Report of Development Fees (AB 1600 Report) for Fiscal Year Ending June 30, 2015.

FISCAL IMPACT: There would be no fiscal impact associated with the adoption of the proposed
Resolution.

BACKGROUND: AB 1600 enacted California Government Codes Section 66000 et seq., which
requires that local agencies prepare annual reports on all development fees collected in the
development process to finance “public facilities” if those fees were established, increased, or
imposed on or after January 1, 1989. It does not include fees charged for processing development
applications, development agreements, or reimbursement agreements.
The report is due 180 days after the close of each fiscal year and requires that a report concerning
each fee fund be made available to the public. A copy of this report of required information was
available at the Finance Department by December 31, 2015, thereby satisfying the law’s
requirement that the report be available to the public by that date. In addition, public contact will
be made through posting of the City Council Agenda on the City’s official website.

RESOLUTION NO. 2016-__
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SUISUN CITY
ACCEPTING THE ANNUAL REPORT OF DEVELOPMENT FEES (A.B. 1600
REPORT) FOR FISCAL YEAR ENDING JUNE 30, 2015.
WHEREAS, the City of Suisun City imposes fees to mitigate the impact of development
pursuant to Government Code section 66000 et seq.; and
WHEREAS, said fees collected are deposited into a special revenue and separate capital
accounts for each type of improvement funded by development fees; and
WHEREAS, the City maintains separate funds for off-site street improvement, park
development fees, and capital improvement fees; and
WHEREAS, the City is required within 180 days after the last day of each fiscal year to
make available to the public information for the fiscal year regarding these fees under California
Government Code (CGC) Section 66006; and
WHEREAS, City staff has prepared a report (“AB 1600 Report”) that contains the
information required by CGC Section 66006, a copy of which is attached hereto as Exhibit “A”;
and
WHEREAS, the AB 1600 Report for fiscal year ending June 30, 2015, was presented to the
City Council for its acceptance.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Suisun City hereby
accepts the Annual Report of Development Fees (AB 1600 Report) for fiscal year ending June 30,
2015.

Council Member Segala commented on the condition of Civic Center Blvd and Cal-Trans
fencing along Highway 12.
Council Member Hudson agreed with condition of Civic Center Blvd and we should take a
look at it, attended the Fairfield-Suisun Sewer Board Retreat, shopping carts behind RiteAid.
Council Member Wilson reported on the Economic Development Ad Hoc Committee
meeting where there were presentations from two developers on the development of the north
and south side of Petersen Road.

Mayor Sanchez reported the City Council attended a workshop for the Fairfield-Suisun
Sewer District where they updated the vision for the agency to make the Sewer District the
leader in the industry and an upcoming Sewer District agenda item hiring consultant for the
next study of the Sewer District rates and needs.

Council Member Day advised citizens had contacted her about chuck holes in the streets and
stated the downtown Christmas tree was in bad shape.
Council Member Segala concurred with Council Member Day about the Christmas tree and
welcomed the new police officers.
Council Member Hudson wished everyone a happy Ground Hog Day and reported attending the
California Sanitation Agency Conference (CASA) and the Fairfield-Suisun Sewer meeting.
Mayor Sanchez reported attending CASA in Palm Springs. Suisun Solano Water Agency
discussing possible bond issue, Solano County Supervisors meeting where the Supervisors
approved putting the bond issue on the ballot and stated there would be two Town Hall meetings
on February 8 and 9, 6:00-8:00 PM, and attended Water Agency Executive Board meeting.

