Preface
For more than 20 years, TKM has been an innovative supplier for system- and customer solutions
to European, German-speaking countries. It is especially the variety of products in the passive
network market, by which TKM is characterized. Production is made in Germany exclusively, so
that individual, technical solutions and variations can be developed, produced and delivered within
a very short time.
The huge product variety in this catalogue will show you that, besides standard products,
we also offer solutions suitable for special cases.

The company‘s core skills guarantee a very high technical standard for
products and service - as a benefit to the customers.
With the core skills in radio-technology, transmission requirements for
conducted networks are measured and recorded, and solution-oriented,
standardized constructions are elaborated.
The compilation of pcb-layouts is based on profound knowledge of datatransmission technology as well as the analogous and digital telephony.
The Product Managers‘ know-how in the field of connection method and
-technology regarding data and communication cables (for both copper
and optical fiber cables) cater for an easy and safe handling in practice.
By reason of the combination of these core skills and specialized staff
in both Development and Engineering, standard products according to
internationally valid standards and even special solutions arise. Whether it
is about standard products or special solutions - all products and services
by TKM have a high quality standard.
The idea of quality conjoins all levels of the company, which are oriented

Quality as a benefit to the customer
Today, the TKM GmbH belongs to the leading suppliers in the field of
„structured cabling“.
Today, the product lines: Distribution panels, wall outlets, terminating,
optical transmission systems as well as custom manufacturing are installed
in standardized networks according to EN 15173 and ISO/IEC 11801, in
what is known as office environment as well as data centers, but also in
industrial application, which are marked due to special requirements by the
ambient conditions (IP 44, IP 68).

have up to today decided to use TKM-supplies for their networks. In addition
to this, many customers distribute their products and offer their services
through numerous partners and traders in the market.
All products are subject to a steady quality process, in the stages of design
and production as well as delivery.
The company has been certified according to the ISO 9001: 2000 Quality
Management Standard for several years and will be re-certified according
to ISO 9001: 2000 in spring 2010.
The ROHS regulatory requirements as well as regulations of the environment
protection law have already been implemented at an early stage. For
instance, all production leftovers and litter are separately collected and
adequately recycled to the production process whenever possible (e. g.
plastics recycling).

General
15-year optiLAN-guarantee as a benefit to the customer
Due to the up-to-date, automated production as well as continuous,
electrical and optical quality inspections, an optimal production result of
all components aligned can be achieved. Construction of all products is
made in such a way that they are robust in their application and easy to
assemble, so that they can be utilized easily and time-efficiently. Yet it is
only this handling, by which the assured values of a whole system will be
reached. Thus, a professional installation by system-trained installation
companies assumed, a 15-year guarantee on the whole device will be
granted. This assures a high degree of investment protection.
The optiLAN guarantee bond
For all passive components and utilized resp. recommended installation
cables produced by TKM, a function guarantee of 15 years will be granted.
In case of tertiary cabling, the function guarantee comprises:
- Category characteristics according to EN 50173 resp.ISO/IEC 11801,
Class E or F
- The plug-in cycles checked out in the wear-area by the socket- and plugproducers
- The contact characteristics of the insulation-displacement connectors
- Link-performance according to the above-mentioned standard for the
tertiary area (copper cables are released by TKM).
In case of secondary and primary cabling:
- The Link-performances for the secondary and primary area (fiber-opticcables) are guaranteed through the cable characteristics warranted as well
as through the component suppliers
- Every single fiber is measured by a comprehensible and confirmed
measuring documentation and made available to the customer in a log.
The requirement for the optiLAN guarantee is a professional installation
(through verifiably trained specialists) according to the TKM assembly
instructions as well as the latest optiLAN regulation.

