General Terms & Conditions: This is a sealed bid/live auction format. Sealed bids must be delivered to
United Country Musser Bros. Inc. with the $50,000.00 earnest money attached prior to MONDAY November
9, 2009 at 6:00 P.M.. Only the top five (5) written bids will be allowed to participate in the live
auction. The Auctioneer reserves the right to change this number to adjust for ties in the written bids or to
make any other adjustments as may be necessary that may be to the benefit of the seller.
A $50,000.00 earnest money deposit in the form of a cashier’s check made payable to you is required to
register for bidding on this property. If you are the high bidder on this property, you will then endorse this
check and make it payable to Shoshone Title Company. This earnest money deposit is nonrefundable if the
Park County Board of Commissioners accepts the high bid and the buyer fails to close for any reason.
A five percent (5%) Buyer’s Premium will be added to the high bid in order to determine the final purchase
price. Sale of this property will be subject to the approval of the Park County Board of Commissioners. The
Park County Commissioners shall accept the offer, submit a counter offer or reject the offer within 48 hours
of the auction. If the offer is accepted, then the closing shall take place no later than December 18, 2009. If
the offer is rejected, the earnest money deposit will be refunded in full.
There is a two percent (2%) buyer’s brokerage commission available to any licensed Wyoming real estate
agent who properly registers a buyer with the auction company and who successfully closes on the property.
This provision does not apply to any buyer who has previously been in contact with United Country Musser
Buyer will be bidding on the property in it’s “As Is” condition without any representations made on behalf of
the Auctioneer or Seller. Seller makes no warranties whatsoever about the property and specifically disclaims
any warranties of fitness for a particular purpose or any warranty of habitability.
The seller will provide a title insurance policy to the buyer in the amount of the total contract price. All
property taxes shall be prorated to the date of closing.
