Minutes of the regular meeting of the Kaysville City Council, held January
6, 1941, at the Kaysville City Council Chambers. Minutes of the meeting held December 30,
1940, were read and approved,
Members present: Mayor Thornley K, Swan; Councilmen : Spencer J, Barton, J, J,
Bowman, B. O. Broug)1, Newell V, Sanders, J, Clifton Linford,
Mayor Swan reported he was unable to find information on Highland Ditch Company
but would try by next meeting.
Councilman Sanders spoke of the delinquent accounts, and recommended that delinquent accounts be cut off as stated in ordinance on electrical accounts, Councilman
Bowman moved that the Electric and Finance collllll1ttee 1 s recommendations be accepted,
seconded by Councilman Barton; unanimously carried.
No report was made on Streets and Highways business,
Mr, Brough made no report on Water and Fire business,
Mr. Bowman r~ported old cemetery lot belonging to Mr. John Thornley, John
Thornley and William • Thornley had paid perpetual maintenance on it, Motion was
made by Councilman Barton that this be accepted; seconded by Councilman Sanders;
unanimously carried,

Councilman Linford moved that the Council approve the action of the cemetery
committee in refusing a loan of $1,200.00 to Ralph Jones from Perpetual Maintenance
fund, seconded by Councilman Barton; unanimously carried,
Mr, Sanders moved that the Council arnmend the city ordinance so license
on bowling alleys and pool tables will be $10.00, and that the ordinance be published
in the Weekly Reflex, Thursday, January 9, 1941;

Mr. Harvey reported that Davis county and W.P,A. want an easement for
Kaysville city gr.a vel ground and fence be moved on mountain road, Mr, Samders
moved that the fence be left where it is; seconded by Councilman Brough; unanimously carried,
Councilman
Barton reported sewer connections would be investigated firther,
Mr, Harvey reported he would like to connect Clifford Green's new home on
the Dirk Koldewyn sewer connection.
The Sanitation committee was instructed to talre up case of people leaving
garbage and garbage cans in streets.
Delinquent accounts were discussed,
Mr. Robins reported he would like to take a row of old boxelder trees
on east of cemetery out, Mr. Sanders moved that said trees be removed as soon as
weather would permit; seconded by Mr, Brough; unanimously carried,

1941, at the Kaysville City Council Chambers. Minutes of the meeting held January 20,
1941, were read and approved.

Howard Thomas met with the Council r egardlrg the removal of marble machine
from his place of business.
Dr. D. K, Barnes met with ta Council regarding bond election. Mr. Cooper and Mr,
Robinson of the Business Accounts Firm talked on the bond election and ways of taking
care of and paying off bonds, The auditor's report for 1940 was approved.
Walter Buhler met with the Council regarding hie being in the city limit, and
asked for a refund on the amount charged him for water and water meter. The matter was
left to the Water and Finance committee to dispose of.
Ray Harvey was authorized to make a study of how to measure water from the
city springs and report back to the Council.
No report was made on sewer and sanitation business.
Councilman Sanders moved that Orlando Bo"Wlllan be authorized to offer anticipated city bonds at 2~% to state land board or anyone else; seconded by Councilman
Brough; unanimously carried.
Councilman Sanders moved that the Council pay the State Municipal dues of
$40.00; seconded by Councilman Linford; unanimously carried.

