T
he Spanish real estate industry
started to improve last year
and is now consolidating itself
with very good news in our country.
The change in the trend is obvious
since, little by little, the real estate
industry is becoming again the
economy’s main player. In fact, the
industry’s activity that has grown
most this year in creating new job
offers is the real estate one, with
an increase of 340%, from 448 job
requests to 1974 requests registered
in the first semester of 2015. Also,
quoting Infoempresa.com, last year
the creation of new companies in the
real estate industry in Spain grew a
10.9%.
MORE GOOD NEWS
House buying grew a 13.9% in July
which means that it has grown
steadily for eleven consecutive
months. In the same way, for the fifth
consecutive trimester, the housing
prices in Spain have increased and,
in the second trimester of 2015,
they have grown a 4%, which is the
largest increase since 2007. The
number of housing mortgages has
grown a 26.3% with respect to last
year, a number that has increased for
the thirteenth consecutive month.
Therefore, the recovery of the real
estate industry is beyond question,
as can be deducted from these facts
supplied by the National Statistics
Institute (INE).
Furthermore, the Spanish real estate
industry is back on track since the
great foreign companies and investors
are returning to Spain. First of all,
the fact that the international funds
support Spain and, secondly, the
sale of the REITs during the first half
of the year, have both heated up
the market. In fact, large REITs have
enlarged their capital in order to be
able to keep on buying, which is a
positive indicator for the industry.
Without doubt, the government’s
decision to improve the tax conditions
for these investment societies has
proved to be right, since they have
become the spearhead of the real
estate recovery: they have invested
almost 5,000 millions in Spain.
This year, we are facing Barcelona
Meeting Point’s 19th edition with
the celebration of the 2nd Barcelona
Funds Meeting, a special Program
that will gather the most important
international Investment Funds and
will be held on the 21st and 22nd of
October. After the massive presence
of international investment funds
last year, where we had 38 firstclass funds, this year we are also
experiencing an interest of many
others to participate in BMP 2015
for the first time. Spain is the third
European country in terms of real
estate investment, namely 5,497
million Euros in the first half of the
year, the largest amount since the
second semester of 2006.Therefore,
the 2nd Barcelona Funds Meeting
will suppose a very good business
opportunity that nobody should miss.
The “Shop in Barcelona. Real Estate”
Cluster will be another one of BMP
2015 strengths, since it will put
in contact the Spanish real estate
companies with buyers and property
agents from the most traditional
markets (France, United Kingdom,
Belgium, Holland, Scandinavian
countries, Germany, Switzerland…),
that are the ones that, at present
time, are buying properties in Spain.
This cluster there will also gather
property agents and buyers from
Russia, China, the US and Latin
America that will also be heating up
the Spanish market.
Barcelona Meeting Point will deliver,
once again, a great International
Symposium, where the best national
and international speakers will discuss
the industry’s current and future
topics. This year, the BMP Symposium
will focus on four conferences of

great interest: 1) The Barcelona Funds
Meeting; 2) Sustainable Solutions for
Housing, Retail and Offices; 3) Real
Estate Investment in Latin America; 4)
Real Estate World Conference.
As you may see, Barcelona Meeting
Point, created 19 years ago by the
Consorci de la Zona Franca de
Barcelona, doesn’t rest nor sleep and
keeps on going with a clear objective:
to be of service to the industry,
helping to sell, presenting the largest
offer in the country, being the most
international Exhibition in Spain,
speaking of the present and the
future and defending a key industry
for the economy that creates many
jobs.
I must confess that we have worked
very hard and travelled a lot,
attracting new cities, new countries
and new companies that come to the
real estate meeting in the Autumn
from the 21st to the 25th of October.
Through these lines, I want to thank
you all for your support that is truly
worth the efforts made for Barcelona
Meeting Point to keep on being an
international, professional, profitable
and useful exhibition for the national
and international real estate industry.
Barcelona, our city, that has an
exclusive world trademark, is also a
great incentive. Everybody wants
either to return to Barcelona or to get

