Introduction The scope of this publication is to assist pleasure boat owners in the preparation for Pleasure Boat Inspection (PBI) under the provisions of the Powerboats Ordinance 2001. Within this booklet you will find information on the survey procedure and advice on the safety equipment that should be onboard during the inspection. 2. Definitions “competent authority” - means the Chief Officer and includes any person authorized by him in that behalf; “operator” - means a person who drives a powerboat and includes a person who has the control of a powerboat while it is moored and “operate” or “operating” shall be construed accordingly “owner” - means the person in whose name a powerboat is registered under the appropriate Republican Law or, where the powerboat is not yet registered as aforesaid, means the person who is in possession of the powerboat including a person who is in possession by virtue of a hire-purchase or other agreement; “powerboat” means a mechanically propelled vessel not exceeding 15 meters in length, which is capable of attaining a speed of 15 knots or more “jet ski” means a small powerboat propelled by an outboard or inboard water jet propulsion system “fee” means any fee imposed by or under the legislation of the Republic in relation to fees and taxation relating to merchant shipping; “length” in relation to the dimensions of any powerboat to which these regulations apply, means the length of the hull of the vessel concerned; Chrysanthou Maritime Services Ltd All rights reserved - 2013 2 (Ver. 0.5-2013) Pleasure Boat Inspection Guide “registration mark” in relation to a powerboat means the registration mark, consisting of numerals or letters or both, allocated to a powerboat and recorded in the Register of Small Craft for the Areas or in the corresponding register of the Republic kept under the legislation of the Republic in relation to the registration of small craft, and “registration” and cognate expressions shall be construed accordingly. “the Ordinance” means the Powerboats Ordinance “category A” being a powerboat for private use and used exclusively for recreation and for no reward; “category B” being a powerboat for public use and offered by its registered owner to third persons for reward (e.g club boats) “powerboat circulation license” means a license issued by the competent authority to the owner on the competent authority being satisfied that the powerboat satisfies all the requirements relating to it under the appropriate Republican law; IN THE INSPECTION APPLICATION FORM WHERE YOU NEED TO CHOOSE CATEGORY, THAT IS ACCORDING TO THE ABOVE. Pleasure Boat Inspection Guide Types of Inspection With reference to the Powerboats Ordinance 2001 / Reg.8.2 a boat is subjected to an inspection by a competent authority or a person authorised by it, in the following cases: 1. an initial inspection before the boat is put into service for the first time (initial registration of the boat) 2. an annual inspection (category B boat) 3. a 5-yearly inspection (category A boat) 4. an extraordinary inspection (where boat has suffered damage or has undergone an alteration in its construction, or whenever the competent authority deems appropriate) According to the Powerboats Ordinance 2001 the validity of the circulation licence is as follows: - Category A: end of June following the expiry of five (5) years from the time of issue and shall be renewable every 5 years - Category B: end of June following the year of its issue and shall be renewable annually upon payment of the prescribed fee. The above inspections shall be carried out in the first six months of the year in which they fall to be carried out. (i.e. between January and June of the year of expiry) Upon the satisfactory outcome of the inspection and settlement of financial obligations the Administration may issue a circulation licence according to the Powerboats Ordinance 2001 / Reg.9.1 Chrysanthou Maritime Services Ltd All rights reserved - 2013 6 (Ver. 0.5-2013) 5. Pleasure Boat Inspection Guide Procedure of Inspection The below procedure need to be followed in order to smoothly arrange for the boat inspection: 1. The boat must first be registered in SBA’s boat registry and bear a valid certificate of ownership before applying for inspection. 2. The owner or a person authorised by the owner may fill in and submit the application form online through our website at the following link: http://www.chrysanthou-maritime.com/ The same application form “MC/PB/001/2012 - Application for Survey” can also be downloaded from the website, completed and sent by email or fax to the following email address: [email protected] A confirmation email will be sent stating that your application has been received and is under process. (kindly ensure that [email protected] is put on the safe list of your email so that it won’t end up in spam folder.) 