This letter notifies you of violations of Health and
Safety Code Section 25249.6, the warning requirement of
Proposition 65. The particulars are set forth below. You
may bring an action to enforce the law under Heal~h and
Safety Code Section 25249.7(c).
This represents the first major enforcement action
undertaken under Proposition 65. It covers a large number
of current and potential violations Involvlng over two
hundred individual brand-name tobacco products, major
national tobacco manufacturers, and major California retail
chains, with estimated potential maximum liability in
excess of $1.3 billion.
This action is also intended as a direct challenge to
the validity of a purported warning system for consumer
products that is now being offered throughout California,
specifically the toll-free "information system"
(800 number) sponsored by the Grocery Manufacturers of
America and affiliated entities, and operated by the
Ingredient Communication Council, Inc. (800-431-6565).
The 800 number is no substitute for genuine warnings to
consumers, and relying on it gives no protection against
liability under Proposition 65.

When the invalidity of the 800-number system as currently operated is
established, it will be clear that warnings for the few consumer products that
exceed state-set limits for known carcinogens and reproductive toxins under
Proposition 65 must be given on an individual basis at point of sale,
replacing the generalized and misleading notice now posted in store windows
throughout the state which purports to cover all products including the vast
majority .for which no warning is required, and which fails to inform the
average consumer as to which products, if any, are actually subject to t h e
warning requirement.
Pursuant to Health and S~fet 7 Code Section 25249.7(d), this notice is
being given to the Attorney General, DistrictAttorneys, and City Attorneys as
indicated, and to the violators, at the addresses shown in the attached proof
of service. A courtesy copy is also being sent to the Grocery Manufacturers
Association, the Ingredient Communication Council, Inc., the California
Retailers Association, and the California Grocers Association.
Sixty days from the date of this letter, the undersigned may bring an
enforcement action or actions by direct citizen suit under Health and Safety
Code Section 25249.7(d).

Individuals throughout the State of California are being exposed to known
carcinogenic and/or reproductively toxic chemicals through the use of
non-clgarette tobacco products, including cigars, little cigars, pipe tobacco,
and loose cigarette tobacco.
Each individual product covered by this notice,
together with the name of the manufacturer, is listed in Attachment A. This
notice does Dot cover any manufactured cigarette product and does not
cover any tobacco product bearing a federal warning pursuant to 15 U.S.C. 9
1333(a) or 15 U.S.C. 4402(a).
On or after July 15, 1988. every one of the products listed in Attachment
A was observed by flrst-hand witness to be offered for retail sale in
California, without adequate warning, on the shelves of individual stores of
one or more of the retail market chains listed in Attachment C; and every one
of the retail chains listed in Attachment C was offering one or more such
pr~d,,r
for sale to consumers without adequate warning.
Individuals exposed. The individuals exposed are each and every
consumer of the non-clgarette tobacco products listed in Attachment A, as well
as all other persons exposed or reasonably anticipated to be exposed to such
items and their combustion products in a manner exposing them to one or more
of the chemicals listed in Attachment B. Such persons include breathers of
so-called "sidestream smoke" and "secondary smoke" from the products listed i~
Attachment A.

Identity of Chemicals. Tobacco smoke contains more than 3800 chemical
constituents, many of which are implicated in the causation of cancer and/or
reproductive toxicity.
The most useful summary of the extensive scientific
literature is vol. 38 of the fARe Monographs on the Evaluation of ~he
CarcinoEenic Risk of Chemicals to H,,m~ns, entitled "Tobacco Smoking" (IARC,
Lyon, France: 1986); see ch. 3, "composition."
The Governor's Science Advisory Panel has recommended and the Governor
has listed "Tobacco smoke" as a chemical known to the state to cause both
cancer and reproductive toxicity, pursuant to Health and Safety Code
Section 25249.8(a). A number of the individual chemical constituents of
tobacco smoke have been similarly listed. For purposes of this notice at this
time, the relevant chemicals are those which were listed more than 12 months
prior to the date of this notice, i.e., those for which the warning
requirement of Proposition 65 is presently in effect. These include chemicals
formally listed on either February 27, 1987, or July i, 1987, as indicated in
22 CCR Section 12000.
The relevant chemicals, each of whlch is contained in
tobacco smoke, are indicated in Attachment B, together with date of listing
for each.

Identity of violators.
The p e r s o n s r e s p o n s i b l e
for the exposures
covered by this notice, within the meaning of Proposition 65, are the

manufacturers of each product listed in Attachment A and the retail s e l l e r ~ o f
each such product.
The manufacturers are indicated in Attachment A. The
retail sellers named in this notice are indicated in Attachment C. Other
persons in the chain of distribution of such products may also be legally
responsible but are not covered by this notice at this time.
Duration of violations. For the chemicals in Attachment B that were
listed on February 27, 1987, unlawful exposures as indicated have been
occurring on each day beginning February 27, 1988, and continuing through the
present.
For the chemicals listed on July I, 1987, unlawful exposures have
been similarly occurring since July 1, 1988. Under Proposition 65, each day
of exposure to each such product by each violator <or, alternatively, each
individual sale of each such product) constitutes a separate violation.
Health and Safety Code Section 25249.7(b).
The maximum civil penalty for
each such violation is $2500.
Id.
Absence of clear and reasonable warning. None of the products covered
by this notice bears any label or other indication on the package in which it
is offered for retail sale that such product exposes persons to chemicals
known to the State of California to cause cancer or reproductive toxicity.
In
addition, none of the same products in the stores covered by this notice was
offered for sale with any shelf label bearing any such warning with regard to
such products.
No other adequate warning information was available at or near
the point of sale for any of the indicated products at any of the indicated
stores.