“cluster” an area, a “meeting point”
for investors within the Professional
Exhibition. It is a fun, direct and

Among the novelties introduced
by BMP 2015, we should highlight
the new edition of the Cluster
“Shop in Barcelona. Real Estate”.
Its aim is to link real-estate Spanish

Scandinavian countries, Germany,
Switzerland…), as well as from China
and Russia.
From 2011, Barcelona Meeting
Point has successfully hold the
“Russian Meeting Point” ( which

sales. In 2013, the thriving Chinese
buyers were included in the same
format, and from 2014, more

12:00, the Barcelona Funds Meeting
Program will start with the session
organized by APCE about residential
property. In this session, two round
tables will be held to discuss the
economic and financial prospects
required to stimulate the recovery of
residential development (1st table),
and under those premises, the view
of the players in the sector: the real
estate developers (2nd table).
Residential development is one of
the subsectors with the greatest
prospects. It is thought to have

bottomed out in 2014 and it will start
growing this current year 2015 and
become reinforced in the following
year, so much that it is expected a
recovery in the demand in 2016 due
to the progressive development of
credit to SMEs and families.
Currently, the residential property is
showing the first signs of recovery
by the increase of purchase and
selling transactions and the start
of new developments. In fact, it
is leading the way. Its progressive
recovery makes us believe that it
will be one of the sectors with the

organized by IESE will be held, “The
Observatory of Vacation Homes: The
“Think Tank” that The Sector Was
Expecting”. Following the recovery
of the Spanish economy, the tourist
sector is the one which enjoys the
greatest consolidation. Besides the
traditional tourism, we can also feel
a change in the holiday home sector.
Some coastal areas have restarted
to sell off-plan properties in high
numbers and to buyers from very
different background.

On the other hand, the second
session organized by IESE will be held
on Thursday 22th October at 9:30
entitled “Banking and Property: A
New Relationship?” Beyond solving
the problems of the past recession,
we need to lay the foundations for a
new relationship between banking and
residential development.
It is widespread to hear that we shouldn’t
go back to the market’s excesses of the
past, but not many talk about what the
new relationship between these two
sectors would be like. The real-estate
industry is too important for the banking
not to approach it again.
As a capital-intensive sector, the realestate and investment industry needs
funding and in Spain it mainly comes
from financial entities. In this session,
we will see what the bankers expect
from the real-estate industry, including
the funding of the final buyer, as well
as the future needs of developers and
companies devoted to rental housing.

EPRA, a former collaborator of Barcelona Meeting
Point, once again teams up with this Fair and will be
responsible for a session entitled “Spain: Back on
Track” that will be held the 21st of October at 5:45
p.m.. Spain is at the top of the list of international
investors. The modifications introduced in the REIT
Spanish system (SOCIMIS) have allowed the entry
of new companies into the market and have raised
global capital. We can predict opportunities and
challenges in the future, so the question is what could
this sector do in Spain to keep the investor`s interest
and keep at the forefront of the countries that receive
more foreign investments?
On Thursday 22nd of October at 11:15 we will hold the session
organized by ESADE within the Barcelona Funds Meeting Program.
One year ago, we analyzed the existing gap between financial
economy and real economy as the key factor of the situation of
the real-estate Spanish sector. In 2013 and particularly in 2014,
the volume of investment in the Spanish sector shot up at liquidity
levels above the average for the previous cycle, 2006 and 2007. This
asymmetry shows the confidence and confidence of the investors
on the recovery of the real-estate fundamentals, and on a real future
growing of the sector, together with a trustworthy economy and a
potential growth of the GDP. For this year, the macro-economy of
Spain confirms the assumptions previously made by foreign investors.
“The recovery of the Real-estate Fundamentals” is therefore the
trending topic for the ESADE session this year.