City prepare a hand bill explaining the bond issue as soon as possible. Mr. Bowman
seconded the motion, which was unan1mibusly carried,

left to the Finance Committee to investigate.
The matter was
Miriam Barnes and Cynthia Layton met with the Council asking the City to
cooperate with the Daughters of Pioneers in fixing up the old Wienell N.ill site. The
first flour mill in Utah,
The James Ball and Albert Barton abstracts 0n property mortgaged to City was
discussed by Orlando Bowman.
Selling of bonds was discussed,
from Business Accounts Firm,
Orlando Bowman was given schedules on bonds
Zoning ordinance and renaming streets in Kaysville was discussed.
Councilman Bowman moved that tre Mayor write the Western Machinery Company,
asking them to investigate the city sewer without cost to city; seconded bf Councilman
Brough; unanimously carried,

Mayor Swan reported that the forestry department asks $42,24 annually to
patrol city property near forest reserve. Mr, Bowman moved that the mayor be authorized to enter into agreement with Forestry department; seconded by Councilman Brough;
unanimously carried,
Councilman Bowman reported cemetery roads badly in need of repair.
Ralph Jones asks loan of $825,00 on Jones home. Councilman Brough moved that
the matter be left to Councilmen Bowman and Sanders to investigate and report,
Councilman Bowman reported that more time was requested on housing project.
Ray Harvey discussed enlarging small pipe lines to Fred Larkins and Emil
Whitesides homes, also lines north of city limit, also the line to R, Ashton's home,
Councilman Brough moved that Ray Harvey be authorised to get as much of project money
from W.P.A as possible and proceed with above projects. Mr. Linford seconded the
motion, which was unanimously carried.

Wayne Sheffield met with the Council, asking that Kaysville City give
him the old fire truck building for wrecking said building.
Councilman Brough moved that the mayor be authorized to sign the James Ball
agreement of extension on note; seconded by Councilman Sanders; unanimously carried,
Councilman Brough moved that the mayor be authorized to sign the Albert B.
Barton agreement of extension on note; seconded by Bouncilman Sanders; unanimously
carried,
Bonds for municipal building were discussed, Mr. Bowman moved that Orlando
Bowman be authorized to investigate and see if bonds could be made redeemable; seconded by
Councilman Linford; unanimously carried.
Orlando Bowman presented a plan drawn by Ole Layton asking the city to make

R. N, Kilfoyle met with the Council asking if the city 1Y0uld allow the American
Legion to use the City build1ng--the Legion will a:ntribute the money they receive from
county (if they do receive any) to the City. The matter of the old city building was
left to Mr. Bowman and Mr. Sanders to investigate and report to Council.
Earl Tall and Howard Thomas met with the Council regarding the buying of their
property.
Walter Buehler met with the Council regarding water service, The matter was
left for the present 121lt11 W.P.A, project can be obtained. Also about cemetery hay land,
Mr, Sanders moved that the matter be left to Mr. Bowman and Mr. Linford; seconded by
Councilman Bowman made motion that the recomCouncilman Brough.( unanimousl-y" carried.

Mr. Snyder of Wasatch Chemical Compar y met with the Council regarding
treating cemetery lawns for night crawlers, He suggested from five to fifteen
pounds of arsenic of lead to 1,000 sq, rt. would require 2,178 pounds at 13¢ a pound.
Councilman Brough moved that the matter be referred to the Cemetery Committee with
power to act. Mr. Barton seconded the motion, which was unanimously carried.