General
Investment protection as a benefit to the customer
With the optiLAN cabling system, customers receive a long-lasting
investment protection for their networks. This assures that the continuously
growing data rates and the consequently growing transmission rate can be
covered through existing network structures for 15 years. Already today, 1
Gigabit-Ethernet (1GBE) is no longer a rarity. New network structures
which are currently being produced, have to bear 10 GBE. And further
considerations in the IEEE already even aim for 40 GBE resp. 100GBE.
Allowing for these considerations and trends, TKM introduced the what is
called optiLAN cabling concept onto the market in 1994 already. What, at
that time, corresponded to the relevant, current standard of the classes D
(Category 5, 5e) and E (Category 6de) and corresponds to the draft standard
of the classes Ea (Category 6a) and F (Category 7) as a requirement today,
will, in future, be possible for the classes Fa (Category 7e, 8) and beyond.

This concept, based on a structured, universal cabling according to the
standards or draft standards valid today, caters for future-proof data and
communication networks due to the use of technically matured, passive
and shielded „category products“, i. e. with a high investment protection
- at an optimal price performance ratio.
Tertiary cabling
(Copper cables)
The high-shielded, easy-to-install RJ45 components developed by TKM
fulfill the requirements of the EN 50173, ISO/IEC 11801 standard as well
as all EIA/TIA 568 values and, due to power reserves, often even beyond.
When using standard terms and values which illustrate a draft state the
products utilized by TKM will at least be marked in the valid data sheets.
Already today, transmissions of 10GBE can be guaranteed in conjunction
with high-quality data cables (e. g. TKM DK10, 1000MHz).
Secondary and primary cabling
(Fiber optical cables)
All components correspond to the today‘s state of the art. The FO plug
components used and the FO cables of different brand suppliers are ideally
adapted to each other, so that the maximum lengths required due to the
DIN EN 50173 standard can be adhered to, with system reserves.

RJ-MOD CATEGORY 6 modular plug connector
The RJ-MOD modules by TKM can be fitted toolless and are employed in
structured communication networks according to ISO/IEC 11801:2002 resp.
DIN EN 50173-1:2007. The modules comply with the relevant Cat. 6 and Class
E requirements.
In connection with high-quality tertiary cables, the TKM modules enable a Class
Ea Channel-Link up to 500MHz with a 10 GBASE-T- transmission according to
the latest ISO/IEC11801 Amendment 1 resp. IEEE 802.3 draft standards.
MF-MOD DISTRIBUTION PANELS
The distribution panels are characterized by their easy installation resp. high
packing density (48x RJ-MOD – 1.5U).
KD-MOD Wall outlet / assembly frame
The wall outlets / assembly frames are characterized by their easy installation
resp. high packing density. A protective cover is integrated into the central washer
to ideally protect the relevant RJ45 sockets against environmental conditions.
System cables
The TKM-labeled installation cable as well as the factory-provided, terminated
trunk cables will guarantee you optimal transmission characteristics with high
system reserves and a fast, on-site assembly.

The GG45 modular connectors by TKM are installed in structured communication
networks according to ISO/IEC 11801:2002 resp. DIN EN 50173-1:2007. In
conjunction with high-quality tertiary cables, these connectors fulfill the relevant
requirements of Cat. 7 and Class F. Likewise, Class E and Class D –links can
reach RJ45 standard conformity by means of backward compatibility.

MF DISTRIBUTION PANELS
Through the various variants of distribution panels, MF distribution panel
(extensible), pass -through distribution panel with different packing density
(1U, ½ U, ½ 19“), we enable you to create a high-quality transmission line
conforming to standards in all environments, up to 4 Connector Link according
to ISO/IEC 11801:2002 resp. DIN EN 50173-1:2007. The use of the LSA-/SIDconnection technology facilitates an installation with standard tools.
Wall outlets
In conjunction with high-quality tertiary cables, TKM products allow for a Class
Ea Channel-Link up to 500MHz with a 10 GBASE-T - transmission according to
the latest ISO/IEC11801 Amendment 1 draft standards resp. IEEE 802.3. The
wall outlets are characterized by their easy installation and capability of being
integrated into all prevalent installation systems.
IP44 / IP67 wall outlets
The wall outlets are characterized by their robustness (DIN 18032) and keep
IP44 protection class at closed cover with plugged or unplugged patch-cord.
High protection classes (such as IP44) are, for example, applied in production
lines, schools, storage areas, laboratories, airports, etc.