collaborate once again with Barcelona Meeting Point with
a session of major interest that will take place on Thursday
22nd October at 3:15 p.m. This session will be about “Big
Data & Real Estate” in general and in particular how certain
data can be used by the agents, consultants and websites in
a more effective way. The attendees will learn about how
the mobile technologies are evolving as well as users and
websites. They will also talk about the “Internet of Things”
and the data transfer by devices as well as the future
relationships “human-to-human” or “human-to-computer”.
The session organized by the Spanish
Association of Shopping Centres will be held on
Thursday 22nd of October at 5:00 p.m. It will
deal with matters such as the reasons to invest
in retail real estate in Spain ; investment versus
development, what are people interested in
nowadays ; the winning formats in the field of
retail Spanish real-estate or an overview of what
the retail sector will be like in 2020.

Latin America with the session: “Uruguay: The
doorway to Mercosur”. Uruguay is one of the
most highly valued countries in Latin America

increasingly choosing Uruguay as the destination

The 18.795 law has made of Montevideo a city
generating new housing, with more than 450
projects approved up to date and more than
12,000 units under way. For off-plan purchases,
capital gains become double digit in 24 months.
The buyer has great tax benefits, 100% tax-free
for 10 years. Uruguay is the natural gateway to
MERCOSUR, and together with the Free Trade
Agreement that the country has with Mexico,

paradise that has it all”. The Dominican Republic has a
full capacity to attract international investment, due to
its strategic geographic location, right in the heart of the
Northern and Southern hemispheres, with fast access to
western markets, which allows profitable trade through their
international airports and ports. It is the world`s largest
producer of premium cigarettes and a major exporter of
cocoa and high-quality organic bananas. Apart from 8
airports, a wide road network, a modern telecommunications
infrastructure and a qualified workforce, the Dominican
Republic offers a modern transport infrastructure unique in
the region. Besides its economic benefits, the country has
a friendly regulation system for investments. It has a Law of
Foreign Investment that grants equal rights to foreigners,
with tax-exemption benefits for retirees who move to the
Dominican Republic.
Additionally, it has a Law of Incentives for Tourism
Development which offers tax exemptions for new projects
and allows the renewal and re-equipment of projects after
5 years from their construction which guarantees their
competiveness and the return of investments.

What are the key factors for a
“healthy” real-estate market in
Spain?
In our opinion, a “healthy” real-estate
sector has to be very professional. It
is clear to us that the future residential sector requires specialization,
professionalism, quality and especially, to carefully listen to the client.
From now on, our market should
be very accurate and give a faster response to demand needs. That
way, we will consolidate it again as a
source of progress, integration and
social development.
How is Neinor Homes dealing with
all these changes in the market?
In Neinor Homes we believe that it
is necessary to dramatically change

the relationship with the consumer,
by means of closeness, transparency why not, humbleness. For that
reason, we are working on a new
business concept and a new approach. We want to get closer to
FMCG sectors that have updated
their costumer’s service in terms of
quality, customization, energy efficiency, sustainability or after-sales
service.

How do you face the relationship
with the most demanding client
ever ?
Buying a home is one of the most
important decisions in someone`s life
on the personal and economic level.
For us, the client should be present
in the whole process of our activity.
To grasp his needs, we should start
listening to him. We believe that the
home must meet the buyer`s needs
and expectations. And only listening,
we can be right about details that
really matter. For that reason, in the
new developments it will be easier
for the buyer to customise his home,
choosing the finishes and colours of
the rooms, or the layout of the flat,
for example.
We are talking about a better communication and information exchange with every possible buyer?
How do we achieve that?
In Neinor Homes we believe in building relations of trust based on integrity and transparency. This involves,
on the one hand, keeping a high level
of information, during and after the
sales process. On the other hand, we
intend to comply with everything we
say, without surprises and always,
close to the client. On that basis, the
digital world is a perfect tool to be in
permanent contact with the buyers.
You have talked about sustainability, do you think it will be one of the
most relevant factors in the sector?
Yes, of course. Sustainability will be
one of our main features. For that
reason, we are really committed to
sustainable construction.
Our under way constructions will
be well isolated and lit up, with new
technologies, energy efficiency and
independent environmental accreditations. We will work this way and
also we will use the most recognised
accreditations in terms of sustainability. For example, BREEAM is the main
system of international sustainable
accreditation and we will use it to
accredit all our properties. Moreover,
we have joined their Advisory Board,
with some representative companies
of the sector to contribute to improve sustainability in the construction in Spain.

