I’m still pumped up from the successful 2015 CADA
Project DC trip, September 27th through October 1st.
Your entire Board of Directors was invited and for the
third year we held our board meeting while we were
on the road. We were also accompanied by one of
our NextGen dealers and select endorsed providers. We attended the annual
NADA Washington Conference. The trip was informative and it allowed us to have
some beneficial and productive dialog with our elected federal representatives. It
helped us cement important relationships among Board
members and our endorsed providers. And it also was
a lot of fun! In short, it was everything I hoped it would
be.
This was our third annual Washington, DC trip and as
in the past two years, our CADA staff planned and
executed the agenda admirably. One highlight was the We had a great meeting with industry suppoter Rep. Ed Perlmutter

There was a separate program for NextGen dealers. Ben Faricy of The Faricy Boys
in Colorado Springs represented CADA. “It was a good introduction to lobbying
and working with members of Congress and it was educational.” Congresswoman
Tulsi Gabbard (D-HI) spoke to them and according to Ben, “We may not be quite
what Congress expected to see and hear, being younger dealers. She shared some
of those characteristics and gave me a little more confidence that there is a next
generation of congressional leadership that’s rooted in the same optimism as this
younger generation of dealers.”

We heard some phenomenal speakers at the NADA
conference. Among them were Congressmen Frank Guinta (R-NH) and David
Scott (R-GA) and Sen. Rand Paul (R-KY). We received briefings on important
industry legislation including the Consumer Finance Protection Bureau reform bill,
open recall bills and changes to LIFO policies.
These were issues that we were able to discuss in one-on-one meetings on Capitol
Hill with Congressman Ed Perlmutter, Congressman Doug Lamborn, Congressman
Senator Cory Gardner
Jared Polis, Congressman Ken Buck and Senator Cory Gardner. All of them were

attentive and receptive to our views. Rep. Perlmutter is a sponsor of the CFPB
reform bill, which is awaiting a vote in the House – soon we hope. We also had meetings with the staff members
for Congressman Mike Coffman, Congresswoman Diana DeGette, and Senator Michael Bennet. “We were
able to share our side of the story and watch it play out at the NADA level. You could see what a force the
dealers could be,” is the way Ben Faricy described it.

For fun we took in several sights in the nation’s capital, including a
moonlight visit on Sunday to the Air Force and Marine Memorials
and the World War II Memorial. On Monday morning we visited
the Vietnam Memorial, Korean War Memorial and Lincoln
Memorial before having a private tour of the Air and Space
Museum.

Back at home, we’ve wrapped up the annual CADA regional meetings, visiting12 different locations over six days
throughout Colorado. These meetings gave us an opportunity to brief members on some of the information and
conversations in Washington, in addition to talking about the state industry’s direction and what we’re looking
forward to in the legislative session. Colorado issues include:
• Fuel-efficiency tax credits
• Sales tax issues
• Franchise relationships
• Motor Vehicle Dealer Board
• CADA services, including educational seminars and workshops
• CADA’s new association management system
• Clear the Air Foundation
At each of our stops, we also unveiled CADA’s newest program - a proactive initiaitve working with Eric
Hartsough,a former Auto Industry Division investigator, who was engaged in August to field consumer calls
regarding issues or disputes with CADA members. This is a service CADA has provided for over ten years—in
the interest of helping ensure dealers understand compliance obligations when disputes arise and to help resolve
disputes before a state complaint is filed whenever possible. The CADA Board, in its strategic planning session,
recommended CADA hire someone for this task to release more resources for other association priorities.
Each of these meetings were very well attended and we were please with the outstanding dealer participation. In
fact, at several of our stops we had 100 percent attendance.
I hope you’ve already made a note on your calendar to attend the 2015 CADA’s The 101 Annual Meeting and
Gala at the iconic Broadmoor Hotel in Colorado Springs on Friday, November 20th from 2 p.m. to 7:30 p.m.
The DEAC (Dealers Election Action Committee) President’s Club will gather at the hotel on the evening before the
annual meeting. While it takes time from your business, the annual meeting is a value-added proposition since
we’ll be talking about many topics affecting our industry and our businesses while also having a chance to get
to know our fellow dealers better. Plus, the staff has made an outstanding effort to get interesting and compelling
speakers. Among them will be Jonathan Sandys, Winston Churchill’s great-grandson, discussing “How to Lead Like
Churchill.”
I’m looking forward to seeing everybody there.

Managing through VW emissions scandal

We are still in the early stages of the entire VW emissions scandal
ordeal. Yet it appears to be shaping up as the biggest and most
damaging auto industry scandal in all of history.

Dealers should rightfully be frustrated as this plays out. After
receiving countless letters, visits, demands for facility upgrades
and even terminations for not having upgraded facilities, all in the name of building
brand image, corporate VW advances a monumental internal scam of epic proportion.
At this time, over 250 separate, highly costly, class action lawsuits have been filed
against VW to recover damages resulting from the misrepresentation of emissions
qualifications. Additionally, governmental entities are beginning to lay out their plans of action to sanction,
penalize, sue VW – or do some combination of those. Already, it’s anticipated that the federal government –
through NHTSA, the EPA and/or the Department of Justice – will clobber VW with massive penalties that could
amount to tens billions of dollars.
Volkswagen, which historically has been a very solid and financially stable corporation, will literally be brought to
its knees through costly government sanctions, litigation, engineering modification expenses, and direct damages
to consumers, dealers and the public.
On the bright side, we have seen through other massive quality issues in the past, that a solid automotive brand can
often survive even under incredible and intense negative public relations coverage.
The one bright spot that has emerged from this debacle is that dealers have found a
new hero; Michael Horn, CEO of Volkswagen of America. Based on his actions in the
early days of the emissions revelations, Michael has shown himself to be a champion
for his dealers and consumers.
Horn has indicated to Volkswagen staff, at the Herndon, Virginia, headquarters for
VOA,that his job was saved through the intense advocacy efforts of U.S. dealers.
Even if you’re not a Volkswagen dealer, that doesn’t mean you won’t be adversely
impacted by this historic scandal. The entire industry has a black eye – and potentially
a target on its back – and the federal and state agencies overseeing motor vehicle
emissions have become more strict and aggressive towards all automakers.
It’s times like these that dealer support through CADA and NADA is so critically
important. We’ve already begun to shift attention to the VW emissions issue and are
searching for ways to significantly support Colorado dealers as they advance through
the maze of issues brought on by this unfortunate scandal.