RJ45 TELEPHONE DISTRIBUTION PANELS (CATEGORY 3)
The RJ45 unshielded distribution panels developed by TKM are used as
special cabling components for the telephone sub-distribution in structured
communication networks according to ISO / IEC 11801 resp. DIN EN 50173.
The base plate provides a good guidance and distribution of the cables. The
proven LSA connection technology guarantees an easy installation.
TK-MOD TELEPHONE DISTRIBUTION PANELS RJ 45
FOR AN EASY CONNECTION OF TELEPHONE SYSTEMS
The RJ45 modular telephone distribution panel developed by TKM is used for an
easy and quick connection of analogous and digital telephone systems (ISDN) via
50-pole champ cables (plug-and-play). Different module versions are available.
MODULAR DISTRIBUTION PANELS
The different TKM modular distribution panels (MMP - / top-hat rails - / SOV – VF) are
developed by TKM and enable you to create a high-quality transmission line
conforming to standards in all environments according to ISO/IEC 11801:2002

RJ45 patch-cords
The high-shielded RJ45 distribution and connection cables produced by
TKM are used in structured communications networks according to ISO/IEC
11801:2002 resp. DIN EN 50173-1: 2007. Their characteristics are described in
the ISO/IEC 61935-2 standard. The cables are highly flexible and the plugs are
safely fastened to the cable, due to an additional strain relief and overmold. The
plug-body overmold comes in six standard colors.

TKM FO patch-cords are individually produced and available in all lengths
desired, different colors and the usual fibers (multi mode (OM1/OM2/OM4) or
single mode). The cables are low-smoke according to IEC 61034 and halogenfree as well as flame-retardant according to IEC 60332-3. They come as simplex, duplex or the more resistant breakout cables. At TKM, the commercially
available FO plugs are terminated. Patch-cords can be produced as adapter
cables with any plug combination.
FO pigtails
Same as the patch-cords, the pigtails produced at TKM‘s correspond to the
TKM quality standards. As standard, an easily demountable 0.9 mm wire (semiloose tight tube) is used. Both length and plug type can be chosen as desired.
The wire‘s color depends on the fiber as standard:
- 62.5/125 (multi mode OM1): blue wire
- 50/125 (multi mode OM2): green wire
- 50/125 (multi mode OM3): turkey wire
- 50/125 (multi mode OM4): violet wire
- 9/125 (single mode): yellow wire
FO pigtail sets
The TKM pigtail sets consist of up to 12 pigtails produced by TKM. They are
splice-readily stripped, color-coded and stored in the TKM splice cassette.
Delivery includes splice cassette, splice-protection bracket (optionally for either
splice protector crimp or heat-shrink) as well as the relevant cassette cover. The
pigtail can be optionally supplied with or without the relevant splice-protection
elements.
As standard, the pigtails‘ total length is 2.5 m of which ca. 1 m is stripped. Further
lengths are also available.
The pigtail sets are available with all common FO plugs and fibers.
TKM quality plug termination
Plug termination, factory-made by qualified personnel strictly following
the plug processing instructions.Machine polish, multiple optical surfaceinspection of plugs at 400-fold magnification.
Random quality control of polish through interferometer.
Attenuation measurement of each plug and documentation in a measurement
report. Use of branded plugs with high-quality ceramic ferrules. Production at the
Mönchengladbach site exclusively. All this assures a consistent quality and a high
delivery flexibility.