COASTAL LAW AND THE ASSESSMENT OF
THE EXTENSION OF CONCESSIONS
40% of the Spanish coast is already developed or it is taken up by land for development. We
have reached this situation due to the lack of any regulation to coordinate the legislation of the
maritime-terrestrial public domain and soil protection. The new Coastal Law regulates within
this framework and provides a greater legal certainty to the hotel industry, as it defines more
precisely the rules of the game and it renews the administrative concessions granted by the
previous regulation up to 75 years.
The Spanish coast has a length of around
7,880 Km., of which 24% is made up of
beaches. This strip of land attracts much
interest due to the high amount of economic and recreational activities and, in
this area the demographic pressure is
four times the national average. Nowadays, 35% of the population lives in the
coast, contrasting with the levels registered at the beginning of the century, with
only 12% of inhabitants.
Currently, around 40% of the Spanish
coast is developed or taken up by land
for development. We are facing this situation because until now there was not
any regulation to coordinate the legislation of the maritime-terrestrial public domain and soil protection. There was no
consideration of the land-sea interaction
or the need to set out measures in order
to guarantee the conciliation between
environmental protection and public and
private interests.
Within this framework, a new regulation
of the coastal land has been introduced,
known as the Coastal Law, which res-
ponds to the Royal Decree 876/2014, of
10 October, approving the General Regulation on coasts.
A Greater legal certainty
The new coastal law regulates the rational use of public goods and guarantees
the public use of the sea, shore and the
rest of goods in it. One of its priorities is
to provide a greater legal certainty and
for that purpose, it defines more precisely, the elements that belong to the maritime-terrestrial public domain (DPMT) and
its differentiation from the private domain through the figure of demarcation.
Another aspect of the new regulation to
be noted is that it seeks more transparency regarding information about land
and/or buildings, so public goods should
be registered in the Property Registry
and Cadastre.
Another aspect of the new regulation
that is of interest to the hotel industry
is the possibility to transfer the concessions, as long as they comply with the

conditions set when granted. Additionally, it allows an extension of the concession period up to 75 years for the permits
granted under the previous regulation
and it provides a more precise definition
of the rules regarding the estimation of
the concession fee.
Conditions to extend the
concessions of hotels
Specifically, the new coastal law solves
the legal uncertainty felt by the owners
of the administrative concessions granted under the previous legislation, and
that, according to the rule 1988, had to
be expired in 2018 without entitlement
to compensation. This situation raised a
great concern and uncertainty among
the hotel industry.
In general, concessions to hotels are extended up to 75 years. However, depending on the uses, the resolution under
which the extension is granted, might set
a shorter extension period and also consider several extensions within that time
limit.

