INDUSTRY RESPONDS TO NEW WVDOH INTERACTION POLICY
The CAWV and other organizations received a letter dated May 23, 2016 from Transportation
Secretary Paul Mattox, Jr. detailing new interaction and meeting procedures involving WVDOH
personnel and industry representatives. This course of action, the letter notes, is “being
pursued in order to formalize and vet any discussions occurring between WVDOH and
industry.”
The new policy sets protocol to include such things as setting an agenda for meeting at least
two weeks in advance, WVDOH management will approve agendas, no changes or additions to
the approved agenda will be permitted and only written comments shall be accepted. Only
WVDOH personnel will attend the meetings to consider written comments. Discussion and
approval of agenda items shall consist only of those attending the meetings. Where industry will
be included in meetings, an approved attendance list of WVDOH and industry representatives is
required.
Reaction by associations and organizations to the WVDOH letter has been swift. In a June 3,
2016 letter to Secretary Mattox, 16 organizations that have various dealings with the WVDOH
stated they have serious concerns with WVDOH’s new procedures modifying and limiting
interaction of industry groups with the WVDOH and its personnel. Two former WVDOH officials
also signed the letter.
“As your letter states, the WVDOH and its associated industry representatives have enjoyed a
long history of working together to produce procedures necessary for the delivery of WVDOH
programs. While we strongly support this statement, we believe the unintended consequences
of the division’s new policy will create a more disruptive, inefficient, litigious and costly
environment that is unnecessary given the need to maximize limited dollars in the State Road
Fund due to stagnant revenues over the past decade,” the groups wrote.
“The joint committees and subcommittees between the WVDOH and industry have a proven
track record in promoting common objectives which have produced better materials and
specifications, designs, innovations, procedures and processes, policies, and, ultimately, a
higher quality project delivered at the most economical cost. All of this has been done in a
collaborative, open and transparent way. The beneficiaries of the joint committees’ actions
have been the taxpayers of West Virginia who fund state road and bridge construction and
maintenance projects,” they stated.
The groups requested this policy be reconsidered and offered to put together a task force to
meet with WVDOH to discuss in further detail. The group is awaiting response from the
department. In the meantime, the Joint WVDOH/FHWA/CAWV Construction Subcommittee
scheduled for June 16 has been cancelled. The June meeting of the Specification Committee
was also cancelled and construction and engineering industry representatives have been
removed from the committee.
Attached for members’ review is the May 23, 2016 WVDOH letter to the CAWV and the June 3,
2016 response by industry groups. More information will be presented as it becomes available.
GOVERNOR VETOES BUDGET IN ITS ENTIRETY; LEGISLATURE CONVENES SATURDAY
TO CONSIDER NEW TAXING PROPOSAL
Gov. Earl Ray Tomblin vetoed the budget bill Wednesday passed last week by the state
legislature and announced he’s reached a bipartisan agreement with the state Senate on what
the new budget should look like just more than three weeks from a possible government
shutdown. Gov. Tomblin struck down the budget bill in its entirety. He opposed the $182 million
that was taken from the state Rainy Day Fund. The plan included no tax increases to fill the
projected $270 million revenue hole for next fiscal year but instead used approximately $245
million in one-time monies. The governor also announced Wednesday a plan for a new budget
that includes a 65-cent increase in the tobacco tax, budgets cuts and account sweeps along
with approximately $70 million from the Rainy Day Fund. It’s a plan senators support, Tomblin
said.
The budget must be passed by July 1 to avoid a shutdown of government services. Senate
President Bill Cole, R-Mercer, on WV MetroNews Talkline Thursday said he will support the
Governor’s plan to increase the tobacco tax .65 cents per pack as will most Senators. The
Senate will take up the tax increase first when the Legislature resumes in special session
Saturday.
The House defeated 55-44-1 the Governor’s earlier .45 cent cigarette tax increase so it is
questioned whether there will be enough votes for a .65 cent raise. House Speaker Tim
Armstead, R-Kanawha, also on Talkline Thursday, said there is not much support for a .65 cent
increase. He said he will be interested to see how the Governor can gain support, even with his
own party, for a tax increase that’s greater than the one already rejected.
In discussions with state contracting agencies, the CAWV has learned that contractors’ estimate
payments could either be delayed or put on hold if agencies don’t have spending authority past
July 1.
EFFECTIVE JULY 1, 28 MUNICIPALITIES WILL IMPOSE LOCAL SALES AND USE TAX
Effective July 1, 2016, in addition to the current municipalities, the following twelve
municipalities will impose local sales and use tax bringing the total number of municipalities
imposing the tax to twenty-eight: Beckley, Bridgeport, Clarksburg, Dunbar, Fairmont, Grafton,
Harpers Ferry, Moorefield, Pennsboro, Romney, South Charleston, and Weirton.
The West Virginia State Tax Department administers the local sales and use taxes for the 28
municipalities. Local sales and use tax applies to sales and purchases made on taxable goods
and services provided within the local taxing municipality’s boundaries. The tax applies to the
same items West Virginia sales and use tax law outlines. The local taxes apply to construction
materials and contractors are required to pay the local 1% but can differ based on where the
products are sold and delivered.