TKM cable distributor
By the use of pre-terminated FO distribution cables, the installer will benefit from
cost and time savings on-site as well as high-quality terminated plugs. The FO
distributer is available for up to 144 fibers.
The TKM cable distributor provides a rugged breakout cable with 2.0 mm single
cables (yellow for single mode and orange for multi mode). The single cables are
gradually cascaded and numbered by cable markers.
The TKM distributor concept is mainly characterized by its defined and sealingcompound-free fiber feeding within the cable divider. Its solid construction protects
the plugs against mechanical strain and assures an IP 68 protection class. Both
breakout cable and plug are protected by a rugged, flexible tube with an integrated
insertion aid. The tube is fastened by a quick connector to facilitate its easy and
multiple removal and restringing. Naturally, the terminated plugs correspond to
the TKM quality standard. Each distributor is marked with a series No. and comes
with a measurement report.
TKM mini distributor
Primarily, the pre-terminated FO mini distributor cables are used at cable lengths
of up to 20m, where an on-site plug assembly is either impossible or unreasonable.
The FO mini distributor is applied when plugs are directly terminated to micro
cables with a very low outer diameter (e. g. 2.5mm with 12 fibers).
The highly compact mini distributor can be easily mounted by means of a
standardized mounting flange (dimensions comparable to a SC-simplex coupling).
For this purpose, there is a special fastening angle for the TKM distribution panels.
Furthermore, the product range is completed by relevant fiber-optic modules for
the different connector faces.
The 12 fibers within the micro cables are distributed in the mini distributor on
900µm wires. The differently colored loose buffer tubes correspond to a standard
FO color code. In regard to the customer‘s choice, fibers may be of equal length
or cascaded and equipped with plugs. In the TKM mini, the fibers themselves
stay free of any sealing compound and thus show a defined, free orientation.

TKM pass-through distribution panel
The TKM pass-through distribution panel with 1 U mainly stands out due to
its very low installation depth of 129 mm and is particularly suitable for preterminated cables. Thus, there are numerous fastening options. For current
couplings, these distribution panels can be supplied without splice option. Its
standard color is similar to RAL 7035.
TKM permanent installation distribution panel
The TKM permanent installation panel with an installation depth of ca.
240mm can be used both as splicing box as well as adapter panel for the TKM
distributors. The reverse is equipped with 2 cable inlets in which either cable
glands (PG16) or TKM distributors can be inserted as an option. Alternatively,
up to 4 splicing cassettes can be inserted into the panel to terminate up to 48
fibers. As a standard, the front plate is RAL 7035 and available for all current
couplings.
The permanent installation distribution panel can also be supplied as preterminated version. This means that pigtails have already been splice-readily
stripped and inserted with color markers into a splice cassette together with cover
and splice-protection bracket. The pre-terminated distribution panels come with
splice-protection as an option.
TKM drawer distribution panels
The sliding-out TKM distribution panel has an installation depth of ca. 300 mm.
The reverse is equipped with 4 cable inlets in which either cable glands (PG16) or
TKM distributors can be inserted as an option, same as the permanent installation
panel. Through a simple modification, two of these 4 cable inlets can be used as
angled inlet. Alternatively, up to 4 splicing cassettes can be inserted into the panel
to terminate up to 48 fibers. The easily replaceable front plate can be supplied
for all current FO couplings. The standard color of both housing and front plate
is similar to RAL 7035.
Same as the permanent installation distribution panel, the sliding-out distribution
panel is available as pre-terminated version.

TKM FO wall outlets multimode / singlemode
The simple, assembly-friendly FO wall box is used as a pure pass-through box
without splicing option. It can be integrated into the current installation systems.
As a standard, the central plate is RAL 9001. The relevant cover frame can be
supplied as an option.
Depending on coupling type and number of couplings, up to 4 fibers can be
connected. The FO box is available for the current FO couplings, e. g. SC/SC
duplex, LC/LC duplex, ST...
Basically, singlemode couplings have a ceramic sleeve.
As a standard, multimode couplings have a phosphor-bronze sleeve. Multimode
couplings with ceramic sleeves are also available by request.
Matching the FO box, a relevant assembly-friendly surface housing with an
appropriate cover frame can be supplied. The surface housing‘s dimensions are
80x80x40mm, the cover frame‘s 80x80x8mm. As a standard, the surface housing is
RAL 9001. Further colors also available by request.