All products indicated by an asterisk in Attachment A are listed with the
800-number system operated by the Ingredient Communication Council, Inc.; and
the persistent and diligent caller m~y eventually receive a recorded warning
message for each such product if he or she calls the 800 number and is
sufficiently precise in requesting information.
The text of this message is
reproduced in Attachment D. However, this information is not available in
conjunction with the product when offered for sale, is not available within
the store, is not available in printed form, and is not otherwise available.
Moreover, no llst of products associated with such message is available as
part of the Ingredient Communication Council's 800-number "information
system," even on request; no llst of covered tobacco products is available;
and no caller who requests information on "cigars," "pipe tobacco," "cigarette
tobacco," "tobacco," or "tobacco products" receives any such message.
None of the foregoing constitutes clear and reasonable warning within the
meaning of Health and Safety Code Sections 25249.6 and 25249.11(f).
Specifically, the 800 number currently in operation fails to provide clear and
reasonable warning to consumers.
By contrast, in some stores in California, non-cigarette tobacco products
including those listed in Attachment A are offered for sale in proximity to
large, clearly worded shelf signs which state:

Individual stores displaying this shelf sign are not included within this
60-day notice.
In addition, all manufactured cigarettes sold in California bear clearly
worded warnings on each package and in all advertising which, inter alla,
state: "Smoking Causes Lung Cancer .
. A~nd Hay Complicate Pre~nancy.Knowing and intentional exposure. All exposures covered by this
notice are both knowing and intentional on the part of both manufacturers and
retail sellers.
On or about March 15, 1988, manufacturers and/or distributors
of non-clgarette tobacco products provided clearly worded shelf signs, as
described above, to stores of each of the retail chains indicated in
Attachment C. Each such retail chain chose not to display such shelf signs in
the stores covered by this notice.
The preparation of the shelf signs with
the message indicated above clearly establishes knowledge and intentional
exposure on the part of manufacturers: and the receipt of such signs clearly
establishes knowledge and intentional exposure on the part of the retail
sellers.

Because of the importance of this action, and because of the previously
expressed view of the Attorney General's office that the 800-number system
covered by this notice is legally inadequate under Proposition 65, we
anticipate that the Attorney General will proceed to prosecute this matter
under Health and Safety Code Section 25249.7(c).

request that the Attorney General and other involved prosecutors indicate that
they will support a motion by the undersigned entities to intervene in any
such action.
Please advise us as soon as possible as to your plans for initiating.
action under Section 25249.7(c) in this matter.

copies of any pleadings you file in this matter and any communications you

A coalition of public Interest groups today filed
advance notice of their action, as required by law, and
invited Attorney General John Van de Kamp and other
prosecutors to participate. The groups include the
Environmental Defense Fund, Sierra Club, Natural Resources
Defense Council, and Campaign California.
The toll-free number system, described by critics as
"I-800-BALONEY," was Invented last February by the food
ifidustr3, when Proposition 65 went into effect, and requlr~
customers to telephone and ask for information about each
15,O00 products in order to receive the health warnings
required by the new law. The system has been almost entir~
shunned by consumers, but is being relied on by many
manufacturers and retailers of consumer products.

The groups' action is targeted at cigar, pipe tobacco, and loose
cigarette tobacco products, many of which are listed with the 800 number but
which are otherwise sold without warning. It covers 225 tobacco products being
sold in violation of Proposition 65 in eight major California supermarket
chains.
"This is a classic example of a legal gap that Proposition 65 was
designed to close," said Carl Pope of the Sierra Club. He noted that federal
law requires cancer and birth defect warnings on cigarettes, but not o n
cigars, plpe tobacco, or even "roll your own" cigarette tobacco.
"Proposition
65 closes the loopholes in exlstlng toxlcs law--that's one reason it was
necessary," Pope said.
The Attorney General and other prosecutors receiving the groups' formal
notice have 60 days to decide whether to prosecute. After that time the groups
themselves may sue the violators under Proposition 65's citizen suit
provision.

available through the 800-number administered by the Ingredient Communication
Council, Inc. (800) 431-6565. This message is associated with each of the
products identified with an a s t e r i s k in Attachment A. It is played, over the
telephone llne, when a caller successfully identifies one of such products by
specific brand'~ame.
No such warning is played if a caller requests
information on "cigars," "pipe tobacco," "cigarillos," "cigarette tobacco,"
"tobacco," or any product description other than specific name brand.
[NOTE: slight variations in the specific brand name requested (e.g.,
"William Penn" cigars instead of "Wm. Penn" cigars; "AyC Grenadier cigars"
instead of "Antonio y Cleopatra Grenadier cigars") can result in being
informed that the product is "not listed with the ICC at this time." In
addition, some tobacco products have different listings for different package
sizes and/or package types of the identical product (e.g., Captain Black
pipe tobacco) and the caller must specify which size and package type in orde~