Earl Tall am Howard Thomae met with the Council regarding the purchase of their
. Weldon Hayes met with the Council regarding new building he intends to erect-a care. Mr. Bowman moved that the application of Mr. Hayes to operate a cafe and beer
parlor be accepted, providing beer is not sold after eleven o'clo ck; sec01ded by
Councilman Sanders; unanimously carried.
Dr. Barnes met with the Council, stating he has investigated the increase in
population at Hill Field, stating Kaysville will get their share of buildings here--also
the State sanitation committee will cooperate, Councilman Bowman moved that this be referred to committee on sanitationJ seconded by Councilman Sanders; unanimously carried,
Mayor Swan appointed Ray Harvey as City building inspector, and Councilman
Bowman moved the appointaent be approved. Motion was seconded and carried,
Councilman Br91lgh moved that a $1.00 filing fee be charged for a building
permit; seconded by Councilman Linford; unanimously carried.
Councilman Sanders moved that Amos Odd, Henry Graham, George W. Barnes,
Keith Barnes and Stewart Bonnemort be appointed on building commission to serve
without pay, Amos Odd being named chairman; seconded by Councilman Brough; carried
unanimously,
Mr, Bowman recommended that the city accept $125,00 perpetual maintenance
from Walter Cottrell on old Cottrell cemetery lot, Councilman Sanders moved that
Mr. Bowman's recommendation be approved; seconded by Councilman Linford; unanimously
carried.
Mr. Bowman recommended that halt of the Patillo cemetery lot be deeded to
Mrs. William Bethel; Councilman Sanders moved that Mr. Bowman' a recammendation be
approved; secaided by Councilman Brough; unanimously carried.
Mr. Brough reported that Ralph Springer wants surplus water from spring.
Ray Harvey reported water was only surplus in the spring and we may lose our water
right to it if we let him use it, and may also lose right to enlarge pipeline at a
future date.
Councilman Brough moved that the city bdy 150 feet of 2i-inch fire hose and
50 teet of l!-inch fire hose; seconded by Councilman Bowman; unanimously carried.
Councilman Sanders moved that Mayor Swan send Earl Tall and Howard Thomas
a letter referring to property on main street, stating Mr, Tall could e~pect not less
thll'l $3,000.00 for his property, and Mr, Thomas not less than $1,500 for his land;
seconded by Councilman Linford; unanimously carried.

Charles Heywood met with the Council regarding his light, water and sewer,
asking for l~ reduction on hie bill and one-half of tenants' sewer bill, and he
would settle his bill. The matter was discussed. Councilman Bowman moved that the
lllQtter be referred to the finance committee; seconded by Councilman Linford, unanimously
carried.
Earl Tall met with the Council asking hov1 fer north the new lighting system
would extend. Mayor Swan advised Mr, iall they w~ld extend to north side of Joseph
Galbraith property on account of change in State road,

Councilman Bowman moved that the recorder write John Pet.e rson sayirig the
city will allow no claim for pipe, and if he has a claim against city tor collecting,
if be will present same, city will consider it; seconded by Councilman Brough; carried
unanimously.
Councilman Barton recommended that Amos Odd 1 s sewer bill be out in half, because of trouble and expense on account of defect in sewer line. Councilman Sanders
moved that the Council accept Mr. Barton's recommendation; seconded by Councilman
Brough; unanimously carried.
Councilman Bowman moved that the city adopt supplemental property standards
and minimum Ca'lstruction requirements by Federal Housing administration; seconded by
Councilman Sanders; unanimously carried.
Councilman Sanders moved that general clean-up week be left to Mr. Barton to
decide when; seconded by Councilman Bowman; unanimously carried.
Councilman Sanders moved that the straightening of the road on Second North
be left to the road commission; seconded by Co,uncilman Brough; unanimously carried.
Dr. Barnes met with the Council, suggesting that the city make restrictions
for transient fruit pickers camping on city grounds. The matter was left with the
committees on Sanitation and Water.
Councilman Bowman recommended that the old Woolsey cemetery lot be deeded to
J. R., Woolsey for the Perpetual Maintenance; seconded by Councilman Linford; unanimously carried,
Councilman Bowman recommended that the city loan $25,000.00 cemetery perpetual
maintenance money to Van Sanders to buy land. He furnished abstracts to be examined
by the Council. Six per cent to be the interest. Councilman Linford moved that the
Council accept Mr. Bowman's recommendation; seconded by Councilman Barton; carried
unanimously,

The matter was left to Mr. Bowman to investigate,
Councilman Sanders moved that Ray Harvey be authorized to apply to the Stat~ to
change the diversion point of water from Weaver spring; seoonded by Councilman Brough;

The matter of appointing new City Marshal was disoussed,

Minutes of the regular meeting of the Kaysville City Council, held April 21,
1941, at the Kaysville City Council Chambers. Minutes of the meeting held April 7, 1941,
were read and approved,