Optical-fiber plug modules
The fiber-optic plug modules with a height of 3 U and a width of 7 HP or 8
HP are suitable for the FO rack system. Additionally, the 8 HP version can be
installed into the GF-AE.
The Eurocard-sized plug module consists of front plate, cassette holder, splice
cassette, excess-length cassette, splice-protection holder and cassette cover.
The plug modules are available completely pre-terminated with couplings and
pigtails. Here, pigtails including excess length are built into the plug module
splice-readily stripped.
The plug modules are available for all current plug faces.
The range is completed by the excess-length compartment, in which the
excess length of both loose-tube cable and bundle can be placed.
FO rack system and FO plug modules
The FO rack system with a height of 3 U, a width of 84 HP and a depth of
175 mm offers space for up to 12x 7 HP optical-fiber plug module. By this, up
to 144 fibers can be terminated. Due to the guide rails, the modules can be
easily assembled. As a safety measure, the modules can be screwed to the rack
system to avoid unintended extraction.

Splice-protection element
The Splice-protection element is used for protecting fiber-optic fusion spliceconnections. The unprotected splice lies within a permanently elastic mass
inside the splice element to protect it against environmental damages. When
properly used, the splice‘s damping will not be affected. The blister pack ensures
a safe transportation and a good protection of the splice-protection elements.
The splice-protection element can be processed in every customary, proper
press for crimp splice-protection. The splice-protection elements correspond to
the highest quality requirements and have been tested and approved according
to the technical specifications of the German Telecom (Deutsche Telekom),
TS0338/96.
FO splice cassette
The splice cassette, which has been tested by initial sample, is suitable
to store up to 12 fiber-optic splices. The splice cassette has four fiber
insertion areas, of which one is used as angled insertion. By means of
anti-torsion elements, several cassettes can be stacked. Besides the TKM
splice-protection bracket for crimp and heat shrink splice-protection, further
splice-protection brackets of other producers can be used to store the splice
elements. Installation can be made at two different positions by snapping
in. Due to spacious fiber bushing areas at the cassette‘s bottom, the splice
cassette can be applied in further fields.
FO splice-cassette cover
Matching the TKM splice-cassette, we offer the splice-cassette cover, which has
also been tested by initial sample. Latches ensure that the cover can be easily
and safely mounted to the cassette. The cover can be supplied in a shortened
version to match the TKM excess-length cassette.
As an option, the cover is labeled with a laser sign.
FO splice-protection bracket (for splice protector heat shrink)
To retain splice-protector heat shrink elements, we provide the TKM heat shrink
splice-protection bracket. This bracket safely stores up to 6 heat shrink spliceprotection elements with a diameter of 2.4mm. The splice-protection bracket itself
is also safely fastened as it snaps into the TKM cassette and can thus be easily
assembled.

