The world-renowned team, this year with their first female pilot Flt Lt Kirsty Moore, will be joined in the display programme by the heart pounding Eurofighter Typhoon, Battle of Britain Memorial Flight which this year celebrates its 70th anniversary, Hawk jet, Tucano and Tutor all ready to take to the skies. Air Festival Director Jon Weaver said, ‘Last year we were bigger and better, but 2010 will see so much more happening to the festival itself – from greater military support to the technological advances and the new patrons scheme launched to get business involved and supporting the Festival. Bournemouth Airport’s passengers can now get into holiday mode as soon as they walk through the new look departures terminal. The terminal redevelopment has seen the size of the departures building double in size, and the amount of catering and retail space tripled. Passengers can now enjoy shopping in the World Duty Free area where they can buy anything from perfumes, wines and spirits to handbags and sunglasses. Three new catering outlets have been incorporated into the new terminal – Joe’s Coffee House, The Olive Tree restaurant and an Estpresso coffee bar. The brands have been carefully selected to offer passengers the widest possible choice of food and drinks, at any time of the day. To coincide with the changes at the Airport, two major airlines have decided to start operating from Bournemouth this summer: bmi baby (flying three times a week to Jersey) and Flybe (flying six times a week to Manchester). In addition, Thomson/First Choice will be replacing the existing aircraft that they have based at Bournemouth with a brand new, larger aircraft, and Ryanair will be basing two aircraft at the Airport this summer. It means that the choice of destinations from Bournemouth is rapidly expanding. They’ve also created a logo and marketing material for the Dorset County Hospital Charity while consolidating work for local clients like Kingston Maurward College and national enterprises like the Denholm group. ‘We’re celebrating a busy year,’ says new Business Manager Nick Morris, ‘and we’re really looking forward to meeting new people and making new relationships in the coming months.’ RCUK is Making its Mark on Dorset HM Revenue & Customs (HMRC) will require all companies to change the way they file their Corporation Tax Returns and Financial Accounts online. For accounting periods ending after 31st March 2010, HMRC will only accept corporation tax returns and company accounts in the new eXtensible Business Reporting Language (XBRL) format. HMRC has already stated that anything filed in a non XRBL format will be rejected. Many large companies produce their own financial statements in Microsoft Excel or Word formats. The change will certainly cause concern where companies need to maintain control over their own reporting. Companies are now questioning the use of XBRL when they approach the preparation of accounts for tax purposes as they need to know that they can produce them in an acceptable format. Money Talks A recent survey commissioned by Tate revealed that the majority of people looking for a job would leave their current employer if offered more money. Unfortunately for those motivated by money, the Office for National Statistics shows that the average weekly earnings growth including bonuses was unchanged from 0.8% up until December 2009, so gaining salary increases would be minimal. The survey examined other motivators and the results, ranked in order of importance, were threat of redundancy (13%), career progression (11%), location (9%) and benefit packages (0.5%). Q I recently received a letter from HM Revenue & Customs informing me that I am now required to submit my VAT returns online. Can you explain further? A From the 1st April 2010 all business with an annual turnover of £100,000 (excluding VAT) and any newly VAT registered business will be required to submit their VAT returns online, and pay any VAT electronically. The online VAT Return is very similar to the paper version and there has been no change to the rules on how you complete your return or how you calculate VAT. Also, you won’t have to change your existing record keeping system - you can still keep your records on paper if you prefer. Any business which is required to file online must sign up to the VAT online service through the HMRC website. Signing up to do your VAT online is straightforward and you don’t have to be a computer expert. The service is designed to make the process easier, more secure and more efficient for small businesses. Further advantages of using the VAT online service system include setting up an email reminder service to advise when your next online VAT Return is due. Another benefit as you are required to make payments electronically either through Direct Debit, internet banking, telephone banking, is that you receive a further seven extra calendar days (in addition to the usual one month deadline) to file your return and for the payment to reach the HMRC bank account. The Conservative party recently announced that, should they be elected to Government, they would pass legislation increasing the level by which a creditor can issue a winding up and/or bankruptcy petition from £750 to £2,000. Presumably the thought behind such a proposal is, that by increasing the petitioning level there will be fewer creditors who can issue petitions and therefore, fewer businesses and/or individuals who shall subsequently be declared insolvent. Perhaps somewhat surprisingly, despite suffering from inflation, the petitioning level has remained at £750 for a number of years. A change in the petitioning level is perhaps well overdue. However, the Insolvency Service recently reviewed the number of winding up and bankruptcy petitions which had been issued. They found that the proposed change mentioned above would actually only effect 3% of all such petitions issued. Accordingly whilst a change in the petitioning level is a move in the right direction, it perhaps doesn’t have the impact which had been hoped for. One of a number of measures implemented by the current Government has been to allow businesses and individuals to enter into ‘time to pay’ arrangements with HM Revenue & Customs with regard to outstanding PAYE/NIC, VAT and corporation tax. According to figures recently released by HMRC, over 303,000 time to pay arrangements have been agreed since the launch