3. Another email or fax will be sent within max. seven working (7) days informing the owner about the place and date of inspection. 4. The owner must make the boat available for inspection at the designated location and date on its trailer. The boat must be able to be launched since inspection takes place while boat is afloat as well and with engines starting. (Failure to attend at the designated place/date without a 48h advance notice will result in a penalty equal to the inspection fee). 5. Inspection fee has been set to 100euro + VAT and is payable in cash only to the attending surveyor at the day of the inspection against a receipt. Payment is completed prior the commencement of the inspection. 6. During the inspection the safety equipment as described later in this booklet and the general condition of the boat and engine are checked along with boat’s documentation. Documentation includes ALL paperwork related to the boat and engine(s) such as Declaration of Conformity, Owner’s Manuals, Certificate of Ownership, (Circulation Chrysanthou Maritime Services Ltd All rights reserved - 2013 7 (Ver. 0.5-2013) Pleasure Boat Inspection Guide Licence for existing boats) etc therefore a complete file must be present with all available documents. 7. Upon completion of the inspection the surveyor will inform the owner as to the compliance or not of the boat with the provisions of the Power Boats Ordinance 2001 and issue to the owner the form “MC/PB/003/2012 - Certificate of survey completion”. 8. For complying boats the original form “MC/PB/003/2012 - Certificate of survey completion” signed and stamped shall be presented to the Administration for the issuance of the boat’s circulation licence. In the case of a category B powerboat the owner must also hold a permit to provide services in accordance with the Foreshore Protection Ordinance, in order to have the a powerboat circulation license renewed / re-issued and upon payment of the prescribed fee. 9. In the case that the boat has been found not to comply, the form “MC/PB/004/2012 – Notice of recommendation” is also issued to the owner, stating the reasons of the non-compliance. Should the owner would like to proceed with another inspection at a later date, a new application form “MC/PB/001/2012 - Application for Survey” will have to be re-submitted and an additional inspection scheduled. It is imperative that the boat is presented on its trailer so that the underwater hull part may be examined. 2. The boat will definitely need to go waterborne. 3. The engine(s) must be able to properly start and run. 4. In case a boat has been inspected and found not to comply the owner is advised to ensure that all deficiencies posed during the first inspection have been dealt with properly before re-applying for a second inspection. The consultation and support of the attending surveyor will be readily available at all times. 5. Expired pyrotechnics must be returned to the nearest police station for proper disposal. 6. Please try to be punctual with dates and times given for your boat’s inspection so that delays are avoided. List of Safety Equipment Powerboats SBA CUSTOMS & IMMIGRATION (as defined in Powerboats Jet Skis Ordinance 2001) L ≥ 6m Equipment Inboard / Outboard engine Remarks An engine, the horsepower of which shall not exceed the limits of resistance and safe navigation of the powerboat in accordance with the specifications of the manufacturer of the powerboat; Lifejackets or buoyancy aids of a number which shall exceed by at least one the number of persons on board. A waterproof case maybe used. Every powerboat shall be fitted with a device which when attached to the body of an operator will cause the engine of the powerboat automatically to cut out if the operator falls overboard or is otherwise propelled away from the vessel. Marking of the boat According to the Powerboats Ordinance 2001 Reg.7-(2) the marking of the boat should be as follows: A powerboat shall bear its registration mark clearly and distinctively above the waterline on each of its sides, • the height of each numeral and letter shall be equal and at least 20cm and be of an appropriate width; • if, by reason of the small size of the powerboat, the application of above is not possible, the height of each numeral and letter may be reduced to not less than 5cm and be of an appropriate width; • the numerals and letters shall be placed above the middle of the height of the topsides of the powerboat; • the colour of all of the numerals and letters shall be the same and shall be in sharp contrast to that of the background, so that they shall be very easily discernible from a long distance; • the competent authority, where it deems such action appropriate, may request the marking of a powerboat to be at a different position and with different dimensions to those described in sub-paragraphs above.
