No mater what your beliefs, I hope you are able to spend time with family and friends. I would like to thank those mem- Wayne Gregan bers who took the time to vote at the November General Membership Meeting. I would also like to go on record as saying these participants now have the right to complain since you participated; however, I would appreciate it if you picked easy topics!! SALES TAX changes as of January 01, 2015 – ARE YOU READY?! As if contractors and suppliers don’t have enough challenges already, our state government has given us one hurdle. Starting January 2015, we will be affected by the changes to Transaction Privilege Tax (TPT). The question some of us are asking is, “Do I even need to have a TPT license?” To help clarify, I have copied two questions from the “ARIZONA TRANSACTION President continued on page 4 www.saca-az.org December 2014 Another SACA Charity Golf Classic in the bag! The Annual SACA Charity Golf Classic was held again this year on Friday, November 7, at Pueblo Del Sol Country Club. The tournament is an enjoyable way for our members and non-members to help support the causes that are important to SACA, our membership, and the community. The tournament is a four-man scramble and awards prizes for both gross and net golf scores, which allows golfers of all levels the opportunity to be in the hunt for a win. We would like to congratulate this year’s winners for Gross Score: Chad Waits, Tom Kennedy, Trace Nuttall, and Jonas Mentjox; and this year’s winners for Net Score: Wesley Cassiere, JB McKenna, Terry Spencer, and Ed Anderson. Other prizes are awarded for Closest to the Pin on par 3’s and the Longest Drive on the Long Drive Challenge Hole. Unfortunately, no one was able to make a hole-in-one and win one of the great vehicles sponsored by Lawley Chevrolet and Donovan Dodge, but it was exciting for all to try. The volunteers, sponsors and participants all make it possible for SACA to raise funds for charitable contributions in the year following the tournament. In spite of the current economic climate this year, we were able to raise over $5,000 which will be distributed to selected charities in 2015. This past year, SACA gave to organizations such as The Good Neighbor Alliance, Honor Flight, The Special Olympics, and both Buena and Tombstone High Schools’ Project Graduations. There could be no tournament without our great sponsors. Who is required to obtain a TPT license under the prime contracting classification? A2. Prime contractors must obtain TPT licenses and are subject to TPT under the prime contracting classification. A prime contractor is a person who performs, coordinates, or supervises modification work, including contracting with any subcontractors. The prime contractor is the person responsible for the completion of the contract. A prime contractor is subject to prime contracting TPT, regardless of whether the contractor furnishes only labor or both labor and materials in the performance of modification work. Q3. After you read these two questions/ answers, you would think it is cut and dried as to whether or not you need to have a TPT license; but THINK AGAIN! The notice’s information in its entirety makes it very clear that this will be a challenge for most and a nightmare for a few. Separating replacement work from modified work and knowing when to apply the “de minimis test” when applicable is going to add excitement to all our lives. SACA has posted a link to the “ARIZONA TRANSACTION PRIVILEGE TAX NOTICE dated November 18, 2014 (TPN 14-1) on the website if you would like to read all of this document. In case anyone is interested, we are trying to get a seminar for our members to better help understand the changes and which changes apply to who. Although it would be beneficial to have it before January 01, 2015 I doubt we will be able to pull it off. Establishments located in states that operate their own safety and health programs (State Plan States) should check with their state plan for the implementation date of the new requirements. OSHA encourages the states to implement the new coverage provisions on 1/1/ 2015, but some may not be able to meet this tight deadline. The final rule will allow OSHA to focus its efforts more effectively to prevent fatalities and serious work-related injuries and illnesses. The final rule will also improve access by employers, employees, researchers and the public to information about workplace safety and health and increase their ability to identify and abate serious hazards.” As posted on the OSHA Website. Changes to reporting: What needs to be reported to OSHA OSHA’s updated recordkeeping rule expands the list of severe injuries that employers must report to OSHA. As of January 1, 2015, all employers must report 1. All work-related fatalities within 8 hours. 