TIME IS RUNNING OUT TO REGISTER FOR THE CAWV WEBINAR - EMPLOYEE STOCK
OWNERSHIP PLANS
The CAWV, in conjunction with the White Planning Group, has scheduled a webinar
presentation on Employee Stock Ownership Plans (ESOPs) for 3:00 p.m. on Thursday, June
16. This presentation examines how ESOPs can be a very tax-advantaged method of
transferring a closely held business from one generation to the next or to key management as
business owners seek advice regarding their exit strategy. ESOPs offer many advantages, tax
and otherwise, to the selling shareholder, the sponsoring company, the employees and the
community, including immediate liquidity (whole or part), no third party interests, significant
corporate tax deductions, tax exemptions and capital gains tax deferrals/elimination. This
presentation also discusses corporate governance, structuring alternatives, financing and
related tax planning related to ESOPs.
The presenter, Daniel Zugell, senior vice president, Business Transition Advisors (BTA), will
inform members on how an ESOP may be the perfect succession plan for their business. BTA is
a nationally recognized firm dedicated to assisting in the design and implementation of ESOPs.
Mr. Zugell has authored and been featured in numerous national financial publications and has
earned several advanced financial designations from The American College.

CONSTRUCTION EMPLOYERS CALL ON CONGRESS TO ENACT MULTIEMPLOYER
PENSION REFORM
This week, AGC joined a group of construction employer associations in a letter to
Congressional leaders calling for multiemployer pension reform. The letter highlighted how
imperative it is for Congress to authorize composite plans for multiemployer plans as soon as
possible. Composite Plans enjoy strong support from both labor and management in the
construction industry stakeholders and we don’t think paralysis should set in because of the
Treasury Department’s rejection of the Central States Rescue plan. AGC thinks this makes a
stronger case for action now on Composite Plans.
COOLING TOWER REPLACEMENT, VAMC, HUNTINGTON
Bids will be accepted until 2:00 PM on 7/5/2016 for replacement of Cooling Tower Building 1S,
VA Medical Center, 1540 Spring Valley Drive, Huntington, WV 25704. This is a multi-phased
project to replace cooling tower of Building 1S, the main patient support building at VAMC
Huntington. A site visit will be held at the Huntington VAMC, Building 8 on 6/15/2016 at 9:00
PM. Work includes demolition of the existing cooling tower, associated piping, electrical,
controls; and installation of new cooling tower in a separate location with new piping, plumbing,
electrical, and controls. Construction of a new pump room in the basement of Bldg. 34 and
relocation of the water treatment system is also included. Plans and specifications are available

ROOF REPLACEMENT, MAIN BUILDING/ CLINICAL ADDITION, VAMC, CLARKSBURG
Bids will be accepted until 7/6/2016 for the replacement of existing roofing material and
insulation, removal of all existing drains in the areas of demolition, and installation of new roof
drains that will allow proper drainage from the finished new roof, with new flashing, insulation
and roofing material for roofs at the Clarksburg VAMC main building and clinical building. A prebid meeting will be held at the Medical Center, Building 7 Conference Room, 513 Rosebud