CITY AGENDA ITEM: HEARING: Adoption of Council Resolution No. 2016-___: Placing
Liens for Unpaid Waste Collection Service Charges on Certain Lands Situated in the City of
Suisun City, County of Solano, State of California.
FISCAL IMPACT: Solano Garbage is requesting that the City Council place liens on 261
delinquent solid waste accounts representing approximately $56,362.07 in uncollected solid
waste collection service charges. The City’s General Fund will receive twenty-dollars per lien
and 1.0 percent of the total levy amount to be used as the recording fee and to offset the
administrative costs associated with the lien and levy process. Through the lien and levy
process, the City will collect on outstanding franchise fees totaling 10.0 percent of the
uncollected solid waste service charges when the money actually is received.
BACKGROUND: Solano Garbage provides solid waste collection service for properties
located in the City of Suisun City. The Suisun City Code (SCC) Section 8.08.015 requires
subscribers to pay the collection charge directly to Solano Garbage. In the event that a customer
does not pay the collection charges, Solano Garbage must prepare delinquent notices to notify
each customer that the account is delinquent and could be subject to a lien/levy process whereby
charges would be recorded against the property.
Solano Garbage began actively pursuing collection of delinquent accounts in December 2001.
Solano Garbage will request hearings three times per year in order for the Suisun City Council to
consider enforcing the lien/levy process for delinquent waste charges.
STAFF REPORT: Solano Garbage customers were compared with the owners of record to the
parcel information database obtained from Solano County property records. Notification letters
were mailed to all known property owners advising them of the lien and levy process. The
letters informed the property owners that they could present their reasons for disputing the waste
collection charges by either attending the hearing on February 16, 2016, or by sending letters to
the Council prior to the hearing.
Solano Garbage is asking that the City enforce SCC Section 8.08.170 by placing a special
assessment/levying a lien on the properties that have delinquent charges. Solano Garbage will
verify accounts for payments prior to recording the special assessments.

COUNTY OF SOLANO, STATE OF CALIFORNIA
WHEREAS, pursuant to the Suisun City Code (SCC) Section 8.08.015 owners of all
occupied premises must subscribe to and pay for weekly waste collection service; and
WHEREAS, the premises located in the City of Suisun City, County of Solano, State of
California, and described in Exhibit A attached hereto and by this reference incorporated herein,
were provided with waste collection service as required by the SCMC Section 8.08.015; and
WHEREAS, pursuant to the provisions of SCC Section 8.08.015, all required notices were
directed to owners of said properties and said owners failed to make payment for waste collection
services as required; and
WHEREAS, as a result thereof, the City of Suisun City has incurred charges for delinquent
waste collection charges and administrative costs, which amounts remain unpaid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Suisun City
that pursuant to SCC Section 8.08.170, the City Council does hereby lien said premises, in the
amounts applicable to each specific premise as identified in Exhibit A attached hereto and
incorporated herein by this reference.
BE IT FURTHER RESOLVED that Exhibit A may be amended to delete any enumerated
waste collection service charges and administrative costs paid before liens authorized hereby are
forwarded to the County Recorder of Solano County, California.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to record this
Resolution, together with Exhibit A as may be amended, with the Office of the County Recorder of
Solano County, California.
BE IT FURTHER RESOLVED that the City Manager of the City of Suisun City is
authorized to take such further actions as are necessary or appropriate to implement this
Resolution and is also authorized to execute any other document(s) that may be necessary or
appropriate to process or release said liens.

City duly held on Tuesday, the 16th day of February 2016, by the following vote:

CITY AGENDA ITEM: Discussion and Direction regarding the Pacific Gas & Electric
Community Pipeline Safety Initiative.
FISCAL IMPACT: There would be no fiscal impact resulting from this program.
BACKGROUND: The Pacific Gas & Electric Company (PG&E) has developed a program to
evaluate potential risks from vegetation and structures within its “pipe zone”. The program is
funded by PG&E stockholders, as opposed to the ratepayers, to address the requirements
imposed by the California Public Utilities Commission (CPUC). PG&E has been working
throughout its service area in collaboration with local jurisdictions and the public looking at its
underground facilities to determine how vegetation or structures may impact those facilities. The
primary issues the program is intended to address include emergency access and potential
damage to pipes from tree roots either through intrusion or damage resulting from falling trees.
The latter is an issue where tree roots may encircle the pipes and upon falling could damage the
pipes. PG&E will also be looking at pipe integrity internally, but that will not impact the
community.
STAFF REPORT: Staff met with PG&E representatives to receive an outline of the program.
There are essentially two components of the program:
•
•
One working with the City for those facilities within the franchise areas (City-owned trees
and structures in the City’s right of way).
The other identifying risks within private property where PG&E will be working directly
with the private property owners.
PG&E has both the right and responsibility to address these risks, and the City’s authority is
limited to ensuring that we receive appropriate mitigation for the losses that may occur due to the
removal of trees or structures. In most cases that would be the relocation/replacement of the assets
in question to an acceptable location.
PG&E has categorized the trees within the pipe zone as “unacceptable risk” and “manageable
risk”. Those in the “unacceptable” category must be removed. Those that are “manageable” may
remain. Within the City limits the area most affected is the north side of Petersen Road across
from Walmart. There are 12 trees between Fulmar and Walters that fall under the “unacceptable”
category. While those must be removed, PG&E is developing a replanting plan to mitigate the
removal. Staff will be working with PG&E to develop the replanting plan and bring that back to
Council for review and approval.
STAFF RECOMMENDATION: Staff recommends the Council receive the presentation and
provide direction as appropriate.

Partnerships to Improve Community Health Grant.
FISCAL IMPACT: The grant would offset any direct City staff costs, as well as any costs for
consultants or subcontractors that the City may hire to serve the community.
BACKGROUND: On May 1, 2012, the Board of Supervisors approved the County’s Health and
Social Services (H&SS) Department’s acceptance through the Center for Disease Control (CDC)
of a Community Transformation Grant (CTG) in the amount of $253,000 per year for five years.
The focus of this grant was to focus on chronic disease prevention.
When the CDC grant ended prematurely due to federal funding issues, Solano County coordinated
with a number of local health supporters from school districts to youth groups to seniors-turnedhealth trainers to secure other funding sources. Through our participation in ATOD and SR2S
programs, as well as our population’s alarming chronic health statistics, Suisun City was asked to
support this effort.
In early September, Solano County H&SS was notified that it had been awarded the Partnerships
to Improve Community Health (PICH) grant in the amount of $1.2 million a year for three years
and the Lifetime of Wellness: Communities in Action (LWCA) grant in the amount of nearly
$480,000 per year for four years. With nearly a sevenfold increase in funding over prior years,
Solano County and Suisun City (among other partners) has a significant opportunity to engage
residents and stakeholders in developing local policies and programs that can educate, heighten
awareness, and increase the choices that individuals and businesses have to reduce chronic disease
and elevate the quality of life for our residents.
On April 7, 2015, the City Council approved the City’s participation in the PICH grant program,
which was initially funded at $48,721 for 2015.
STAFF REPORT: Suisun City has taken advantage of the opportunity to participate as one of
many partners in the Partnerships to Improve Community Health (PICH) grant. Given the
diversity of factors that play into chronic health issues such as diabetes and obesity, the public, notfor-profit and private sector entities that have the opportunity to collaborate through this grant are
likewise many and varied. Among others, they include Solano County Parks, Solano Public
Health, Solano County and the cities of Suisun City and Vallejo; NorthBay Healthcare, Kaiser
Permanente, Sutter Health, La Clinica, Travis AFB HAWC and Touro University; American
Cancer Society and American Lung Association; and Solano Transportation Authority (STA).

WHEREAS, Solano County has the highest rate of diabetes (9.8%) as compared to
California (7.72%) and the United States (8.95%); and
WHEREAS, Suisun City has the highest rate of childhood overweight/obesity (46.3%) of
all Solano County cities, Solano County (38.4%) and the State of California (38.0%); and
WHEREAS, Solano County Health & Social Services was awarded the Partnerships to
Improve Community Health (PICH) grant in the amount of $1.2 million a year for three years; and
WHEREAS, the City of Suisun has the opportunity to participate in the PICH grant with a

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Suisun
City authorizes the City Manager to execute necessary documents related to Suisun City’s
participation in the Partnerships to Improve Community Health (PICH) grant.
