Stuart Cowan was presented the Advocate of the Year Award for his work on defeating residential licensing initiatives in Columbus. Sheila Baker was given the Membership Award for her stellar recruitment and retention efforts. Jeff Hebeler was recognized with the Educator of the Year Award for coordinating the HBA’s outstanding Lunch & Learn series. Congratulations to them all! Sheila Baker with John Ballantyne Stuart Cowan with John Ballantyne Jeff Hebeler with John Ballantyne Posthumous Award HBA Newsline Issue one 2014 www.cincybuilders.com Dan May Elected 2014 HBA President 4 Dan May, vice president of Ireland May Ltd., has been elected the 80th president of the Home Builders Association of Greater Cincinnati (HBA). The Montgomery, Ohio based builder/remodeler specializes in both custom remodeling and new home construction. His official installation was conducted on December 13th by Hamilton Co. Commission President Chris Monzel at the Cincinnati Netherland Hilton Hotel. He has previously served the HBA as vice president/treasurer and second vice president/secretary, as well as a member of the board of directors since 2008. May also serves as a director of both the Ohio and National Associations of Home Builders. May has been a homebuilder since 1996. He is a graduate of the University of Kentucky and has received recognition from Xavier University, in addition to several industryrelated awards. He also holds the national designations of Residential Construction Specialist (RCS), as well as Certified Graduate Builder (CGB)-- held by less than 10 percent of builders nationwide. His community involvement has included the Montgomery Chamber of Commerce and Montgomery Citizens Leadership Academy. He and his wife, Maya, and daughter, Piper, are residents of Montgomery, Ohio. The HBA plans to host three major home shows during May’s tenure: New Home Tour April 5-6 and April 12-13, the fiftysecond HOMEARAMA® at Carriage Hill in Liberty Township July 12-27, and the twelfth CiTiRAMA® at Witherby Meadows in College Hill September 13-21. Joe Bayer, co-founder of Bayer Becker was posthumously awarded the Greater Cincinnati Spirit of Construction Lifetime Achievement Award in October. Bayer passed away in 1999. Bayer Becker, founded in 1968, operates four engineering offices in Ohio and Kentucky. Ohio Court Decision Does Not Impact HBA Arbitration Clause The Ohio Supreme Court recently decided not to consider a decision made by the Portage Co. Court of Common Pleas and confirmed by the 11th District Court of Appeals, to negate a builder’s contract arbitration clause. According the HBA of Greater Cincinnati’s general counsel, the decision in the Jamison v. LDA Builders case was narrow in scope and does not impact the HBAGC’s contract arbitration clause. Cooperative Sales Agreement Extended The HBA Board of Directors recently voted to extend the current version of the Cooperative Sales Agreement between builders and Realtors. The annual agreement provides specific provisions for compensation for transactions between the two. For a list of signatories visit CincyBuilders. com. To have your company included on the list email [email protected]. 2014 HBA Leaders Elected New HBA leaders for 2014 include Dan May, President (Ireland-May, Ltd.); Mike Hoffmaster, Vice President/Treasurer (Maronda Homes); Ray Neverovich, Second Vice President/ Secretary (The Drees Co.), and John Ballantyne, Chair of the Board (The Leland Group). Other newly elected directors include John Hensley (Hensley Custom Homes), Scott Lucke (Robt. Lucke Group), and Julie Zicka (Zicka Homes). Re-elected for a second term include Tim Burgoyne (Hal Homes), Jeff Hebeler (M/I Homes), Shannon Lachenman (Brookstone Homes), and Mat Walker (M/I Homes). Presidential appointees to the board of directors include Mark Meinhardt (Star One Realtors) and Stuart Greenlee (CenterBank). 5 New SMC Leaders Named Associates Council Elects for 2014 New leaders were recently elected to the HBA’s Associates’ Council. They include Warren Whalen, President (Ernst Concrete), Adam Weber, Vice President (A E Door Sales, Inc.), Jon Sauerland, Secretary (Moen, Inc.). Other newly elected directors include Jay Hyson (Park National Bank), Brad Murphy (Janell, Inc.) and Todd Rieger (Tremco Barrier Solutions, Inc.). Re-elected for a second term was Chris Teghtmeyer (Keidel Supply Company). Build-PAC Trustees Elected The HBA’s political action committee, Build-PAC, has elected 2014 trustees including Rex Gordon, Chairman; Stuart Cowan, Vice Chairman; Dan Dressman, Treasurer; John Ballantyne, Josh Blatt, Charlie Bullington, Scott Dallis, John Del Verne, Jim Frey, Dan May, Carolyn Rolfes, Alan Schmidt, Sr., Terry Sievers, Joe Smith, Mat Walker and Adam Weber. OVDC Elects New Leaders Several were elected to leadership positions with the HBA’s Ohio Valley Development Council (OVDC). Ben Hurst (Contech Engineered Solutions), Joe Smith (SiteWORX), and Brent Coppage (Coppage Construction) will be returning to the board of directors and Mark Burgess (Bayer Becker) and Shane DeLong (Kleingers and Associates) will be joining the board of directors. Mat Walker (M/I Homes) was elected Secretary/Treasurer. In 2014 Doug Smith (McGill Smith Punshon) will serve as President and Craig Abercrombie (Abercrombie and Associates) will serve as Vice President. Doug