Councilmen:
Spencer J, Barton,
Mr. Wilsey of the Salt Lake and Ogden Railway Company met with the Council
asking them to consider an ordinance changing the speed limit in Kaysvilil City.
Mr. Bowman made the motion that the Counci~ adopt an ordinance, seconded by Councilman Brough, unanimously carried,
Mr. H. L. Strong met wlththe Council with regard to the old fire truck
building on which American Legion have an option to buy. Mr. Strong said the Legion
have $1,000.00 available and wcnld like to discuss the putting of this money in the
new city building. Mr. Paul Williams also spoke of the Legion having a desire to
put their money in the new city building.
Mr. Ray Ashton, architect, explained the plans for the new city hall to Mr, Strong and
Mr. Williams. 'lhe matter was ·left to Councilmen Bowman and Sanders to draw up a
plan and present 1t to the Ameri·can Legion and 1D be discussed at the next meeting
of the Council,

Mr, Raymond and Mr, Bolton met with the Council to discuss the new lighting
Councilman Bowman moved that Mr. Galbraith be authorized to check into
materials and obtain prices and specifications for materials to be used in new
lighting project and to obtain bids on materials which will be required on W.P,A.
and purchase the same and reserve the right to reject any or all bids; motion was
seconded by Councilman Brough; unanimously carried.
Plans for the new City building were discussed.
Councilman Barton announced that clean-up week will start April 21, and
continue until April 26, inclusive, The clean-up truck will begin to haul Garbage
Wednesday,

Councilman Brough moved that the Council authorize the cemetery committee to do

at the Kaysville City Council Chambers. Reading of the minutes of the meeting held

Attorney Orlando J. Bowman reported that title to the Earl Tall property
was subject to a mortgage which would be paid at the time the City purchased the
property. Councilman Linford moved that the Treasurer and Attorney Bowman be au- ·
thorized to pay Earl Tall $3,250,00 for his main street p~operty on which the
city holds an option to purchase, upon receiving a warranty deed and an abstract to
the property, which shows a good marketable title; Councilman Barton seconded the
motion; unanimously carried.
Attorney Bowman reported a defect in the title of the Howard Thomas property which
the city is purchasing. He advised that the defect be cleared before the balance
of the purchase price be paid,
Councilman Brough moved that Mrs, Lydia Sheffield, administratrix of the estate
of Fred A, Sheffield estate property on Main street which the city has under option to
purchase, and that she be given the right to remove the scales, blacksmith shop, and
lumber from coal dump, and provided that the estate pay the curb and gutter assessment,
abstract coats and taxes, Motion was seconded by Councilman Barton and unanlmously
carried,
Mrs, Lydia Burton, Mrs, Merriot Nance, and Mrs. Alice Burton of the ParentTeacher'a Association met with the Council and asked for an appropriation for summer
playground project. After some discussion it was decided that the P-T. A should
meet with the school board and return to the Council next meeting with more specific
requests.
R, o. Layton met with the Council and requested the approval of a subdivision
in lot 5, Plat C, After some discussion it was moved by Councilman Llnford that Mayor
and recorder be authorized to accept the plat and to do whatever ls necessary to approve
the subdivision, Motion was seconded by Councilman Brough and unanimously carried,
The American Leglon's contribution to the proposed Municipal Building was
discussed, and Attorney Bowman read a proposed agreement which was referred to Mr.
Kllfo~ for the American• Legion's consideration,
R01Vard Thomas met with the Council regarding the operation of hie marble
machine. He stated that the machines were legal and was advised that he could operate
the machines as long ae they were operated in a legal manner.
John PeteraCD. met with the Council to discuss his olaim for services rendered from April l, 1940 to April 15, 1940, as city collector, and a claim he had for
pipe installed several years ago and later used by the city. The claim for services
was discussed and approved,
The claim for pipe and damages was discussed and denied.
Thomas White met with the Council and discussed the sale of his property
to the City and hie loan from the Cemetery Fund, Attorney Bowman advised that the
title to Mr. White's property was clear and Mr. White stated that he desired to
pay his note to the Cemetery FUnd.
Phil Phillips met with the Council and inquired about water and sewer rates
for a place of business in the R,O, Layton building. Y..r. Phillipa was advised that the
business rate for water and sewer would be applicable even though they would be
seccnd connections.
Councilman Sanders moved that the light meter deposits for renters be raised
from $5.00 to 10.00 for dwellings, and $15.00 for places of business, effective May
5 1 1941; motion was seconded by Councilman Barton and unanimously carried,
Councilman Barton moved that Mr. B. E. Ashby's delinquent sewer account
of $9.50 be cancelled, provided that hie delinquent water and light account ie
paid in full; the reason for cancelling the delinquent sewer account being that Mr.
Ashby was not connected with the sewer for over one year while he was being charged.
Councilman Barton moved that Councllman Bowman be authorized to sell the
land on which is situated the old fire department building to the highest cash
bidder, with provisions that the building be remodeled or torn down within
sixty days from date of sale, with right to reject any or all bids, and with
instructions to allow'Vaughn Sheffield to bid on said property; motion was seconded
by Councilman Brough and unanimously carried,