2. All work-related in-patient hospitalizations, all amputations and all losses of an eye within 24 hours. You can report to OSHA by: 1. Only fatalities occurring within 30 days of the work-related incident must be reported to OSHA. Further, for an in-patient hospitalization, amputation or loss of an eye, these incidents must be reported to OSHA only if they occur within 24 hours of the work-related incident. Changes in Record Keeping Requirements: OSHA regulations require certain employers to routinely keep records of serious employee injuries and illnesses. However, there are two Construction News & Views OSHA has changed its procedure on a couple of reporting and record keeping processes. “First, the rule updates the list of industries that are exempt from the requirement to routinely keep OSHA injury and illness records, due to relatively low occupational injury and illness rates. The previous list of industries was based on the old Standard Industrial Classification (SIC) system and injury and illness data from the Bureau of Labor Statistics (BLS) from 1996, 1997, and 1998. The new list of industries that are exempt from routinely keeping OSHA injury and illness records is based on the North American Industry Classification System (NAICS) and injury and illness data from the Bureau of Labor Statistics (BLS) from 2007, 2008, and 2009. Note: The new rule retains the exemption for any employer with ten or fewer employees, regardless of their industry classification, from the requirement to routinely keep records. Second, the rule expands the list of severe work-related injuries that all covered employers must report to OSHA. The revised rule retains the current requirement to report all workrelated fatalities within 8 hours and adds the requirement to report all work-related in-patient hospitalizations, amputations and loss of an eye within 24 hours to OSHA. Fortunately, living in the southwest U.S. allows us many sun-filled days and few lost days of work due to poor weather conditions. Although a day or two of rain or snow may interrupt productivity, those dependent on the climate, such as ranchers and farmers, closely follow past trends and predictions. One program that provides this information is the University of Arizona’s Climate Assessment for the Southwest (CLIMAS). Although the mission of CLIMAS is to improve the region’s ability to respond to climatic events, the information is helpful to everyone interested in knowing how our weather behaves and what to expect. On the third Thursday of each month, CLIMAS publishes the Southwest Climate Outlook (climas.arizona.edu/ swco), which provides a summary of the previous month’s climate conditions, and a glimpse into the future. Here is their summary for the southwest region published November 20, 2014. Precipitation: Little precipitation fell in Arizona from mid-October to mid-November following the official end of the monsoon on September 30. New Mexico recorded some precipitation of note, mainly in the southeastern corner and in scattered pockets of the central and north-central parts of the state. This is a marked change from monsoon precipitation and the substantial contributions made by the incursions of tropical storms, but this drop-off in rainfall is typical for this time of year; November joins April as one of the driest months for the region. Temperature: Most of Arizona and New Mexico were warmer than average in the past 30 days, a pattern that was consistent across much of the Southwest. The cold front that brought winter weather to much of the U.S. in mid-November also stretched into the region, but with limited effect and primarily in portions of eastern and southeastern New Mexico. There was a shift towards colder temperatures across the region in the last few days (at time of publication), and while the air feels colder given the previously above average temperatures, the temperatures are close to historical averages. Snowpack: Sporadic early winter precipitation resulted in below to aboveaverage snowpack levels across the region. It remains to be seen how much of this early season snowpack will remain, and an above-average snowpack is needed this winter to improve storage in the Upper Colorado and Rio Grande basins. Water Supply: In October, total reservoir storage was 46 percent (compared to 47 percent last year) in Arizona, while total reservoir storage was 22 percent (compared to 21 percent last year) in New Mexico. Drought: Above-average monsoon precipitation and an active Pacific hurricane season provided some shortterm drought relief in the Southwest. Long-term drought relief was limited by the inconsistency of precipitation coverage and the runoff and evaporation associated with high-intensity precipitation events. The likelihood of an El Niño event continues to offer hope for additional drought relief, as these events are typically associated with increased winter precipitation in the region. Precipitation Forecasts: The NOAA-Climate Prediction Center is calling for elevated chances for aboveaverage precipitation through the winter and into early spring. These predictions are thought to be picking up on both the possibility of an El Niño event this winter and the impact of the Pacific Decadal Oscillation. Temperature Forecasts: The NOAA-Climate Prediction Center temperature forecasts are split across the region, with elevated chances for above-average temperatures along the West Coast, extending eastward into Arizona, and with increased chances for below-average temperatures along the Gulf Coast into New Mexico.