BEWARE OF ADVERSE WEATHER
Carrying 100 million volts of electricity, a bolt of lightning is deadly. Lightning strikes without
warning.
Many times high winds can kick up from an approaching storm without warning. A tornado
could be the next thing seen. Is there a plan? What are employees going to do? Where are
they going to go?
According to the National Weather Service, lightning will strike and kill hundreds each year.
WHY? Hundreds more are seriously disabled.
Flash floods are another very common storm-related hazard in West Virginia. People all have
experiences that can recalled in our communities and around the state where flash flooding
takes people by surprise and takes lives.
Here are some good rules to help reduce the possibility of being a statistic of adverse weather:
▸
Plan what employees are to do and where they are to go in the event of bad weather.
Hold safety talks with all employees to communicate the plan to them.
▸
Look over the project site and check the landscape to see if flash flooding could pose a
threat. Are there small creeks, streams, ditch-lines or the like surrounding or cutting
through the project? Even a small dry creek bed in the far distance can rise without
warning from a rainstorm. Don’t get caught with no way out.
▸
Take approaching storms seriously. Shelter inside a building or hard topped vehicle if
lightning is present. Do not use an open-sided shelter house, car port, porch, tree or
stand under an extended roof. Get completely inside. Stay away from outside open
spaces. REMEMBER: Lightning is often on the fringe of storms, both coming and going,
so waiting to take shelter until the storm is right there may be too late.
▸
Stay off the phone until the storm has passed and turn-off all 2-way radios.
▸
Most importantly.........be prepared and have a plan before adverse weather hits.

HOUSE TRANSPORTATION AND INFRASTRUCTURE COMMITTEE RELEASES ITS
VERSION OF THE WRDA REAUTHORIZATION MEASURE
On May 25, 2016, the House Committee on Transportation and Infrastructure unanimously
released its version of the Water Resources Development Act of 2016. To the dismay of the
Clean Water Construction Coalition, the House bill does not include funding for the Clean Water
or Drinking Water SRF program. A prior bipartisan agreement to fund the Clean Water and
Drinking Water program at the last five–year average was agreed to by Committee members.
What eventually was approved was strictly a Corps of Engineers bill.
On April 28, the Senate Environment and Public Works Committee reported out its WRDA
reauthorization bill, S.2848. While WRDA is a traditional Corps of Engineers bill, this version
also contains significant provision on safe drinking water (in response to the Flint, Michigan
crisis), and clean water. Highlights include:











Authorizes $1.8 B over 5 years for sewer overflow grant program to address CSO, SSO
and storm water discharges.
Authorizes $15 M over 5 years for technical assistance to small communities (<10,000
population).
Directs EPA to promote Green Infrastructure.
Authorizes a pilot program related to innovative public-private partnership financing.
Provides a number of changes/improvements to WIFIA, also stating that WIFIA
appropriations must be in addition to “robust” appropriations to SRFs.
Establishes a Water Infrastructure Investment Trust Fund. This would provide grants
under the SRF with money coming from voluntary fees/labeling. This is modeled after
Blumenauer’s bill, which we’ve supported. Under this program, the Secretary of treasury
and departments would design a label that businesses could choose to add to their
product, with 3 cents being collected from every unit (e.g., bottle of water). Of fees
collected, 85% would go to the CWSRF and 15% to the DWSRF. It also includes a
provision that no grants will be provided from this fund unless the SRF appropriations
exceed the average of the last 5 years.
Authorizes an Innovative Water Technology grant program at $50 M/year – subject to
appropriations - supporting reuse. It also includes $10 M in direct spending (via EPA).
Reauthorizes the Water Resources Research Act at $1.5 M annually form 2015-2020.
Reauthorizes the Water Desalination Act at $8M annually from 2015-2020.
Directs EPA with other Federal agencies to develop drought resilience guidelines.
Encourages use of SRF funding and additional subsidization for innovative technologies.
The clean water and safe drinking water issues will be major issues in conference on the two
bills. Clean Water Construction Coalition representatives will be meeting with the Congressional
Clean Water Caucus staff (Chairman, Congressman John Duncan, R-TN-2, advocate of a
national clean water trust fund, and Co-Chair Congressman Dan Lipinski, D-IL-3 – both
members of the Transportation and Infrastructure Committee). The purpose of the meeting with
these House Representatives is to encourage them on clean water and safe drinking water
reauthorization and funding.
SEWER GRAVITY, ROAD BORES AND PUMP STATIONS PROJECT– TASK 19B, CITY OF