application date, regardless of the time
remaining for the concession to expire,
unless it is requested within six months
prior to expiration, in that case, the extension period begins from the expiry
date.
The requested extensions will be granted
as long as the ownership is not expired,
or the procedure of ownership expiry is
being processed. The extension of concessions or the setting-up of new ones,
will require an accreditation of sustainability of the activity to develop.
In order to extend the concessions, there should be investments to prolong the
useful life of buildings, therefore remodelling will usually be a key factor. Any works will require to submit a basic project
which complies with the general, specific, technical regulations approved by the
competent authority.
Additionally, they should respect the environment and be aware of the influence
of a potential shoreline retreat and include measures to adapt to climate change.
For this reason, it is necessary to submit
a financial-economical study that will
comprise the estimated income, the fees
to be paid by the public, and if available,
the breaking up of its constitutive factors
for future revisions
The study should also comprise a statement of costs, including the costs of projects and works and the taxes and fees
to cover, as well as the costs of maintenance, energy consumptions, staff and
any other costs involved in the use of the
property. And finally, it should include an
estimation of the net profitability before
taxes.
Concession fee payment
The extension of concessions are subject to the payment of the concession
fee, which is estimated according to the
occupation or utilisation of the maritime-terrestrial public domain. Therefore,
the occupied good will be allocated the
highest of the following values: the cadastral value, the value verified by the
Administration regarding any fees, the
price and remuneration or the acquisition
value registered by taxpayers applied to
land adjacent to right of the way areas
with a similar development. If a similar
utilisation could not be found, we will use
the average of the values used to estimate concession fees in the municipality.
The resulting amount will be increased
by the estimated average amount of annual net profits, before taxes, that will be
predictably made by the utilisation of the
public domain. For that purpose, predictable economic studies are required. In
case of works or installations, their material value will be added.
The concession fee depends on the characteristics of the occupied good. Firstly,
we have to see if the occupied surface
has buildings or facilities, and if it does,
their potential to make profits.

Usually, only a small part of the hotel
industry occupies public domain, and
in those areas we only find secondary
constructions or facilities, as gardens,
swimming-pools, sports facilities as they
are not allowed to take up the right of
way areas with buildings, therefore, there are no constructions on public domain.
In case of properties on public domain,
it should be considered the value of the
surface of occupied land and the cost of
work execution strictly that built up on
public domain. Also, it should be analysed in detail the income allocation of
the part of the property located on public domain. For that purpose, benefits
should be allocated proportionally to
the amount of the investments made in
different areas, as long as the constructions hold profitable business units.
On the other hand, the regulation also
requires to include accounting information in order to grant the extension of
concessions. The required accreditation
of sustainability of the works and facilities needs an economic development
to justify it. For all this, decisions about
the amount of investments to make,
their schedule and funding, are aspects
to consider as they affect the payment
of the concession fee. We should not
forget that we are dealing with land or
facilities at the seafront, whose real-estate assets are the highest in the area and
their wrong estimation leads to possible
excesses of the concession fee payment.
This will penalize the economic activity
throughout the concession period.
Therefore, the analysis of the future investments is of great interest so that the
concession fee does not jeopardize the
profitability of the hotel industry.

THE PROPERTY MARKET
COMES BACK

Seven years after Spain’s property
crisis, various indicators now
suggest, for the first time, that the
sector may truly be recovering.
Apartment prices, for example,
rose by 4.2% in the second quarter
of the year, according to recent
reports by Spain’s National Statistics
Institute (INE), and the number of
permits granted for new residential
developments rose by 28.2% year
on year. These are not just isolated
figures; they appear to be the result
of positive financial conditions
in Spain, thanks to policies
implemented by various international
bodies to underpin the market
recovery, including the widespread
interest rate cuts enacted by the
European Central Bank (ECB).
Particularly over the last two years,
there has been a clear change
of trend in both the format and
the volume of the real estate
transactions taking place in the
Spanish market. It seems that the
trend that drove the market to
record highs in 2014 is consolidating
in 2015, mainly thanks to the
appearance of SOCIMIs (REITs)
on the investment scene and the
reactivation of the rental segment,
which traditionally has taken a back
seat in the Spanish market. The
arrival of various international funds
looking at prime buildings as well as
residential property and even land
in some cases, is further evidence
that now is the time to invest in the
Spanish real estate sector.
There have been warnings of a
potential repeat of Spain’s welldocumented “property bubble”,
but lower structural demand and
new banking sector regulations will
moderate the number of mortgages
granted compared with previous
economic cycles.
With this backdrop, it is likely that
the property investment sector will
continue to consolidate through the
concentration processes underway
among some of the SOCIMIs
currently present in the market. The
residential sector will grow as long
