LIQUOR 6A. DISCUSSION, DELIBERATION AND POSSIBLE DECISION CONCERNING A REQUEST TO ISSUE A 72 HOUR LIQUOR PERMIT TO OUR LADY OF THE VALLEY CHURCH IN PAHRUMP, NEVADA FOR A FASHION SHOW ON JULY 28 TH , 2007. DISCUSSION, DELIBERATION AND POSSIBLE DECISION CONCERNING A REQUEST TO ISSUE A 72 HOUR SPECIAL EVENT PERMIT FOR THE VFW POST 10054 IN PAHRUMP, NEVADA FOR THE FREEDOM FESTIVAL AT PETRIC PARK ON JUNE 30 TH THROUGH JULY 1St, 2007. DELIBERATION AND POSSIBLE DECISION TO APPROVE A BROTHEL APPLICATION FOR THE CHICKEN RANCH. 10511 HOMESTEAD ROAD. PAHRUMP. NEVADA. TCR HOLDINGS. LLC DBA THE CHICKEN RANCH. BRUCE KAHN. APPLICANT. DEBORAH RIVENBURGH AS A KEY EMPLOYEE FOR THE NEW OWNERS. BACKGROUND AND LICENSE FEES PAID. Sheriff DeMeo read a statement regarding a Brothel License in the State of Nevada and the process of investigation of an applicant and application for such a license. Lieutenant Jack Grimaud stated that approximately two weeks prior to March 18, 2007 he had attended a meeting with Sheriff DeMeo, Captain William Becht and John T. Moran III who stated that he was the attorney of record for the applicant, Mr. Bruce Kahn. He reviewed the information that was given to Mr. Kahn to obtain a Brothel License which included that the application needed to be filled out in its entirety; needed to be honest in all answers; needed to provide all documentation as required by Nye County Codes for Brothel Application; needed to provide all tax records for the past 10 years and all telephone numbers for everyone listed on his application. Lieutenant Grimaud stated that Mr. Moran stated that he and the applicant had read and fully understood the application and that it was a straight-forward process. Lieutenant Grimaud stated that on March 20, 2007, he received Mr. Kahn's Brothel License Application. He reviewed the specific information that was incomplete or lacking on the application. The Sheriff's Office requested that the financial statement be made a part of the record. Commissioner Eastley made a motion to accept additional documentation in support of the agenda item; seconded by Commissioner Liakopoulos; 6 yeas. The additional documentation was labeled Exhibit A. Lieutenant Grimaud continued his review of what was incomplete or lacking on the application. He concluded that the discrepancies and omissions prevented him from completing his investigation and submitting a factual and comprehensive report. He stated that this process would require a considerable amount of time and interstate travel to complete the investigation. He stated that the applicant would need to be more forthcoming with requested information to satisfy both the application process and the investigation. Page 3 6/19/07 A. BACKGROUND AND LICENSE FEES PAID. - Cont'd Sheriff DeMeo stated that there had been a little over 125 hours spent on the investigation. He reviewed the matter. Lieutenant Grimaud stated that public records indicated that here were currently three Federal Tax Liens against the applicant in the area of $1 million. Sandra Merlino swore in the applicant Bruce Kahn. Mr. Kahn stated that Mr. Moran was no longer his representative in this matter. He stated that he had attempted to provide as much documentation as what was requested and apparently he had failed in that. He stated that at this time he would ask that the matter be tabled to allow him to supplement documentation to complete the application. Sheriff DeMeo stated that he had sufficient information based upon the investigation that his office had completed thus far that he would make a recommendation to deny the application. Commissioner Eastley made a motion to deny; seconded by Commissioner Liakopoulos; 6 yeas. Commissioner EastJey requested that the Sheriffs Office provide a dollar figure to equate to the investigation of the license. Sheriff DeMeo stated that they would provide the Board with the cost amount. 1. APPROVAL OF MINUTES - N/A There were no minutes. 2. GENERAL PUBLIC COMMENT There was none. 4.