NEW WVDOH INDUSTRY INTERACTION POLICY
The CAWV and other organizations received a letter dated May 23, 2016 from Transportation
Secretary Paul Mattox, Jr. detailing new interaction and meeting procedures involving WVDOH
personnel and industry representatives. This course of action, the letter notes, is “being
pursued in order to formalize and vet any discussions occurring between WVDOH and industry.”

Please note that the Construction Subcommittee meeting scheduled for June 16 has been
CANCELLED. We will attempt to reschedule the meeting after we learn more about new
WVDOH policy changes relative to meetings and interaction with industry.
AGC WEBINAR EXPLAINS MILEAGE-BASED USER FEE
AGC is hosting a free webinar on June 21 from 1:30-3:00 PM EDT to explain how mileagebased user fees can be used as a next generation revenue source for funding highway and
bridge improvement projects at the federal and state levels. The recently enacted FAST Act
included $95 million in grant funding for states to use for pilot programs to test implementation
of alternative user fee systems. Since the gas tax user fee has become a less reliable funding
source because of more fuel efficient vehicles, use of alternative fuels, and the political
difficulties of increasing the fee, transportation advocates have been looking for other revenue
sources.
This free AGC webinar will feature experts who will discuss using a mileage-based user fee to
fund future transportation construction projects, state pilot programs to test the concept and
federal grant funds available to support the pilots. Members can click here to register and obtain

HIGHWAY REVENUES $37 MILLION UNDER LAST YEAR COLLECTIONS
Revenues to the State Road Fund through eleven months of the fiscal year are $37 million
under revenue for the same period last year. Through May 2016, the WVDOH collected $627.8
million in total tax revenue. This compares to $664.8 million through May 2015, a 5.56% drop.
The biggest drop in revenue is due to the Motor Fuel Tax. Last year, the WVDOH collected
$366.3 million. In 2015, the figure was $392.4 million. Registration Fees are down $11.8 million
for this year, $71.5 million in 2016 compared to $83.4 million in 2015. The Privilege Tax on
vehicles is about even, $188.5 million compared to $188 million last year.
The Motor Fuel Tax is down due to the drop in the wholesale price of gas. The Wholesale Gas
Tax dropped 1.1 cents per gallon in 2015 and 1.4 cents per gallon in 2016. Each cent of the
wholesale tax generates about $15 million.

WVDOH TO HOST INFORMATIONAL WORKSHOP ON JEFFERSON ROAD
IMPROVEMENTS
The West Virginia Division of Highways (WVDOH) will hold an informational public meeting on
Monday, July 11, 2016, at the South Charleston Recreation Center, located at 601 Jefferson
Road, South Charleston, on the proposed improvements to an approximately 1.7 mile section of
Jefferson Road (WV601) in Kanawha County between its intersection with US 119 (Corridor GDavis Creek Interchange) in the south to its intersection with US 60 (McCorkle Avenue) in the
north. The improvements will relieve current and future traffic congestion and improve safety in
the corridor. This meeting complies with the public involvement requirements of the National
Environmental Policy Act (NEPA) and Section 106 of the National Historic Preservation Act.
The approved Environmental Assessment will be available for review.
The scheduled public meeting is from 4:00 to 7:00 p.m. and the public will be afforded the
opportunity to ask questions and give written comments on the project throughout the meeting.