General Conditions for the supply of products
and services of the TKM GmbH
I. Scope of supplies or services
1. The scope of supplies or services shall be determined by the mutual written declarations. If
a contract is concluded without submission of such mutual undertakings, then either the written
order confirmation of the supplier or service provider (hereinafter: the Supplier), or if none has
been issued, the written order of the Purchaser shall be decisive.
2. Protective devices shall be included in the delivery to the extent prescribed by law or expressly agreed.
3. The provisions of the Association of German Electrical Engineers shall apply to all supplies
and services insofar as they are relevant for the safety of the supplies or services. Variations are
permitted provided that equivalent safety is guaranteed in another form.
4. The Supplier herewith reserves any industrial property rights and/or copyrights pertaining to
its cost estimates, drawings and other documents. The documents shall not be made
accessible to third parties without the Supplier’s prior consent. Drawings and other documents
pertaining to quotations must be handed back on request without delay, if the contract is not
awarded to the Supplier. Sentences 1 and 2 shall apply mutatis mutandis to the Purchaser’s documents; these may, however, be made accessible to those third parties to whom the Supplier
has rightfully subcontracted supplies or services.
5. Collateral agreements are only valid if confirmed in writing.
II. Price
Prices shall be deemed ex works excluding packaging in case of delivery or erection or
assembly.
III. Retention of title
Title of all goods is retained by Supplier until each and every claim of Supplier against the
Purchaser originating in the business relations has been duly satisfied. Until then, the Purchaser
may not pledge the retained goods or use them as security, and resale shall be possible only for
resellers in the ordinary course of their business and only on condition that the reseller receives
payment from its customer.
Any intervention expenses which may arise shall be born by the Purchaser. In so far as the
value of all security rights to which the Supplier is entitled according to Sentence 1 exceeds the
sum of all secured claims by more than 25 %, the Supplier shall release a corresponding portion
of the security rights at the Purchaser‘s request.
V. Terms of payment
1. Payments are payable free of any charges to the Supplier‘s paying agent.
2. The Purchaser may set off only those claims that are undisputed or against which no legal
recourse is possible.
V. Time for supplies or services
1. With respect to the time limits for supplies or performance of services, the mutual written
statements shall be decisive. Article I, 1, Sentence 2 applies accordingly. Observance of the
time limit premises the receipt, in due time, of all documents to be furnished by the Purchaser,
including any requisite authorizations and licenses, releases, timely clarification and approval of
plans, observance of the agreed terms of payment and fulfillment of other obligations.
If these pre-requisites are not met in due time, the time limit shall be extended by a reasonable
period of time.
2. The delivery time is met:
a) In case of delivery without assembly or erection, if the operational goods have been dispatched or collected within the agreed delivery or performance time limit. If the delivery is delayed
owing to reasons for which the Purchaser is responsible, then the timeframe shall be considered
to have been met if the Supplier makes notification of readiness for delivery within the agreed
timeframe.
b) In case of delivery including assembly or erection, as soon as this has been realized within
the agreed time limit.
3. If any failure to observe the time limit for supplies or performance of services can be proven
to have been caused by mobilization, war, riot, strike, lockout or the occurrence of unforeseeable hindrances, the time limit will be extended accordingly.
In the case of any failure to observe a time limit for reasons other than those specified under
Section 3, para. 1, the Purchaser can, providing he can establish the probable validity of his
claim, demand compensation for default for each completed week of the delay of between 0.5%
and 5% of the value of that part of the supplies or services, which could not be put into useful
operation due to individual constituent components thereof not being completed on time.

Claims for compensation on the part of the Purchaser in excess of the 5% limit specified in
paragraph 2 are excluded in all cases of late delivery, also if a period of grace granted to the
Supplier has lapsed. This shall not apply in cases of mandatory liability for intent or gross
negligence.
The Purchaser‘s right to cancellation upon futile expiration of time extensions granted to the
Supplier remains unaffected.
4. If dispatch or delivery is delayed at the wish of the Purchaser, the Purchaser may be charged
for storage at a rate of 0.5% of the invoiced amount for each month begun, beginning one
month after notification of readiness for dispatch; the storage charges are capped at 5%, unless
higher charges can be provably justified.
VI. Passing of risk
The risk shall pass over to the Purchaser even if carriage paid delivery has been agreed upon:
a) In case of delivery without erection or assembly, if the consignment in operational condition
has been dispatched or collected. Packaging shall be performed with utmost care. Dispatch
shall be effected at the Supplier‘s best discretion. At the request and at the costs of the
Purchaser, the consignment shall be insured against breakage, transport and fire damage by
the Supplier.
b) In case of delivery with erection or assembly, on the day of takeover in the Purchaser‘s own
facility; insofar as test operations has been agreed, after a faultless test operation. This applies
on the condition that test operations and/or start-up take place immediately after operational
assembly or erection. If the Purchaser declines the offer of test operations or start-up, the risk
shall transfer to the Purchaser for the period of the delay when 14 days have lapsed since this
offer.
c) If the dispatch, delivery or the commencement or realization of assembly or erection is delayed upon the request of the Purchaser or also for reasons for which it is responsible, the risk for
the period of the delay shall transfer to the Purchaser; however, the Supplier is obliged upon the
request and for account of the Purchaser to arrange the insurance coverage it demands.
VII. Assembly and erection
A.
Unless otherwise agreed in writing, the following terms and conditions shall apply for all types of
assembly and erection:
a) The Purchaser shall provide at its own expense and in good time;
1. Auxiliary teams such as general labor and, if required, bricklayers, carpenters, fitters, crane
operators, other skilled workers together with the tools they require in the requisite number,
2. All earthworks, bedding work, construction, lifting, scaffolding, plastering, painting and other
unrelated subsidiary work, including any construction materials required,
3. The equipment and materials necessary for assembly and commissioning such as construction wood, chocks, underlays, cement, cleaning and sealing agents, lubricants, fuels etc.; also
scaffolds, lifting equipment and other devices,
4. Energy and water at the point of use including necessary connections, heating and general
lighting,
5. Suitable dry and lockable rooms of sufficient size adjacent to the site for the storage of
machine parts, apparatus, materials, tools, etc. and adequate working and recreation rooms for
the erection team, including sanitary facilities as are appropriate in the specific circumstances;
furthermore, the Purchaser shall take all measures it would take for the protection of its own
possessions to protect the possessions of the Supplier and of the erection team at the site,
6. Protective clothing and protective devices needed due to particular conditions prevailing on
the specific site and which are not customary in the Supplier’s trade.
b) Before the erection work starts, the Purchaser shall unsolicitedly make available any information required concerning the location of concealed electric power, gas and water lines or of
similar installations as well as the necessary structural data.
c) Before erection or assembly starts, all supply parts required for the start of works must be on
site and all bricklaying, carpentry and other preparatory works be sufficiently advanced before
erection starts that the erection or assembly can begin immediately following the arrival of the
installation or assembly team and continue without interruption. In particular, the approach
routes and the assembly or erection site must already have been levelled off and cleared, the
foundation walling must be set and dry, the foundation walls must be trued and back-filled, in
case of indoor installation the walls and ceiling must be fully plastered and doors and windows
fitted.
The Purchaser may demand payment of compensation for default also when the circumstances
referred to under Section 3, para. 1 occur after the originally agreed time limit has already been
overstepped.