Councilman Linford moved that the matter be left to the committee on public grounds;
(Councilmen ·Bowman and Sanders); seconded by Councilman Brough; unanimously carried-the committee to meet with P-T, A Friday, May 23, 1941.
Dr, D, Keith Barnes met with the Council asking that Kaysville city a ssiet
the Kaysville Rotary club in purchasing an electric sign displaying the Rotary \blel
and words Kaysville City, Discussion followed and the matter waen€erred to the Finance
connnittee to report back at next meeting,
Lloyd Bishop met with the Council asking the Council to have a road near his
home on mill road fixed, Mr. Linford stated he considered the project too expensive,
Councilman Sanders moved that the matter be referred to the Road Co111111ittee; seconded by
Councilman Barton; unanimously carried,
Mr, Archer from the Western Machinery Co. met with the Council, aeldng if the
city had considered their suggestion to improve sewer system at cost of $1,900,0Q·,
The matter was feferred to the committee on sanitation and Ray Harvey,
Mr. Earl Tall met with the Council, stating when he cut the price of his
option $250.00 he did it with the understanding that all options should be cut. Inasmuch
aa others did not come down on their options, be should have $3 1 500,00. The matter was
discussed and Councilmen Bowman moved that the City allow Mr, Tall $3,500,00 for his
property; seconded .by Councilman Sanders; .unanimously carried,
Councilman Linford moved that Mayor Swan be authorized to make satisfactory
settlement with Mrs, Fred Sheffield up to $5,000,00; seconded by Councilman Brough;

five feet, thence west fifty two feet to point of beginning, Councilman Bowman reported
that it was made public to be sold at Kaysville City Hall at 10 a,m,, Bids were received from V, P. Sheffield for $125,00 and E. Van Sanders for $140,00, E. Van Sander's
bid being accepted, The recorder returned Mr, Sheffield's bid.
Councilman Barton moved that the Council CQ'lfirm Councilman Bowman's action
in selling property to E. Van Sanders for $140.00 and authorized Mayor and Recorder to
execute special Warranty Deed to E, Van Sanders.
Mr, Cooper of the auditing firm reported on audit to date made of city
books. Mr, Cooper stated that in the treasurer's accounts were no shortages, but
nwnerous errors, and as there will be more work in the future, the Council should
take action, It was recommended giving the treasurer fer mer salary and give r_,, " ,