According to Wingate, CDLE continues its long-standing
interpretation that under Colorado law, vacation pay
that is earned in accordance with the terms of any
agreement is wages owed to the employee upon separation of employment. Employers who have implemented a use-it-or-lose-it policy regarding paid vacation
should reconsider. According to CDLE, “Once vacation
pay has been earned, it cannot be unearned. Forfeiture clauses are not permitted in vacation agreements.”
CDLE’s enforcement position applies to all paid vacation earned on or after January 1, 2015.
The EEO-1 Joint Reporting Committee has extended the deadline for all EEO-1 Report Filers
from September 30, 2015 to October 30, 2015.
The EEOC requires all organizations with 100 or
more employees from “affiliated entities” to use
the EEO-1 Report to self-identify gender and race. The
report must be generated from data collected during
any pay period between July and September 2015. The
data must include all full-time and part-time employees.
An entity is considered “affiliated” if they have
centralized ownership, control, or management. An
entity is still considered affiliated if each location or
business operation is a separate corporation or business
for tax reasons, as long as there is common ownership
or control. Affiliated entities are responsible for filing
multiple reports:
1. A report for the principal office.
2. A report for each individual location with more than
50 employees.
3. A consolidated report covering all locations and entities, including those with fewer than 50 employees.
4. A list showing the name, address, total number of
employees, and the major activity for each location.

POLICIES FOR COLORADO EMPLOYERS

Last week, the Colorado Department of Labor and
Employment (CDLE) indicated it would adopt a tougher
enforcement stance against “use-it-or-lose-it” vacation
policies, according to the agency’s Deputy Director,
Dr. Peter Wingate. CDLE is responsible for enforcing
the state’s wage and hour statute, the Colorado Wage
Protection Act (C.R.S. § 8-4-101 et. seq.). New rules
that assist CDLE’s investigators and hearing officers in

CDLE has had the authority to adjudicate complaints for
unpaid wages and compensation up to $7,500 since
January 1 of this year.
According to MSEC’s most recent survey on Paid Time
Off Policies, 15 percent of Colorado employers have
a policy allowing an employee to carry over only a
portion of earned vacation from one year to the next.
Among resort-area employers, the percentage climbs
to 19 percent. These employers should consider revising their policies to ensure employees are not losing, or
forfeiting, any earned vacation time.

UNCLAIMED PROPERTY REPORTING
REMINDER: NOVEMBER 1ST
A reminder that annual unclaimed property reports are
due each year to the state covering unclaimed property
through June 30th of that year—the report filing deadline is Nov.1st of each year. Interest and penalties
can apply; if not yet reported, submit as soon as possible. Every business in Colorado is required to report
“unclaimed property” to the state of Colorado, attempt
to reach the actual owner(s), report/track these items,
and ultimately turn over such funds to the state. The state

The Colorado Consumer Protection Act (“CCPA”) identifies a number of acts that are ‘deceptive’ and provides
for the award of triple damages and attorney fees.

requirement. Dealerships need to ensure proper
handling of a computer system breach that may
compromise customer personal information. Colorado requires a “prompt investigation” to determine
the likelihood that personal information has been or
will be misused. If the internal investigation determines personal information has been compromised
and is reasonably likely to occur, notice must be
provided. Dealers who experience a system breach
should consult the specific provisions in C.R.S. 6-1716.

newer and excludes private party transactions. Please keep in mind that monthly registration figures can occasionally be subject to fluctuations, resulting in over or under estimation
of actual results. This usually occurs due to processing delays by governmental agencies. For this reason, the year-to-date figures will typically be more reflective of market results.
Reported monthly registration totals for August and September of 2014 were impacted by title processing delays by the DMV. Registration figures were modified by Auto Outlook to
more accurately reflect the level of new vehicle sales in these months. Annual and year-to-date totals for 2014 were not impacted by these adjustments Green shaded areas in tables

CADA Staff Profile - Sandra Crocco
Sandra Crocco became CADA’s Service Coordinator in April 2015. Her role includes providing excellent customer service, fulfilling order requests from dealer
members, administering the Mastery Exam to potential sales people, and assisting
all CADA employees with any and all requests. Furthermore, she coordinates various schedules for CADA staff and building events, is the lead in database entry
projects, and assists in distributing CADA publications.
Prior to working for CADA, Sandra pursued further studies in mathematics and
chemistry at the University of Colorado Denver. Her love of education stemmed
from working as an Office Manager at the Community College of Denver. She also
obtained a B.A. in Distributed Social Sciences from the University of Wyoming.
Sandra moved to Denver in 2008, but before that she lived in Wyoming, Washington, Oregon, Illinois, and England, and has travelled to almost 30 countries. She
spends her time listening to vinyl records, reading at least three books a week, and
knitting various different projects.