d) If the erection, assembly or commissioning is delayed by circumstances, particularly on the
construction site, without the Supplier being at fault (creditor delay), the Purchaser has to bear
to an appropriate extent the cost of waiting time and additional journeys of the installation or
assembly team.
e) The Purchaser shall certify the installation or assembly team work time weekly according to
the best of its knowledge. Furthermore, the Purchaser is obliged to issue the assembly team
with written confirmation of the completion of the assembly or erection work without undue
delay.
f) The Supplier shall not be liable for the work carried out by his installation and assembly team
and other vicarious agents if such work is not carried out in conjunction with the actual delivery
and assembly or erection or if such work is instructed by the Purchaser.
B.
If the Supplier has accepted the assembly or erection against individual calculation, the following terms shall apply in addition to the terms set down under A:
1. The Purchaser shall credit the Supplier the cost rates agreed at order placement for hours
worked and additional pay/bonuses for overtime, night work, work performed on Sundays and
public holidays, for work carried out under difficult or exacting circumstances as well as for
planning and supervision.
2. In addition, the following costs will be remunerated separately:
a) Travel costs, and tool and personal luggage transport costs;
b) Daily allowances for working time as well as for rest days and public holidays.
VIII. Receiving supplies
1. The supplied objects shall be accepted by the Purchaser, even if they should show any
insignificant defects.
2. Partial deliveries shall be permissible.
IX. Liability for defects
For defects, which shall include the absence of guaranteed properties as well, the Supplier shall
be liable as follows:
1. All parts or services, which, irrespective of the duration of operation, become unfit for use
or become significantly restricted in their use within 12 months from the day of transfer of risk
due to a circumstance, which existed prior to the transfer of risk, especially due to defective
construction, poor materials or defective workmanship, shall be repaired or redelivered or, in the
case of services, provided again at Supplier‘s choice. Any ascertainment of such defects must
be reported to the Supplier in writing without undue delay.
2. The Purchaser shall observe the contractual obligations it is obliged to fulfill, especially the
agreed terms of payment. If a claim is made in respect of a defect, the Purchaser shall have
the right to withhold payment of an amount which is commensurate with the defects which have
appeared. However, if the contract is incidental to the operation of its trade, the Purchaser shall
only withhold payments if a claim is made in respect of a defect, which is justified beyond any
doubt.
3. The Purchaser must grant the Supplier the time and opportunity that is required in its fair
judgment for the rectification of the defects. Should the Purchaser refuse, then the Supplier shall
be released from its liability for defects.
4. If the Supplier allows an appropriate period of grace to lapse without removing the defect,
the Purchaser shall have the right to demand rescission of the contract (redhibitory action) or
reduction in price.
5. The right of the Purchaser to make claims for defects shall fall under the statute of limitations
in all cases 12 months after a claim is made in respect of a defect. If no settlement is reached
within this period, the Supplier and the Purchaser can agree on an extension of the period of
limitation.