of the scheme with a total value of £5.2 billion. Approximately £4 billion has been repaid to date leaving around £1.16 billion outstanding, which is under repayment schedules by participants in the scheme. Furthermore, 60% of time to pay arrangements are for a period of 3 months or less, and over 90% of the arrangements are adhered to. The current Government and HMRC in particular, have therefore played a huge part in ensuring that a large number of local businesses will survive during this recession. Whoever wins the election has clearly got a difficult job to do – I just hope their policies are good for the local economy. Such exclusivity provisions should be amended to ensure that exclusivity terminates well in advance of the termination of the contract if there are certain specified ‘events’, namely where the customer runs into financial difficulty or fails to make payment. A recent case in the Employment Appeal Tribunal (EAT), Bateman v Asda Stores, confirmed that an employer is permitted to make unilateral changes to contractual terms in line with the business needs, without the express consent of employees. The changes must be properly implemented and the employer must maintain their implied duty to maintain trust and confidence. In the EAT, Asda were thought to have acted properly in harmonising the terms and conditions of employment for a small proportion of staff that refused to agree to a new pay structure. Asda had carried out extensive consultation and most staff had voluntarily moved on to the new pay scheme. A provision in the staff handbook allowed Asda to ‘review, revise, amend or replace’ the contents of the handbook, some of which were contractual, and introduce new policies ‘to reflect the changing needs of the business’. The new electronic notes replace the traditional sick notes from doctors and become effective from 6th April. In the past, GP sick notes confirmed that an employee was unfit to work. Fit notes will shift the emphasis from sickness to fitness, allowing doctors to indicate whether an employee is capable of doing some work. The hope is that more people will stay in work, rather than drift into long-term sickness. Currently more than 2.6 million people are on incapacity benefit with sick leave and absence costing the economy an estimated £100bn a year. Lesley Walford, an Employment Solicitor with Dorset and New Forest law firm Ellis Jones Solicitors, said the new fit notes will allow doctors to suggest various options. These could include a phased return to work, altered hours, amended duties, workplace adaptations or another option. ‘There will be no option for a doctor to certify a patient as fit for work. This is because doctors do not have the necessary knowledge about an individual’s job role to be able to assess this,’ explained Lesley. ‘The onus will be very much on the employer to make a decision as to whether they can accommodate any changes to facilitate a return to work. ‘The present system is clear cut whereas the new fit notes will enable an employer to consider adjustments to secure the employee’s return sooner, rather than later. This will be a “win-win” situation for employer and employee alike.’ However, Lesley warned that employers who fail to take action as a result of suggestions made by an employee’s doctor could find it more difficult to defend disability discrimination claims. They could also face problems if ‘reasonable adjustments’ were not adopted to enable the employee to return to work. Lesley said, ‘My advice to employers is to give your sickness procedures a good spring clean to ensure you’re ready for the arrival of fit notes.’ Her recommendations include: b Employers should take the initiative when it comes to managing sickness absence and ensure good communication with sick employees. b Have a clear sickness policy, backed up by line manager training. b If necessary, refer the matter to an independent specialist, especially if dismissal is a possibility. Garden leave is routinely used by companies as a way of keeping staff who are leaving a job – through choice or otherwise – away from work during their notice period. This paid absence is used to ensure staff are not aware of commercially sensitive information which could be shared with a potential new employer. But practices could face action for sending employees on garden leave if their employment contracts do not include guidance on this. Mark Briegal, head of Ralli Partnership Law, said this breach of contract could have disastrous results. He added, ‘It is commonplace in businesses for departing staff to be put on garden leave but often employers act in haste, without checking out the employment law issues they could be facing. ‘Garden leave provisions must be written into partnership or LLP agreements to ensure businesses are protected from future actions. Putting a partner or member on garden leave without precautions in place is unlawful exclusion and can result in anything from a damages claim to a winding-up order.’ Briegal said extreme conclusions can be avoided if employers check their contracts from the outset. He added, ‘Garden leave is only an option if the employment contract makes reference to it. We have already worked on cases where a departing member has contested garden leave because it was not referred to in his contract. ‘Employers need to ensure they have relevant and accurately drafted clauses to cover all eventualities. Its success has been down to the hard work and determination of Managing Director Gary Fendley and his team. The TJ Group, which has customers ranging from bluechips to sole traders, will test the greener product in partnership with Yateley Industries, a social enterprise in north east Business Hampshire which turns waste cooking oil into greener fuel. Yateley Industries, a charity funded through the Department for Work and Pensions and local authorities, provides accommodation and employment at a 4.5acre community for the disabled in Yateley. It recently set up a £20,000 biodiesel plant, with waste oil collected from companies and organisations for free before being sold on as converted fuel to help fund the community’s operations. John Gosling, a Director at TJ, which employs 110 people, said, ‘With biodiesel currently cheaper than conventional diesel, we anticipate a 12% saving on fuel costs on our three recycling collection vans.’ opportunity for those who take early action to benefit from enhanced reputation, as well as cost savings through greater efficiency.’ Businesses will be able to establish whether they qualify for the scheme by recording details of their company structure in a CRC-ready format. To register for carbon counter organisations should visit www.carboncounter.co.uk Finding the Key to a Low Carbon Future Harnessing the UK’s abundant wind, tidal and wave resources could hold the key to tackling the UK’s energy crisis, as well as make a massive contribution to the economy with the creation of over 40,000 jobs, experts said recently in a report published by the Institution of Civil Engineers (ICE). The UK energy sector is facing a security of supply crisis. One third of our power plants are due to close by 2025, which equates to a loss of 30GW of energy. At the same time, we urgently need to decarbonise our energy supply to meet pressing environmental targets. ICE’s report Offshore Renewables: Unlocking the Potential says the rapid upscaling of offshore renewable resources, on a similar scale to that experienced by the North Sea oil and gas sector in the 60’s and 70’s, could provide the solution. The UK possesses some of the richest wave, tidal and wind resources in the world, with the potential to provide up to half of the UK’s current energy demands as well as create a major new industrial sector, with significant export potential. In January this year the third round of tenders for offshore wind sites was announced, representing over £100bn of private investment and 32 GW of projects. If achieved, these projects, combined with advances in wave and tidal energy generation, could contribute significantly to plugging the energy gap faced by the UK. However, ICE warns that to deliver on such a massive scale industry requires a secure commercial environment within which companies can invest with confidence. The wave of positivity surrounding the manufacturing sector in the region is reflected by outcomes of the South West Manufacturing Barometer, compiled by MAS-SW, which reveals that more than half those manufacturers surveyed either saw no change or an increase in their turnover in the past six months, with 81% expecting to see this figure continue to rise in the next six months. Order books also look healthy with 67 % seeing either no change or an increase since June 2009, and enquiry levels are also up by more than a third. Britannia Contracting, which has its headquarters in Poole and was established four years ago, has successfully pitched for almost £1m worth of work from Bournemouth’s biggest private landlord in recent months. Warning Check Your Lease Business owners could be liable for payment of rent long after they have vacated a property. That’s the warning from Adams & Remers solicitors, following a recent court ruling. The case of Newham v Van Staden has caused concern in legal circles because leases thought to be excluded from security of tenure provisions in the Landlord & Tenant Act 1954 might not in law be excluded afterall. The new ruling means that anyone who was a former tenant of a lease could remain liable for a ‘holding over’ period long after the original tenancy has been assigned to a third party. Therefore the former tenant may think his responsibility has ended at the end of the original lease so what they believe to be excluded leases should be checked. ‘This has widespread ramifications for any business owner that has owned a lease on their own or other properties,’ says Robin Illingworth, Managing Partner at Adams & Remers. ‘Basically, they could now find themselves liable to rent payments many months or years after they have vacated a property.’ The Van Staden ruling also means that businesses who have not spelled out this potential liability in their records could find themselves liable for misleading accounts. Robin Illingworth comments, ‘Our advice, following this case, is that businesses should seek legal guidance as soon as possible to confirm whether the Van Staden decision applies to any leases which they have formerly owned and “were excluded”. Otherwise, they may have a nasty shock when they get a big demand for back payment of rent for a property they no longer have anything to do with.’ Building Insurance Valuation It is important to ensure your buildings insurance is up to date and accurate especially in a fluctuating property market. If you are over insuring your property this will be money wasted since the insurers will only pay up to the current market value of the property using the ‘average’ clause in the policy. If you are under insured then your insurers will only pay up to the value of the sum insured which may be far lower than the current value of the property, potentially, leaving you with a large shortfall in the event of a total loss. Property values vary over time and can go down as well as up, and since the cost of building work also varies, especially in recessionary periods, it is possible, for example, that building reinstatement costs could be quite low for a property which has maintained or even increased its value; the insurance premiums need to reflect this. Building Insurance Valuation calculations are not straightforward. This is why it is important to maintain up to date and accurate valuations by qualified professionals to ensure piece of mind in the event of a claim. Presenter, Rick Jackson, had wished a listener luck for their driving test, then asked colleagues Kate Weston and Shaun Aquilina, ‘If we were to take our driving tests again would we pass?’ Listener and new driver instructor, Adam Parker, immediately picked up on the point and rang in with the challenge. Over the next few days, the trio had time to brush up on their driving skills and revisit the Highway Code, all the time talking about it on air with all the tension of a real driving test. When the day of the mock test arrived, the stakes were even higher, with the worst driver of the three losing the use of their car to get into work for a day. Wave 105 presenter, Rick Jackson, said, ‘Fortunately we all passed our tests, but it was pretty close as you are allowed a maximum of 15 minors before it becomes an instant fail. Kate and I got 13 minors each and Shaun got 15, so Shaun will have to get the train to work for a day! While we all had a bit of fun with this challenge it certainly highlighted that we’ve all picked up some bad driving habits.