moved that Mr, Jarman be restored to his original salary of $30.00 per month.
The finance camnittee, with the help of Mr. Cooper and Mr. Robinson to decide the
duties of the Recorder and treasurer--and the recorder's salary to be set at $75.00
per month as long as this arrangement continues,
Glen Robins asked to be relieved of meter reading, Councilman Sanders moved
that Glen Robins be relieved of meter reading for next four months, and Vestal BloKhlll!I
read meters; seconded by Councilman Linford; unanimously carried.
Councilman Sanders moved the matter of draining part of cemetery where water
entered graves when dug be left to the cemetery committee with power to act; seconded by
Councilman Brough; unanimously carried,
Councilman Bowman reported the school board asks the city to make an approach
on first north street to new school road on public school grounds, Councilman Sanders
moved the matter be left with the Streets committee with power to act; seconded by
Councilman Barton; carried unanimously.
Mayor Swan read a letter from Dr. D, Keith Barnes on chlorination or water,
advising all Davis cpunty towns to chlorinate their water systems. No action was

permit to move a root beer stand and build a blacksmith shop on the Charles Wilson

Public Grounds colllll!ittee and Mayor to investigate; seconded by Councilman Linford;
carried unanimously, Mr. Wilson was given permission to go ahead, subject to
Building Committee approval.
Mr, Ashton met ~1th the Council advising same that it would be unadvisable
to build a basement in the new city building, owing to poor drainage on property to
be built on. Mr, Ashton reconmended the basement be eliminated and utility rooms be
on ground floor, owing to drainage problem. Councilman Bowman moved that the Council
accept the neVI plane and give the architect power to get approval for change from
w. P.A., seconded by Councilman Brough; unanimously carried.
Hubert Smith met with the Council regarding the sale of two acres of land,
land to be purchased when title is clear from Arthur Smith estate,
Councilman Barton reported he had investigated sewer problems and recommends
they postpone buying new machinery for the present,
Councilman Bowman reported he and Councilman Sanders met with P,T,A,
mittee, and after consideration, recommend the Council appropriate $375.00 for
ground activities, Councilman Barton moved that the Council accept committee

in regard to Mr, Ashton's water supply and report back. Councilman Linford seconded
motion; unanimously carried.

Councilman Brough reported it would cost approximately $300,00 to connect
Van Sanders on a larger line, Water committee recommended line to Van Sanders be enlarged. Councilman Bowman moved council accept water comm: ttee 1 e recommendation, Councilman Barton seconded motion; unanimously carried.
On Ashton water system, water committee reported, Councilman Bowman moved
that installing a small storage tank be left to water committee to investigate, with
power to act, Councilman Sanders seconded; unanimously carried.
William Galbraith ask to raise wages from,40cents rate per hour to.50 cents,
per hour on water and streets, He also ask to rehire Peter Sherner, Council decided
.40 cents rate per hour wage would still stand for common labor and . ~epartment heads

Councilman Brough moved city rent ten (10) shares of water @ $12,50 per
share subject to recall; fifteen (15) shares of water @ $13,00 per share to Haights
Creek Irrigation Company, Councilman Barton seconded motion; Unanimously carried,

J.J. Bowman, B. 0, Brough, N.V. Sanders, J, Clifton Linford,

on Electricity and Finance reported everything in order,
Councilman Linford reported Streets Committee had received $1,139,04
from State Road Commission,
Councilman Barton reported on connecting house drains to sewer, Said
State Sanitation Committee could not see any harm in connecting house drains.
Sewer Conunittee recommended that house drains be permitted to connect to
sewer drains, Mr, Sanders moved Council accept Sewer Committee's recommendation, Mr, Bowman seconded motion, Unanimously carried,

On two Sewer connections in one home, Sewer Committee will investigate
further and report back,
Mayor Swan discussed the Defense Area Project to maintain sewer and
water in defense area,
Co~ncilman Bowman moved Mayor and Recorder be authorized to sign an
applicatioh to Government for defense Sanitation Project money, Councilman Linford seconded motion. Unanimously carried,
Councilman Sanders moved City appoint Dr, D,K, Barnes on Federal
