CODE states if collectively, all existing and proposed impervious surfaces
exceed 35 percent of the gross site area, or if existing and proposed impervious
surfaces collectively include 9,000 or more square feet of ground coverage a
drainage plan shall be submitted.
APPLICANT requests waiver for the demolition of the existing structure and
construction of a new 80’ x 80’ building.
DRC consensus was to renew and update the Special Use Permit first and
determine how the following two issues will be addressed: (a) if there is a need
or not to provide a compensation for the flood plain encroachment and (b) how
the drainage that is going to be running directly into the grotto is going to be
treated before it gets into that feature.

This parcel is zoned A-1. Resolution 08-R-539 was issued inconjunction with a special use permit for a diving
school. It was clearly spelled out in the concept plan that the structure being replaced was allowed as a home.
Application calls for replacement with a commercial building. The resolution allows for a new Special Use to be
applied for in the event any expansion or changes from the original concept plan shall occur. Spoke with Miles,
consultant for applicant, and he understands that a new special use permit must be approved showing the

wetland, the net increase in impervious area is 2,953 sf with a total gross site impervious area (including the
south parcel- 5.7 ac.) of +/-16,394 sf , the area consists of Type “D” and “A” soils and there are known
historical road flooding problems on NW 115th Ave. Improvements are proposed within floodplain and
compensation must be provided.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS
OF
MARION
COUNTY,
FLORIDA, APPROVING THE ISSUANCE OF A
SPECIAL
USE
PERMIT,
PROVIDING
AN
EFFECTIVE DATE.
WHEREAS, an application for a Special Use Pennit was duly filed and considered by
the Marion County Zoning Commission at its meeting on March 25, 2013; and
WHEREAS, the aforementioned application was considered at a public hearing held by
the Board of County Commissioners of Marion County, Florida at its meeting on Tuesday, April
16, 2013; now therefore,
BE IT RESOLVED by the Board of County Commissioners of Marion County, Florida:
SECTION 1. SPECIAL USE PERMIT APPLICATION APPROVAL 130406SU
Lonnye Ray Black - The application for a Special Use Permit as submitted by Miles C.
Anderson, P.E., a copy of said application being on file with the Planning/Zoning Manager
is hereby approved is hereby approved for a Special Use Pennit, Section 5.3 of the Marion
County Land Development Code, to modify existing Special Use Pennit # 081010SU to
increase the number of students to 40, expand buildings and staff, in a A-I (General
Agriculture) zone, on Parcel Account Nos. 12339-002-00 and 12339-003-00, ~acres.
SECTION 2. FINDINGS AND CONDITIONS. The Board of County Commissioners
agrees with the recommendation and findings of the Zoning Commission recommending
approval of the Special Use Pennit and the Board approves the Special Use Pennit subject
to the following conditions:
1. The site shall be developed and operated consistent with the submitted conceptual plan
and the conditions as provided with this approval.
2. All new development and expansion of existing development shall provide and maintain
a pennanent vegetative buffer around any sinkhole, cave, lineament, escarpment, solution
pipe and other known Karst Feature. The buffer shall be clearly delineated, labeled and
described on the preliminary plat, final plat, master plan, and/or site improvement plan,
as applicable.
3. The minimum width of the required karst buffer shall be one hundred fifty (150) feet for
Karst Features with a direct connection to the aquifer and seventy five (75) feet for Karst
Features with no direct connection to the aquifer, as measured from the outennost closed
contour or edge of the escarpment, as applicable, but no greater in width than the
contributing watershed. These minimum buffer widths may be reduced if the applicant
demonstrates either of the following:

A narrower buffer can be calculated using the "Design Methodology for

Handbookfor Regulation of Storm water Management Systems, SJRWMD 2005,
as amended; or
B. The lot of record is too small to accommodate permitted development in
compliance with the minimum width, in which case the applicant shall, as an
alternative, design and construct a vegetated swale and/or berm that effectively
prevent drainage to the Karst Feature.
The diving school & retail sales hours of operation shall be limited to a maximum of
Monday- Saturday, 8:00am-5:00pm. Any increase in the hours of operation is prohibited;
however a new Special Use Permit Application may be submitted for consideration to
increase the hours of operation.
The diving school shall be limited to a maximum of forty (40) students, five (5) staff
members, ten (10) buildings, including storage shed, lean to covering for diving
equipment, compressor(s) and like machineries, and 27 floating docks as shown on the
conceptual plan; however, the applicant may submit a new Special Use Permit
Application for consideration for potential expansion in the future.
Access to the site shall be via NW 115 th Avenue.
A Type "E" Buffer (minimum 5' wide, minimum of 4 trees per 100 LF, and a continuous
double-staggered hedgerow to be 60" high in 2 years) shall be provided along the subject
properties' northern, southern, and eastern boundaries.
The Special Use Permit will run with the Lessee (Lonnye Ray Black) for the term of the
Lease. The applicant may submit a new Special Use Permit Application for consideration
to renew and extend this permit in the future.
This Special Use Permit 2008081 OSU/Resolution No. 2008-R-539 is hereby repealed and
replaced by this Special Use Permit.
SECTION 3.
REVOCATION. Violation or failure to comply with one or more
condition(s) of this Special Use Permit could result in revocation of this Special Use Permit
by the Board at a noticed public hearing.
SECTION 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon its
adoption.