7. Any improper alterations and corrective maintenance performed by the Purchaser or by a
third party shall reverse liability for any consequences thereof.
8. The warranty period is 3 months for rectification of defects and 6 months for compensation/
replacement supplies or services. The said shall last at least to the lapse of the original warranty
period for supplies or services provided. The period of liability for defects shall extend by the
period of any business interruption occasioned by the essential removal of defects, compensation/replacement supplies and services, for those components which cannot be usefully operated
due to the interruption.
9. The terms regarding warranty periods set down in Sections 1, 5 and 8 shall not apply if longer
periods are mandatory according to law.
10. All further claims made by the customer against the supplier and his official representatives
are excluded, in particular claims for compensation in respect of damage not arising in or on the
object supplied. The said shall not apply in case of personal injury or damage to privately used
objects in keeping with the German Product Liability Act or in case liability is prescribed by law
for intent, gross negligence or the absence of guaranteed properties.
11. Sections 1 to 10 apply as appropriate to claims by the Purchaser for remedying, replacement deliveries or compensation arising from suggestions or advices within the framework of
the contract or the breach of ancillary contractual obligations.
X. Impossibility of performance, adaptation of contract
1. If the delivery or service incumbent on the Supplier or Purchaser proves impossible, the
general rules of law shall apply subject to the following requirement:
If such impossibility is the fault of the Supplier, the Purchaser shall be entitled to claim compensation. The Purchaser‘s claim for damages shall, however, be limited to an amount of 10 %
of the value of the part of the supplies or services which, owing to the impossibility, cannot be
put to the intended use. Purchaser’s claims for compensation exceeding the mentioned limit of
10 % shall be excluded. This shall not apply in cases of mandatory liability for intent or gross
negligence. The Purchaser‘s right to cancel the contract shall remain unaffected.
2. Should unforeseen events in the context of V., Section 3, para. 1 considerably change the
economic significance or the content of the delivery or have a considerable impact on the
Supplier‘s operations, the contract shall be adjusted accordingly, provided that this is compliant
with the principles of good faith. Where doing so is economically unreasonable, the Supplier
shall have the right to cancel the contract. If the Supplier intends to exercise its right to cancel
the contract, it shall notify the Purchaser thereof without undue delay after having realized the
repercussions of the event; this shall also apply even where an extension of the delivery period
had previously been agreed with the Purchaser.
XI. Other claims for damages
Claims for compensation asserted by the Purchaser arising from a positive breach of claims,
from any breach of obligations during contractual negotiations and from any tortious act are
excluded. This shall not apply if, for example, in the case of bodily injury or losses to private
property, liability is mandatory according to the Product Liability Act, or in cases involving intent
or gross negligence. This limitation of liability shall apply for the Purchaser correspondingly.
XII. Venue
1. If the Purchaser is a registered merchant under German law, the courts with jurisdiction and
venue either at the Registered Office or branch of the Supplier at the discretion of the Supplier
shall have exclusive jurisdiction and venue over all disputes arising indirectly or directly from the
contractual relationship.
2. Contractual relations shall be governed by German law.
XIII. Severability Clause
The legal invalidity of one or more provisions of this contract shall in no way affect the validity of
the remaining provisions. This shall not apply if it would be unreasonable for one of the parties
to continue the contract.
6. Liability for defects shall not apply for natural wear and tear and also not to losses or damage
caused after the transfer of risk due to incorrect or negligent handling, excessive strain,
inappropriate means of operation, defective construction work, unsuitable foundation soil and
any such chemical, electrochemical or electrical influences, which are not premised under the
contract.