Smith appointed David Morsch (ADS, Inc.) and Tom Kilbane (Kilbane Environmental) as his presidential appointees. Outstanding Urban Cooperator Award Liberty Land Co., developers Randy and Todd Terry, were awarded the 2013 Outstanding Urban Cooperator Award by the Butler Co. Approved amendments to the HBA’s Standard Home Warranty to address remodeling-related construction issues. Collaborated in numerous media stories on the resurgence of the regional housing market. Partnership with the Blueprint for Success Program received the NAHB’s Best Community Service Program Delivered Award. Received resolution acknowledging this award from the Cincinnati City Council. As I look around this room and see some of the men and women that have held this position before me and know the hard work and dedication you have given for the HBA, I am truly humbled to be here. Many of these past presidents have let me know that they are available to share their advice and counsel based on their experiences. To them, I have two things to say: “thank you” and “careful what you wish for.” Your commitment to this association and your hard work have led the way for all of us and I welcome your input as we collectively move forward. hard work and dedication to their businesses, their association and their industry. I hope to follow their collective example and continue that tradition. Whether you’re a builder, a developer, a contractor or a supplier, you’ve got one thing in common: you’re still here. My story is not unlike many others throughout the HBA. Brad Wenstrup Addresses OVDC On November 5, OVDC members elected Mark Burgess, Brent Coppage, Shane DeLong, Ben Hurst, and Joe Smith to 2-year terms on the OVDC Board of Directors and welcomed Rep. Brad Wenstrup (R-Hamilton County, Ohio) as special guest. Rep. Wenstrup addressed the group on the national economy, housing and land development issues, and took their questions. The Board later elected Doug Smith president, Craig Abercrombie vice president, and Mat Walker secretary/treasurer for 2014. John Del Verne will take on the immediate past president role next year. OVDC has several informative events planned for 2014: February 11th – Board of Directors Meeting & Open House, 4:00 p.m. at the original Montgomery Inn. Builders should provide all relevant data to appraisers, including plans and specifications of the property, information on how their products differ from their competitors’, a list of energyefficiency features in the home, details on materials that were chosen, and the buyers’ reactions to products selected. Builders cannot talk about the specific value of the home, but they can give the appraiser factual information that is verifiable. • Insist on a qualified appraiser. Use lending institutions that hire competent appraisers. If an appraisal assignment goes to an appraiser who you know is unfamiliar with your geographic area, insist that the lender switch to an appraiser who knows the area. • Request an appraiser who is familiar with new construction and/or energy-efficient construction. Keep a detailed record of data provided to the appraiser (email, notes in calendar, etc.). Engage with the lender and provide the facts. Nothing prevents a lender from ordering a second appraisal if the first appraisal appears flawed. • Be present during the appraisal. A builder can answer any questions the appraiser has during appraisal of the property and also point out added features, amenities, and products that make the house stand out from others in the market. • Stage the property. Just like a buyer looking at an open house, an appraiser is likely to look more favorably on a home that exhibits curb appeal and is clean, clutter-free, and move-in ready. • Provide additional info. This little-known rule at the Department of Veterans Affairs states that if the appraiser determines that the value will come in lower than the sales price, he is required to halt the appraisal before it is completed and make the lender aware of the value coming in below the sales price. This allows any party to the transaction, including the builder, to provide additional information in support of the sales price. Since this is done at the VA, a builder can ask any lender to consider this policy without violating current regulations. Source: National Association of Home Builders Education • Advocacy Immigration Reform Lobbying Tax Deduction HBA Executive Director, Dan Dressman, joins allied organization leaders from the Cincinnati USA Regional Chamber of Commerce and the Ohio Valley Associated Builders and Contractors at a media conference in December to promote immigration reform. The HBA of Greater Cincinnati supports an employer e-verify system that provides a safe harbor when companies legally use the federal system, as well as an increased annual guest worker quota system to address growing residential construction labor shortages. Dues payments to the Home Builders Association of Greater Cincinnati are not deductible as charitable contributions for federal income tax purposes. However, dues payments may be deductible as ordinary and necessary business expenses, subject to exclusion for lobbying activity. Because a portion of your 2013 dues was used for lobbying by NAHB, OHBA, and the HBAGC, $90 is not deductible for income tax purposes.
