBORAH LEWIS: Reminded all to be mindful of all the events happening this
evening; how the Salvation Army had their First Annual Kick Off luncheon and raised
over $,3000 just at the luncheon and how it was a very good event encouraging all to
remember the Salvation Army during the Holiday season, wished all a very safe and
Merry Christmas.
SCOTT SILVEIRA: Offered his condolences to the Lee family on the passing of
Pacheco Principal Brett Lee; he spoke regarding the Kiwanis' Club's 30 th Annual
Christmas Dinner being held on December 24,2013, the Christmas Parade being held
on December 6, 2013, the Salvation Army Angel Tree at M & M Restaurant and
encouraged all to donate, he too wished all a very Merry Christmas and a Happy New
Year.
ELIZABETH STONEGROVE: Reminded all about the Christmas parade, Breakfast
with Santa event, thanked the City Manager and Public Works Director/City Engineer
Fachin for working on the warming shelter, and she too sends her condolences to the
Brett Lee family.
MAYOR MICHAEL VILLALTA: Offered condolences to Brett Lee's family and spoke to
the wonderful man that he was; encouraged all to shop at the local businesses; thanked
City of Los Banos Staff Accountant Rosemarie Souto and all her elves for the food and
decorations provided tonight and all that you do; spoke to the Rotary Club Empty Bowls
Fundraiser and other service clubs and all they do to help others, spoke to all that the
City of Los Banos employees do.
City Manager Carrigan reminded all that the City is accepting applications for the
several commission vacancies.

Acceptance of a Donation for the Purchase of a Police Service Canine

Recommendation:
That the City Council approve a resolution accepting a donation in the amount of
$15,000 for the purchase of a Police Service canine.
Discussion:
Earlier this year a resident of Los Banos, who has asked to remain anonymous,
donated $15,000 to the Police Department for the purchase of Police Service canine.
The Police Department has accepted the donation and begun the initial steps towards
the purchase.
With this donation the Police Department intends to acquire an apprehension/protection
dog, cross-trained in the detection of illegal drugs. The Police Department has
maintained this type of service dog in the past and this addition will increase our ability
to effectively and efficiently handle calls for service requiring the use of a canine. We
request outside agency assistance for canine-use calls.
The Police Department currently maintains one (1) service canine through a partnership
with the Los Banos Unified School District. This canine, named Capone, is assigned to
the School Resource Officer (SRO) and is trained in the detection of illegal drugs.
This donation has additionally provided an opportunity for the Police Department and
the Los Banos Unified School District to again partner for the purchase of a new drug
detection canine as Capone has reached retirement age; this canine will replace
Capone.
If this request is approved the Police Department will research then select a vendor;
then negotiate for the purchase of the two (2) dogs, one (1) paid for through the
donation, the other one (1) to be paid for by the Los Banos Unified School District.
Once the canines are purchased, the Police Officer handlers will go through five (5)
weeks of training with their new canine partners. Upon successful completion of
training, the SRO will take his new canine partner back to the schools and the other will
assume his place on patrol.
Fiscal Impact:
This donation will allow for the purchase of the canine and up-fitting of the canine patrol
vehicle. The ongoing personnel, training, and material costs are within reasonable
Police Department budgetary limits.
Revenue and expenditures will increase through the following accounts:

That the City Council approve a resolution accepting Remote Access Network (RAN)
Board funding in the amount of $65,000 for personnel costs associated with Los Banos
Jail, Community Services Officers (CSO's).
Discussion:
The State of California Department of Justice operates the California Identification
System, commonly referred to as CAL-ID. This automated system is responsible for the
retention of fingerprint file submissions throughout the State and the identification of
latent fingerprint impressions found at crime scenes and submitted by law enforcement
agencies.
To help fund this system locally the State established a County level fee assessed to
the vehicles registered within that County: $1.00 for non-commercial vehicles; $2.00 for
commercial vehicles.
The County of Merced has established the Remote Access Network (RAN) Board to
oversee and distribute this funding.

equipment.
If this request is approved and because the Department is in the process of hiring a
CSO, we will pursue two (2) more applicants from that list, which should expedite the
hiring process.

There is no negative fiscal impact associated with this request.

Recommendation:
That the Los Banos City Council reject all bids submitted for the purchase of the
2013/2014 Fire Command Vehicle (1500 Crew Cab Pickup 4X4).
Background:
The Fire Department, as part of the approved 2013/2014 Fiscal Year Budget, was
authorized to solicit competitive bids for the purchase of a new 2013/2014 Fire
Command Vehicle. Invitations to submit a bid for the purchase of this vehicle were
advertised in the Los Banos Enterprise, Merced Sun-Star and on the City of Los Banos
web site. The release date of this bid was November 22 nd 2013 and the Deadline for
Submission was December 6th 2013 at 2:00 pm.
Discussion:
The Los Banos City Clerk's Office received four (4) bids for this project. Each bid was
carefully evaluated to determine if the proposed vehicle complied with the minimum
specifications as outlined in the Invitation to Bid packet. It was determined that three of
the bids submitted were non responsive and that the defects could not be waived by
staff.
The following is a brief explanation of the defects:

Santos Ford chose to submit two separate bids for this project. The first bid
($33,586.36) was submitted to meet the minimum standards as outlined in the Invitation
to Bid packet. The second bid ($35,106.97) was submitted because Santos felt that it
was a better value compared to the vehicle that was specified and exceeded the
minimum standards.
However, the Santos Ford bids were submitted without an authorized signature, The
City Attorney's office was asked to make a determination if the failure to sign the
proposals would make the proposals non responsive, The City Attorney has advised
that the total absence of a signature is a material deviation making the bid non
responsive and may not be waived.

The Fire Department will need to release a Public Notice to solicit future bids for this

WHEREAS, THE City Council of the City of Los Banos has the ultimate
responsibility for fleet procurement; and
WHEREAS, the request for sealed bids for ONE (1) new 2013/2014 Fire
Command Vehicle was officially opened on December 6th , 2013; and
WHEREAS, it has been determined that three (3) out of four (4) of the submitted
proposals were non responsive; and
WHEREAS, Fire Department Administration believe that it is in the best financial
interest of the City of Los Banos to reject all bids based on the fact that the only
responsive bid exceeds the Fire Departments expectation of cost for the Command
Vehicle.

Is an Unsigned Bid Responsive?
Short Answer: No. The lack of a signature is a material deviation and cannot be
waived.
Discussion: In order to be awarded a contract, the low bid must be "responsive" to
the specification, and the low bidder must be a "responsible" bidder. As one court
explained, a "bid is responsive if it promises to do what the bidding instructions demand.
A bidder is responsible if it can perform the contract as promised."
Issues of responsiveness involve a two part inquiry. First, the City must consider
whether the bid promises to do what the solicitation requires. A bid which contains a
deviation from what the solicitation requires is non-responsive. Once the City has
determined that a bid is non-responsive, the agency must consider whether the deviation
is material or immaterial. A bid which contains only an immaterial deviation may be
accepted, but is not required to be accepted, at the City's discretion. MCM Construction.
66 Cal. App. 4th at 373-74. A bid that is materially non-responsive is unavailable for
award.
A bid is materially non-responsive if it gives the bidder a competitive advantage not
available to other bidders. As one California court explained:
"A basic rule of competitive bidding is that bids must conform to
specifications, and that if a bid does not so conform, it may not be accepted.
However, it is further well established that a bid which substantially conforms
to a call for bids may, though it is not strictly responsive, be accepted if the
variance cannot have affected the amount of the bid or given a bidder an
advantage or benefit not allowed other bidders or, in other words, if the
variance is inconsequential. ..."
Most clearly, a deviation which affects the bidder's price would be a material
deviation. Deviations also are material, even if they do not affect price, if they afford a
bidder the ability to withdraw its bid without forfeiting its bid bond. Valley Crest
Landscape. Inc. v. City ofDavis. 41 Cal. App. 4th 1432, 1442 (1996).
For example, where no authorized signature appears anywhere on the bid, the
contractor cannot be bound to perform. If the public entity were to simply waive the
requirement of a signature, it would give that contractor an unfair advantage because the
contractor could decide, after bids were opened and prices disclosed, whether it actually
wanted to perform at its bid price. If it did not want to perform, it could decline the
contract award and would not have to forfeit its bid bond. Other bidders, who signed their
bids, would not have that opportunity. Thus, the total absence of a required signature
is a material deviation, and may not be waived. However, if the bid included an
authorized signature at other places, such as on the bid bond, but lacked a signature on
the bid form, such a deviation could be considered an immaterial deviation. If the bidder
were bound by its bid, then the public entity could choose to waive the deviation and
accept the bid.
Conclusion: Under the facts given the city cannot waive the non-conformance by
Santos to the Bid Form. The City can reject all bids and rebid; the City can reject the
Santos bid and accept the next lowest responsive bid.

Use Permit #2013-14 - Large Family Day Care
NOTICE IS HEREBY GIVEN THAT a Public Hearing will be held by the Los
Banos Planning Commission to consider a Use Permit to allow the operation of a
Large Family Day Care facility for Sandy Gong's Child Care operated by Sandy
Gong. The subject property is located in the Low Density Residential zoning
district at 1027 Cardoza Road; more specifically identified as Assessor's Parcel
Number: 431-161-018.
A PUBLIC HEARING on this matter will be held at the next scheduled meeting of
the Los Banos Planning Commission on Wednesday, January 8, 2014 at 7:00
p.m. in the Council Chambers of Los Banos City Hall located at 520 "J" Street.
Questions regarding the above-referenced item may be directed to Stacy Souza
Elms, Assistant Planner at City Hall or at (209) 827-7000, Ext. 133.
Persons wishing to provide oral comments on the proposed project may do so at
